NEGATIVE DECLARATION
April 15 , 1985
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617 . 10 and Chapter 44 of the Code of the Town Of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Mohring -Enterprises ,Inc. is four
lots on 15 . 9 acres located at Mattituck, Tax Map No. 1000-122-3-11
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence from the New York
State Department of Environmental Conservation in the &711otted
time it is assumed that there are no comments or objections
by that agency.
The Suffolk County Health Department has no objection to our
lead agency status . They have received an application and the
proposed project is in non-conformance with Article 6 due to
insufficient depth of test well. In addition, required test
hole inspections have not been done to determine subsoil
conditions .
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

RE: Plinor subdivision - Plohring
Enterprises, Inc. , Matfituck,
New York
Dear Mr. Orlowski:
In reference to a letter dated November 9, 1984 from the
Suffolk Countv Planning Commission on the disapproval of above
proposed minor subdivision per the enclosed copy.
In regard to reason #1 - As it is quite obvious, the
proposed subdivision will not create land locked parcels,
as the proposed right of way along the Tiesterlv houndary will
be constructed to town specifications, thereby alleviating
any problems to the land locked parcels. It is obvious,
also, that this would not come under the jurisdiction of
the Zoning Board of Appeals in the Town of Southold. because
the right of way will be constructed within the metes and
bounds description of the proposed subdivision.
With regard to reason #2 - The Potential further subdivision,
we are in complete agreement that no further subdivision of
the A residential ProDertv is Proposed. I also stipulate that
it is a request of the Planning Board.
In regard to reason #3 - We feel that the proposed minor
subdivision of the property reduces the regidential densitv,
improves the rural characteristics of the community and is in
keeping with as much open space as Possible. Coupled with the
above and the Covenants and Restrictions as Proposed bv the
Planning Board, we feel this design is more in keeping with
the spirit and intent of the regulations.

In light of the above, we would appreciate a resolution

8. comments:
The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI , and relevant
construction standards for water supply and sanitary sewage disposal .
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems Is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval .
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.

Re: Minor Subdivision - Mohring Enterprises, Inc.
Southeasterly side of Main Road, New York State Route
25, 280.48 feet southwesterly from New Suffolk Avenue,
Mattituck, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on November
7, 1984, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Mohring Enterprises, Inc.", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to dis-
approve said map for the following four reasons :
1. The proposed subdivision will result in the creation of three land-
locked parcels; that is, parcels that do not have frontage on an exist-
ing or proposed public road. The creation of such lots is contrary to
good subdivision principles and creates problems as far as access by
emergency and service equipment is concerned; this could result in
health, safety and welfare problems for the future residents of these
lots. Creation of landlocked lots also places the Zoning Board of
Appeals in the awkward position of having to grant a building permit
for each of these lots under Section 280-a of the Town Law as the
future owners of these lots cannot be held responsible for the land-
locked nature of the parcels.
2. Two of these lots have the potential to be subdivided thereby placing
further dependence on the right-of-way as access.
3. It is felt that the proposed right-of-way should have been laid out as
• proposed public road and the subdivision of this property treated as
• major subdivision instead of a minor subdivision.
4. No information was provided to show that future residents would be in-
formed by an advisory covenant that this property is located within one
mile of Mattituck Airport and, therefore, may be subjected to noise from
aircraft activity.

Re: Minor Subdivision - Mohring Enterprises, Inc.
---------------------------------------------------------------------------
The Commission also offers the following comment on the map for your use
and consideration:
Lot 4 should not exist as a lot in two zoning districts of different nature,
that is , business and residential. This will result in conflicts over the future
use of the parcel and possibly result in an application to rezone the balance of
the parcel to business. The question of the zoning of this parcel should have
been resolved at this time by either rezoning the parcel or dividing it into two
lots using the zoning district as a common lot line.

Dear Mr. Young:
The Planning Board has reviewed the various submissions
for the subdivision of Mohring Enterprises , Inc. at
Mattituck.
The Planning Board recommends that the development be for
five (5) residential lots of 80,000 square feet, and the
entrance road be terminated in one cul-de-sac. The two (2)
business lots are acceptable, and in lieu of the park and
playground area, we will accept a cash deposit to the Town
for the park and playground fee.
If you have any questions, please don' t hesitate to contact

Re: MOHRING ENTERPRISES - Cluster Proposal
Mattituck
Gentlemen:
Please find enclosed 12 copies of the above captioned subdivision plan.
This is a cluster development and has been amended in accordance with
our conversations with your Board at the May 21 , 1984 meeting.
This map indicates seven (7) lots: two (2) commercial lots on the Main
Road and five (5) residential lots varying in size from 57,000 sq. ft.
to 94,000 sq. ft. The open space area totals 5.8± acres.
The cluster yield calculation indicates that 4.7 lots are permissable.
Should your Board determine that based on your code only four (4) re-
sidential lots will be permitted, we would then wish to withdraw this
application and submit a convential subdivision (copies of which are in
your files) which indicates a yield of two (2) commercial lots and six
(6) residential lots.
Should your Board require any additional information, please do not
hesitate to contact me.
Very truly yours,
