Applicant is withdrawing his petition for the Change of Zone on the above-
referenced property. Concomitant with this action, the applicant is requesting a
refund of fees paid to the Town to process this application. This request was
reviewed with the Planning Board.
A brief history of this application, as per the Planning Board's files, are as follows:
1. The application was made in October, 2001.
2. The application was declared an Unlisted Action in December,
2001.
3. Nelson, Pope & Voorhis was hired to conduct the environmental
review, also in December, 2001. His report, submitted in February of
2002 indicated that the applicant needed to provide more information.
4. At the same time, the Town made the determination that the
application included a request for accessory apartments attached to
single-family dwellings which was found to be not permitted by the
Zoning Code within the Affordable Housing District.
5. The applicant revised the application to bring it into compliance with
Code in April 2002.
6. The amended application was re-circulated to the public, the Planning
Board and Nelson, Pope & Voorhis in June 2002. The consultant
charged an additional fee to review the amended application. It is not
known if this additional fee was paid by the applicant.
7. The environmental review prepared by Voorhis in July of 2002
indicated that additional information was needed from the applicant
before the Town could proceed with SEQR process.
8. The Planning Board agreed with Voorhis' assessment and notified the
Town Clerk of such in July of 2002.
9. The Suffolk County Planning Commission wrote several times to say
that additional information, some pursuant to SEQR, was needed
before the application could be reviewed by them. Those letters were
dated August and October of 2002.
10.The Town Attorney's office, in consultation with the Planning office,
reviewed the file and sent a letter in October of 2002, reminding the
applicant to supply additional information (as required to fulfill intent of
SEQR).
Conclusions:
The applicant did not submit a complete application in the first place.
Additionally, the apolication was found to be a request for an action not permitted
by the Zoning Code.
When the application was revised to request a permitted use, it did not include
sufficient information for SEQR review purposes.
The applicant did not respond to requests for the necessary information.
The consultant's fees cannot be reimbursed as they have already been
contracted for.
The Planning Board staff spent several hours working with the Town Attorney's
and Town Clerk's offices to assist the applicant in making a complete application.
Estimated time by Planning Board and staff: 8 hours at $50.00 an hour =
$400.00. This does not include for time expended by the Town Attorney's Office
or the Town Clerk's office in the processing of this application.

Re: Change of Zone Applications
The following is a monthly status on the pending change of zone applications:
Amerada Hess —Val Scopaz prepared a 1/21/03 memo to Elizabeth Neville containing
numerous comments on the second draft SEQRA report prepared by John J: Raynor, the
consultant performing the SEQRA review for the Town. On January 29, 2003, 1 forwarded
the memo to Raynor, asking him to consider Val's comments and prepare a final report. I
have received several calls from the attorney representing Hess inquiring as to the status,
as well as from Jospeh Finora, a neighbor of the gas station. Both have been advised that
the SEQRA process is moving along. I expect to receive a report from Raynor within the
next few weeks. Once the report is received, it will be forwarded to Val for review and
subsequently scheduled for hearing.
MaNtuck Housing/Factory Avenue (AHD�-- You have recently received a copy of my
2/10/03 letter to George Weiser outlining the next steps of the process, as it relates to the
change of zone. This letter was sent in response to his inquiry both by phone and letter
about the process and when he could expect a public hearing.

No request for moratorium waiver has been filed by the applicant, nor have they provided
all the requested information to complete SEQRA.
Quad Enterprises — no activity - see attached 10/21/02 memo.
I)BM Co. — Please see attached memo for information on this application. To date,
nothing has been done with this application. Richard Israel was in the Clerk's office last
week requesting information on the status of the application. At this time, the Board can
decide if correspondence should go out to the applicant regarding the moratorium, if the
application should be accepted and SEQRA should begin, or if the application should be
returned. Please advise how the Board wished to handle this matter as Mr. Israel has
been calling the Town Attorney's office for advice on the application.
Peconic P07910p and,Construction- This is a George Weiser subdivision proposed in
Southold.' See 'attached memo. On December 3, 2002, an incomplete application for
waiver from the moratorium was received in the Clerk's office. I returned the application to
Ms. Mesiano on December gth with a copy of the moratorium law and advised her that
more information was required. On January 22, 2003, a letter was received in the Clerk's
office asking that the waiver application be withdrawn and the fee refunded. No further
information was offered.
Estate of Grace Edson- no activity - see attached memo.
Windham Resources LLC- This is a new application, which has just been determined to
be acceptable by Planning and the Town Attorney's Office. Accordingly, the SEQRA
process will begin shortly. The applicant seeks to change the zone on a property located
at Athol Crescent, Fishers Island, from R-80 to HB. The request is made because the
"residential zone is out of character with the surrounding land uses and the proposed use
of the property next door".
It is hoped that the SEQRA and Planning process can move along such that the public
hearing can be scheduled for the August Town Board meeting on Fishers Island.

