Gold Fishermans Beach Road Cutchogue, New York 11935 RE: Property of Thornton Smith North side of Sound Ave.. Mattituck SCTM# 1000-121-1-1.1 Dear Mr. Gold: On April 3. 1995. Thornton Smith. owner of the above mentioned property, and Tim Caufield of the Peconic Land Trust met with the Planning Board to discuss a limited development proposal for the above mentioned 80 acre parcel. Mr. Smith wishes to sell the development rights on approximately 35 acres of his property. In addition, he wants to subdivide the remaining 55 acres into five. approximately five acre residential lots. with the remaining land to be included in a conservation easement to the Peconic Land Trust. In 1989, the Planning Board granted preliminary approval to a major subdivision of 35 lots on Mr. Smith's property. Although this approval has expired, the potential for the property to be developed in a similar manner remains. From our discussion with Mr. Smith. it is apparent that the pivotal part of the proposal is the purchase of the development rights on the 35 acre area. The 35 acre area is located on prime agricultural soils in addition to being located adjacent to an existing vineyard and winery. The Planning Board feels that the property fulfills the criteria for the purchase of development rights and supports a Town purchase of the development rights on this property. Please feel free to contact Melissa Spiro if you require any additional information pertaining to this property. Sinc~'ely -- Richard G. These extensions will expire on November 20, 1991 unless a complete application for final approval for all three sections is received by that date. This will be the last extension that the Planning Board will be granting for any of the Sections. In a letter dated July 10, 1990, from the Planning Board, you were notified that an extension for Section 1 was not required as the final maps had been submitted. This statement was incorrect. Although the final maps had been submitted, the final application was not complete. In light of this error, the Planning Board has granted an extension of the preliminary approval for Section I. The Planning Board has also granted an additional extension of preliminary approval for Sections II and III. As stated above, this will be the last extension that the Planning Board will be granting for any of the Sections. Expiration of the preliminary approval will require resubmission of the application and application fee. Regarding Thornton Smith's subdivision, I would like to discuss the Board's request of November 21, 1989 that covenants and restrictions be filed to prohibit the removal of vegetation. On the Taylor matter, I spoke with Matt Kiernan on January 16, 1990 and he advised that the Town did not intend to oppose our Article 78 with respect to a reversal of the Planning Board's Resolution dated November 21, 1989. It seems it would be appropriate in light of the Town's position for the Board to re-consider its previous resolution and approve the Taylor subdivision application. The Article 78 Petition is to be submitted to the Court on January 25, 1990 and for this reason we request a meeting before that date. Esq. At the November 20, 1989, regular Planning Board meeting, the Board igsued a Negative Declaration for the project. Listed below are the Board's reasons supporting this determination. The landward limits of the freshwater wetlands, designated by the New York State Department of Environmental Conservation, are marked on the map. All lot lines have been set back at least one-hundred (100) feet from the landward limit of the wetlands. The road layout has been designed to provide for future access on Bergen Avenue which will eliminate some of the traffic flow onto Sound Avenue. The Board has requested that a temporary access to Bergen Avenue be maintained over the applicant's parcel, for emergency reasons, until such time that the access to Bergen Avenue over the adjacent property is constructed. The layout has been designed to provide a block of open space which is adjacent to land already planted as vineyards, thus having the potential to be farmed. In addition, the Planning Board and the Town Engineer worked with the applicant to provide a drainage design which prohibits direct flow of run-off into the wetland areas. The Board has also requested a covenant stating that clearing and grading within each lot shall be limited to that necessary for siting and constructing a house, with the intent of preserving as much of the natural vegetation on the site as possible. Please note also, that the Planning Board will not grant final approval until such time that Health Department approval is received. Thank you for your review of the above mentioned .subdivision. Box 1179 Southold. New York 11971 TELEPHONE (516) 765-1938 PLANNING BOARD OFFICE TOWN OF SOUTHOLD NEGATIVE DECLARATION DATE: November 20, 1989 Pursuant to Article 8 of the Environmental Conservation Law State Enviornmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board, as lead agency for this unlisted action described below has determined that the