Present were:

Mr. Orlowski: Good evening. I'd like to call this meeting to order. The Board to
set Monday, May 1st, 2000, at 7:30 p.m. at the Southold Town Hall, Main Road,
Southold, as the time and place for the next regular Planning Board Meeting.
Mr. Cremers: So moved.
Mr. Latham: Second.
Mr. Orlowski: Motion made and seconded. All those in favor?
Ayes: Mr. Orlowski, Mr. Caggiano, Mr. Cremers, Mr. Edwards, Mr. Latham.

PUBLIC HEARINGS:
Mr. Orlowski: 7:30 p.rn. - Periwinkle/Lori Feilen - This proposed site plan is to
convert a residence to a commercial retail store located on the southwest corner
of Main Road and Town Harbor Road, Southold. SCTM#1000-62-3-38.
Are there any comments on this?
Ms. Feilen: I'm Lori. I'm just here to answer questions if you have any for me.
Mr. Odowski: I don't have any. Does the Board have any questions for the
applicant?
Any other comments or questions on this?
Ms. Feilen: I just really came to answer any questions that anyone might have. I
think we covered most of the site plan at the work session.
Mr. Odowski: Yes, I think everything is pretty much in order now. We were a little
bit concerned about the setback line but the way it's drawn on the site plan we'll
go along with.
Anybody else have any questions? Any from the Board?
I'll entertain a motion to close the hearing.

Mr. Cremers: I'll offer the following resolution:
WHEREAS, the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, (6NYCRR), Part 617, makes a determination
that this project is a Type II action and not subject to the provisions of the State
Environmental Quality Review Act (SEQRA); and

WHEREAS, this proposed site plan, to be known as site plan for Lori
Feilen/Periwinkle, is to convert a residence to a commercial retail store; and
WHEREAS, Lori Feilen is the owner of the property known and designated as
Lori Feilen/Periwinkle, Main Road Southold, SCTM#1000-62-3-38; and
WHEREAS, a formal application for the approval of this site plan was submitted
on March 28, 2000; and
WHEREAS, this site plan, last revised March 28, 2000, was certified by the
Building Inspector on April 7, 2000; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of
Southold have been met; be it therefore
RESOLVED that the Southold Town Planning Board authorize the Chairman to
endorse the final survey, dated March 2, 2000, subject to a one year review from
date of building permit.

Hearings Held Over From Previous Meetings:
Mr. Orlowski: Summit Estates, Section 4 - Section 4 of this major subdivision is
for one 4.3739 acre lot (Lot #33). The property is located off Shipyard Lane in

East Marion. SCTM#1000-38-7-p/o 10 (a.k.a. SCTM#1000-35-8-5.3). Boy, this
thing has been held open for a long, long time.
I'll make the following motion:
BE IT RESOLVED that the Planning Board hold the final hearing for Summit
Estates, Section 4, open until such time that Conditions Number 3, 4, and 5 of
the approval in regard to the public hearing in accordance with Condition
Number 11 of the Declaration of Covenants and Restrictions are fulfilled to the
satisfaction of the Planning Board.
Mr. Edwards: I second the motion.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF
APPLICATIONS:
Sketch Determinations:
Mr. Orlowski' John Sidor - This minor subdiviSion is for 3 lots on 21.97 acres.
The development rights will be purchased by the Town on the 13.296 acres of
Lot No. 3. The property fronts on the north side of CR 48 and the south side of
Wickham Ave. in Mattituck. SCTM#1000-107-10-6.
Catherine Sidor - This proposal inCludes 2 lot line changes and a clustered
set-off. The lot line changes are to subtract 33,273 sq. ft. from the original 21.08
acre parcel and to add 13,172 sq. ft. to an adjacent parcel to the west and
20,101 sq. ft. to an adjacent parcel to the east. The lot to be set off is 0.966
acres. The development rights will be purchased by the Town on the remaining
19.347 acres. The property fronts on the north side of CR 48, the east side of
Mary's Rd. and the south side of Wickham Ave. in Mattituck. SCTM#1000-107-
10-1, 3 &4.

Mr. Cremers: Mr. Chairman, I'll offer the following resolution:
WHEREAS, the Planning Board has before it two separate applications for
adjacent properties, one owned by John Sidor, and the other owned by
Catherine Sidor; and
WHEREAS, the Planning Board will be processing the applications as two
separate applications, but will review the applications together for purposes of
SEQRA; and
WHEREAS, the application for John Sidor (SCTM# 1000-107-10-6) is for 3 lots
on 21.97 acres. Lots 1 and 2 are each 2 acres in area. Lot Number 3 is 18.296
acres, of which the Town will purchase the development rights on 13.296 acres;
and
WHEREAS, the application for Catherine Sidor (SCTM# 1000-107-10-1, 3 and
4) is for2 lot line changes and a clustered set-off lot of 0.966 acres. The
development rights will be purchased by the Town on the remaining 19.347
acres; and
WHEREAS, the lot line changes, which are included with the clustered set-off
application, are to subtract 33,273 square feet from the original 21.08 acre
parcel, and to add 13,172 sq. ft. to the adjacent parcel to the west (SCTM#
1000-107-10-1 ) and 20,101 sq.ft, to the adjacent parcel to the east (SCTM#
1000-107-10-4); and
WHEREAS, as noted on the map for Catherine Sidor, the area of the clustered
set-off lot is less than the 80,000 square feet required by the R-80 Zoning
District. Therefore, 37,901 square feet (80,000 sq. ft. minus the 42,099 sq. ft. for
the set-off) must be excluded from the yield of the remaining parcel; be it
therefore
RESOLVED that the Southold Town Planning Board grant sketch approval to the
Minor Subdivision for John Sidor, map dated March 15, 2000.

15, 2000.

83,966 square feet located on Main Road in Arshamomaque.

Mr. Latham: I'll offer this, Mr. Chairman:
BE IT RESOLVED that the Southold Town Planning Board grant an additional
six month extension of sketch approval from April 5, 2000 to October 5, 2000.
Conditional sketch approval was granted on April 5, 1999.

Mr. Edwards: Mr. Chairman, I'll offer the following resolution:
BE IT RESOLVED that the Southold Town Planning Board grant a retro-active
six-month extension of sketch approval from March 17, 2000 to September 17,
2000. Conditional sketch approval was granted on September 30, 1996.

Determinations:
Mr, Odowski: John Tuthill - This proposal is for a clustered set-off of a 0.574
acre lot from an existing 35,918 acre parcel. The parcel is located on the
southwest corner of the intersection of Main Road & Rackett's Court in Orient,
SCTM#1000-17-6-6, 13 & 14.

Mr. Orlowski: Private Ferry Terminal/Robins Island - This proposal is for the
construction of a 1,800 square foot private ferry terminal for office and storage.
The property is located on First Street in New Suffolk. SCTM#1000-117-8-19 &
20.
Mr. Latham: Mr. Chairman, I'll offer this:
BE IT RESOLVED that the Southold Town Planning Board start the lead agency
coordination process on this unlisted action.
