REQUEST
Town Board requests Planning Board's comments on above zone change
request.
REVIEW
The rear section of this General Business (B) property is zoned
R-40, one acre residential. The rear residential lot is .69 of an
acre, thus it is non-conforming as to area. The General Business
section of the lot is .71 of an acre, the total lot comprising 1.4
acres.
The use of this lot for a conforming use ie. residence, is
precluded by it's non-conformity as to area. A area variance
would be required for this use.
The business zoned front parcel contains buildings that require
adequate off street parking. The current parking is mostly in the
front of the buildings and close to the Main Road. This has
resulted in a dangerous situation of cars backing onto the Main
Road. In order to correct this situation the applicant has
requested a zone change to use the rear portion of the property
for adequate off-street parking.
3. Because of the lack of on-site parking the property has been
vacant, allowing the buildings and the property to fall into
disrepair. The zone change will provide for adequate on-site
parking.

2. I do hereby petition the Town Board of the Town of Southold to change, modify
and amend the Building Zone Ordinance of the Town of SoUthold, Suffolk County,
New York, including the Building Zone Maps heretofore made a part thereof, as
follows:
R-40 Residential to Zone B - General Business.

3. Such request is made for the following reasons: The parcel to be rezoned is
an integral part of the entire parcel and the rezoning is necessary to the proper
use of the parcel. The business-zoned front parcel contains buildings which will
require adequate off-street parking and the current non-conforming parking of those
buildings is in front of buildings along the street. This has resulted in a dangerous
situation of cars backing out into the Main Road. In order to correct this condition
and upgrade the buildings and property, applicant requires adequate rear parking in
keeping with the zoning of the remainder of the parcel and area.
The parcel to be rezoned contains approximately 30,000 square feet less than the
requirement for the R-40 zone. It's location i~ediately behind the commercial
building renders it unsuitable as a residential parcel. It has historicelly been used
as part of the entire parcel for parking and otherwise, and this application merely
seeks to establish that use in conformity with the zoning code. The prior rezoning of
200 feet from the Main Road did not take into account the size of the entire parcel.

FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine· in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, rmany who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applican, ts and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3..
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

The Planning Board is in favor of this zone change from Low-Density
Residential (R-40) to General Business (B).
There is insufficient area and parking on the General Business portion of
the property to support two uses in the existing two buildings on the
property. With the zone change there would be sufficient area and
parking for two uses.
Because of the lack of parking, this property has remained unused and
unsightly for many years. The Planning Board considers this zone change
to be in the best interests of the Town.
