Dear Mr. Raynor:
The following action was taken by the Southold Town Planning
Board, Monday,August 4, 1986.
RESOLVED that whereas a formal application for the approval
of a subdivision plat entitled "Russet Acres" located at Mattituck
was submitted to the Planning Board on January 13, 1986 and
filing fee was paid on January 21, 1986 and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on Monday, July
14, 1986 at 8:15 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat
and application,
NOW, therefore, be it RESOLVED that the application of Henry
E. and Mary Raynor for approval of said subdivision plat prepared
by Rod Van Tuyldated as amended July 24, 1986 be approved
and the Chairman be authorized to endorse approval on said
subdivision plat, subject to:
1. Review and consideration of the comments and recommendations
from the Suffolk County Planning Commission.

We found no visual evidence of the leaching basin referred to
Davis' report #521, dated June 28, 1986. We also found a sect~
curb within the right-of-way, southside of Sound Avenue, which ha~
be removed and a paved entrance way, as per Suffolk Court
requirements.
Upon notification of the resolution of this above mentioned remedial
work, we will re-inspect this subdivision for compliance to the Town of
Southold requirements.

Dear Mr. Orlowski:
Regarding the Suffolk Countv Planning Commission's
letter of August 8 on Russet Acres, the county's contention
that the creation of land locked parcels, as has been the
ususal complaint over 15 years, still is not valid or
correct.
The minor subdivision as proposed does not create
any land locked parcels but is fully serviced by and
approved by Inspector Davis by a roadway and underground
utilities.
This subdivision design results in the creation of
oversized parcels maintaining the rural nature of the area.
The county has also failed to note the restrictions for
set backs already affixed to the subdivision. It is still
apparent that the Commission does not understand the
advantages to the township of larger lot developments, thus
lowering the population density~

Dear Mr. Orlowski:
The Suffolk County Planning Comission at its regular meeting on August 6,
1986, reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Russet Acres", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reasons:
1. The proposed subdivision will result in the creation of two
landlocked parcels; that is, parcels that do not have frontage on an
existing or proposed public road. The creation of such lots is
contrary to good subdivision layout principles and creates problems as
far as access by emergency and service equipment is concerned. This
lack of access could result in health, safety and welfare problems for
the future residents of the landlocked lots, not to mention potential
disputes over the use and maintenance of any right-of-way over an
adjacent parcel that may be created for the purpose of access.
2. Creation of landlocked lots also places the Zoning Board of
Appeals in the awkward position of having to grant a building
permit for those lots under Section 280-a of the Town Law as the
future owner(s) of these landlocked lot(s) cannot be held responsible
for the landlocked nature of their parcel(s).

The Comsnission also offers the following comments on the map for your use
and consideration:
The subdivision should be redesigned to provide a right-of-way with a
minimum width of 50 feet. The right-of-way should be offered for
dedication to the Town of Southold as a public road. Design of this
proposed public road should include adequate drainage structures to
retain stormwater runoff on site so that it does not flow into the
right-of-way of the county road. In addition, the alignment of the
proposed road should not have any sharp angular bends; curves should
be used to modify bends in alignment.
A 50 foot wide minimum conservation easement should be established
along the upland edge of the freshwater wetlands.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of "Russett Acres" for Mary and
Henry E. Raynor, Jr. is for four lots on 13 acres located
at Sound Avenue, Mattituck. Tax Map No. 1000-121-5-1.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment,has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
The Suffolk County Department of Health Services has no
objection to our designation of lead agency. They have
received an application and it is incomplete. It appears
that the project can be served by Subsurface sweage disposal
and individual water supply systems (pending a test well
analysis). The proposed realty development appears to
conform to Article 6 lot size requirements. The department
is awaiting test well analysis prior to further processing.
If test well analysis indicate naturally potable water,
the department would agree with our intitial determination.
Because there has been no correspondence from the
Department of Environmental Conservation in the alotted
time, it is assumed that there are no comments nor
objections from that agency.
The project will meet all the
Code of the Town of Southold

We find that the roadway drains aaequately, however, at the inter-
section of the north-south and east-west roads, water ponds at the
northwest inside corner due to the elevation of the right-of-way and-
the adjacent property being lower than the edge of roadway. It was
this area that was referred to in our letter of August 3, 1987. We
feel that aOditional grading and/or a leaching basin at this location
would eliminate this drainage problem. To date, the section of curb
has not been removed, nor an acceptable access/egress provided at the
entrance to the subdivision from Sound Avenue.

Russet ACres) with regard to $ l~tter of approval for the
improvements completed on this; subdivision.
Mr. Nine tells me that all improvements listed in the inspection
report , of the Planning Board's inspector, Mr. Jack Davis
had been compliedwith 'by the end of April.
Aoparently, as a result of Mr. Davis's retirement the final
letter ~f approval had been overlooked.
Should you have any cuestions with the report compliance
please check with Mr. Davis and/or Mr. Nine.
As he has been told that all elements for i~Drovements have
been addressed, I would appreciate the finst report approval
so Mr. Nine and myself could close the operating contract on
this ~roject.

