Dear Mr. Olsen:
The following actions were taken by the Southold Town Planning
Board at a regular meeting held September 18, 1978.
RESOLVED to waive the requirement of A106-32F of the Code of
the Town of Southold that states that a subdivision of more than
twenty lots must have two connections to a town highway in the
subdivision of Macari in view of the fact that the Planning Board
has requested that the developers have a single ingress and egress
because of the inherent danger of the double entry sketch that was
first presented to the board.
R'ESOLVED to grant approval of the sketch map of Macari as
dated June 18, 1978.

In my opinion better sight conditions would be obtained for traffic leaving or

pronerty should be used for drainage recharge areas. Some of the
advantages of natural drainage are: 1. Little or no maintenance is
required. 2. Vegetation keeps the soils -porous. 3. Vegetation
uses some of the nitrates that may be present in the storm water
thereby reducing the amount that may enter the ground water. 4. The

Dear Mr. Young:
The following report was made regarding a field inspection of
the subdivision of property of Macari. Present were Henry E. Raynor,
Jr. ; G. Ritchie Latham; Bennett Orlowskit Jr. ; Raymond C. Dean and
John W. Davis.
The entrance to the subdivision should be located on the north-
west corner just east of the property line of Woessner. On the
northwest quadrant there are two runs of drainage to natural recharge.
One is 1,000 feet and one is 1,200 feet. These should be piped
according to inspector's specifications. Natural drainage in the
two basins shown are adequate although elevations should be raised to
the 20.0 foot on the smaller basin. The plan is short of buildable
park and playground. The swamp is not acceptable as park and play-
ground. The recommendations is that Lot 16 be included. This will
eliminate the�t.construction of town specifications road to this lot.
These recommendations were officially accepted by the Board at
a regular meeting held October 18, 1979.

data should be used.
Other profiles are in order, however at two locations (at drainage areas) on Road "A"p
grades are 7.6% and 7.04% due to existing elevations . I would accept these grades.
Raising them would create higher embankments and leave a less desirable condition.
Drainage:
Plans call for one solid wall ring in the 3 ring leaching pools. I would reconnend that
all rings be storm drain rings.

five leaching pools. Runoff at 611 of rain w.ith factor of .95 is 6850 C.F. The five pools

Even with normal leaching the pool capacities are not sufficient.

I have reviewed theD above mentioned subdivision with Mr.
Raymond C. Dean, Superintendent of Highways ani make the

quality. This Department would normally request a test well prior
to approval. " There is a letter from us to the DEC regarding the
State Environmental Quality Review Act. There is a notice to the
applicant' s attorney stating the hearing date. There is the
description and correspondence, a resolution approving the sketch
map on March 3rd and setting lead agency on that date. We have a
receipt from the Town Clerk' s Office for the fee of $20 and
application for the approval of a plat. There is a statement
concerning grading that has been filed and a short Environmental
Assessment Form and copies of old maps. As is the procedure with
this Board, we will ask if there is anyone present that would like
to speak in opposition to the minor subdivision of James Dean.

favor of the minor subdivision of James Dean.
Gary Olsen, Esq. : I am the attorney for Mr. Dean. This is
probably as innocuous an application as you could have. We have
two parcels having 84,000 plus square feet in one and parcel two
of 81,000 square feet. It is wooded property. This property has
been before the Board off and on for a period of time. We did
submit an application for more lots than two and with the Board' s
recommendation, we have come down to two lots. I would respectfully
ask that the Board give approval to the application.
Mr. Raynor: Is there anyone else that would like to speak in favor.
Is there anyone present that has some information for this Bdard.
Mrs. Gossner: Do you know when the Board of Health checks a
subdivision do they check for Temik as well as nitrates?
Mr. Raynor: I do not know. Does anyone else have some information

eliminating the spur in the vicinity of lots 14 and 15.

Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The major subdivision of Joseph Macari is a forty-nine lot residential
subdivision of 65.8 acre cated at Eaurel in the Town of Southold.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment were
likely to occur should the project be implemented as planned.
Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation
it is assumed that there is no objection nor comments by that
agency.
The Suffolk County Department of Health Services has indicated
that it has no objection to the designation of lead agency
and that a complete review of the sewage and water supply
facilities will be conducted upon receipt of proper application.
The project will meet all requirements of the Code of the Town
of Southold Subdivision of Land Regulations.

On April 9, 1980 we received a copy of letter to
Mr. Macari relative to above captioned from Attorney Gary F.
Olsen. In this letter it was stated that Mr. Olsen attended
the Planning Board of the Town of Southold meeting of April 7,
1980 and that the Board at that meeting passed a resolution ap-
proving the Preliminary Plan subject to the recommendations by
Consultant John W. Davis as set forth in his letter of Januray
247 1980 and to the recommendations of Engineer Lawrence M,.
Tuthill as set forth in his letter dated February 5, 1980.
Yesterday, I called Ms . Muriel Tolman, Secretary to
the Southold Town Planning Board, and was advised that a copy
of the resolution had been sent to Mr. Olsen and the Board had
approved the Preliminary map subject to the recommendations of
., the Engineer and Consultant .
The recommendation which disturb us is in the letter
of February 5, 1980 by Engineer Tuthill and cosigned by Super-
,intendent of Highways Raymond Dean: "4. To provide fencing and
curbs argund drainage areas." During the preparation of this
subdivision plan members of the Planning Board inspected the
sites for the drainage areas shown on the Plan and concluded
that these low wooded areas should not be disturbed and might
be used for drainage. In the Town of Southold low areas, have
been used for drainage and it was not required to fence same.
We had believed that the same policy would be followed for ,this
subdivision. The erection of a fence and installation of concrete
curb would destroy most of the natural beauty of these areas. Also
it would be expensive to construct as many., many large trees would
have to be removed and extensive grading would be required-.

review of this file it appears that the unique natural recharge
proposed by Mr. Celic, representing your client, at this time is
unacceptable. This opinion was given to me verbally by Super-
intendent of Highways, Raymond Dean, after a discussion he had
with Town Attorney Tasker.
I would suggest if you want to pursue this course further a joint
meeting be set, by this office, with the Town Highway Commission,
Superintendent Of Highways, Town Attorney's office, and our Board.
I hope this resolves any question with regard to this matter.
