On motinn by'Mr, Moisa, seconded by Mr. Young, it was
RESOLVED: WHEREAS Frank Zaleski has petitioned the'Southold
Town Planning Board for final approval of his plat known as
"Deep Hole Creek Estates'14., at Mattituck, New York, and
WHEREAS the Superintendent of Highways of the Town of
Southold has inspected the map and approves the highway layout
of the roads to be constructed, and his report is hereby approved
by the Planning Board,, and
WHEREAS the Southold Town Planning Boarde pursuant to due
notice thereof, held a public hearing on the matter of approval
of the plat at which time all interested persons were given an
opportunity to be heard.. and
WHEREAS the Southold Town Planning Board waives the provisions
in the Rules and Regulations for the subdivision of:Land .requiring
park and playground area or cash equivalent;
the signing of the final maps by the Chair -man of
Town Planning Board is waived until such time as
,a performance bond is posted for the roads and drainage in
the subdivisionj and such bond is accepted by hhe Southold Town
Board;

premises in question, its present zoning, and the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. By this application, applicant -seeks a determination under the Zoning Code
that the subject premises complies with the lot area and width regulations - of the
zoning code applicable to the R-40 Low -Density Residential Zone District
single-family residential use. for
2. The premises in question is identified on the Suffolk,County Tax MapsasNo. 1000-115-13-15 and is located along the westerly side of Theresa Drive, Hamlet
of Mattituck.
3. It is noted for the record that:
(a) the subject land, and the adjacent lands, have had several conveyances
since 1943, as shown on the single -and -separate search dated December 7,
submitted with this application; 1993,
(b) the lands contiguous and immediately adjacent to the subject lot are
shown on the SuffolkCountyTax Map as Lots 10, 14 and 16.
4. A survey prepared for Frank R. Zaleski May 2, 1985 by Roderick VanTuyl,
P.C. has been submitted under this application, which depicts 100 ft. (lot width)

5. For record purposes the following additional information is furnished:
(a) during January 1965, the zoning requirement was a minimum lot area of
12,500 sq. ft.; this parcel existed as Lot No. 11 as shown on a certain map
entitled, "Map of Deep Hole Creek Estates" as Map No. 4256; and conformed to the
zoning requirements;

(d) on January 10, 1989, a new Master Plan was adopted, and the zoning for
this property was changed to R-40 Low -Density Residential with a lot size
requirement of 40,000 in area, 150.0 ft. in width, and 175.0 ft. in depth, excepting
those lots held in separate ownership. This lot was in January 1989 in
single -and -separate ownership. However, in March 1990 Frank R. Zaleski became
the surviving tenant by the entirety when his wife, co-owner of County Parcel No.
10, died while he remained the owner of Lot 15. on January 22, 1993, a one-half
interest of Lot No. 10 was -conveyed by the applicant as survivingtenant to Johanna
Mary Zaleski.
6. For the above reasons, it is determined and found that the owners have
adequately proven their intent to keep the lots in single and separate ownership,
and its existence under zoning is confirmed and recognized as a single.. and separate
lot.
Accordingly, on motion by Member Wilton, seconded by Member Dinizio, it was
RESOLVED, that the subject parcel, identified on the Suffolk County Tax Maps
as No. 1000-115-13-15, presently owned by Frank R. Zaleski, be and hereby is
CONFIRMED and RECOGNIZED as a single -and separate lot, provided that at the
time of an application for a building permit to construct, or other activity, all
set -back, zoning (with the exception of lot area, width and depth), health

advising us that the bond we executed for Ivlr. Zaleski was in
default. We did not answer sooner as our file was closed.
On June 27, 1969, the Town of Southold, the Obligee on the bond,
wrote Mr. Zaleski and advised him that he was released from his
oblibations to the Town. A copy was sent to us. On the strength
of this letter we closed our file and returned to 11r. Zaleski
collateral which had been deposited with us as security for writ-
ing the above bond.

If such an extension was made it was subsequent to the J -Line 27,

This is to confirm our telephone conversation whereby 1
informed you that my client, above captioned, has resided at said
a,ldress for. a period of ten years. During this time my client
hea never had any problems until recently when the farm across
the road, owned by r, rank Zileski was being developed by Deep
Holo Drive Estates and Olson Realty of Main Road, Maatttituck.
In doveloping said land the developer cut a new road through
the property causing rain to drain off said property and go across
the existing raad, namely. Deep Sole Drive, thereby causing con-
s idereble damage to my clihnt's property. Said damage consisted
of c10positi:;g silt and mud over an inch thick; damage to driveway
and shrubbery. Also, this mud becomes .slippery when it micas,
therwby making it not only hazardous to walk on my citent'p property,
but a1: o the roadway. With said mud drying up the cars passing said
row.i eq, cause a duet storm, further damaging my client's property
anti eou3ing ill effects to his health.
The drain on the Deep Hole Drive ixa not adegaate to accommo-
