NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The minor subdivision of Peconic Homes is for 4 lots on
45.2 acres located at Sound Avenue, Mattituck, tax map no
1000-121-3-7.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has been no correspondence from the Department
of Envirionmental Conservation in the alotted time, it
is assumed that there are no comments or objections from
that agency.
Because there has been no correspondence from the Suffolk
County Department of Health Services in the alotted time,
it is assumed that there are no comments or objections
from that agency.
She project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Form and a copy of the map of the subdivision of "Peconic
Homes, Inc." 1000-121-3-7.
This project is unlisted and an initial determination
of nonsignificance has been made. We wish to coordinate
this action to confirm our initial determination.
May we have your views on this matter. Written comments
on this project will be received at this office until September
29, 1986. We shall interpret lack of response to mean there
is no objection by your agency in regard to the State Environmental
Quality Review Act, and our agency will assume the status
of lead agency.

Please let this confirm the following action taken
by the Southold Town Planning Board, Monday, June 23, 1986.
RESOLVED that the Southold Town Planning Board approve
the sketch map of Peconic Homes, Inc. for 4 lots on 45.2
acres located at Sound Avenue, Mattituck (tax map no. 1000-
121-3-7) survey dated at last amended January 30, 1985.
It was noted that a right-of-way agreement with the
adjoining property owner, Mr. Daniel Jacoby, has been
received and approved by the Town Attorney.
Would you please forward six (6) surveys in accordance
with the enclosed list for our necessary referrals.
Upon receipt of approval from the Suffolk County
Department of Health Services, pursuant to Article. 6,
we will schedule a public hearing on this matter.

Sound Avenue, Mattituck, New York (hereinafter "Peconic"), and DANTEL ~,
.'esiding at (no number) Sound Avenue, Mattituck, New York, (hereinafter
"Jacoby"), and DAVID HO~ and Pn~4INE HO~II~N, residing at (no number)
Kirkup !~ne, Laurel, New York, (hereinafter "Horton").
WHEREAS, Peconic is the owner of a 46 acre parcel of property at
Mattituck, New York, more fully described on Schedule A, attached hereto, ar~
lereinafter r~ferred to as "the Peconic parcel", and
WHEREAS, Horton is the owner of a lot described in Schedule A-l,
WHEREAS, Jacoby is the owner of an adjoining ll-acre parcel of
property at Mattituck, New York, more fully described~on Schedule B, attached
hereto and hereinafter referred to as "the Jacoby parcel", and
WRER~AS, the Peconic parcel is subject to a 16-foot right of way in
favor of the Jacoby property, which right of w~y runs fz~L Sound Avenue to
the Jacoby property and is more fully described on Schedule C attached
WHEREAS, Peconic desires to relocate the southern portion of said
right of way and Jacoby is agreeable provided cer*e~n conditions are imposed,

WHEREAS, the parties are agreeable to an exchange of property to
straighten and relocate the bour~ary between the Peconic parcel and the
Jacobi parcel,
NOW, THEREFORE, in consideration of the mut,~al prc~ises and
agreements herein made, it is agreed as follows:
1. The right of way described in Schedule C is hereby terminated
and Jacoby releases all right, title and interest thereto, for himself, his
heirs, successors and assigns.
2. In place thereof, Peconic b~reby grants, quit claims and
conveys to Jacoby, his heirs, successors and assigns, a 16 foot right of way
situated within the 50-fcot wide strip of land described in Schedule D,
running frc~ Sound Avenue to said land of Jacoby. The location of the right
of way within the parcel described in Schedule D shall be determined by
Peconic, and may be changed within said 50 foot strip upon relocation of the
roadway in the condition required by this agreement.
3. The right of way as described in Schedule D shall be for
ingress and egress and for telephoD~ and electric services to lands of Jacoby
described in Schedule B.
4. Peconic agrees to be fully responsible for relocating the right
of way and improvir~ the roadway within such right of way to specifications
of the Southold Town Planning Board in correction with their approval of a
minor subdivision of the Peconic parcel, and to cut a driveway with 6-inch
stabilized soil base on the Jacoby property frun the southerly terminus of
the aforesaid right of way, to the ~xisting r~sidence on the Jacoby parcel.
Said roadway and driveway shall be cu,~leted within six months of final subdivi
a he
sion approv~,~ ~a~t~l be granted a t~orary license to use the
right of way described in Schedule C until such ccmpletion.
5. Jacoby agrees to z~,uve the gat~.~ and supporting posts frcm the
Peconic parcel within sixty (60) days following c~91etion of the
right-of-way and driveway, in default whereof; Peconic may remove same on ten
(10) days' prior notice to Jaccbi sent by certified mail, return receipt
requested, to the a~dress set forth above.
6. Jacoby agrees to covenant that no further buildings or other
structures of any kind shall be erected northerly of the existing deck on the
residence now located on the Jacoby parcel, with the exception of a fence not
to exceed three (3) feet in height erected in accordance with the Zoning Code
of the Town of Southold.
-~ 7. Horton agrees to convey to Jacoby the parcel marked as Parcel 1
on Schedule E, and Jacoby agrees to convey to Peconic the parcel marked as
Parcel 2 on Schedule E, and Jacoby agrees to convey to Horton the parcel
marked as Parcel 3 on Schedule E, upon the execution of this agre~nent. The
parties each agree to execute and deliver a deed and all other documents
necessary to effectuate such transfer. The conveyances shall be subject to
the terms of this agreement.
8. Peconic and Jacoby each agree not to cut or r~nove any healthy
trees having a diameter of more than 8 inches frcm Parcels 1 and 2, except as
may be necessary to construct the roadway within the 16-foot right of way.
9. The existing telephone and electric service to the Jacoby
residence may re~ain until the Jacoby parcel is subdivided or until telephone
and electric service is provided over the new right-of-way relocated herein,
whichever occurs first. Upon subdivision of his property, Jacoby shall bear

The property is adjacent to the property of David Horton, and/or
Peconic Houses.
Last week Mr. Hoz~on i~formed me that he has submitted a plan to
your board regarding his property. I was also informed by the
secretary of the planning board that this matter will be before
you on Monday, May 6th.
At this time, I wish to make known to you my objection to Mr. Horton's
plan. My primary objection is to the drastic modification of the
right of way which provides ~ access to my land.
This right of way is contained in the deed I received from James
Mulvihill when I purchased the land more than ten years ago.
The map proposes a 16 foot road which touches the edge of my
property approximately 225 feet above the point where the existing
right of way enters my land, and no further provision for my access
is made.
In addition, the proposed new road ends in a wooded, very deep
ravine which would make access very difficult if not impossible.
I therefore urge you to take into account this serious problem
before acting on Mr. Horton's map.
