WHEREAS· the Declarant is the owner in fee simDle of a certain parcel of land situate at Mattituck, Town of Southold, Suffolk County, New York and designated on the Suffolk County Tax MaD as District Section 121Block 1 and Lot 4.1containinq approximately 24+ acres, being the same premises acquired by the Declarant by deeded dated March 4, 1985 and recorded in the Suffolk County Clerk's Office on March 14, 1985 in Liber 975~f deeds at Daqe 475 , and referred to herein as the "premises" and WHEREAS, the Declarant intends to subdivide said premises for residential purposes and desires to subject said premises to certain conditions, covenants and restrictions in order to preserve the maximum open space, natural scenic beauty and natural vegetation and to prevent overcrowding and to conserve the ground water resources of the Town of Southold, and WHEREAS· the Declarant had applied to the Plannin~ Board of the Town of Southold for approval of the subdivision and development of the premises as a Minor Subdivision, to contain no more than four (4) lots or parcels. NOW, THEREFORE, the Declarant does hereby declare that the aforesaid premises and every portion thereof is hereby held and shall be conveyed subject to the conditions, covenants and restrictions hereinafter set forth, and that every purchaser of said premises, or any portion thereof, by the acceptance of a deed thereto, covenan%s an~ agrees that the premises so purchased shall be held subject to the covenants, conditions and restrictions hereinafter set forth. 1. No lot or plot as shown and designated on the Minor Subdivision map approved by and filed with the Southold Town Planninq Board shall be further subdivided. 2. No dwelling, or other building or structure shall be erected or maintained within feet of the tod of the bluff or cliff adjacent to Long Island Sound. 3. In order to prevent erosion of the bluff or cliff adjacent to Long Island Sound, no vegetation shall be removed therefrom nor disturbed in any manner, nor shall any stairways, paths or other structures be placed on maintained thereon, withouth the written approval of the Southold Town Planning Board. 4. That all of the covenants, conditions and restrictions contained herein shall be construed as real covenants running with the land and shall continue and remain in full force and effect at all times as against the owner of the premises or any portion thereof in perpetuity. Said convenants, conditions and restrictions shall be binding upon, inure to the benefit of and be enforceable bv the Declarant, their heirs, successors and assigns; any ox~ner of any portion of the aforesaid premises, their heirs, successors and assiqns~ and the Town of Southold, and its successors and assigns, and the failure of any of the foregoing to enforce any of such covenants, conditions and restrictions shall in no event be deemed a waiver of the right to do so thereafter. R.O.W. for an access road. According to VanTuyl, the 50 ft. width was recommended by H. Raynor. Met W. Gatz on the site and discussed the following: Location of access in R.O.W. which has been staked. Test hole by Van Tuyl. Width of pavement Road profile to be submitted. Contours as shown. No utilities - telephone, electric and t.v. to be installed. No intention by subdivision owners to have Town take over the access in the 50 ft. R.O.W. All of the road construction will be done by Gatz. Made two other test holes on ]2/5/86, one 75 ft. and another at 500 ft. from Sound Avenue. Found one ft. of topsoil and two ft.~ of loam and traces of clay before sand and gravel which agrees with test hole by Van Tuyl. Recommendations: ]. Do any necessary clearing, 3 ft. additional outside of shoulder areas. 2. Road width to be 16 ft. with 3 ft. shoulders centered in R.O.W. A 20 ft. width for a four lot minor subdivision has not been approved to date. 3. Remove topsoil and other unsuitable material for at least two ft. for the shoulder and pavement width. 4. Replace the unsuitable material to road subgrade with a good grade of compacted clean fill. 5. Place a compacted 6" base course of bankrun containing ]5% or more of gravel, ]0% of loam on the replaced material. Place a top course of crowned compacted 3/4" stone blend on the ]6 ft. width. The depth of the top course to be 3" L.M. to obtain a compacted 2" depth. 6. Drainage: Contours indicate some runoff into Sound Avenue and a low point at the right angle intersection of the R.O.W. Drawer A Jamesport, NY 11947 November 21, 1985 Bennett Orlowski, Chairman Southold Town Planning Board Main Road Southold, NY 11971 RE: minor subdivision, Green Pastures, Walter and Marilyn Gatz Dear Mr. Orlowski: Pursuant to the Suffolk County Planning Commission's letter of November 8, 1985, I would like to offer for the board's consideration the following responses to their objections: 1) The proposed subdivision will not result in the creation of three land locked parcels. Although the parcels do not front on existing roads, the creation of right of ways, built to the town inspectors requirements, is considered practical planning application where a limited number of homes, four in this case, are being designed to hold down density within the township. Needless to say, as apparently the Suffolk County Planning Commission is not aware, the Zoning Board of Appeals has no jurisdiction within the perimeters of subdivisions in regard to Section 280A. 2) With regard to the second reason, on behalf of the applicants, Mr. and Mrs. Gatz, we fully propose that this map be filed in the office of the County Clerk. This should only be done and accepted in final form and after a signature so that the document is a complete filing. 3) Any storm run off resulting from the right-of-way, we hereby stipulate will not go: A) through any countrytowned portion of Sound Avenue and B) will be completely on the subdivision itself. Please regard this stipulation as a direct response to their Item 3. 4) Wi~h regard to future subdivision, the Planning Board is already in receipt of Covenants and Restrictions so stipulating that no further subdivision will be forthcoming on this property. These will also be filed in the office of the County Clerk as a matter of record. Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on November 6, 1985, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Green Pastures", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: 1. The proposed subdivision will result in the creation of three landlocked parcels; that is, parcels that do not have front age on an existing or proposed public road. The creation of such lots is contrary to good subdivision layout principles and creates problems as far as access by emergency and ser vice equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the landlocked nature of the parcels. 2. There is no indication that this proposed map will be filed in the County Clerk's office. This is contrary to the con dition of approval imposed upon "Map of Minor subdivision - Joseph & Lee Pufahl and Walter & Marilyn Gatz" on September 4, 1985; 3. There is no indication that any consideration has been given to the control of stormwater runoff from the right-of-way so % that it will not flow into the county-owned portion of Sound Avenue, especially since the right-of-way will be developed as a road. This is felt to be necessary since the area of each lot exceeds the minimum required area by 150% and has potential for future subdivision. The Commission also offers the following comment on the map for your use and consideration: It is felt that this proposed subdivision should be redesigned utilizing the cluster concept.
