the above appeal was considered, and the action indicated below was taken

of land located along the south side of Case Road, Cutchogue, NY; County
Tax Map Parcels No. 1000-116-2-15 and 16.
WHEREAS, a public hearing was held and concluded on August 14,
1986, in the Matter of the Application of THOMASSHALVEY under
Appeal No. 3520; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS,-the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its Present zoning,
and the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premis~s in question is "a described parcel of land
containing an area of 33,750 sq. ft., frontage (lot width) along
Case Road of 225 feet, and frontage (lot depth) along Bay Road
of 150 feet, and is more particularly designated on the Suffolk
County Tax Maps as District 1000, Section 116, Block 2, Parcel
Nos. 15 and 16.

ft. in area, 125.0 ft. frontage along Case Road and 150.0 feet

(b) No.2 of 15,000 sq. ft. in area, 100 feet along Case Road
and 150 feet deep.

Town records show that the premises was conveyed from
Case Estate during or after September 1963 into three

5. The board also finds that lots of a size proposed
by this application would change the character of this
block since two other parcels within this residential
block are subst~ntially larger, to wit: Parcels 1000-
116-2-14 and 22 (22.3).
6. Article III, Section 100-31 and Bulk Schedule of the
Zoning Code requires a minimum: (a) lot area of 80,000 sq.
ft., (b) lot width of 175 feet; (c) lot depth of 250 feet.
The proposed area of each parcel meets 23% or less of these
requirements. The percentage of relief requested is
substantial in relation to the requirements.
In considering this appeal, the board also finds and
determines that the relief must be denied since: (a) the
practical difficulties claimed are not sufficient;
(b) the circumstances are not unique; (c) a precedent
would be set since there are other similar circumstances
in the neighborhood; (d) this proposal is not consistent
with those generally existing on this block; (e) the
relief requested is substantial in relation to the require-
ments; (f) in view of the manner in which the difficulty
arose, and .in considering the above factors, the interests
of justice will be served by denying the variance as applied.
Accordingly, on motion by Mr. Douglass, seconded by
Mr. Sawicki, i.t was
RESOLVED, that the relief requested under Appeal No. 3520
for insufficient lot area, width and depth of two parcels,
as applied in the Matter of THOMAS SHALVEY, BE AND HEREBY
IS DENIED.

Comments: The Health Department's primary environmental concern
pertaining to development is that the applicant comply with the
requirements of the Suffolk County Sanitary Code especially
Articles V and VI, and relevant construction standards for water
supply and sanitary sewage disposal. These considerations are to
be reviewed completely at the time of application. Full considera-
tion in placement of water supply wells and disposal systems is
given to State and Town wetland requirements. The Health Depart-'
ment maintains jurisdiction over final location of disposal and
well systems and the applicant should not undertake to construct
any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Articles VII and XII. The Lead
Agency is requested to forward a copy of this form to the applicant
with its findings. ~

COVENANTS AND RESTRICTIONS
.
1. There shall be no board fences or fences or hedge over four (4) feet
in heignt.
2. That no dwelling building shall be erected on said premises wich shall
cost less than $8.000.00. All roofs shall be of asbestos. cedar or composition
shingle and no roof shall be laid down with rolled roofing.
3. That no more than bne tal dwelling house, shall be erected on the premi-
ses herein convu,yed. and shall be not in excess of a one-family dwelling.
4. That no dwelling house shall be completed on the exterior with other
than new materials of a finishing nature, exclusive of paint or brick and shall
not be finished in imitation brick.
5. That no building shall be erected within twenty-five (25) feet of the
highway lin~ of Meadow Road. No building shall be erected within ten (10) feet
of any boundary line other than mentioned above. no part of any cesspool shall
be erected within ten (10) feet of any boundary of said lot.
6. That there shall be no outside toilets of any nature whatsoever and
there must be no polution of the water table.
7. No fowl and/or animals other than the usual type of household pets are
to be kept on said premises.
8. The said promises shall be used for residential purposes. That neither
the party of the second part nor their heirs, distributees or assigns, shall
or will manufacture, or sell or cause or permit to be sold, on any portion of
the premises hereby conveyed. any goods or merchandise of' any kind, and shall
not carry on. or permit to be carried on. on any part of said premises. any
trade. business or profession (except practice of law were no sign is displayed)
whatsoever, or any boarding house. asylum or hospital.

9. Without representation. as to the availability of any particular utility
service, the premises shall be subject to electrio. electric light. gas and
telephone easements above. on and/or below the surface along any roadway adjacent
to said premisos.
10. That neither the party of the second part nor their heirs, distributees.
or assigns. shall or will permit any nuisance or noise. unwholesome and o1'fen-
sive to the person occupying adjoining premises. No accumulations of rubbish,
materials of' any kind, or junk, shall be permitted to remain on said premises.
11. That no house trailers will be kept. used or allowed upon said premises
except wnen kept within an enclosed building or garage.
12. The foregoing covenants and restrictions shall be and are hereby declared
to be covenants attached to and running with the land, but said covenants and
restrictions shall cease and expire on January 1. 2000.
13. The covenants and restrictions herein imposed shall apply solely to the
premises herein conveyed and these covenants and restrictions may be modified.