project will not have a significant effect on the environment. NAME OF ACTION: Thornton Smith - major subdivision SEQR STATUS: Type I Unlisted CONDITIONED NEGATIVE DECLARATION: YES NO DESCRIPTION AND LOCATION OF ACTION: Applicant proposes to subdivide a 80+ acre parcel into 35 lots. This major subdivision is located at Mattituck. SCTM #1000-121-1-1, 19.9. REASONS SUPPORTING THIS DETERMINATION: An Environmental assessment has been submitted, reviewed and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The wetlands have been designated by the N.Y.S.D.E.C. and all lots have been set back at least one-hundred (100) feet from the landward limit of the wetlands. The road layout has been designed to allow future access on Bergen Avenue which will eliminate some of the traffic flow onto Sound Avenue. There has been correspondence receive~ from the Department of Health Services. All of their concerns have been addressed. Because there has been no correpondence received from the New York State Department of Environmental Conservation in the allotted time, it is assumed that there are no comments or objections from that agency. Further information can be obtained by contacting Melissa Spiro, Southold Town Planning Board, Main Road, Southold, NY 11971. 765-1938. Thorp Planning Board Office Town of Southold Town Hall 53095 Main Road Southold, New York 11971 RE: Thornton E. Smith-Major Subdivision SCTM#: 1000-121-1-p/o19 Dear Ms. Tho~: The Suffolk County Depa~hiient of Health Services (SCDHS) has received your letter dated October 19, 1989, concerning the above-referenced project. This Department has no objection to your designation as lead agency. SCDHS has received an application for the above-referenced project. The application is currently incomplete due to the absence of sewage disposal system details for a typical lot and test hole/test well locations and details on the subdivision map. We have several concerns regarding the current site plan as it may affect the contiguous woodlands and wetlands present on the subject site. In light of these concerns and in order to effect an adequate evaluation of alternative site development schemes, we recommend that a positive declaration be issued to this project. Our concerns are outlined and suggestions for alternatives to be discussed in a DEIS are as follows. WETLANDS The site contains freshwater wetlands designated as MT-68 on the New York State Department of Envkonmental Conservation's (NYSDEC) Tentative Freshwater Wetlands Letter to Jill M. Thorp November 8, 1989 Page 2 Regulatory Maps for Suffolk County. The subject parcel may be affected by Article 24 (Freshwater Wetlands Act). Wetlands boundaries as designated by NYSDEC should be clearly delineated on the site plan. Proposed development of the subject property should incorporate the maximum practicable setback from any wetlands boundaries. ROAD LOCATION / SITE LAYOUT The location of the proposed roadway would require extensive regrading at certain locations including an area approximately 100 feet north of wetlands. The proposed roadway also meanders through existing woodland on the central and nortbeastem portions of the parcel. The contiguous woodland present on the property represents a valuable resource in terms of vegetation and wildlife habitat. In the interest of better protecting the wetlands and wooded areas of the site, we recommend the evaluation of an alternative site scheme with a relocated road. Such a scheme, in order to preserve more of the wooded areas proposed for development on the eastern portion of the site, might place the access road entrance along the western bounda~ of the parcel at Bergen Avenue. Lots could then be placed further from the wetlands and forested areas. LOT SIZE The lots proposed for the site range in size from 40,000 to 63,000 square feet. We favor the evaluation of an alternative development scheme for this property which would incorporate a reduction of lot size for the purpose of maintaining a larger portion of the property in its natural state. Such a scenario could be coupled with the above-mentioned recommendation for the evaluation of an altemate roadway scheme, thereby preserving more of the contiguous woodland and better protecting the wetlands areas. AGRICULTURAL / OLD FIELD AREAS The existing condition of the non-wooded open space at the site is not clear from the Environmental Assessment Form (EAF) or the site plan. The portions of the site which are old field and any areas which are actively used for agriculture should be specified. We also would encourage that any old field or agricultural areas dedicated to open space subsequently be allowed to remain as, or revert to, old field conditions via natural succession. Such old field areas represent invaluable wildlife habitat resources and should be maintained through an appropriate management program. The applicant must comply with the requirements of the Suffolk County Sanitary Code, especially Articles V and VI, and relevant construction standards for water supply and sewage Letter to Jill M. Thorp November 8, 1989 Page 