' After an on site field inspection on the property captioned above, it was noted that there are two existing buildings in the rear of the property and they are not indicated on our filed maps. Also noted in this report was the site plan has no buffer- ing along the front of the property. The following resolution was passed by the Planning Board: RESOLVED that the Southold Town Planning Board approve the parking on the site plan of Director's Seat, located at Mattituck, subject to receipt of amended maps designating the two rear buildings will be removed and a planting schedule for the front of the property, and said maps being acceptable to the Board prior to signature. Kinq~ located at Orient. Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski Mr. Latham reported, after an on site field inspection, a house and a large garage presently exists on the property in question. He also noted the right-of-way was graveled and in good condition. Mr. Edson requested that the Board approve of the Building Department issuing a building permit, subject to no CO being issued until the right of way to lot ~3 has been approved by the Planning Board. Mr. Edson referred to letter from George Fisher, Building Inspector, dated September 28, 1978, regarding the right-of-way and building permit for the property. Concensus of the board noted on page 13 of the minutes for January 10, 1983 regarding this right of way on the property of Jonathan Stern, located at Orient. Director's Seat at Mattituck - Mr. Mullen reported on the field inspec- tion made on this property. It was noted that there are two existing buildings in the rear of the property and they are not indicated on the maps filed in the office. Schultze, Secretary Sout'hOld Town Planning Board enc. 734-5100 AREA CODE 516 July 13, 1984 Mr. Bennett Orlowski, Chairman Southold Town Planning Board Town Hall - Main Road Southold, NY 11971 Re: Razmataz Dear Mr. Orlowski: Your letter of July 10, 1984, addressed to Mr. Victor Lessard, Executive Administrator of the Southold Town Building Department, with a copy to the undersigned, requires immediate response as to the matters therein set forth. Firstly, many of the items set forth in your letter are inaccurate and nebulous as to their content and secondly, no one appreciates the inaccurate statements made to the newspapers re- garding any of the situation, as you perceive it, existing at Razmataz. I think it appropriate that you take immediate action to retract statements made to the Suffolk Times wherein you are quoted, on July 12, 1984, in their article as stating "I don't see that they did anything we asked them to do". That statement is com- pletely false in that all of the items that Razmataz was compelled to do were done; otherwise, no certificate of occupancy would have been initially issued. I would point out to you that your statement in your let- ter of July 10, 1984 under Item #1, "there is no dust-free surface", is not only general, but inaccurate. Assuming you are referring to some area of the premises, which may be lacking in gravel, I would point out that the only area of the premises which at the time of your inspection may have lacked full and adequate gravel, was in the area of installation of three new cesspools, as required by the Suffolk County Health Department. In addition, that very area was exposed to extremely heavy rainfall in the recent past. The rest of the premises, however, meets,and has since the date of is- suance of the certificate of occupancy, all requirements of the Mr. Bennett Orlowski, Chairman Southold Town Planning Board July 13, 1984 Page two Planning Board and the Building Department with respect to the installation of gravel where required. For the record, the gravel in the area of the cesspools was also initially installed as required for site plan approval and issuance of a certificate of occupancy. As concerns Item #2 in your letter; "Insufficient plantings", I would point out that all plantings were installed as required by the Planning Board before site plan was approved. The plantings were only recently removed due to damage caused by automobiles and snow removal efforts made during the past winter. Again, for the record, the plantings were installed, as required by the Planning Board prior to the approval of the site plan and issuance of a certificate of occupancy. As concerns Item #3 in your letter - "Drainage appears to go through Mr. Crenshaw's property and on to the Main Road" - you can appreciate, I am sure, that what appears to be the case, is often not the case. I would suggest that before you make same a requirement, you first determine that there is a violation or something to be rectified. There never has been, and is not to this present date, a drainage problem with respect to the said premises. In no event has any water from the said premises ever drained to the Crenshaw premises. That being the case, it is obvious that none of the water or drainage from the Razmataz property has drained into the Crenshaw property and thus on to the Main Road. As to Item #4, "As yet no lease has been secured with Mr. Crenshaw as to the additional parking", I would point out to you that Mr. Crenshaw's letter of June 6, 1983 adequately indicates that parking does exist to the benefit of Razmataz pursuant to agreement, confirmed by that letter, between the parties. It is obvious that the agreement is in full force and effect as Mr. Crenshaw to date has voiced no objection with anyone that illegal parking by Razmataz exists on his premises. The parties consider this a binding agreement and I can see no reason why the Planning Board should not likewise accept same as such. ~ ever ceases to exist, a full and complete remedy exists wi~h reL_- t to the termination of the c--~t~fica-~e'&u~y ~,~ ~- ~at~i~--i-s--IRTt--w±thin t'~-~province of the Planning Board to determine the legality of the lease arrangement. With respect to this parking situation, I would