Mr. Orlowski: There is nothing left on your agendas I know, but we have a few here. Winds Way, do you have a few comments on that Valerie? Ms. Scopaz: Yes, I inspected the property with Ray Dean. Victor Lessard had also brought to my attention, as well as Ray Dean that there was some concern about the drainage culvert that had been constructed on this property. At the time of final approval, the Planning Board had requested that the drainage culvert be built to handle all the storm water runoff from the field to the west. There is a farm field on higher ground to the west. A good deal of the water runs off the farm into a wooded drainage swale to directly to the west of this property and continues across the property to the tidal wetlands to the east. The culvert is constructed in accordance with the plan that is shown there. However, the opening in the retaining wall, where the water is to drain into the culvert pipe, is maybe between a foot to two foot off the ground and there is some concern as to whether what will happen if there will be ponding behind that wall. I recommended to Ray Dean subject to approval by this Board, that he keep a close eye on it as the road is being constructed. I think that it's difinately an engineering problem. Its a technical problem that has originated in the field that, I think, Ray Dean, as a representative, as the Town engineer, should be able to authorize the developer to do whatever is necessary, to make whatever changes may be necessary in the field depending on what he finds as a result of what he finds in keeping an eye on the drainage. Mr. Orlowski: O.K. Is that alright with the Board, we will send Sidney Bowne out to check it out? Mr. Ward: There may in fact be some advantage to having that pond, as long as its a small ponding, area, to keep debris and everything out of that pipe. ~ Ms. Scopaz: There might be, one of the concerns is,the way the wall, the edge of the retaining wall, meets the slope of the Planning Board I~ 2/22/88 ground; is whether the water will indeed go down or shoot over the edge of the wall. So that is something that we will have to keep an eye on. If that problem develops they may need to put, extend the wall a little bit, make it a little bit higher. I think it's an engineering problem, I don't see any need to treat it as anything other than that. Mr. Orlowski: O.K. any other questions? Mr. Ward: So moved. Mr. Orlowski: Motion made and seconded. (SBB 87204) S.C.T.M. 1000-116-1-1 Gentlemen: During an inspection conducted of this site on April 26, 1988 and the following corrective measures to effectively stabilize the slopes and provide adequate drainage was formulated. 1. Area to the west of the wall and culvert must be graded to culvert invert elevation. The castings of the leaching pools must be reset to insure water collection and the adjacent areas stabilized with cobbles. This will not only stabilize the leaching area, but provide for vegetation growth in the future. Leaching pools have been installed at the entrance way of New Suffolk Road, again without notification to this office. The distance between the inlet castings is approximaely 9'-0" +/-, which is too close. The plans submitted reflect a 16' road with the inlets on the outer edge. WHEREAS, the Declarant is the owner of premises described in Schedule "A" annexed hereto (hereinafter referred to as the Premises); and WHEREAS, the Declarant desires to make this declaration setting forth reservations, restrictions, conditions, covenants and agreements sub3ect to which the property shown on said map is now held and shall be sold and conveyed. NOW, THEREFORE, it is declared that said property shown as subdivided on said map is held and shall be sold and conveyed sub3ect to the reservations, restrictions, conditions, covenants and agreements hereinafter set forth, to wit: 1. No structure shall be erected, altered, placed or permitted on any of the hereinabove described premises other than a single family, detached dwelling not to exceed two stories above highest foundation level in height with a private garage. 2. After due study and deliberation it resolved to disapprove said map for the following reasons: 1. The proposed subdivision will result in the creation of three landlocked parcels; that is, parcels that do not have frontage on an existing or proposed public road. The creation of such lots is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the landlocked nature of the parcels. No conservation buffer has been proposed along the upland edge of the wetlands to insure the protection of the wetlands. o There is no indication that measures will be taken during and immediately after construction on each lot to insure that eroded soil and other deleterious materials will not be carried into the marsh. Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on March 5, 1986, reviewed the proposed subdivision plat, entitled, "Final Plat - Winds Way", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: The proposed subdivision will result in the creation of three landlocked parcels; that is, parcels that do not have frontage on an existing or proposed public road. The creation of such lots is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of these lots. Creation of landlocked lots also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for each of these lots under Section 280-a of the Town Law as the future owners of these lots cannot be held responsible for the landlocked nature of the parcels. No conservation buffer has been proposed along the upland edge of the wetlands to insure the protection of the wetlands. There is no indication that measures will be taken during and in~nediately after construction on each lot to insure that eroded soil and other deleterious materials will not be carried into the marsh. Clearing done approximately for ]8 ft.± in width. One large tree was left in the R.O.W., about ]6 ft.± from the property line where the access road will end. Topsoil stripping has been done for ]6 ft.l for length as shown on plan except for area where above mentioned tree was not removed. Test holes show from 6" to 12" of topsoil removed. There is a definite low area in the R.O.W., 730 ft.~ from New Suffolk Avenue as shown by contours. Also, the first 400 ft.~ (see contours) will drain toward New Suffolk Avenue. Recommendations: Access road width 16 ft. with 3 ft. shoulders Rt. & Lt. 2. Complete clearing for shoulder areas except for the few large trees. Remove large t~ee at north end so that access goes to the property line of Lot No. 4. 3. Remove additional topsoil where necessary in 16 ft. width - in areas that show 4"± remaining. 4. Road section for ]6 ft. width to consist of a 6" compacted base course of bankrun containing ]5% or more of gravel, ]0% loam and a'crowned top course Of 3/4" stone blend. The depth of the top course to be 3" L.M. to obtain a 2" compacted depth. 5. Submit a centerline road profile for approval showing existing ground elevations (from stripped surface ) and not from contours. If additional fill is required from present surface (stripped) to subgrade for the 6" course any compacted grade of clean material may be used. Install leaching basins Rt. & Lt. at New Suffolk Ave. Use 8 ft. x 8 ft. diam. with reinforced top and inlet castings. Locate L.B.'s within property not in Town R.O.W. There may be a water problem at the low point in the road, 730 ft. frnm New Suffolk Ave. Runoff from the adjacent property (Elak) will cross the access road and continue across this subdivision to the marsh land and tidal creek. Suggest this matter be discussed with owner. 8. The remaining area to the North and South would then be the open space. The Board also requests that the right-of-way be re-aligned to provide better sight for egress onto New Suffolk Avenue.