3 disposal. Design and flow specifications, subsurface soil conditions, and complete site plan details are essential to the review of this project. These considerations are reviewed completely at the time of SCDHS application. SCDHS maintains jurisdiction over the f'mal location of sewage disposal and water supply systems. The applicant, therefore, should not undertake the construction of either system without Health Depal'hllent approval. Thank you for the oppommity to review this application. All of our comments of May 2, 1989 have been addressed in a satisfactory manner and the existing drainage problem on Sound Avenue should be alleviated to a considerable extent. The proposed stormwater recharge basins shown on the plan could impound up to a four foot depth of water. For this reason, we would recommend enclosing these areas with fencing in order to protect the safety of the public. Subject to the above comment we therefore recommend approval of the subject map. We find that the proposed drainage design should be modified to insure that backflow from the subdivision drainage system does not flow onto Sound Avenue. It is evident from the plans submitted that storm water would back out of the proposed catch basins on Sound Avenue before the subdivision drainage system begins to contribute runoff to the open space area. (SBB No. 87453) Dear Mr. Orlowski: We have reviewed the above referenced preliminary subdivision plan and itemize our comments as follows: A 12 foot wide pavement widening should be constructed along Sound Avenue on both sides of the proposed subdivision road. This will provide an acceleration lane and deceleration lane for proposed traffic. Additional drainage structures must be provided to dispose of the stormwater runoff from Sound Avenue. Sound Avenue presently floods in this vicinity during moderate storms. It appears that drainage easement "A" as shown on the plan could be enlarged to accommodate this additional runoff. 3. The typical road section should be shown on the plans. An alternate access road should be provided connecting the development westerly to Bergen Avenue. This would supply a secondary access for fire protection, police and rescue vehicles in the event of an emergency. The future access shown on the map depends on the development of adjacent lands to the north which cannot be predicted with certainty. It would also provide an access to Sound Avenue via the Bergen Avenue intersection which has better sight distance than the proposed intersection. 5e The drainage design for this subdivision is unique and therefore requires a conference between the design engineers, Raymond Jacobs, and ourselves to resolve certain features. Con- sequently, these wetlands are being added to the final Suffolk Gounty Freshwater Wetlands Maps and, as such, are now regulated by the Department. HALPIN SUFFOLK COUN~f EXECUTIVE MAY 16 1988 May 12, 1988 Mr. Bennett Orlowski, Jr. Chairman - Planning Board Town of Southold Southold, New York 11951 Dear Mr. Orlowski: As per your request our office has reviewed the preliminary map for the THORNTON SMITH major subdivision and have several comments regarding the proposed plan. Specific concerns include: estimated storm water surface runoff, dissipation of stored runoff water, soil erosion from steep slopes and excessive cuts or fills from road grades. Storm water surface runoff calculations were based on a 6 inch rainfall. This would seem adequate in this situation and represents a design storm of a 25 year return frequency. However, a coefficient of runoff of 0.25 was used for the entire watershed in both drainage areas. This proposed major subdivision is located on predominantly Haven, Riverhead, Plymouth, and Carver and Plymouth soils (see attached soil map and descriptions). Haven and Riverhead soils are in hydrologic Soil Group B whereas Plymouth and Carver and Plymouth soils ara in hydrologic Soil Group A. Hydrologic soil groups indicate the minimum rate of infiltration obtained for bare soil and transmission rates of the soils. Group A soils have substantially greater infiltration and trans- mission rates than Group B soils. This results in greater surface runoff on Group B soils. Therefore, the coefficient of runoff should be differentiated according to soil type, among other factors. Based upon a 6 inch design storm, the 0.25 coefficient for the proposed land use represents 1.5 inches of surface runoff water. Applying the soil cover complex method of calculating storm water runoff developed by the U.S.D.A. Soil Conservation Service, the same land use would produce 1.44 and 2.26 inches of runoff on hydro- logic Soil Groups A and B, respectively. Consequently, use of 0.25 as a coefficient of runoff for the proposed land use on hydrologic Group A soils agrees with the estimated runoff using the S.C.S. method; however, there would be a 66 percent difference in runoff calculations on Group B soils. Mr. Bennett 0rlowski, Jr. 2 May 2, 1988 Storm water surface runoff calculations for drainage area 'A', which consists of 66 percent Group B soils, was estimated at 