The following is a list of all of the pending change of zone applications presently before
the Town Board.
• Amerada Hess - I forwarded a status memo on this on October 15 1h — Val
Scopaz's memo was forwarded to Raynor on October 10, 2002, for review in
conjunction with SEQRA
• Skrezic – hearing to be held 10/22/02
• Quad Enterprises - R-80 to HD. Application to construct 126 senior townhouse
units on a 31.4 acre parcel between Young Avenue (Railroad Avenue) and
Boisseau Avenue, south of Rte 48 in Southold. SEQRA has been commenced and
file has been forwarded to Suffolk County Planning for review. They will not
perform their review until they have the recommendations of the Planning Board,
and additional items mentioned in the SEQRA report (SCWA availability letter,
density computation, and Archaeological Survey). The Planning Board will not
prepare recommendations until after the moratorium has concluded. The Board
can consider whether they want the Town Attorney to correspond with the applicant
re: the moratorium, to advise the applicant that no further action will be taken on
this application until after the moratorium has concluded, and to advise them of the
further information needed to complete SEQRA per the report of NPV.
• DBM Co. – Two applications have been submitted by Richard Israel on behalf of
DBIM Co., for developments known as Highpoint Pines and Highpoint Landing.
Highpoint Pines is designed as an affordable subdivision under the AHD and
Highpoint Landing is a senior condominium development under the HID zone, The
property is currently zoned R-80. No action has been taken on these applications
to date, and they are waiting to be reviewed by the Planning Board and the Town
Attorney's Office for completeness. Again, the Board can decide if correspondence
-should go out to the applicant regarding the moratorium, and decide if they want to
begin the SEQRA process now or wait until the moratorium has concluded It
makes no sense to refer the matter to the Planning Board at this time
Peconic Design and Construction — Petition submitted by George Wieser for
rezoning from HB and R-80 to HB to allow for the development of an 18-unit
retirement community, consisting of 9 serni-detached units. The property is on the
north side of the Main Road, oast of BoisseaLi Ave in Southold. Applicat�on was

landscaping, etc. I have left a niessage with applicant's agent, Cathy f0esiano. I( ,

Estate of Grace Edson — On the Main Road in Cutchogue, change from R-80 to
HB. Pe� the applicant, SEORA has not been started. The applicant was
considering altering the application to change the zone to B- General Business.
Greg spoke with Gail Wickham, applicant's attorney in May 2000 and asked if the
rezoning application was ready for submittal to the Town Board. She said it was
not, she was still considering changes and would be meeting with the Planning
Board. Ms. Wickham indicated that she would send a letter when the application
was ready to be submitted, and the Town Attorney's office has not heard from her
on this matter since then. At this time, the Town Board could either do nothing,
consider denying the application for inactivity, or I could correspond with applicant
to determine what applicant intends to do.
Accordingly, the only two active applications not held up by the moratorium are Skrezic
and Hess. Skrezic will have the hearing on Tuesday, and SECRA is still being conducted
on Hess. A question has been raised as to whether the Board is required to consider the
applications that have been submitted, or whether, particularly in the case of DBM where
no action has taken place, the Board can simply refuse to entertain the petition at this
time. The Code reads, "The Town Board, upon its own motion or by petition, may, from
time to time, amend, supplement, change, modify, or repeal..." the Zoning Code. The
question is whether the word "may' gives the Board the right to refuse to entertain the
petition. There is no state law requirement that the Board hear the petition. However,
since the Code provides the opportunity to change the zone by filing a petition, the Board
may run into some problems if it simply decides to refuse the petition. I spoke with an
attorney at the Department of State, who agreed that basic due process would require the,
Board make some decision on the application. Based on the moratorium, it may be
reasonable for the Board to pass a resolution rejecting the application of DBM, indicating it
would be appropriate to refile it after the moratorium. Otherwise, SEQRA could be started
with the understanding that no action will be taken by the Planning Boar-cl until after the
moratorium. As such, the Board can decide how it wishes to proceed with these nlatter�,
either to correspond with the applicants, take no action at all, or return the applications.

