In an orderly manner, whether a project or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is dlso understood that those who determine significance may have little or no formal knowledge of the environment or mav be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3 Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether It IS a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is lIsed to evaluate whether or not the impact is actually important. A summary of the study follows: In lieu of a separate traffic impact report Dunn Engineering Associates refers to two recent traffic nnpact studies recently prepared for other projects in the vicinity of the proposed Dunkin Donuts site. A 1992 study of the Bridgehampton Bank on Main Road east of the proposed Dunkin Donuts site and a 1993 study for a Burger Kin2 on Main Road west of the site were identified as analyses that already assessed traff1c impacts in the area and could be utilized for the subject project. SU('Plementary analyses were offered to include the incremental prediction of additional traffic generated by the proposed Dunkin Donuts. The supplementary anal~ calculates 38 trips attracted to the Dunkin Donuts facility during -the AM peak penod. A reasonable 50% pass-by credit was assumed which brings the number of trips attracted to 19. Therefore, 19 vehicle trips traveling to the site and 19 vehicle trips traveling from the site were added to the Main Road traffic volumes in a "worst case scenario. distribution, either all from the west or all from the east. While the trip generation and distribution procedure described above is an acceptable methodology, the information suppo~ how 38 trips were calculated was not supplied to our office. Presumably, trip generation was based on the S<!.uare footage of the building or the number of seats ~~~vided. That information IS needed to corroborate the number of generated trips. . ewise, a supporting statement or justification should be provided, that the weekday AM peak period used in the analysis is in fact the worst case for generated traffic. The resultant levels of service with the incremental Dunkin Donuts traffic added to the analysis, result in the same levels of service that were achieved in the Burger King analysis, i.e., the LOS was unchanged. Thus the same conclusion can be reached as in the Burger King study, the proposed Dunkin Donuts project will not result in a degradation of traffic operations if built. Box 1179 Southold, NY 11971 Re: Review of Traffic Impact Analysis Dunkin Donuts, Mattituck, NY Dear Mr. Kassner: As per the authorization of the Planning Board, we have completed a review of the Traffic Impact Analysis prepared by Dunn Engineering Associates for the above captioned application. A summary of the study follows: In lieu of a separate traffic impact report Dunn Engineering Associates refers to two recent traffic Impact studies recently prepared for other projects in the vicinity of the proposed Dunkin Donuts site. A 1992 study of the Bridgehampton Bank on Main Road east of the proposed Dunkin Donuts site and a 1993 study for a Burger King on Main Road west of the site were identified as analyses that already assessed traffic impacts in the area and could be utilized for the subject project. SUl?plementary analyses were offered to include the incremental prediction of additIOnal traffic generated by the proposed Dunkin Donuts. The supplementary analysis calculates 38 trips attracted to the Dunkin Donuts facility during the AM peak penod. A reasonable 50% pass-by credit was assumed which brings the number of trips attracted to 19. Therefore, 19 vehicle trips traveling to the site and 19 vehicle trips traveling from the site were added to the Main Road traffic volumes in a "worst case scenario" distribution, either all from the west or all from the east. While the trip generation and dislribution procedure described above is an acceptable methodolo~, the information supportin~ how 38 trips were calculated was not supplied to our office. Presumably, trip generation was based on the s'l.uare footage of the building or the number of seats provided. That information IS needed to corroborate the number of generated trips. Likewise, a supporting statement or justification should be provided, that the weekday AM peak period used in the analysis is in fact the worst case for generated traffic. The resultant levels of service with the incremental Dunkin Donuts traffic added to the analysis, result in the same levels of service that were achieved in the Burger King analysis, i.e., the LOS was unchanged. Thus the same conclusion can be reached as in the Burger King study, the proposed Dunkin Donuts project will not result in a degradation of traffic operations if built. 