WHEREAS, this proposed 3 lot minor conservation subdivision will subdivide a 71.42 acre parcel into 3 lots where Lot 1 equals 10 acres of which the Town of Southold is in contract to purchase fee title for open space purposes, Lot 2 equals 2 acres with Development Rights intact and Lot 3 equals 59.42 acres which Suffolk County will purchase fee title for open space purposes; and WHEREAS, the parcel is located within an R-80 Zoning District and the proposed action conforms to the R-80 minimum zoning requirements; and WHEREAS, on September 30, 2003, the Southold Town Planning Board, acting under the State Environmental Quality Review Act, performed an uncoordinated review of this unlisted action. The Planning Board established itself as lead agency, and as lead agency, made a determination of non-significance and granted a Negative Declaration; and WHEREAS, on September 30, 2003, the Southold Town Planning Board granted sketch plan approval on the maps dated August 8, 2003; and WHEREAS, on October 31,2003, the Suffolk County Department of Health Services issued approval; and Adamowicz - Paqe Two - 11/11/03 WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the maps, dated as revised August 27, 2003, and authorize the Chairman to endorse the final surveys. Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the Office of the County Clerk. However, Mr. Calderone stated that the barn will be repaired and remain in its present location. A letter, dated September 30, 2003, verifying the removal of the residence is attached. Based upon the removal of the residence, the applicant is seeking a waiver from the following items as outlined in the Notice of Incomplete Application dated September 16, 2003: 1. Test Hole(s)/Test Hole Location(s)/Details Reasoning: The applicant has stated that the dilapidated house and existing septic and water supply systems that occupy Lot 2 will be removed. 2. Wetlands Permit or Determination Letter Reasoning: The applicant has provided the location of wetlands on-site. The Planning Board concurs with the delineations. The boundary of Lot 2 is greater than 100 feet from a wetland boundary, is improved, and therefore following removal of the existing residential structure, maybe improved in the future. No impacts to wetlands will occur as a result of the proposed subdivision action. Note: this request does not relinquish the applicant from any future permits or non-jurisdictional letters required by any other reviewing agency or department, including the Town of Southold Building Department. The Planning Board has also considered the letter, dated September 30, 2003, and recognizes that a waiver from the identified items will provide for an expedited review of the action and is in the best interest of the Town of Southold. As apart of any final approval, the Planning Board will require the removal of the residence within a Covenant and Restriction filed with the Office of the Suffolk County Clerk.