Dear Mr. Weiser-,
Please allow this letter to respond to your inquiry about the procedure the Town
Board will follow regarding the processing of the pending application for change of zone,
and the anticipated date for a public hearing.
As you are aware, the Southold Town Zoning Code dictates, at Section 100-55,
that approval of thefinal, detailed subdivision plat by the Planning Board, and the zone
change for the parcel, be processed together. This allows the Town to conduct a
coordinated review of the entire application, and enables the Town to utilize a single
SEQRA review. See NOTE at Sec. 100-55.
There are presently two obstacles to holding the public hearing at this time:
(these were set forth in my letter to Cathy Mesiano dated October 15, 2002, but will be
repeated here).
(1) SEQRA must be completed before the Planning Board can approve the
subdivision plan, and before the Town Board can grant the zone change.
Several items are still outstanding in order to complete SEQRA. They are:
• Trip generation and traffic impact analysis. This has been requested by
Nelson, Pope &Voorhis to complete SEORA, and has been requested
by the Planning Board.
• Contact should be made with the school district to assess
impacts/mitigation of additional school-aged children. This has been
requested by Nelson, Pope &Voorhis and the Planning Board.
• Phase I Archaeological Survey is necessary for all portions of the
project that involve ground disturbance. The site plan cannot be
approved until this has been completed.

The SCWA has indicated that they will not provide assurance of water
availability until they have reviewed SEQRA, approvals of the zone
change and affordable housing program.

(2) As y?jj arq aware, there is presently a subdivision moratorium in effect
'7-'1Tn:VffT5wn of Southold. The moratorium provides, in part, that "the
Plab '
shall not accept for review, continue review, hold a hearing
or make any decision upon any application for a subdivision...... See L.L.
No. 3 of 2002 attached hereto. Accordingly, the Planning Board is
prevented from continuing their review of your project until the moratorium
is over, approximately six (6) months from now. The coordinated review
process dictated by the Code is precluded from taking place at this time.
The law does provide for a procedure to apply for a waiver from the effect
of the moratorium, if you choose to do so. I have also attached a copy of
L.L. No. 3 of 2003, which extends the current moratorium through August
2003.
The Town Board is required to make a decision on the zone change application
within 45 days of the close of the public hearing, so clearly a hearing is premature at this
time. If all of the requested items are received, the Planning Board will be able to
complete their review at the conclusion of the moratorium and the hearing date can be
scheduled.

