At the hearing held on March 20, 1987, you had an opportunity to
present your appeal of the department's ruling on the subject
application.
In accordance with the provisions of Article 2, Section 220, of
the Suffolk County Sanitary Code, the determination of the Board of
Review is as follows.
Based on the information submitted, the Board will grant the
request for a waiver for the 2 lot development. Article 6 is intended
to protect water quality by establishing limits on density of
population. Approval of this development should not have an adverse
effect on the groundwater.
The granting of this waiver does not imply that your application
will be automatically approved. It is your responsibility to ensure

The public hearing on ~his matter was also held on November 15, 1984.
The board made the following findings and determination:
Th!s is an appe,al fro,m Article',IIi, Sect}ol) 100-31, Bulk ,Schedule of
the Zon1ng Code for approval of: (al' 1nsufflclent lot area of 3Z,bOU:t
sq. ft. and 34,100:t sq. ft.. and (b insufficient 'lot width of 110.00
feet and 123.68 feet along Marratooka Lane, the northerly and southerly
parcels, respectively, as shown on survey most recently amended Novem-
ber 22, 1983, prepared by R. VanTuyl and Son. The southerly parcel is
being improved with a one-family dwelling structure pursuant to a
building permit issued 11/15/84 under Permit No. l3539Z, with a 65' ~
front yard setback and 22' southerly sideyard setback, all in conformance
with the requirements of the zoning code. The northerly parcel is
"acant.
The board members are familiar with the site in question, ',as well
as the surrounding neighborhood. In viewing the character of the area
along the east side of Marratooka Lane, the board finds a majority to
be of similar size, or smaller, than that proposed, and that the
premises in question is the largest parcel, and that a precedent
would not be set.
In considering this appeal, it is the opinion of the board that:
(1) the relief requested is not substantial, (2) that by allowing
the variance, no substantial detriment would be created affecting

purposes of zoning; (5) the circumstances are unique; (6) that
no adverse effects will be produced on available governmental facilities
of any increased population; (7) that the interests of justice will
be served by allowing the variance, as indicated below.
Accordingly, on motion by Mr. Sawicki, seconded by Mr. Douglass,
it was
RESOLVED, that the relief requested under Appeal No. 3266, in
the Matter of ANTONE AND JEAN MIlESKA for approval of insufficient
ar,ea of 32,600:!: sq. ft. and 34,100:!: sq. ft., and for approval of
in~ufficient lot width of 110 feet and 123:!: feet along Marratooka
lane, BE AND HEREBY IS APPROVED, SUBJECT TO THE FOllOWING CONDITION:
That there be no further lot area reductions, nor front, rear
or sideyard setbacks reduction to less than that permitted under
the zoning ordinance (to require building of a house to conform to
the lot and the neighborhood).

Dear Mr. Orlowski:
Tbe Suffolk County Planning Commission at its regular meeting on February
6, 1985, reviewed the proposed subdivision plat, entitled, "Minor Subdivision _
Antone Mileska", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reasons:
Creation of a subdivision with substandard lots, that is, lots whose areas
are considered less than the minimum required by the zoning classification of
the property, constitutes an overintensification of land use in a groundwater
sensitive area in what is meant to be a low density area. Such action could
establish a precedence for future subdivision of this kind which would essen-
tially be a circumvention of the Town Board's action taken over the past years
to upzone these groundwater sensitive areas. Tbe Commission feels that the Town
Planning Board should have the prerogative to review this type of application
rather than it being left to the sole discretion of the Zoning Board of Appeals.

The Health Department's primary environmental concern
pertaining to development is that the applicant comply with
the requirements of the Suffolk County Sanitary Code especially
Article V and VI, and relevant construction standards for
water supply and sanitary sewage disposal. These considerations
are to be reviewed completely at the time of application. Full
consideration in placement of water supply wells and disposal
systems is given to state and town wetland requirements. The
Health Department maintains jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval.
Other portions of the Suffolk County Sanitary Code also
apply to commercial development such as Article XII. The
Lead Agency is requested to forward a copy of this form to
the applicant with its findings.
Further comment may be provided upon completion of the
application review.
