No application or fee has been made for site plan approval. o The Planning Board will be unable to proceed with such an application until all appropriate approvals are obtained from the Zoning Board of Appeals. You should be aware that retail uses are permitted in conjunction with other permitted uses, provided all the requirements for parking, screening, setbacks, etc., are met under the site-plan review process. No interpretation has been made by this Board to reflect your position prohibiting same. Also, retail sales and rental of merchandise or equipment are within the definition of Section 100-63 particularly since the items to be stored are not being displayed for sale or rent outside of the building. Section 100-63 permits storage inside of a building in each of the commercial zones. Outside storage of equipment or other items should also be shown on the map (which then would not comply with Section 100-63 and could be deemed a contractor's storage yard permitted in the Industrial Zone District). SCTM ~1000-122-7-3 Dear Mr. Waddington: The Planning Board reviewed the proposed site plan, again at a work session pursuant to your meeting with the Town Planner. Its observation is that the subject site is not an appropriate one for the proposed use. The property should be large enough to provide adequate maneuvering room for a sixty (60) foot tractor trailer onsite, with out the trailer intruding onto a public thoroughfare. September 29, 1988 The following is a synopsis of my meeting with James DeLucca and Bob Waddingtion on Tuesday, September 27th. Existin9 uses at Metro Rental -rental of contractor's and homeowner,s equipment. -sales of small tools.(Mr. Waddington stated that this was a minor part of the business) -servicing the equipment that he rents. proposed uses at new site -same as above plus: -retail space for rent to other businesses -outside s~rage of equipment/if an allowed accessary use At this point, no fencing is being requested ~ front yard. Overhead doors will face Old Main Road. Manuevering room is needed for a sixty foot (60') tractor trailer to back onto property from Old Main Road. Manuevering would take place on public street as pposed to on site. SCTM ~1000-122-7-3 Dear Mr. DeLuca: A review of your pre-s~ission sketch with the Planning Board indicated several changes that should be incorporated into your actual submission. The first item is that the proposed use of the site requires a Special Exception for a public garage under Section 100-70.B.(4). Therefore, an application would have to be made to the Zoning Board'of Appeals before the Planning Board could proceed. The second is that your client is proposing two different uses (public garage and retail stores) on the property, which the zoning code does not provide for. Enclosed is a marked copy of the sketch. Thirteen observations are listed for your review. It is strongly reco~ended that you and your client set up a joint meeting with this office to discuss these items before submitting a revised application so that your client's options can be explaned.