Dear Ms. Mesiano:
As you know, I have been reviewing the file in the above referenced
Change of Zone application. Please be advised that the following items are
outstanding:
(1) Trip generation and traffic impact analysis. This is requested in order
to complete SEQRA and has been requested by the Planning Board.
(2) Letter of Availability of water service from SCWA. I have received the
letter you dropped off in the Clerk's office on 10/2/02, dated
September 23, 2002. This has been forwarded to Suffolk County
Planning and will be provided to Nelson, Pope and Voorhis. As you
know, this letter does not confirm availability, but indicates that SCWA
needs to review a SEQRA statement and approvals of the zone
change and affordable housing program, before determining
availability. 1
(3) In response to Suffolk County Planning's request for information on
number of proposed lots, rate schedule, and affordability plan, you
provided a letter from Jim McMahon of the Southold Community
Development Office. From my review of the letter, I note that Mr.
McMahon included information that the plan calls for 12 homes, half of
which are to include accessory apartments. It is my understanding
that the application presently before the Town does not include
accessory apartments. Please clarify.
(4) Nelson, Pope & Voorhis and the Planning Board have requested that
contact be made with the school district to assess impacts/mitigation of
additional school-aged children.
(5) The NYS OPRHP indicates that a Phase 1 Archaeological Survey is
warranted for all portions of the project that involve ground
disturbance, unless prior ground disturbance can be documented.
This is necessary before a site plan can be approved, which happens
simultaneously with a change of zone approval under the Town's
Affordable Housing law.
Lastly, as you may know, there is presently a subdivision moratorium
in effect in the Town of Southold. The temporary moratorium is in effect for six
(6) months from August 15, 2002, and provides, in part, that the Planning Board
shall not continue review on any application for a subdivision, whether that
application was submitted prior to or after the effective date of the law. See Local
Law No. 3 of 2002. The law provides for a procedure to apply for a waiver from
the effect of the moratorium, at Section 6., if you choose to do so. Accordingly,
unless you apply for and are granted a waiver, you should not expect to have the
public hearing or a Planning Board recommendation before February 2003, if
the above requested information can be provided in the interim, we will endeavor
to act on your application as promptly as possible once the moratorium has
concluded.

MATTITUCK HOUSING, LLC
This request is for a rezoning approval from the Southold Town Board from R-80 to
Affordable Housing (AHD) District. The subject property is a 7.1-acre parcel located at
Factory Avenue, south of Sound Avenue, Mattituck, also know as Suffolk County Tax
Map # 1000-122-2-23.1.
It is the intention of the applicant to develop the subject site into 12 lots, which is a yield
of less than that allowed under the AHD Bulk Schedule. It is proposed that the lots be
clustered so that a buffer area may be designated at the southerly end of the property,
abutting land of the Long Island Railroad.
The need for affordable housing on the North Fork has been well documented. The
subject site is situated to meet the criteria set forth in the Zoning Code for the AHD
District, as it is located approximately Y2 mile from the Mattituck Post Office. The
Town's Master Plan provides for the creation of Affordable Housing Districts. We
believe this project is consistent with the concepts set forth in the AHD criteria in that
the opportunity for the development of high-density housing for families of moderate
income will be created.
The proposed project fulfills the stated purpose of Article V of the Zoning Code of the
Town of Southold. The New York State Housing Corporation has endorsed this project
and will play a vital role in its implementation.
The subject property is located in a mixed-use area. The properties adjacent to the site
are zoned R-40 and R-80. The lots to the north and east are improved with single-
family dwellings. The 4.7-acre parcel to the west is improved with a single-family
dwelling. Within close proximity are Light Industrial (LI), General Business (B), Hamlet
Business (HB), and Residential Office (RO) uses. The subject property is within walking
distance to the shopping center, the Love Lane business district, houses of worship,
and public transportation.
The area is serviced by the Suffolk County Water Authority and LIPA. No public sewer
system is available. On-site septic systems will be designed to conform to Suffolk
County Health Department standards.
It is anticipated that the traffic generated by this project will not compromise the safety
and capacity of the street system in the area. The site plan for the proposed project has
not yet been developed. However, these concerns will be addressed in the planning
process. Having access to both Factory Avenue and Sound Avenue provides sufficient
alternatives for implementation of the most workable plan.
The typical home to be offered will be a single family dwelling consisting of 2-3
bedrooms, I Y2 baths and attached one-car garage. The homes will be held in fee
simple ownership. There are no cooperative interests proposed. The subdivision will
be created to Town specifications with dedication of the road and drainage system upon
completion.