433,500 cubic feet of water. The plan estimated 287,000 cubic feet of water. This difference could obviously affect the required volume of storm water storage within a storage structure. in this subdivision, storm water surface runoff is proposed to be stored in "kettle hole" depressions located on the wooded portion of the property. Es- timates of existing storage volumes in the depressions indicate that there would be suffficient volume to store all of the surface runoff from the design storm. Even in drainage area 'A', with the calculated greater amount of runoff water, the existing depression has adequate capacity. The high water mark would be increased from the reported elevation of 28 to approximately 30. There should be concern, however, regarding the infiltration and discharge of storm water from within the depression. A soil boring in the bottom of drainage area 'B' found from 0-6 inch~s depth, silt loam; 6-12 inches, loamy sand; 12-32 inches, ~lt; 32-38 inches, organic matter and silt; and 38-60 inches, fine silt loam. In addition, ground water was found approximately 6 inches below the ground surface. In drainage area 'A' the bottom of the depression contained water on the ground surface which was approximately 12-18 inches deep. A soil boring approximately 4 feet above the water elevation found from 0-48 inches below the surface, sandy loam, and 48-50 inches, fine sandy loam. Due to the presence of surface water, shallow ground water and fine to medium textured soils in the bottom of the depressions, infiltration and percolation rates would be expected to be very slow. Development of the property will in- crease the volume of water and sedimentation entering the depressions. The effectiveness of the depressions as outlet structures or recharge areas for storm water runoff is questionable. Considerable documentation regarding soil profiles and infiltration rates should be evaluated by a professional engineer and a determination made. The remaining concerns regarding the proposed subdivision involve soil erosion. Most obvious are potential soil erosion problems on lots with steep slopes such as Lots I, 24, 25, 33, 34 and 35. These lots have slopes ranging from 12 to 24 percent. During development of the lots, special precautions should be required to reduce soil erosion. Recommendations are available from this office upon re- quest. A potential soil erosion problem could also arise from excessive cuts or fills from road grades. Road 'A' at Stations 3+00, 24+50 and 31+00 have proposed road cuts of 4.5 to 5.0 feet while Stations 6+00 and 30+00 have proposed road fills of 3-4.5 feet. These cuts and fills could cause steep road banks which may be- come an erosion problem if not graded and vegetated adequately. In addition, deep cuts on Plymouth and Carver and Plymouth soils will expose their very coarse sand and gravel subsoils. Stability of these subsoils for road banks is poor. I hope this information will be useful to ygu. If you require any additional information, please contact our office. Sincerely, Thomas J. McMahon, Senior District Technician At t achment s HAVEN SOILS (HaA~ HaB~ HaC~ He). 'Haven soils are deep, well-drained, medium-textured soils that formed ~'in a loamy or silty layer over stratified coarse sand and gravel. The texture from 0 - 19 inches is leam, silt loam, and very fins sandy loam. From 19 - 28 inches the range is silt loam~ very fine sandy loam, end gravelly loam, while the texture from 28 - 55 inches'is gravelly sand, loamy sand, sandy loam or stratified sand and gravel. The permeability is moderate in the root zone (surface layer and subsoil) end rapid or very rap~d in the underlying 'layer. These so/l~ have moderate to high &reliable moisture capacities (see attached table).. Haven soils have low organic matter content and low natural supply of plan~ nutrien~s, but crops r&spond well to lime and fertil~zer. When the soils are intensively cultivated the li~elih6od of crusting is §reat~ however the returning of cover crop residue decreases this problem. ~enerally, these soils are well suited 'to crops commonly grown in Suffolk County. HaA ~aven lo~m, 0 - 2 percent slopes. These soils are usually large in area and nearly level with some areas of slight undulation. The erosion hazard of these soils is slight but erosion problems are likely to occur in undulating areas. Irrigation water should be applied at a moderate rate. Management concerns in- clude crusting after rain, maintaining tilth, and reduction of the plow pan. HaB Haven loamy 2 - 6 percent slopen. Most small deposits of this soil have short slopes, but larger areas are undulating. Cultivated areas of this soil are 2 - 3 inches shallower to gravel than the representative Haven soil because of past erosion. The erosion hazard of this soil is moderate to slight. The number of consecutive years these soils can be safely cultivated depends on practices used for erosion control and water management. These soils should not be cultivated intensively unless adequate measures are used to help control erosion. In addition to erosion control, management concerns include increasing the organic matter content to help keep the soil loose and crusg free, and breaking up the plow pan. Irri- gation water can be applied at a moderate rate. Practices that help control erosion greatly increase the effectiveness of natural rainfall and irrigation water. Areas of soil that are eroded have reduced water holding capacities. _'~C~,~E.