54 NORTH COUNTRY ROAD, SUITE 2, MILLER PLACE, NY 11764 (516) 331-1455 Dunkin Donuts Traffic Analysis Review Since a com/?lete independent traffic impact analysis was not provided for the Dunkin Donuts application, it would be illustratIve and beneficial to provide an array of the analyses' conclusions for easy inspection. In summary, the r:~est of the applicant to reference the recent Bridgehampton Bank and Burger King tr c studies and to provide the supplementary analyses to account for the Dunkin Donuts generated traffic is reasonable. The supplemental information provided is based on sound transportation plannin~ principles; however, several minor points of information are requested to provide justification of assumptions used in the analysis. If a sound basis for trip generation and peak hours of operation is provided, the analysis supports the applicant's claim that the project will not have an adverse impact on local traffic operations. The curb line at the east end of the property must be continued in a westerly direction to tie into the existing structure located at the west end of the property. This width will be sufficient to handle the fuel trucks entering the property. The location of this curb cut will be to the west of the building with the double bays. The westerly curb cut cannot be installed directly in front of double bays, as the backing up of cars directly into the State Highway is not permissible. 3. The shoulder which fronts the property shall be removed and replaced full frontage. The shoulder, which is directly in front of the westerly curb cut, shall consist of traffic bearing asphalt. After review, we find that the subject site plan indicates that the westerly property line of the site terminates at the westerly edge of the building which will house the proposed donut shop. In our conversation with the Town of Southold, it was indicated that the si te plan they were in the processing of reviewing shows the property line terminating approximately 3'-0" west of the building which has the double bays. This building is located west of the property line you have indicated. Mr. Ward: Is there anybody else tl1is evening that would have any questions or would like to address the Board? Linda Levy: I'm Linda Levy, tile Southold coordinator for the North Fork Emvir-- onmental Council and I wanted to just speak with the Board briefly tonight about the Burger King and the Dunkin Donuts applications. I note that you to~{ lead agency tonight on botl:1 of those. We would lil{e to take this opportunity to re-- quest once again that a full SEQRA review be initiated on the Burger King application. While we are aware that this is an unlisted action, and therefore doesn't require tl:1at you do a full SEQRA review, we believe that the potential impact to our communi ty of a fast food restaurant demands an environmental im-- pact study. As we stated in our memo to you of August 5, we believe that there are many sections of tl:1e law that apply to the determination of significance of this action. These include substantial changes in noise ann traffic levels, an increase in solid waste production, impairment of neighborhood character and change in intensity of use. In addition, the consequential significance of this action needs to be assessed. We are fully aware that the ZBA has ruled this is the same application as that of the 1990 application for a McDonald's restaurant on the same site. However, that application was withdrawn before many of the issues raised were addressed by the Planning Board. We do not believe that these applications are tl:1e same and in any case, we believe that a hard loo'{ must be taken before any determinn ation on the current application is made. The New Yor', State legislature has directed that SEQRA be administered to the fullest extent possible. Given the overwhelming community response to the 1990 McDonald's application, a full SEQRA review must be applied to the new proposal so that the impact to our community may be completely understood. We are concerned about the DunldnDonuts application before you as well. We believe that many of the same issues, traffic impact, storm runoff, etc. apply to this proposal. Most important, however, is the change in intensi.ty in use of the site. The burden of such increased intensity must be assessen. Regardless of rUlings by other agencies, and here I'm referring to the ruling by the Build-- ing Dept. that permits the second use on this si.te, ',e believe that the Planning Board must require that impacts on our community and environment ~ mitigated. Recently we've been made aware that a building is being constructed without a site plan approval at the Mattituck Airport. We all know that a used car lot has been allowed to operate despite the fact that it's not permitted under our zoning code and now we have these two applications,cBurger King ann Dunkin Donuts, to be situated on the already dangerously congested Main Rd. in Mattituck. These are the types of actions that led to the nestruction of the rural character of all the towns west of Southold. Tonigl1t we request tl1at the Southold Planning Board use its legal authority to fully review these two applications. The law states the lead agency shall make every reasonahle effort to involve applicants, other agencies and the public in the SEQRA process. Only through a full review can this charge be met. Recently we have been made aware that a building is being constructed without site plan approval at the Mattituck Airport. We all know that a used car lot has been allowed to operate, despite the fact that it is not permitted under our Zoning Code. Now we have these two applications, Burger King and Dunkin Donuts, to be situated on the already dangerously congested Main Road in Mattituck. These are the types of actions that led to the destruction of the rural character of all of the towns west