In cases where a state agency is involved in this undertaking,it iq appropriate for that agency to
determine whether consultation should take place with OPRHP under Section 14.09 of the New York State

Based on reported resources, there is an archeological site in or adjacent to yoUr
project area. Therefore the office of Parks, Recreation and Historic Preservation
(OpRHP) recommends that a Phase I archeological survey is warranted for all portions
of the project to involve ground disturbance, unless substantial prior -round diStUrbance
0
can be documented. if you consider the projcct area to be disturbed, documentation of the
disturbance will need to be reviewed by OPRFIP, Examples of disturbance include
mining activities and multiple episodes of building construction and demolition.
A Phase I survey is designed to determine the presence or absence of
archeological sites or other cultural resources in the project's area of potential effect. The
Phase I survey is divided into two progressive units of study includine a Phase I A
sensitivity assessment and initial project area field inspection, and a Phase I B subsurface
testing program for the project area. The OPRHP can provide standards for conducting
cultural resource investigations upon request. Cultural resource surveys and survey
reports that meet these standards will be accepted and approved by the OPRfl?_
Our office does not conduct cultural resources surveys. A 36 CFR 61 qualified
archeologist should be retained to conduct the Phase I survey. Many archeological
consulting firms advertise their availability in the yellow pages. The services of qualified
archeologists can also be obtained by contacting- local, regional, or statewide professional
archeological organizations. Phase I surveys can be expected to vary in cost per mile Of
0 u to contact a number
right-of-way or by the number of acres impacted. We encourage yo
of consulting firms and compare examples of each firm's work to obtain the best product.
Documentation of ground disturbance should include a description of the
disturbance with confirming evidence- Confirmation can include current photographs
and/or older photographs of the project area which illustrate the disturbance
(approximately keyed to a project area map), past maps or site plans that accurately
record previous disturbances, or current soil borings that verify past disruptions to the
land. Agricultural activity is not considered to be substantial ground disturbance and
many sites have been identified in previously cultivated land.

MATTITUCK HOUSING, LLC
This request is for a rezoning approval from the Southold Town Board from R-80 to
Affordable Housing (AHD) District. The subject property is a 7.1-acre parcel located at
Factory Avenue, south of Sound Avenue, Mattituck, also know as Suffolk County Tax
Map # 1000-122-2-23.1.
It is the intention of the applicant to develop the subject site into 12 lots, which is a yield
of less than that allowed under the AHD Bulk Schedule. It is proposed that the lots be
clustered so that a buffer area may be designated at the southerly end of the property,
abutting land of the Long Island Railroad.
The need for affordable housing on the North Fork has been well documented. The
subject site is situated to meet the criteria set forth in the Zoning Code for the AHD
District, as it is located approximately 1/2 mile from the Mattituck Post Office. The
Town's Master Plan provides for the creation of Affordable Housing Districts. We
believe this project is consistent with the concepts set forth in the AHD criteria in that
the opportunity for the development of high-density housing for families of moderate
income will be created.
The proposed project fulfills the stated purpose of Article V of the Zoning Code of the
Town of Southold. The New York State Housing Corporation has endorsed this project
and will play a vital role in its implementation.
The subject property is located in a mixed-use area. The properties adjacent to the site
are zoned R-40 and R-80. The lots to the north and east are improved with single-
family dwellings. The 4.7-acre parcel to the west is improved with a single-family
dwelling. Within close proximity are Light Industrial (LI), General Business (B), Hamlet
Business (HB), and Residential Office (RO) uses. The subject property is within walking
distance to the shopping center, the Love Lane business district, houses of worship,
and public transportation.
The area is serviced by the Suffolk County Water Authority and LIPA. No public sewer
system is available. On-site septic systems will be designed to conform to Suffolk
County Health Department standards.
It is anticipated that the traffic generated by this project will not compromise the safety
and capacity of the street system in the area. The site plan for the proposed project has
not yet been developed, However, these concerns will be addressed in the planning
process. Having access to both Factory Avenue and Sound Avenue provides sufficient
alternatives for implementation of the most workable plan.
The typical home to be offered will have 2-3 bedrooms and 1 1/2 baths with a one-
bedroom, one bath attached apartments. The apartments are proposed at ground level
and will consist of no less than 450 square feet. The homes will be held in fee simple
ownership. There are no cooperative interests proposed. The subdivision will be
created to Town specifications with dedication of the road and drainage system upon
completion.

I That it is the intention of the undersigned to petition the Town Board of the
Town of Southold to request a change of zone from Low Density Residential R-
80 to Affordable Housing (AHD) District.
2. That the property which is the subject of the Petition is located adjacent to
