Ail construction must be completed in accordance with the

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR part 617,
Section 617, Section 617.10 and chapter 44 of the Code of the
Town of Southold, notice is hereby given that Southold Town
Planning Board, as lead agency for the action described below
has determined that the project will not have a significant
effect on the environment.
DESCRIPTION OF ACTION
The site plan for Andrew Stype, located on the Main Road
at Mattituck. SCTM #1000-22-3-18.3,15.1.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no correspondence received from the
Suffolk County Department of Health Services in the
allotted time, it is assumed that there are no comments or
objections from that agency.
BeCause there has been no correspondence received from the
NY State Department of Environmental Conservation in the
allotted time, it is assumed that there are no comments or
objections from that agency.
There has been correspondence received from the Board of
Trustees stating that the Trustees determined that they
have no jursidiction.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Gentlemen:
We have received a copy of Mr. Strangms letter regarding
the above referenced site plan. Our response to the points in
question is as follows:

contingent on all runoff being contained on the
site. In the event that runoff does encroach
onto adjacent property, remedial measures will
be required.
It is our understanding that the town will
accept a system designed for a 2 inch rainfall.

Dear Mr. Orlowski and ~embers of the Board:
I am in receipt of your letter of April 13, 1988 and accompa-
nying report from the Southold Town Engineer. At this time,
I would like to respond to the items mentioned, as follows:
1. The field inlet requested for the southwest corner of
the site is in an area designated to be left in a natural,
undisturbed state. It is my position that existing vegeta-
tion in this area will absorb any surface runoff, before it
would flow on to adjacent properties. It would be very dif-
ficult to install the requested system, without disturbing
existing vegetation.
2. The installation of swails and field inlets is appar-
ently a new consideration of either the Planning Board or
Town Engineer. To the best of my knowledge, this has never
been a requirement in the past. Please advise if the Board
feels that the landscaped area will not adequately absorb any
rainfall, and what design criteria should be implemented to
design the field inlet.
3. Pitch will be adjusted to a more appropriate perce~]tage.
4. To the best of my know]edge, the present Code calls for
containment of only a 2" rainfall, with respect to site de-
velopment plans. An arbitrary increase to 6" without taking
into account either the minor scale of this project or the
subsurface conditions, (which provide excellent drainage in
this geographic area), is inappropriate and poses economic
hardship on the applicant.

If the Board is insistent upon requiringing containment for
6" of rainfall, I respectfully request you provide the neces-
sary design criteria for the rail]fall period, as well as the
coefficient of percolation per hour that would be acceptable.
5. The size of the connecting pipes will be duly noted on
the site plan.
I respectfully request your immediate attention to the above,
so that this application can be finalized.

Gentlemen:
We have reviewed the above referenced site plan and have the following
comments:
A field inlet is required at the base of the new slope in the
southwest portion of the site to prevent runoff onto adjacent
property.
2. The landscaped areas, since they are fairly flat, should be
graded with swales to direct runoff into field inlets.
3. The parking area east of drainage system no. 2 has excessive
pitch toward the drain {13%~}.
4. Storage capacity is adequate for a 2" rainfall not a 6" rain-
fall as required. This must be modified.
All connecting pipes must be 12" diameter minimum.

With regard to the above-named proposal and pursuant to our
meeting of November 17 , 1987, I am listing the information that
should be shown on a revised site plan.
1.
The configuration of the planting island at the easterly
end of the rear parking area shall be changed to provide
greater width and a more gradual radius.
Since the proposed floor area requires 29 parking spaces,
but only 18 are thought to be needed as per your letter
dated October 27, 1987, the site plan may show only 20
spaces to be built. However, the plan should then
state that if the property owner and the Planning
Board find that the remaining nine spaces are needed,
the rear parking area could be expanded as needed.
3. Building elevations, floor plans, and lighting plans.
Ail interior curbing shall be of 6" concrete. Interior
paving is to be asphalt. Please provide drainage
calculations and grading plans (existing and proposed
grades).
5. Concrete curbing along S.R. 25 shall be shown.

Dear Ms. Scopaz:
I am in receipt of your letter of September 24th, with re-
spect to the above referenced project, and would like to take
issue with your comments, as follows:
#1. It has been my experience that the Planning Board deter-
mines parking requirements for general business uses (other
than shopping centers), on the basis of the occupant load.
To the best of my knowledge, there is no new zoning criteria
stipulating a general formula of one parking space per 150
sq. ft. of floor area.
You will note on the site plan prepared by my office,
there is a designated building population of 15, with 21
parking spaces provided. It is my opinion that the 6 addi-
tional spaces are more than ample for the intended business
use.
If you make reference to the site plan, you will also
note that there are practical difficulties in extending the
parking area in a southerly direction as you suggest, by na-
ture of the slope of the land as depicted by the topographic
data.
I respectfully request that the Board consider and ap-
prove the parking as submitted, based on the above.
#2. Access to State Route #25 is shown at 30' inasmuch as
the State has mandated 30' curb cuts on all Route 25
projects recently submitted by my office.
~3. I am awaiting further input from the Owner with regard
to N.Y.S.D.P.W. easement and will forward same upon receipt.

#4. In my opinion, the planting area next to parking space
adjacent to easterly corner of the building is adequate for

I ala in receipt of your letter of September 24th, with re-
spect to the above referenced project, and would like to take
issue with your comments, as follows:
#1. It has been my experience that the Planning Board deter-
mines parking requirements for general business uses (other
than shopping centers), on the basis of the occupant load.
To the best of my knowledge, there is no new zoning criteria
stipulating a general formula of one parking space per 150
sq. ft. of floor area.
You will note on the site plan prepared by my office,
there is a designated building population of 15, with 21
parking spaces provided. It is my opinion that the 6 addi-
tional spaces are more than ample for the intended business
use.
If you make reference to the site plan, you will also
note that there are practical difficulties in extending the
parking area in a southerly direction as you suggest, by na-
ture of the slope of the land as depicted by the topographic
data.
I respectfully request that the Board consider and ap-
prove the parking as submitted, based on the above.
#2. Access to State Route #25 is shown at 30' inasmuch as
the State has mandated 30' curb cuts on all Route 25
projects recently submitted by my office.
#3. I am awaiting further input from the Owner with regard
to N.Y.S.D.P.W. easement and will forward same upon receipt.

When the above-referenced application is submitted, the site plan should
include the following items or changes:
1. 29 parking spaces are required for 4300 square feet of office area
(I parking space per 150 sq. ft. floor area)
The access to State Route 25 should be 20' wide, not 30'. Show curbing
along S.R. 25. Application should be made with the N.Y.S. Department
of Transportation at this time for a curb-cut permit. Final approval
may be contingent upon the obtaining of this permit.
3. Explain the terms of the "permanent easement to N.Y.S.D.P.W." shown on
the sketch plan.
Planting area next to parking space adjacent to the easterly corner of
the building should be expanded to include one parking space so as to
improve the turning angle. See enclosed copy of sketch for details.
5. Include existing and proposed grading, drainage calculations, building
elevations, floor plans, curbing and paving details.
