an office at 1065 Hyatt Road, Southold, New York 11971, herein-
after called the "Decalrant", duly executed a Declaration of
Covenants and Restrictions dated June 4, 1986 which were duly re-

WHEREAS, SUNBOW ASSOCIATES is still the owner in fee simple

of all of that certain parcel of land as shown on the Suffolk
County Tax Map as District 1000, Section 122, Block 6, Lot 29

and more particularly bounded and described as set forth in the

aforesaid Covenants and Restrictions heretofore recorded in Liber

10052 page 319 aforesaid. A description of said premises is

attached hereto as Schedule "A", and
WHEREAS, the said Declarants have applied to have the afore-
said premises subdivided into four (4) lots being a minor subdi.-
vision with the Southold Town Planning Board, and
WHEREAS,
the said Southold Town Planning Board has approved
the said subdivision subject to six (6) conditions as hereinafter

NOW, THEREFORE, SUNBOW ASSOCIATES do hereby amend the afore-
said Covenants and Descriptions as follows:
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the
Town of Southold Planning Board.
2. Due to the minimum lot area requirement of the zoning
classification of this property being considerably less
than the area of Lots 1 and 2, each lot shall be
subject to a covenant that will prohibit future subdi-
vision..
3. All driveways on Main Road shall make an angle of at least
70 degrees and preferably 90 degrees with the county road.
4. Each lot having frontage on Main Road shall have a turn-
around provision, such as a T-shaped shunt, so that a
vehicle leaving a lot will not have to back out into the
traffic stream on the road.
5. All stormwater runoff resulting from the development and
improvement of this subdivision or any of its lots shall
be retained on the site by adequate drainage structures
so that it will not flow out onto the right-of-way of
Main Road or the adjacent State-owned land.
6. In order to minimize the number of access points on Main
Road and to insure that there will not be any conflicts
between points of access that are created, consideration
shall be given to creating a plan indicating the placement
of access for Lots 1 to 4, inclusive, and the parking
areas on these lots. Consideration shall also be given
to establishing, through the creation of easements, common
use of access points and parking by these lots; that is,
allowing a vehicle to pass from a parking area on one lot
to another parking area on a lot without the vehicle hav-
ing to re-enter the road.
All other Covenants and Res.tr ictions not inconsistent herewi lh
and contained in the aforesaid Declaration of Covenants and Re-
strictions recorded in Liber 10052 at page 319 shall remain in full

NOW, therefore, be it RESOLVED that the application of "Sunbow
Associates" for approval of said subdivision plat prepared
by Rod Van Tuyl dated as amended February 21, 1986be approved
and the Chairman be authorized to endorse approval on said
subdivision plat, subject to the following conditions which
must be completed within 6 months from the date of this
resolution:

Northwesterly side of Main Road, New York State Route 25,
approximately 1,680 feet southwesterly from Factory Avenue,
Mattituck, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on June 4,
1986, reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Sunbow Associates", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following eight conditions deemed necessary to help preserve
the traffic safety and carrying capacity of Main Road, a state road:
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Town of Southold Planning
Board.
2. Due to the m1n1mum lot area requirement of the zoning classification
of this property being considerably less than the area of Lots 1 and
2, each lot shall be made subject to a covenant that will prohibit
future subdivision.
3. All driveways on Main Road shall make an angle of at least 700 and
preferably 900 with the county road.
4. Each lot having frontage on Main Road shall have a turnaround
provision, such as a T-shaped shunt, so that a vehicle leaving a lot
will not have to back out into the traffic stream on the road.
5. All stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out onto the
right-of-way of Main Road or the adjacent State-owned land.

6. In order to minimize the number of access points on Main Road and to
insure that there will not be any conflicts between the points of
access that are created, consideration shall be given to creating
a plan indicating the placement of access for Lots 1 to 4, inclusive,
and the parking areas on these lots. Consideration shall also be
given to establishing, through the creation of easements, common
use of access points and parking by these lots; that is, allowing
a vehicle to pass from a parking area on one lot to another
parking area on a lot without the vehicle having to reenter the
road.
7. Conditions 1-6, inclusive, shall be filed as covenants and
restrictions in the office of the County Clerk on or prior to the
granting of approval to this subdivision.
These covenants and restrictions can be modified only at the
request of the then owner of the premises with the approval of a
majority plus one of the Town Board and/or Planning Board of the
Town of Southold after a public hearing. Adjoining property owners
shall be entitled to notice of such public hearing but their consent
to such modification shall not be required.
8. The final map shall bear the following note: A Declaration of
Covenants and Restrictions has been filed in the Suffolk County
Clerk's office which affects lots in this subdivision.
The Commission also offers the following comments on the map for your use
and consideration:
1. Adequate prOV1S1on shall be made for properly designed and properly
located handicapped parking spaces. In locating a handicapped parking
space consideration is to be given to the nature of the occupancy of
the building and the probability of a handicapped person utilizing a
specific unit within the building.
2. The map of this minor subdivision should be filed in the office of the
County Clerk. This is to insure the validity of the subdivision map
and that the subdivision map will be available to the general public
in a central office of official records.