of Southold. We request that the Southold Planning Board use its legal authority to fully review these two applications. The law (NYCRR Part 617.3(g)) states, "The lead agency shall make every reasonable effort to involve applicants, other agencies, and the public in the SEQR process". The plans which were submitted to this office with the above noted correspondence have been reviewed by this office. As part of that review, contact was made with the Mr. Bob Cassner of the Town of Southold Planning Board. A site review was conducted by Mr. Kassner and myself concerning the access to the proposed site. At that time, I was informed by Mr. Kassner that the application the Town was reviewing was for the entire parcel, which was owned by Mr. Dale Berger. It was also indicated that the Town would require two curb cuts from Route 25 to service this parcel. It was our understanding that the revised site plan submitted to this office was the same as the one submitted to the Town of Southold. Our decision to allow one curb cut to service the easterly part of the property was based on your submittal, which did not include the entire site. Therefore, in accordance with the re-evaluation of the proposed access, we will require the submittal of revised prints showing the installation of an additional curb cut to the west of the proposed. This access will service the garage bays and to the rear of the building on the west side of the proposed donut shop. The construction requirements for the installation of the curb cuts, apron, asphalt shoulder and sidewalk will as be indicated in the attached booklet. The additional work will increase the amount of the surety bond, which will be determined upon review of the revised plans. ./ , . . Box 1549 Riverhead, NY 11901 Re: Proposed Burger King Route 25, Mattituck Southold, New York Dear Mr. Cuddy: As discussed, we have investigated the impact on traffic conditions in the vicinity of the above project of the Dunkin' Donuts facility as you described it. As a result of this investigation, the following can be concluded: I. The Dunkin' Donut facility can be expected to attract 38 vehicles during its peak hour of operation, 7:00-8:00 A.M. This is bascd on the assumption that each vehicle arriving at the facility will carry an average of 1.2 persons, a nationally accepted rate; 2. Some, if not most, of the tramc associated with the Dunkin' Donuts facility can be expected to be already on the road for another purpose, such as traveling to work or to a recreational activity. Analyses performed in connection with this investigation have assumed that 50% of the tramc destined for the Dunkin' Donuts facility will be pass-by trips; therefore only 19 new vehicles will be generated by this proposed facility during the A.M. peak hour; 3. The addition of this tramc to the roadway network results in barely perceivable impact, even if all 19 originated in and returned to the west, so as to have the greatest impact on the Burger King site. This is evidenced by the results of unsignalized capacity analyses performed with these 19 vehicles added. Since it can be expected that some of the donut shop tramc would originate in the east, this analysis examines a worst case scenllrio as it relates to the Burger King operation. A copy of these analysis is attached; As a result, it can be seen that the tramc generated by the proposed Burger King can be accommodated by the existing roadway network, even with the addition of traffic generated by the Dunkin' Donuts facility. ~J i\UiJ 2 11993 . ~ . . While the NFEC generally approves of the re-use of existing facilities for new businesses or for expansions of existing businesses, we feel that this proposal presents special difficulties. Our concerns are outlined as follows. 1. Present traffic conditions along this section of Route 25 are over capacity. The addition of this facility, with an additional curb cut, would generate even more in/out traffic than presently exists at the site, adding to the congestion. 2. Parking requirements according to Southold Town Code Section 100-191 require 1 space for 50 square feet of floor space (for restaurant, drive-in, curb service or fastfood facility) or at least 1 space per 200 square feet of gross floor area (for retail shop or store, other than those listed herein). Can these requirements be met on this site considering the existing uses and site configuration? 3. According to the Southold Town Code Density and Minimum Lot Schedule for Nonresidential Districts, 30,000 square feet is the minimum lot size required for one use. The lot is already substandard as it is only 16,000 square feet and it already has an existing use on it. How can another use be permitted? 4. It is also necessary to know it the applicant intends to sell cOffee/tea, etc. at this facility. If these beverages are prepared on site, Suffolk County and/or State Department of Health permits may be required. a non-profit organization for the preservation of land, sea, air and quality of life printed on 100% recycled paper . . 5. Review and compliance with health codes will also be necessary for the sanitary waste system which will be needed. 6. And finally, we feel that alternative sites, in other existing store fronts, should be explored. Thank you for the opportunity to comment on this application.
