Dear Mr. Cuddy:
The following actions were taken by the Southold Town Planning Board,
Monday, March 22 , 1982 :
RESOLVED that the Southold Town Planning Board override the Suffolk
County Planning recommendations #1 and #2, dated January 11, 1982 ,on
Minor Subdivision entitled John Simicich, located at Mattituck.
RESOLVED that whereas , a formal application for the approval of a
minor subdivision plat entitled Minor Subdivision of John Simicich
was submitted to the Planning Board on August 12, 1981 and an applica-
tion fee of $50 was paid on September 8 , 1981, and
WHEREAS , a public hearing was held on said subdivision application and
plat at the Town Hall, Southold, New York, on February 8 , 1982 at
8 : 00 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have met by said subdivision plat anJ application,
NOW, therefore, be it RESOLVED that the application of John Simicich
for approval of said subdivision plat prepared by Roderick Van Tuyl,
P.C. dated July 6 , 1981 and amended November 27 , 1981 be approved and
the chairman be authorized to endorse approval on said subdivision
subject to the following conditions:
1. No lot shall be subdivided or its lot lines changed in any
manner at any future date unless authorized by the Southold
Town Planning Board.

2. Approval of this subdivision shall be made subject to the sub-
division' s meeting the requirements and standards of the Suffolk
County Department of Health Services .
3 . The above conditions shall be filed as covenants and restrictions

4 . The 121, foot wide strip reserved for possible future construction
of a Town road should be extended across the tract' s entire
frontage on Camp Mineola Road to insure that the property is
available for highway use when the need arises .
Upon receipt of a copy of the recorded covenants and restrictions
and three copies of the final map, within six (6) months from date of
resolution, the chairman will endorse said maps; two copies of the
approved map will be returned to your office.
If you have any questions concerning the above, please do nothesitate

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of John Simicich is a two lot subdivision
located at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Water supply and sewage disposal conditions appear
adequate.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

Re: John Simicich - Minor Subdivision
Gentlemen:
In response to your letter of February 10, 1982, this is to
advise that Mr. Simicich does not have any plans to subdivide or
utilize parcel No. 2 on the subdivision map other than for its
present use. He, his wife and children reside in the dwelling on
that parcel. Mr. Simicich will , of course, covenant that no
further subdivision will be made without application being made
to the Planning Board.
we are also in receipt of a copy of the proposed restrictions
submitted by the Suffolk County Planning Commission. Again, we
reiterate our opposition to covenants #1 and #2. It is true that
Mr. Simicich 's home is within one (1) mile of the airport.
However, the airport referred to is not MacArthur Airport or
Suffolk County Airport but a macadam landing strip for single
engine planes.
Mr. Simicich 's parcel is not in the landing path. It is located
approximately one-half mile west of the airport. Dozens of homes
have been built within one (1 ) mile of the airport within the
past decade. To my knowledge, there has been no adverse affect
upon the occupants of these homes.
The location of the airport prevents its expansion and, in fact,
it has reduced its operation by severing its relationship with
the Town. The airport is closed at night and most flights occur
during the summer months.
To require noise proofing materials in new homes constructed
within one mile of the airport is a penalty to anyone who owns
property from the Mattituck-Cutchogue line to the North Road. To
my knowledge the County Planning Commission just does not have
that kind of jurisdiction.
The facts do not support requiring either a warning covenant or
the use of special materials. If upon this application a warning
of record is required then will waterfront property owners be

required to advise prospective purchasers of speedboat noise , or
will owners of land adjacent to farms be required to advise of
the noise from low level helicopter crop spraying at 6:00 a.m.
Similarly, should there be a warning if you are building within
one (1 ) mile of the town garbage dump. What type of construction
should there be in each instance? There may be no end to what
offends individual sensibilities. The County Planning Commission
has created something from wholecloth. Covenants #1 and #2
should not be adopted.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on January 6,
1982, reviewed the proposed subdivision �Pa�lentitled "Minor Subdivision - John
Simicich", referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
following six conditions deemed necessary to alert prospective owners of lots
within the subdivision that they are in close proximity to Mattituck Airport and
may be subjected to noise resulting from airport activities and aircraft; to
help avoid pressures from these future residents to close the airport or to cur-
tail its activities because of noise resulting from the use of the facility; and
to help insure the preservation of Suffolk County groundwater resources:
1. The recording in the office of the County Clerk of covenants and
restrictions advising all prospective purchasers that this subdivi-
sion is located within one mile of Mattituck Airport and may be sub-
jected to noise from the operation of that facility and noise from
aircraft flying overhead or nearby.
2. All residential structures that are erected within this subdivision
shall be constructed using materials and techniques that will re-
duce interior noise levels in accordance with the recommendations
of the Department of Housing and Urban Development or any other
authority that has promulgated adequate standards for reduction of
noise levels.
3. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning Board.

4. Approval of this subdivision shall be made subject to the subdivi-
sion's meeting the requirements and standards of the Suffolk County
Department of Health Services.
5. The above conditions shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of
approval to this subdivision.
6. The 12 1/2 foot wide strip reserved for possible future construc-
tion of a Town road should be extended across the tract's entire
frontage on Camp Mineola Road to insure that the property is avail-
able for highway use when the need arises.

have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of John Simicich is a two lot subdivision
located at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Water supply and sewage disposal conditions appear
adequate .
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

Dear Mr. Cuddy:
At a regular meeting of the Southold Town Planning Board, Monday
November 9, 1981 the following actions were taken:
RESOLVED to approve sketch map dated July 6, 1981 and amended October 15 ,
1981 of the minor subdivision of John Simicich, located at Mattituck.
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act for the
subdivision of property of John Simicich, located at Mattituck. An
initial determination of non-significance has been made .
On review of this subdivision, the board strongly urges a restrictive
covenant on lot #2, as the proposed lot lends itself very poor to
future configurations to further subdivide and that the applicant re-
serve a strip on the easterly border, in the width of 12� feet, for
possible future construction of a Town Highway.
Would you kindly submit, to our office, six (6) copies of the above
captioned map so that we may begin SEQURA action. Thank you.

Gentlemen:
We are enclosing six (6) copies of the minor subdivision map
submitted on behalf of John Simicich under date of August 11,
1981. We had forwarded a map for the same property and it has
now been revised to include lot #3.
Your files will show that under date of November 18 , 1975, a
sketch plan for the subject property was submitted to you. No
further action was taken in connection with the subdivision,
except for the sketch plan submission. However, under date of
April 9 , 1976, a letter was submitted on behalf of Mr. Simicich
in connection with an application that was before the Zoning
Board of Appeals for a 280-A variance. That letter referred to
the earlier map submitted in November 1975. We, at this time,
ask that you note on your records that the proposed minor
subdivision submitted in 1975 was abandoned and should be noted
as having been withdrawn by the applicant.
The map now presented to the Planning Board includes a third lot
which was sold to Frank Was and Netti Was , his wife, in June of
1976. This lot is included without prejudice and is included in
the minor subdivision map so that the Board will have before it
all of the property which had been in one name. Kindly consider
the enclosed map and advise if you have any additions or changes
which you feel are necessary in order to comply with your
requirements.