~,~_P_L_Y_M_~'Ij~_S__~_~ (CPA, CpC, CpE) These soils are deep~ excessively drained and coarse-textured. Soils in these units can be made up entirely of Carver sand~ entirely of Plymouth sand~ or of a combination of the two soils. The texture of the Carver soils is fine sand and coarse sand 0 - 22 inches. Coarse sand and gravelly sand is found 22 - 60 inches. The Plymouth soils have textures of fine sand and sand 0 - 27 inches. The permeability of these soils is rapid or very rapid. Available moisture holding capacities are low to'very low. Natural fertility and organic matter ~ontent of Carver ~.nd Plymouth soils is low. The crop response to lime and fertilizer applications is fair. If fertilizer is applied, frequent applications of small amounts should be made to reduce nutrient loss by leaching. These soils are not well suited to crops commonly grown in Suffolk County. They are too droughty~ too steep, too stony or too sandy for crops~ pasture or nursery stock. These sandy soils severely limit installation and maintenance of lawns and land- scape shrubs. A permanent cover of plants should be maintained or restored on all soils in this unit to reduce erosion. CpE Carver and Plymouth sands? 15 to 35 percent slopes. These soils are almost exclusively on moraines except for a few steep areas on side slopes along some drainage channels. The gravel content of these soils is up to 15 percent more gravel~ by volume~ than the representative soils. On some moraines the gravel content can be as much as 30 percent~ and can contain a few cobblestones. Erosion hazards of these soils is moderate to severe. A permanent cover of plants should be maintained or restored on these soils. Riverhead Soils (RdA, Rdl~ RdO). Riverhead soils are deep~well drained~ moderately coarse-textured soils that formed in a layer of sandy loam or fine sandy loam over thick layers of coarse sand and gravel. The texture from 0 - 32 inches is sandy loam and fine sandy loam. Sand, loamy sand, gravelly sand and gravelly loamy sand is found at depths of 32 - 65 inches. The permeability is moderately rapid in the root zone (surface layer and subsoil) and very rapid in the underlaying layer. Riverhead soils have moderate to high available moisture capacities (sea attached table). Natural inter'al drainage is good, but in many places where these soils have been farmed a plowman has formed. These soils have low organic matter contents and low natural supply of plant nutrients, but crops respond well %0 lime and fertilizer. Generally, these soils are well suited to crops commonly grown in Suffolk County. RdB Riverhead sandy loam; 3 - 8 percent slopes. Most small deposits of this soil have moderately short slopes, but large areas are undulating. Cultivated areas are 2 - 3 inches shallower to coarse sand and gravel than the representative Riverhead soil because of past erosion. The erosion hazard is slight to moderate. Keeping cover crops on the soil in winter and ret6rning crop residue will help to pro- tect exposed areas from erosion. Diverting runoff water from higher areas also helps to reduce erosion damage. Irrigation water can be applied at a moderate rate. Plymouth Soils (Pi-~ P1B, PiG, PmB3, PsA, PsB) Plymouth soils consist of deep, excessively drained~ coarse-textured soils that formed in a layer of loamy sand or sand over thick layers of stratified coarse sand and gravel. The texture of Plymouth soils PlA, PiB, P1C, PmB3 and PmC3 from 0 -. 27 inches is loamy sand, loamy fine sand~ gravelly loamy sand and sand. From 27 - 58 inches the texture is sand and gravel, coarse sand and gravelly coarse sand. The permeability of these soils is rapid. Available moisture capacity of these soils ranges from low to very low (see attached table). These soils are droughty during periods of iow rainfall. Unless irrigation water is applied, deep-rooted crops are better suited. Irrigation water can be applied at a rapid rate but frequent~ s~all appli- cations should be made to reduce t_he amount lost to downward movement. The organic matter content and natural fertility of ~hese soils is low. Crop response to lime and fertilizer is fair. Maintenance of fertility is difficult because of the sandy texture. Frequent applications of ~mall amounts of ferti- lizer should be m~ue to reduce nutrient loss by leaching. The sandy surface layer reduces the suitability of these soils for nursery stock. Because of the above limitations, these soils ~re only fairly well.'suited to crops conxnonly grown in Suffolk County. P1C Plymouth loamy sand~ 8 .