THIS DECLARATION made this 28th day 01 December 1988 ,
by Cofam Realty Company a New York general partnership, with an
address at 4623A Sunr I ise Highway. Bohemia, New York hereinafter
referred to as the Declarant .
WHEREAS the Declarant is the owner of certain real
property situate at Main Road Mattituck Town of Southold
Suffolk County, New York more particularly bounded and described
as set forth in Schedule "A" annexed hereto and
WHEREAS the Declarant has made application to the
Planning Board of the Town of Southold for approval to subdivide
the said real property into 2 parcels , and
WHEREAS for and in consideration of the granting of
said approval, the Planning Board of the Town of Southold has
deemed it to be for the best interests of the Towik of Southold and
the owners and prospective owners of said parcels that the within
covenants and restrictions be imposed on said par( els. and as a
condition of said approval said Planning Board haE required that
the within Declaration be recorded in the Suffolk County Clerk 's

NOW THEREFORE , THIS DECLARATION VITNESSETH -
That the Declarant. for the purposes of carrying out the
intentions above expressed, does hereby make known , admit ,
publish, covenant and agree that the said premises herein
described shall hereafter be subject to the following covenants
which shall run with the land and shall be binding upon all
purchasers and holders of said premises, their hei s , executors,
legal representatives,I' distributees, successors an assigns, to
wit :
That n o lot shall be subdivided or its lot lines
changed in any manner at any future date unless authorized by the
Town of Southold Planning Board.
(2 ) That any future subdivision of any part of this
tract shall have a map of the subdivision filed in the office of
the County Clerk.
(3 ) That all driveways on Main Road siall make an angle
of at least 70 degrees and preferably 90 degrees with the state
road.
(4 ) That each lot having frontage on 4ain Road shall
have a turnaround provision so that a vehicle leiving a lot will
not have to back out. into the traffic stream on :he road.
( 5) That a 11 stormwater runoff resulting from the
Jevelopment and improvement of this subdivision or any of its lots
:3hall be retained on the site by adequate drainage structures so
,:hat it will not flow out onto the rights-of-way of Main Road and
Old Main Road.
(6) That the within Declaration may nct be annulled,
waived, changed or modified, unless and until ap1roved by
resolution of a majority plus one vote of the Planning Board of
the Town of Southold.

The Suffolk County Planning Commission at its regular meeting on December
7, 1988 reviewed the proposed subdivision plat, entitled, "tinor Subdivision -
Cafam Realty Company" referred to it pursuant to Section AV -24, Article XIV of
the Suffolk County Administrative Code. After due study anc deliberation it
resolved to approve said map subject to the fol w,

Main Road, a state road.
1. No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold Planning
Board.

subdivision of any part of this tract in the futura shall have a map of
the subdivision filed in the office of the County lerk.
3. All driveways on Main Road shall make an angle of at least 70* and
preferably 900 with the state road.
\j 4. Each lot having frontage on Main Road shall have a turnaround
provision; such as a T-shaped shunt,� so that a vehLcle leaving a lot
will not have to back out into the traffic stream n the road.
\j 5. All stormwater runoff resulting from the development and improvement of

adequate drainage structures so that it will not flow out onto the

6. In order to- minimize the number of access points )n Main Road and to
insure that there will not be any conflicts between the points of
access that are created, consideration shall be gLven to creating
a plan indicating the placement of access for Lot; I and 2, and the
parking areas on these lots. Consideration shall also be given to
establishing, through the creation of easements, :ommon use of access
points and parking by these lots; that is, allowing a vehicle to pass
from a parking area on one lot to another parking area on a lot without
the vehicle having to reenter the road.
7. The sight distance for vehicles entering or leaviig each lot on Main
Road shall be checked to ascertain if it is adequate due to the bank
along the road7--,
8. Conditions 1-5, inclusive, shall be filed as covei ants and restrictions
in the office of the County Clerk on or prior to he granting of
approval to this subdivision.
These covenants and restrictions can be modified cnly at the request
of the then owner of the premises with the approvz 1 of a majority plus
one of the Board or Planning Board of the Town of Southold after a
public hearing. Adjoining property owners shall te entitled to notice
of such public hearing but their consent to such modification shall
not be required.
9. The final map shall bear the following note: A Declaration of

deleterious substances that can have an adverse impact upon the

I appreciated the opportunity to speak with YOU OFer the telephone
concerning the minor subdivision application of Cofam Realty to
divide its parcel into two lots. You raised ques :ions concerning
the earlier site plan for part of the property as submitted by the
Friendly Ice Cream Corp; and also as to the regrading of the
property.
This is to advise that the Friendly Ice Cream Corp, has terminated
its lease agreement with Cofam Realty and no longer is interested
in proceeding at the subject site.
I also wish to reiterate that there has been no rEgrading of the
subdivision site in connection with the tree remo% al. The
topography of the parcel has not been altered or modified. I have
confirmed this with the principal of the land clearing firm. if
you have any evidence to the contrary I would appreciate your
promptly advising me.