Access road for Russet Acres - Minor Subdivision at Mattituck
Map dated 3/27/86
Map contours indicate that runoff for about three quarters of the
property would be south and not into the adjoining subdivision on the
west side. From observation the northern quarter is fairly level.
At the entrance the original surface is approximately 2 ft. higher
than the pavement on Sound Avenue.
Test holes in estimated location of the 25 ft. R.O.W. w{dth show
from 12" to ~5" of tops0il~
Recommendations for access road:
1. Clear the 25 ft. R.O.W. for full width.
2. Road to be 16 ft. in width with 4 ft. shoulders. W~luld suggest
a triangular section with a ~0 ft. width be added to ~he R.O.W.
on the inside of the right angle ture.
3. Remove topsoil for 12" or as necessary to sand and ].oam for a
20 ~t. width.
4. Replace topsoil with bankrun - 20%~ gravel, 20%~ ]oam, 60%~ sand.
5. Place a 2" compacted top coorse of recycled concrete or 3/4" stone
blend on the 16 ft. width. This material should be placed L.M. at
3" to obtain a compacted 2" depth.
6. Based on contours there will be a low point at the intersection
of the north south aod east west roads. Place a leaching basin.
8 ft. diam., 4 ft. depth with a 6" reinforced cower and casting
on the right side at the intersection.
7. VanTuyl to submit a profile for the length of the road showing
original surface and proposed grades. The north south section
should be sllght]y higher than the O.S. to prevent runoff from
going into the Sundown Farms subdivision. Also, the profile
should show a short minos grade north where the road meets
Sound Avenue.
8. Emergency vehicles will have ~o turn via driveways at the lots.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of "Russett Acres" for Mary and
Henry E. Raynor, Jr. is for four lots on 13 acres located
at Sound Avenue, Mattituck. Tax Map NO. 1000-121-5-1.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
The Suffolk County Department of Health Services has no
objection to our designation of lead agency. They have
received an application and it is incomplete. It appears
that the project can be served by Subsurface sweage disposal
and individual water supply systems (pending a test well
analysis). The proposed realty development appears to
conform to Article 6 lot size requirements. The department
is awaiting test well analysis prior to further processing.
If test well analysis indicate naturally potable water,
the department would agree with our intitial determination.
Because there has been no correspondence from the
Department of Environmental Conservation in the alo'tted
time, it is assumed that there are no comments nor
objections from that agency.
The project will meet all the requirements of the
Code of the Town of Southold Subdivision of Land Regulations.

Comments: The Health Department's primary environmental concern
pertaining to development is that the applicant comply with the
requirements of the Suffolk County Sanitary Code especially
Articles V and VI, and relevant construction standards for water
supply and sanitary sewage disposal. These considerations are to
be reviewed completely at the time of application. Full considera-
tion in placement of water supply wells and disposal systems is
given to State and Town wetland requirements. The Health Depart-~
ment maintains jurisdiction over final location of disposal and
well systems and the applicant should not undertake to construct

the Southold Town Planning Board, Monday, April 14, 1986.
RESOLVED that the Southold Town Planning Board declare
themselves lead agency under the State Environmental Quality
Review Act for the minor subdivision of Russett Acres located
at Mattituck. An initial determination of non-significance
has been made.
RESOLVED that the Southold Town Planning Board approve
the sketch map for the minor subdivision to be known as "Russett
Acres" located at Sound Avenue, Mattituck for four lots on
13 acres. Survey dated as last amended March 27, 1986. This
approval is subject to:
1. The Town Attorney's determination with regard to

I have reviewed the copy of the declaration of covenants and restrictions in
the above matter and have the following comments~
The proposed declaration is made by Russett Acres, c/o Henry Raynor.
The survey indicates that the property is owned by Henry Raynor and
Mary Raynor. The declarants should be the actual owners of the
property.
Paragraph 1 of the declaration indicates that a senic easement is to
apply to a 13.185 acre portion of the minor subdivision. Since a minor
subdivision is not recorded in the County Clerk's Office, it is not
notice to anyone purchasing property in the subdivision of the
existence of the easement. Accordingly, the actual senic easement must
be described in the declaration by a metes and bounds description.