- 15 percent slopes. This soil is found on rolling terrain or on short side slopes. The texture is s~m~lar to that described as representative for the series except that in places it is a few inches shallower to coarse sand and gravel and con- tains as much as 15 percent gravel. The hazard of erosion is moderate to severe because of the slope and sandy texture. A cropping system that in- cludes several years of close growing crops is necessary to provide adequate protection from erosion. Farming on the countour and, where practical, diversions are practices that will help control erosion. Where such prac- tices are not used, this soil should be protected by permanent cover. This soil is not well suited to crops commonly grown in the County because of slopes and droughtiness. PmC3 Plymouth Kravelly lqamy sand~ 8 - 15 percent slopes; erodeH~ The areas of this soil are usually small and slopes are short and uniform. This soil is shallower to loose sand and gravel than the representative Plymouth soil because of past erosion. The upper layer is only 10 - 12 inches thick. Soil material in this layer is 15 - 35 percent graval~ by volume, because of the loss of finer soil particles. All the surface soil and much of the subsoil has been lost through eros. ion. The hazard of further erosion is moderate to severe. Crops show signs of severe moisture deficiency after short periods of dry weather. This soil is not suited to crops commonly grown in the County because of past erosion damage and extreme droughtiness. A permanent cover of plants should be maintained or restored on this soil. I hope this not a problem for you. Unfortunately, when I asked Diane schultz if there was a time limit on either sketch plan approval she said no. She said that the time limit factor did not kick in until one obtained preliminary approval. I was therefore unaware of any limit even though I have been in almost weekly contact with the Planning Board on various matters concerning both sketch plan approvals' since last September. Dear Sirs: In response to your letter dated 3/27/87, I am requesting Howard Young, of Young & Young Land Surveyors, to prepare a new survey incorporating the alternate road proposal which the Planning Board has found as potentially acceptable. After further inspection I have learned that the subdivision of Mohring is not adjacent to our property. There is a lot which lies between us and therefore makes any future connection impossiblle. With regard to the corner lot on Bergen Avenue (to be conveyed to John Simicich) John Simicich and myself expect to come before the full Planning Board to file for a set off in the near future. If you have any questions with regard to this please do not hesitate to call me. NHS:ch Very truly yours, · Neil H. Smith T LD Southold, N.Y. 11971 (516) 765-1938 March 27, 1987 Mr. Neil H. It was the consensus of the Board that the line of site may be acceptable for this location. The Planning Board requests that your surveyor prepare a survey with this road location and the new right-of-way on Sound Avenue which the State is proposing to determine how this would line up. The Board also requests that you have a survey prepared indicating a connecting road to the road proposed within the subdivision of Mohring as indicated in your correspondence of March 13, to see how this would line up. With regard to the corner lot on Bergen Avenue (to be conveyed to John Simicich), the Board requests that there be covenants and restrictions that there will be no residential strutures on this property. Dear Sirs: I would like to thank you for your time and effort in helping me to resolve our second access problem. Upon further investigation I find that the Mohring property, to our east, which is presently under consideration for a major subdivision, borders on the Simicich property which we plan to acquire in a property swap. Our proposed northern cul de sac is within several hundred feet of the Mohring's proposed northern cul de sac. If you were to request that Mohring extend cul de sac to meet ours, we could obtain via Cox second access which you are requesting. his northern Neck Road the We believe that this idea could lead to a very good solution for the area and request your consideration of it and your early response. Dear Sirs: I wish to ask whether you would look favorably upon a proposal to include the property of Walter and Marilyn Gatz, to the east of our property, in our request for a major subdivision. If you would, we will consider purchasing the Gatz property. Such a purchase on our part would allow us to achieve the second access which you want either via the Mohring property to the east of Gatz and on to Cox Neck Road, or to Sound Avenue. We understand, however, that the Gatz property has already received a minor subdivision approval with covenants restricting further division. Any further discussion on my part with Mr. & Mrs. Gatz would be of no value if the Planning Board would not approve a withdrawal of the approved minor subdivision with its covenants and resubmission as part our major subdivision. We would, of course, also need your support in obtaining the cooperation of Mohring. CTY:DDP.:co's SOIL AND WATER CONSERVATION DISTRICT COUNTY OF SUFFOLK PATRICK