Brown, FIELD PERSONNEL: Raymond Dean PERIOD: July 26 - August 4, 1987 ----------------------------------------------------------------------------------- SBB Job No. NAME STATUS 087112 Hill Crest Estates Contractor laid 489 tons of binder -course (major subdivision) over well rolled and shaped Pulver mix on 7117, with 4 trucks running (3" to 3-1/2") , in addition to 250 tons on 7/16. They laid 460 tons of binder on 7120 and 7121. Road was finished today with 150 tons, the base course has run 3" to 3-1/2". 087114 Long Pond Estartes Contractor (Corrizini ) finished grading (major subdivision) crushed concrete on 7/26. He has rolled and shaped 4" stone base for binder course. Started laying 3" to 3-1/2" binder course on 7/28 - 457 ton. Binder course, 307 ton (7/30), with six men raking shoulder and picking stones. There is a lot of sand in shoulder, top soil will have to be added (1-112") for seeding. Contractor finished road today (8/1), base course looks good 145 ton. 087115 Paradise by the Bay Contractor stated no work will be done until (major subdivision) electric and telephone is put in, projected for the end of this month, road work will not start until September. 087135 Meeting with Mohring today (8/4), requested TWinor subdivision) that he ask Planning Board for another inspection. 087140 Kings View Partners 500 ft. of road has bank run, the basins are (minor subdivision) in, not covered. DESCRIPTION OF ACTION The minor subdivision of Mohring -Enterprises ,Inc. is four lots on 15 . 9 acres located at Mattituck, Tax Map No. 1000-122-3-11 The project has been determined not to have a significant effect on the environment for the following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no correspondence from the New York State Department of Environmental Conservation in the &711otted time it is assumed that there are no comments or objections by that agency. The Suffolk County Health Department has no objection to our lead agency status . They have received an application and the proposed project is in non-conformance with Article 6 due to insufficient depth of test well. In addition, required test hole inspections have not been done to determine subsoil conditions . The project will meet all the requirements of the Code of the Town of Southold Subdivision of Land Regulations . Further information can be obtained by contacting Diane M. In regard to reason #1 - As it is quite obvious, the proposed subdivision will not create land locked parcels, as the proposed right of way along the Tiesterlv houndary will be constructed to town specifications, thereby alleviating any problems to the land locked parcels. It is obvious, also, that this would not come under the jurisdiction of the Zoning Board of Appeals in the Town of Southold. because the right of way will be constructed within the metes and bounds description of the proposed subdivision. With regard to reason #2 - The Potential further subdivision, we are in complete agreement that no further subdivision of the A residential ProDertv is Proposed. I also stipulate that it is a request of the Planning Board. In regard to reason #3 - We feel that the proposed minor subdivision of the property reduces the regidential densitv, improves the rural characteristics of the community and is in keeping with as much open space as Possible. Coupled with the above and the Covenants and Restrictions as Proposed bv the Planning Board, we feel this design is more in keeping with the spirit and intent of the regulations. After due study and deliberation it resolved to dis- approve said map for the following four reasons : 1. The proposed subdivision will result in the creation of three land- locked parcels; that is, parcels that do not have frontage on an exist- ing or proposed public road. The creation of such lots is contrary to good subdivision principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the land- locked nature of the parcels. 2. Two of these lots have the potential to be subdivided thereby placing further dependence on the right-of-way as access. 3. It is felt that the proposed right-of-way should have been laid out as • proposed public road and the subdivision of this property treated as • major subdivision instead of a minor subdivision. 4. No information was provided to show that future residents would be in- formed by an advisory covenant that this property is located within one mile of Mattituck Airport and, therefore, may be subjected to noise from aircraft activity.