WHEREAS, Section 247 of the General Municipal Law of the
State of New York provides that municipalities, including
towns, may acquire the fee or a lesser interest, development
right, easement, covenant or other contractual right in and to
real property necessary to achieve the aforesaid purposes, and
WHEREAS, the grantee, in furtherance of the above policy
and in accordance with ~247 of the General Municipal Law wishes
to accept a scenic and conservation easement hereby proffered
by the grantor, and
WHEREAS, a public hearing was held by the town board of
the Town of Southold after due notice thereof, with respect to
the terms and conditions embraced herein, at which public
hearing all interested persons were given an opportunity to be
heard;
NOW, THEREFORE, in consideration of One ($1.00) Dollar and
other good and valuable considerations paid by the grantee to
the grantor, the receipt of which is hereby acknowledged, this
agreement witnesseth that:
1. The grantor does hereby donate, transfer and convey to
the Town of Southold, a scenic and conservation easement in
gross, of the nature, character and to the extent hereinafter
set forth, over, in and upon the premises.
2. The nature, character and extent of the easement hereby
granted is as follows:
(a) No dredging, excavating or land filling operations
shall be authorized or permitted in or on the
premises.
(b) Except as provided in paragraph 2(c), no development

of any kind shall be permitted nor shall any
commercial use, except agricultural uses, be
permitted in or on the premises, including any
beaches or underwater lands in, on or adjacent to the
premises.
Except for the maintenance of the existing buildings
and structures on the premises, no buildings or
structures shall be placed or erected on the
premises.

(d) No sand, gravel, peat or other material, except salt
hay, thatch, seaweed, drift, or dead or deseased
trees or vegetation shall be removed from the
premises, nor shall any sand, gravel or other

materials be placed in or upon the premises.
No roadways or driveways shall be constructed on the
premises, except unimproved farm roads.
The grantee and its authorized agents shall have the
right to inspect the premises at any time to
ascertain compliance with the terms and conditions
hereof.
3. That the nature, character and extent of the
limitations on the within grant of easement are as follows:
(a) Notwithstanding the provisions hereof, the premises
shall at all times remain in the exclusive possession
of the grantor.
(b) Ail rights, interests and privileges of the grantor
in the premises not herein specifically donated,
granted, transferred and conveyed shall remain and
reside with the grantor.
4. That for a term of eight (8) years from the date
hereof, and any extensions thereof, the grantor and his
successors and assigns covenant and agree as follows:
(a) That those portions of the premises presently used
for the production of agricultural crops shall be
used solely for such purposes during the term hereof,
and any extensions thereof.
(b) That the remainder of the premises shall be
maintained in their natural state during the term
hereof, and any extensions thereof.
5. That in order to entitle the premises to a continuing
reduction in assessed valuation for real property tax purposes,
the grantor shall, prior to the taxable status date in each
year, file a written statement with the ~outhold Town Board of
Assessors wherein the grantor commits the premises to the uses
set forth in paragraph 4 hereof for an additional year.

6. That in the event that the grantor or his successors or
assigns fails or elects not to file the annual statement
pursuant to paragraph 5 hereof, then and in that event the
premises shall not thereafter be entitled to a reduction in
assessed valuation to which it was granted by reason of the
restrictions imposed pursuant to the terms and conditions of
this agreement.
7. That in the event that the grantor or his successors or
assigns, during the term hereof or any extension thereof,
converts the use of the premises, or any part thereof, to any
use other than the uses set forth in paragraph 4 hereof, such
conversion shall constitute a breach of the terms and
conditions of this agreement and shall disqualify all of the
premises from thereafter being entitled to a reduction in
assessed valuation by reason of the restrictions imposed upon
the premises pursuant to the terms and conditions of this
agreement. Such breach of committment shall also subject the
premises to a charge as compensation for prior tax benefits
conferred, which charge shall be equal to two times the taxes
determined in the year following such breach of committment,
which charge shall be added by the town board of assessors to
the real property taxes determined for that year, and when
levied shall become a tax lien on the premises.
8. That in the event that the grantor or his successors or
assigns desires to dispose of the premises, or any part
thereof, during the term of this agreement, or any extension
thereof, by sale, the grantor or his successors or assigns
shall give the grantee thirty (30) days written notice of such
sale and the terms thereof. The grantee shall have the first
option to acquire the premises within said thirty (30) day
period on the same terms as any such proposed sale.
9. That the failure of the grantee to insist upon the
strict performance of any of the terms, conditions, covenants
or restrictions contained herein, shall ~ot be deemed a waiver
of any subsequent breach or default in the terms, conditions,
covenants or restrictions contained herein.

10. That in the event that the whole or any part of the
premises is taken by eminent domain, then this agreement shall
forthwith cease from the date of title vesting in such
proceeding. In such event, the grantor shall not be required to
pay any penalties or charges hereunder, nor shall the value of
the premises be limited by the provisions of this agreement,
nor shall any part of any award belong to the grantee.
11. That the grantee covenants that to the extent legally
permissible, the valuation placed upon the premises for
purposes of real property taxes will be limited by the
restrictions of the scenic and conservation easement imposed by
this agreement in accordance with the provisions of ~247 of the
General Municipal Law of the State of New York.
12. That this agreement and all of the terms and
conditions contained herein shall apply to and bind the
distributees, heirs, executors, administrators, successors and
assigns of the respective parties hereto.