G. HALPIN ~;UFFOLK COUNTY EXECUTIVE STANLEY A. I~AUZER DISTRICT I~IANAGER May 12, 1988 Mr. This would seem adequate in'this situation and represents a design storm of a 25 year return frequency. However, a coefficient of runoff of 0.25 was used for the entire watershed in both drainage areas. This proposed major subdivision is located on predominantly Haven, Riverhead, Plymouth, and Carver and Plymouth soils (see attached soil map and descriptions). Haven and Riverhead soils are in hydrologic Soil Group B whereas Plymouth and Carver and Plymouth soils are in hydrologic Soil Group A. Soil Conservation Service, the same land use would produce 1.44 and 2.26 inches of.runoff on hydro- logic Soil Groups A and B, respectively. Consequently, use of 0.25 as a coefficient of runoff for the proposed land use on hydrologic Group A soils agrees with the estimated runoff using the S.C.S. method; however, there would be a 66 percent difference in runoff calculations on Group B soils. Mr. Bennett Orlowski, Jr. 2 May 2, 1988 Stor~ water surface runoff calculations for drainage ar~a 'A', which consists o~ 66 percent Group B soils, was estimated at 433,500 cubic feet of water/ The ~lan estimated 287,000 cubic feet of water. A soil boring in the bottom of drainage area 'B' found from 0-6 inch~s depth, silt loam; 6-12 inches, loamy sand; 12-32 inches, silt; 32-38 inche~, organic matter and silt; and 38-60 inches, fine silt loam. Most obvious are potential soil erosion problems on lots with steep slopes such as Lots 1, 24, 25, 33, 34 and 35. I hope this information will be useful to you. If you require any additional information, please contact our office. Sincerely, Thomas J. McMahon, Senior District Technician Attachments .-- SHEET NUMBER 16 H_AVEN SOILS (HaA? H~B? HaC? The texture from 0 - 19 inches is loam, silt loam, and very fine sandy loam. From 19 - 28 inches the range is silt loam, very fine sandy Ioam', and gravelly loam, while the texture from 28 - 55 inches'is gravelly sand, loamy sand, s~ndy loam or stratified sand and gravel. The permeability is moderate in the root zone (surface layer and subsoil) and rapid or ye.fy rapid in the underlying 'layer. These so~l~ have' moderate to high ~vailable moisture capacities (see attached table).. Haven soils have i0w organic matter content and low natural supply cf plan~ nutrients, but crops r~spond well to lime and fertilizer. When t-he soils are intsnsively cultivated li~elih6od of crusting is great, however the returning of cover C~op residue decrease~ this problem. ~enerally, these soils are well suited 'to crops CO,only grown in Suffolk County. HaA ~aven loam? 0 - 2 percent slope~. These soils are Usually large in area and nearly level with Some areas of slight undulation. The erosion hazard of these soils is slight but erosion problems are likely to occur in undulating areas. Irrigation water should be applied at a moderate rate. Management COncerns in- clude cruS~ing afner rain, raaintaining tilth, and reduction of the plow pan. HaB Hav~n loam~ 2 - 6 percent slopes. CARVER .and PLYMOUTH SANDS (CPA, CpC, CpE) ~ These soils are deep, excessively drained and Coarse-textured. Soils in these units can be made up entirely of Carver sand, entirely of Plymouth sand~ or Of a combination of the two soils. Available moisture holding capacities are low to' very low. Natural fertility and organic matter =ontent of Carver and Plymouth soils is low. The crop response to lime and fertilizer applications is fair. If fertilizer is applied, frequent applications of Small amounts should be made to reduce nutrient loss by leaching. These soils are not well suited to crops cormnonly grown in Suffolk County. They are too droughty, too steep~ too stony or too sandy for crops~ pasture or nursery stock. These sandy soils severely limit installation and maintenance of lawns ~nd land- scape shrubs. A permanent cover of plants should be maintained or restored on all soils in this unit to reduce erosion. Cpi Carver and Plymouth sands, 15 to 35 percent slope,. These soils are almost exclusively on moraines except fo~ a few steep areas on side slopes along some drainage channels. The gravel content of these soils is up to 15 percent mere gravel, by volume, than the representative soils. On some moraines the gravel content can be as much as 30 percent, and can contain a few cobblestones. Erosion hazards of these soils ts moderate to severe. A permanent cover of plants should be maintained or restored on these soils. Riverhead soils are deep~ well drained, moderately coarse-textured soils t-hat formed in a layer of mandy loam or fine sandy loam over thick layers of coarse sand and gravel. The texture from 0 - 32 inches is sandy loam and fine sandy loam. Sand, loamy sand~ gravelly sand and gravelly loamy sand is found at depths of 32 - 65 inches. The p~rmeability is moderately rapid' in the root zone (surface layer and subsoil) and very rapid in the underlaying layer. Riverhead soils' have moderate tohigh available moisture capacities (see attached table). Natural inter'al drainage is good~ but in many places where