further point out to you that the Southold Town Zoning Board of Appeals, under File #3151, made the following determination in its decision granting a variance for parking at the Crenshaw premises, to wit, Mr. Bennett Orlowski, Chairman Southold Town Planning Board July 13, 1984 Page three "An agreement has been executed by both parties (Crenshaw and Buchinski for Razmataz) for permission to use adjoining premises on the west for a period of ten years, commencing June 6, 1983, for the purpose of parking employee or customer vehicles". It is obvious,that Board had no difficulty accepting the validity of the agreement between the parties. As concerns Item #5 in your letter, "Westerly exit has not been blocked off". Before discussing this matter, I would like to bring to your attention the inconsistency of the Board in its reasoning. Firstly, the westerly exit that you refer to is on the premises of Crenshaw and is to be blocked in connec- tion with the use of the parking spaces by Razmataz on the Cren- shaw premises. For you to indicate that Razmataz must block this exit, implicitly recognizes the validity of the agreement to park cars by Razmataz on the Crenshaw premises. If that were not the case, Razmataz would have no right to enter upon the Crenshaw premises and block the westerly exit thereof. As to this west entrance, however, please be advised that the entrance had been properly blocked until it was damaged in a recent storm. In any event, that westerly entrance is blocked at night, in an appro- priate manner, and has in attendance a parking attendant who properly directs the flow of traffic in and out of the parking area. With respect to Item #6 in your letter, "We question the location of the sign". In response to this item, I should like to point out that it was the Board itself who requested Razmataz to relocate the sign, as indicated on the site plan, due to the fact that in the Board's opinion, it was a hazardous location. The sign now exists in the location suggested by the Planning Board. In the circumstances, one can only assume that the Planning Board is questioning its own judgment, rather than that of Razmataz. In the light of the foregoing, I would again request a complete and full retraction of the statement made by Mr. Orlowski to the Suffolk Times. In addition to that statement, I would suggest that any other statements by any members of the Planning Board made to the newspapers regarding alleged violations that exist with respect to Razmataz, based upon the Planning Board's inspection, be re- tracted on the ground that a full inspection was made by the Mr. Bennett Orlowski, Chairman Southold Town Planning Board July 13, 1984 Page four Building Department last Thursday and there were absolutely no fire code violations or problems in existence at that time. In this connection, statements made to the effect that "a hallway exists with an exit sign that leads to nowhere" is totally false and not based upon fact. As concerns an observation that a fire exit door was blocked, that too was totally false in that no such fire door was in fact blocked. In the light of the foregoing, I do hereby demand, on behalf of Razmataz, that the Planning Board immediately approve the site plan and withdraw its recommendation to the Building Department that no certificate of occupancy be issued for the recent addition. As the attorney for Mr. Buchinski and Razmataz, I indicated to you that I would use my best efforts in securing a more firm lease arrangement with Mr. Crenshaw in behalf of Razmataz or, in lieu thereof, to try to effect a better, or perhaps a purchase, arrangement with an adjacent neighbor. I have been in contact with Mr. Buchinski relative to same and, hopefully, we will be in a position to carry out all objec- tives to the satisfaction of the Planning Board at the time that the review, scheduled in or about July 13, 1984, is to take place with the Planning Board. Box 1412 Southold, New York 11971 Re: Razmataz Site Plan Dear Mr. Strang: At our meeting of October 18, 1983, Mr. Joseph Crenshaw appeared before the Board producing with him a letter refer- ring to parking between himself and Mr. Buchinski. Upon review of this it is impossible to determine what, if any, rights Razmataz has to utilize Mr. Crenshaw's prop- erty. I believe at the time, both you amd Mr. Cron represen- ted that it was a lease and/or a formal agreement leased be- tween parties for a length of 10 years. In order for us to pursue a site plan of Mr. Crenshaw, it is paramount that we resolve the parking question and whether or not a formal agreement exists; obviously, this will also have a direct effect on the Razmataz site plan. Dear Mr. Raynor & Members of the Board: Subsequent to the discussion on the amended Parking Plan,of the above referenced job, this past Monday, I have been advised the Zoning Board of Appeals must grant a varience for the use of adjoining leased parking. In light of this occurance, construction of the proposde patio and adjacent parking would not be considered by the Z.B.A. until after the 30 day certificate of occupancy had expired. In order to expedite matters and hopefully streamline these proceedures, my client is requesting permission to construct the patio at this time, however, installing a partition in such a fashion so as to allow occupancy of only 350 sq. ft. at this time. The remaining area to be used for storage until such time as all parking approvals, for occupancy of the entire patio, are received. The proposed restricted occupancy of the patio was calculated on the basis that the approved building occupancy of 127 people requires parking for 26 vehicles. Inasmuch as 30 vehicle parking was approved and is provided, the added occupancy will be at the pa'aio. If there are any questions, comments or requirements by the Board, please contact my office at your earliest convenience. Thank you for your continued cooperation and prompt attention to this matter.
