WHEREAS, the proposed site plan, to be known as New Suffolk Shipyard Boat Racks, is for two boat storage racks as follows: Rack A equals 14' x 76' and Rack B equals 14' x 50' and stores a total of 36 boats on a 2.287 acre parcel in the MI, Mil Zones; and WHEREAS, New Suffolk Properties, LLC is the owner of the property known and designated as New Suffolk Shipyard, located approximately 300' north of Orchard Street, on the east side of New Suffolk Road, in New Suffolk. SCTM#1000-117-5-29.1; and WHEREAS, on September 9, 2003, a formal application for approval of this site plan was submitted; and WHEREAS, on March 25, 2003, the Southold Town Trustees approved the proposed construction; and WHEREAS, on March 31, 2003, the New York State Department of Environmental Conservation approved the proposed construction and issued a Permit #1-4738-00941/00007; and WHEREAS, on June 19, 2004, the Southold Town Zoning Board of Appeals approved the proposed construction under Appeal #5149; and WHEREAS, on September 23, 2003, the Southold Town Engineer reviewed the site plan and issued comments on changes and the Planning Board has accepted his recommendation for approval; and New Suffolk Shipyard ( Boat Racks) - Paqe Two - 2/10/0d WHEREAS, on September 23, 2003, the Architectural Review Committee reviewed the site plan and indicated there are no architectural characteristics that bear comment and the Planning Board has accepted the recommendation; and WHEREAS, on October 3, 2003, the Cutchogue Fire District indicated no fire well is needed and the Planning Board has accepted the recommendation; and WHEREAS, on December 9, 2003, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5, made a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on December 29, 2004, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, on February 6, 2004, the Southold Town Engineer reviewed and approved the site plan and the Planning Board has accepted his recommendation for approval; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold h~e been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the site plan prepared by Peconic Surveyors, PC and certified by John T. Metzger, Land Surveyor, dated December 13, 1999 and last revised February 2, 2004, subject to fulfillment of the following condition, and authorize the Chairperson to endorse the final site plans with the following condition and subject to a one year review from the date of the building permit: 1) All outdoor lighting shall be shielded so that the light source is not wsible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that are subjective or unmeasurabIe. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analYSis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. Also enclosed is the DEC permit and revised site plans dated November 5, 2003 which include the following: The site plan includes the existing buildings- only the boat storage racks are shown as proposed. The surveyor has shown the parking for the existing Marina with 58 boat slips, 5 employees and 2 spaces for the retail sales. The Storage buildings are existing and the parking for the boat slips more than Crovides for the use in the storage buildings. The storage buildings provide work space for the boats in the slips and the use is accessory to the Marina use. The new dry racks for 36 boats provides for an additional 18 spaces. A total of 83 spaces is required, however, the surveyor has provided for 82 spaces which could actually function. The board should consider further reducing the number of spaces given the use of the Marina as a community Marina. The parking must be surfaced with pervious blue stone therefore bumper guards will delineate the spaces. The Drainage calculations have been revised in accordance with the Town Engineer's comments. Four (4) Handicap parking spaces have been shown by the surveyor. If an additional space is required please advise. The Handicap spaces require paving, impervious surfaces are discouraged by the DEC. The lighting (flood lights and area lights) are shown on the site plan. These are existing conditions, no lighting is proposed for the Dry Racks. My client is anxious to complete the site plan review and construct the storage racks for this winter season. These racks are accessory structures preferred by Environmental Agencies, we would appreciate your cooperation in seeing that the site plan process does not become overwhelming. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with thfs permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, flue, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modity, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Pen'nit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this ~ermit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. The existing building has security lighting which is not the subject of review. The history of this property is as follows: The Marina and Boat repair facilities predate zoning. In 1994 an existing storage building was replaced with a smaller metal building. In 1994 the Trustees and the DEC approved the location of the building with a boat storage rack at the location where a covered porch existed. The rack was never constructed and is now the subject of this application. The building department issued a building permit for the replacement building. The building department and Planning Board determined that no site plan was required in 1994. However, the Planning Board would have reviewed the existing structures and replacement structure and made a determination at a work session. The current site plan was prepared in 1994 by Peconic Surveyors (see attached plan). The same plan was used and revised for the current application, the surveyor has added the proposed racks and parking. We have submitted a site plan for the storage racks but respectfully request that you recognize the fact that the existing structures are not being changed. Drainage calculations indicate that the area for buildings & concrete pavement areas are approximately 12,747 Sq. Ft. Preliminary