these soils have been farmed a plowpan has formed. These soils have low organic matter contents and low natural supply of plant nutrients, but crops respond well to lime and fertilizer. Generally~ these soils are well suited to ~rops corznonly grown in Suffolk Coun~-~. RdB Riverhead sandy loam~ 3 - 8 percent slope~. Most small deposits of this soil have moderately short slopes~ but large areas are undulating. Cultivated areas are 2 - 3 inches shallower to coarse sand and gravel than the representative Riverhead soil because of past erosion. The erosion hazard is slight to moderate. Keeping cover crops on the soil in winter and ret6rning crop residue will help to pro- tect exposed areas f~om erosion. Diverting runoff water from higher areas also helps to reduce erosion damage. Irrigation water can be applied at a moderate rate. Plymouth Soils (PLA, P1B, P1C, PmB3, PsA, PsB) Plymou~_h soils consist of deep, excessively drained, coarse-textured soils t_hat formed in a layer of loamy sand or sand ov~rlthick layers of stratified . coarse sand and gravel. The texture of Plymouth soils ~IA, P1B~ P1C~ PmB3 and PmC3 from 0 - 27 inches is loamy sand, loamy fine sand~ gravelly loamy sand and sand. From 27 - 58 inches the texture is sand and gravel, coarse sand and gravelly coarse sand. The permeability of these soils is rapid. Available moisture capacity of these soils ranges from low to very low (see attached table). These soils are droughty during periods 'of low'rainfall. Unless irrigation water is applied, deep-rooted crops are better suited. Irrigation water can be applied at a rapid rate but frequent~ small appli- cations should be made to reduce the amount lost to downward mov~nent. The organic matter content and natural fertility of ~ese soils is low. Crop response to lime and fertilizer is fair. Maintenance of fertility is difficult because of t. he s~ndy texture. Frequent applications of small amounts of ferti- lizer should be made ~o reduce nutrient loss by leaching. The sandy surface layer reduces the suitability of these soils for nursery stock. Because of the above limitations, these soils are Only fairly well-~uited to crops co~o~ly grown in' Suffolk ~ount¥. P1C ~.lymouth loamy sand~ 8 - 15 percent slope~. This soil is found on rolling terrain or on short side slopes. The texture is s{mflar to that described as representative for the series except that in places it is a few inches shallower to Coarse sand and gravel and con- tains as much as 15 percent gravel. The hazard of erosion is moderate to severe because of the slope and sandy texture. A cropping system that in- · cludes several years of close growing crops is necessary to provide adequate protection from erosion. Farming on the countour and, where practical, diversions are practices that will help control erosion. Where such prac- tices are not used, this soil should be protected'by permanent cover. This soil is not well suited to crops co~nonly grown in the County because of slopes and droughtiness. PmC3 Plymouth ~ravell¥ loamy sand, 8 - 15 percent slopes~ erodel). The areas of this soil are Usually small and slopes are short and uniform. This soil is shallower to loose sand and gravel than the representative Plymouth soil because of past erosion. The Upper layer is only 10 - 12 inches thick. Soil material in this layer is 15 - 35 percent graval~ by volume, because of the loss of finer soil particles. Ail the surface soil and much of the subsoil has been lost through eros-ion. The hazard of further erosion is moderate to severe. Crops show signs of severe moisture deficiency after Short periods of dry weather. This soil is not suited to crops cou=nonly grown in the County because of past erosion damage and extreme droughtiness. A permanent cover of plants should be maintained or restored on this soil. Kellar, Alternate Permit Administrator, indicating that the referenced property was more than 100 feet from the Freshwater Weglands. In early May, 1988, the Town of Southampton Trustees informed us that small wetlands are present on the property in question. A field inspection by Depart- ment staff has verified this and that they are of "unusual local importance" in that they provide breeding habitat and related benefits to wildlife. Con- sequently, these wetlands are being added to the final Suffolk County Freshwater Wetlands Maps and, as such, are now regulated by the Department. Although sub- division of the property, per se, is not a regulated activity under the Freshwater Wetlands Act, any construction or development of this property is regulated and will require approval by the Department. For information on the precise locations and boundaries of these wetlands, please contact Dr. Frank M. Panek, Regional Supervisor of Natural Resources, at the above address. Pursuant to 6NYCRR 621.(2)(4), the Department may reverse itself on a prior decision on the basis of newly discovered information. The reqe~t physical confirmation that wetlands exist on the property of Thorton B. Smith is consistent with this and, accordingly, I hereby revoke Mr. Kellar's letter.
