Enclosed please find a copy of the map which was endorsed by the Chairman. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the office of the County Clerk. If an application has not yet been submitted to the SCDHS, one should be filed at the earliest date to allow for the technical review of the proposed action. Project designs submitted to the department should be fully consistent with any action currently under review through tile SEQRA process. Design and flow specifications, information regarding subsurface soil conditions, water supply information, and complete design det~fils are essential to the review of dfis project, and are evaluated fully at the time ol application review. Should the town require additional environmental infomlation (such as a DEI$), discussion of the compliance requirements of the SCDHS should be required. 5. 0 f pa~cular concern to the department are those areas wlfich because of elevaled groundwater conditions, or soils which ;u'e not conducive to the proper functioaing of conventional subsurface sanitary sewage disposal systems. All private water supply systems must be constructed in confurmance with requirements of the SC. SC. II. NATURAL RESOURCES: I. The SCDHS fully suppotls all efforts to maximize protection of natural resources which may be impacted upon by construction and development activities. It is the pnsition of the department that the SEQRA review process provides the greatest opportunity for comprehensive consideration of these resources, and that all practicable plamimg measures should be employed to help ensure theft protection. Of particular concern to department is the adequate protection of wetlands, surface waters, natural communities, contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensiOve physical resources such groundwaters, dunes, bluffs, shorelines, nalural drainage channels, groundwater recharge areas, and steep slopes are fully supported and encouraged by the SCDHS. In gener',fl, the depaflment encourages the following land use measures be considered (where appropriate) to actions being reviewed pursuant to SEQRA. 1. Maximum practicable setbacks from all wetlands, surface waters, dunes, and bluffs. 2. Non-disturbance buffers between weiland thnits and requited structural setbaclcs. 3. Clustering of subdivision lots to provide for maximum preservation of large contiguous areas of dedicated open space. 4. Stringent clearing limitations which can reduce potential impacts to wildlife habitats, vegetative communities, and unconsolidated soils. 5. Maxi~num practicable confinement of development to areas with slopes of less than 10%. 6. Maximum use of native species for hmdscaping purposes. 7. Construction of recharge areas, so as to minimize the tunount of disturbance and structural modification to the site. 8. Maximum use of land-banked parking on commercial sites. 9. Minimal use of fertilizer-dependant tuff and landscaping. 10. Employment of stormwater runoff control measures necessary to maintain runoff on-site. By this variance application, appellant is requesting permission to reestablish separate parcels as existed prior to January 2, 1970 (when both lots were jointly held by Frank and Margaret Dawson), and subsequently held by Frank Dawson between January 1970 and March 1986. In March 1986, the present owner, Mary Holland, acquired the entire property by deed described at Liber 10000 page 363. For the record, it is noted that the subject premises has been in common ownership and the dwellings have existed for more than 20 years.. 5. The following variances are necessary for the proposed separation and set-off as shown on the June 21, 1984 survey, amended November 15, 1993: (a) proposed Lot No. 1 (northerly half of the total lot) is proposed at 7,153 square feet in area, 70.59 ft. of lot width (road frontage), 101.41 ft. in lot depth; (proposed as Lot No. 1); (b) proposed Lot No. 1 (southerly half of the total lot) is proposed at 7,147 square feet in area and 70.59 ft. of lot width. 6. In considering this application, the Board also finds and determines: ~'~ (a) the area lots in this vicinity are similar, or smaller, to that proposed by this application; (b) the practical difficulties claimed are sufficient, as submitted in the record, to warrant a grant of this variance; (c) there will be no substantial change in the character of the neighborhood and a precedent would not be set for the following reasons: {1) immediately to the north and west are parcels of character and size comparable and similar to the lots proposed by this application; the results of the granting of this application will not have a direct effect or set a precedent for other lots on this block; and {2) the density of the proposed lots will not be increased since there is a single-family dwelling existing, since prior to 1962; (3~ the Board Members agree that practical difficulties claimed are due to unique physical conditions peculiar to and inherent in the lot as it presently exists, the circumstances are not personal to the landowner; and (d) although the difficulties claimed were self-created over the years, they cannot be obviated by some method feasible for the appellant to pursue, other than a variance; (e) the denial of this variance would result in significant economic injury to the landowner; (f) the variance will not produce a substantial change in the character of the neighborhood; (g) the variance, as granted, is the minimum . necessary to relief the hardship; and (h) in view of the manner in which the difficulties arose, and in considering all the above factors, the interests of justice will be served by granting the variance, as noted below. Past policy has been to separate the lots through the planning process, eg. set-off or minor subdivision. In the attached case the the deed was changed by letter upon the death of the previous owner. The question is, do we have to put the applicant through the expense of a subdivision, when in most cases the lots are merged as a result of a death or lack of understanding of single and separate ownership on the part of the applicant and/or their attorney?