The following actions were taken by the Southold Town
Planning Board, Monday, January 13, 1986.
RESOLVED that the Southold Town Planning Board declare
themselves lead agency with regard to the State Environmental
Quality Review act for the minor subdivision of Sunbow
Associates located at Mattituck. An initial determination
of non-significance has been made.
RESOLVED that the Southold Town Planning Board grant
sketch map approval to the minor subdivision of Sunbow
Associates for 4 lots on 4.176 acres located at Main
Road, Mattituck; survey dated June 27, 1985. This
subdivision received insufficient width variance from
the Board of Appeals.
Upon receipt of Article 6 approval from the Suffolk
County Health Department we will schedule a public hearing
on this subdivision.
Would you please forward six (6) of surveys in
accordance with the enclosed list of requirements for our
referral to the Suffolk County Planning Commission.

Commen ts :
The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be revie\~d completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct-any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.

WHEREAS, a public hearing was held and concluded on November 14,
1985 concerning the Matter of the Application of SUN BOW ASSOCIATES
under Appeal No. 3420; and
WHEREAS, the board has considered all testimony and documentation
entered into the record concerning this application, and it is noted
for the record that no public opposition has been received; and
WHEREAS, the board members have personally viewed and are familiar
with the premises in question as well as its surrounding area; and
WHEREAS, the board made the following findings of fact:
1. The property in question is located in the "B-1" General
Business Zoning District having a total frontage along the north side
of the Main Road in the Hamlet of laurel of 507.16 feet and total
acreage of 4.176 acres, and is identified on the Suffolk County Tax
Maps as District 1000, Section 122, Block 6, lot 29.
2. By this application, appellant requests approval of insuffi-
cient lot width (frontage) of four parcels in this Minor Subdivision
pending before the Southold Town Planning Board of 126.79 feet each.
Each of the proposed parcels is in compliance with the area and depth
requirements of the code: .. (a) Parcell. of 49,585 sq. ft. in area and
average lot depth of 392.28 feet; (b) Parcel 2 of 47,361 sq. ft.
in area and average lot depth of 373.18 feet; (c) Parcel 3 of
44,205 sq. ft. in area and average depth of 348.64 feet; (d) Parcel
4 of 40,759 sq. ft. in area and average depth of 322.19 feet.
3. Article VII, Section 100-71, and Bulk Schedule of the Zonin9
Code, requires a minimum lot width of 150 feet.

4. In considering the alternatives submitted by applicant,
it is the board's opinion that this application as applied is the
most practical and reasonable in assuring appropriate and adequate
building area and circulation.
In considering this appeal, the board finds; (a) that the
relief as requested is not out of character with this zoning dis-
trict; (b) that the circumstances of this appeal are unique;
(c) that by allowing the variance, no substantial detriment would
be created affecting adjoining properties; (d) that no adverse
effects will be produced on available governmental facilities of
any increased population; (e) that the relief is not substantial,
being 15% of a variance from the requirements; (f) that there is
no other method other than a variance feasible for appellant to
pursue; (g) that the interests of justice will be served by
allowing the variance, as indicated below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Douglass, it was
RESOLVED, that the relief requested under Appeal No. 3420
in the Matter of the Application for SUNBOW ASSOCIATES for
approval of the insufficient lot width (frontage) of 126.79
feet along the Main Road of each of the proposed four lots in
question, BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING
CONDITION:

that shown on Minor Subdivision Map prepared by Roderick VanTuyl,
P.C. dated June 27, 1985.

Monday, October 7, 1985.
It was the consensus of the Planning Board to conduct a
field inspection of the premises prior to any further action

Board of Appeals.
