Dear Ms. Diefendorf:
The following action was taken by the Southold Town Planning Board,
Monday, September 19, 1983. .
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Elizabeth Diefendorf" located at
New Suffolk was submitted to the Planning Board on October 31, 1982
and, an application fee in the amount of $50 was paid March 14, 1983,
and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 22, 1983 at
7 : 3 0 p. m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Elizabeth
Diefendorf" for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated January 17, 1983 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions:
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the
Southold Town Planning Board.

2. No residential structure or sanitary disposal facility
shall be installed or constructed within 100 feet of
the upland edge of the tidal wetlands along the shore-
line of West Creek.
3. No stormwater runoff resulting from the development of

directly into the adjacent body of water and tidal wet-
lands.
4. Conditions 1-3, inclusive, shall be filed as covenants
and restirctions in the office of the County Clerk within
six (6) months from date of resolution.
Please forward four (4) copies of the subdivision map for the
Chairman to endorse approval. Prior to endorsement of said maps
a copy of the filed covenants and restrictions are to be filed in
our office. When the maps are signed two copies will be returned
to you for your records.

THIS INDENTURE made this 19th da7 of February. 1984 by

hereinafter called the Declarant.
WHEREAS. the Declarant is the owner in ~ee simple o~ a

vegetation and to prevent overcrowding and to' conserve the ground

WHEREAS. the Declarant had applied to the Planning Board of

aforesaid premises and every portion thereof is hereby held and
shall be conveyed subject to the conditions. covenants and

contrary to the rules and regulations of New York State Department
of Environmental Conservations Tidal Wetlands Act, Article 25.
3) No stormwater runoff resulting from the development of the
subdivision or any of the lots shall be discharged directly into
the adjacent body of water and tidal wetlands.
4) That all of the covenants, conditions and restrictions
contained herein shall be construed as real covenants running with
the land and shall continue and remain in full force and effect at
all times as against the owner of the premises or any portion
thereof in perpetuity. Said covenants, conditions and restriction
shall be binding upon; inure to the benefit of and be enforceable
by the Declarant. their heirs, successors and assigns; any owner
of any portion of the aforesaid premises, their heirs, successors
and assigns, and the Town of Southold, and its successors and
assigns, and the failure of any o~ the foregoing to enforce any of
such covenants, conditions and restrictions shall in no event be
deemed a waiver of the right to do so, therea~ter.

Dear Mr. Tasker:
Enclosed please find a copy of Planning Board approval
for the above captioned subdivision, a cover letter from the
applicant explaining his proposed covenants and restrictions
for this property and the covenants and restrictions proposed
for our approval to amend condition number two.
After a review of this at our meeting December 5, 1983,
it was noted the property would not contain more than four lots;
no where is it noted "two lots", The applicant also proposes
that no residential structure would be constructed near the
wetlands in accordance with the restrictions set under Article
25 of the New York State Department of Environmental Conserva-
tion (requesting amendment to our condition of 100 foot); it
appears this covenant would leave us open to any changes the
DEC might have in the future regarding setback requirements.
We would appreciate your opinion regarding the proposed
covenants and restrictions for this property.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on May 4,
1983, reviewed the proposed subdivision plat entitled, '~nor Subdivision -
Elizabeth Diefendorf", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following four conditions deemed necessary to help preserve
the natural and aesthetic attributes of the shoreline of West Creek.
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning
Board.
2. No residential structure or sanitary disposal facility shall be in-
stalled or constructed within 100 feet of the upland edge of the
tidal wetlands along the shoreline of West Creek.
3. No stormwater runoff resulting from the development of the subdivision
or any of the lots shall be discharged directly into the adjacent body
of water and tidal wetlands.
4. Conditions 1-3, inclusive, shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.
These covenants and restrictions can be modified only at the request of
the then owner of the premises with the approval of a majority plus one
of the Town Board of the Town of Southold after a public hearing. Ad-
joining property owners shall be entitled to notice of such public
hearing but their consent to such modification shall not be required.

The Commission also offers the following three comments On the map for
your use and consideration:
1. It is suggested that the approval of this subdivision be made subject
to the subdivision's meeting the requirements and standards of the
Suffolk County Department of Health Services.
2. A short radius curve should be required at the northwesterly corner
of New Suffolk Avenue and Grathwohl Road to facilitate turns at the
corner. Both the northerly lot line and the lot area of Lot 2 should
be adjusted to insure that the lot will have the required minimum lot
area when the lot corner at the intersection is modified by use of
the curve.
3. Since New Suffolk Avenue carries a considerable amount of traffic,
consideration should be given to restricting vehicular access for Lot
2 to Grathwohl Road no closer than 50 feet from the end of the short
radius at the corner. If access to New Suffolk Avenue is allowed
then a turnaround, such as a T-shaped shunt, should be required so
that a vehicle leaving the lot will not have to back out into the
traffic stream on the road.

State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Elizabeth Diefendorf is a two (2) lot
subdivision located at New Suffolk.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The New York State Department of Environmental Conservation
has responded to the lead agency designation. It appears
that a permit is required from the NYSDED in accordance
with the Environmental Conservation Law, Article-25, Tidal
Wetlands Act.
The Suffolk County Department of Health Services has in-
dicated no objection to design~tion of lead agency status.
The application recieved by this department is incomplete.
Test well data and test hole data is needed. Approval of
the Department of Environmental Conservation may be re-
quired.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision' of Land Regulations.

itself lead aqency in regard to the State Environmental Quality
Review Act in the matter of the minor subdivision of Elizabeth

of nonsignificance has been made.
RESOLVED that the Southold Town Planning Board approve the