calculations appear to suggest that this number is approximately 20% shy of the actual area. Calculations should be adjusted accordingly. Drainage calculations indicate a runoff coefficient of 0.3 for stone blend parking areas. This should be 0.6. Calculations should be adjusted accordingly. Details and/or Sections of the proposed leaching pools should be shown or indicated on the plan. Leaching pools should be numbered and test hole information should be provided to indicate soil type and ground water elevations. Leaching pool invert & top of grate elevations should be provided and pavement contours or surface flow direction indicators should be shown to maintain a positive pitch of all parking areas away from all tidal waters. A trench drain should be constructed at the landward edge of any proposed boat ramp. This drain should be directly connected to one or more leaching pools. Leaching pools should be located at each entrance to the proposed facility immediately adjacent to New Suffolk Avenue. The southerly most entrance to this site has an existing drainage problem. This problem should be addressed by the project Engineer and the engineered drainage design should be shown or indicated on the site plan. The parking layout does not appear to function properly. Spaces do not appear to have adequate clearances for access and some spaces seem to block entry into others. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003 and May 1, 2003 with written extended to May 15, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant's original request is shown on the Peconic Surveyors, P.C. map dated December 13, 1999, revised January 9, 2002, for two open storage racks, noted as follows: (1) rack 'A' at 14' wide x 76' long x 26' high with a location five (5) feet from the closest northerly property line, in between the existing metal/frame building to the west and the shed to the east; and (2) rack 'B' of a size 14' x 50', and proposed to be at a maximum height of 26 feet and will be located inside an open notch immediately abutting the existing 86.2' metal storage building, as shown on the plan prepared by Peconic Surveyors, P.C. dated December 13, 1999, revised January 9, 2002. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance The waterway and wetlands exist along the shorelir]es, and tile applican~ testified that the environmental agencies governing these sensitive enwronmental areas prefer a location tha~ will not impact the waterways. Storage racks are common to all boat yards/shipyards and marinas in the Town of Southold. The only alternative to store the boats is on this type of open rack. 3. The entire system (both racks) will accommodate only 36 boats, the boats are only 15' to 25' in size. The rack system is, at most, a three tier open racks considered to be "Temporary Structures". Rack A: The rack along the north property line (shown as Rack "A") will be only 2-tier and can accommodate 21 boats. The first tier having a 12' clearance and the second tier a 10' clearance. The total height of Rack "A" is 25'4" (allowing for ground clearance and bar spacing). The location was chosen because it will not be visible from the road and will not be visible to the waterfront property owners or block the waterfront. The landscape plan shows suitable screening. There is virtually no buffer between the properties, and the wire fence affords no screening. Additionally the proposed height of the storage racks would present a sheer wall of boat storage to the neighbors and be very visible from many pelspectives. The Planning Board suggests a maximum height of eighteeu feet at this location, heavily screened, and set back ten feet. We note that no parking is shown or designated on the proposed plan. The Shipyard is bordered by the property of Michael J. Withers and S.G.&A. Alexander to the North. To the West is New Suffolk Road. To the South and East is School House Creek. Fanning Road is the nearest cross street. Project: To set up a three tier high & d~y storage rack system along the north property also to set the same along the North East wall of the boat storage building. The rack system to he a three tier (uncovered) and would allow the storage of an additional 21 boats (for boats up to 25') on the North property line. The first rack would he three across and the following two will he 2 across. Along the bffflding would he an add'aionat 3 tier 2 boat system allowing storage for an additional 15 boats. Purpose: New Suffolk is a boating community and the demand for slip spaces is strong. The Shipyard's dockage is at 100% with most slips being occupied by larger boats. This leaves little opportunity for local community to have access to dock spaces. The majority oftbe boats is in the 15' to 20' range and are either outboards or stern drives. The Shipyard's goal is to serve the eomniunity. The Shipyard has attempted to serve the community by updating the facility and providing a more attractive setting. This is an expense but can he offset by the demand for dockage. Relief: In order to complete the project the Shipyard would have to seek relief from the Town of Southold's normal 20' required set hack. The racks would be installed with a 10' set back so the boat bows will he in line with the back walls ofthe two existing buildings on the property line. This would allow us to accomplish three items that could he of concern. First the 10' set back would not allow enough room between the bows of the boats and the property line to store the usual accumulation of equipment found at marinas. Second, it would allow enough room to plant a buffer thus screening the racks from neighbors view. Third, it will provide the needed room for a fork track to safely make the swing in and out of the racks. The height of the present storage building will limit the visibility of the racks from the street side of the Shipyard. The rack system will be well hidden and completed in a manner to reduce their visib'dity to the public. Goal: Is to update the Shipyard to support recreational boating in New Suffolk both now and in the future. A financially secure marina is key to a neat and environmentally aware facility. Marinas today need to use every profit point available in order to he secure. The Shipyard needs to serve the small boater and provide access to reasonably price dockage for the community. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is 2.287 acres in size with 264.07 feet along the east side of New Suffolk Road in New Suffolk. The property is managed as a boat yard and marina in a waterfront, boating community. BASIS OF APPLICATION: Building Department's March 27, 2002 Notice of Disapproval, citing Section 100- 121C1, in its denial of a building permit lo construct accessory open storage racks within the area zoned M-II, proposed at a height over the code's 18 ft. limitation and in an area other than a rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003 and May 1, 2003 with written extended to May 15, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant's original request is shown on the Peconic Surveyors, P.C. map dated December 13, 1999, revised January 9, 2002, for two open storage racks, noted as follows: (1) rack 'A' at 14' wide x 76' long x 26' high with a location five (5) feet from the closest northerly property line, in between the existing metal/frame building lo the west and the shed to the east; and (2) rack B' of a s'ze 14' x 50', and proposed to be at a maximum height of 26 feet and will be located inside an open notch immediately abutting the existing 86.2' metal storage building, as shown on the plan prepared by Peconic Surveyors, P.C. dated December 13, 1999, revised January 9, 2002. Rack "A" will have two storage tiers, and rack "B" will have three storage tiers. ADDITIONAL INFORMATION: An an alternative, the applicants submitted a revised plan dated April 30, 2003, by Peconic Surveyors, P.C. The alternative plan shows an increased setback for storage rack "A" from 5 feet to 10 feet from the northerly property line; and includes a plan for a landscape buffer of screening between rack "A" and the northerly property line, as described below. The applicants also confirmed that they wish to withdraw their initial request for a height variance with respect to storage rack "A." REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page ~.- June 19, 2003 Appl. A) Grant of alternative relief with respect to rack "A" will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Proposed storage rack "A" will not exceed the code's height limitation of 18 feet and will be ten (10) feet from the closest northerly property line. A landscape buffer will be provided and maintained in the northerly yard adjacent to the northerly house near rack "A". The buffer will consist of 12-14 ft. Eastern Cedar Trees and 6' high slated privacy chain-link fence. B) Grant of alternative relief with respect to rack "B" will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The maximum height of rack "B" will be 26 feet, and will be shielded in the requested location, within an open notch immediately adjacent and close to the existing 86.2' metal storage building. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The waterway and wetlands exist along the shorelines, and the applicant testified that the environmental agencies governing these sensitive environmental areas prefer a location that will not impact the waterways. Storage racks are common to all boat yards/shipyards and marinas in the Town of Southold. The only alternative to store the boats is on this type of open rack. 3. The relief granted is substantial relative to open storage rack "A" because it is a 50% reduction in the 20 ft. minimum setback requirement of the code. The relief granted is substantial relative to storage rack "B" because it is an 8 ft. increase in the 18 ft. maximum height limitation of the code pertaining to accessory structures. 4. The difficulty was self-created when applicant planned to locate the open storage racks. 5. Claims of excessive noise, air pollution, excessive traffic and have been submitted relative to the storage of boats on the proposed open racks. The Board finds no substantial evidence to suggest that the proposed two accessory storage racks will have an adverse impact on physical or environmental conditions in the neighborhood. The storage racks will be placed away from traffic areas and traffic circulation and will be placed where large boats have been stored. 6. Grant of alternative relief is the minimum action necessary and adequate to enable applicants to enjoy the benefit of locating accessory storage racks, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, on motion by Member Orlando, seconded by Member Oliva, it was RESOLVED, to DENY the variances as applied, and to GRANT ALTERNATIVE RELIEF as follows: 1. Rack 'A' is limited to 18 feet in height to meet the code requirement and shall be a minimum distance of ten (10) feet from the northerly property line, as shown on the revised plan prepared April 30, 2003, by Peconic Surveyors, P.C. 2. The storage rack on the southerly side of the property is located in close proximity to the existing building, and will not be intrusive. The second storage rack, along the northerly property line, and setback 5 feet, will be landscaped by the applicant. This appears adequate, in l{ght of the actual uses occurring on the abutting property. The Planning Board further reviewed the proposed site plan, the landscaping plan, and the applicant's description of the proposed operation with the applicant and his Attorney. The Planning Board reviewed the availability of adequate parking (83 spaces) for both the current marina operation, and the additional boat storage racks, and feels that because of the seasonal usage of the boat racks, and the local nature of this marina where many customers walk to the facility, sufficient parking can be accommodated on site. Note was made of the area wide shortage of boat slips, and that storage racks of this type help alleviate this overall shortage. Such uses are now common to marinas in the area.
