We will complete the following requirements, but are asking for a waiver for the planters located in the parking lot. The reasons are due to oversized trucks not being able to deliver the stock to the back doors of the store locations. The stores stock inventory is too overabundant for deliveries to come through the front entrance. Front entrance deliveries would also cause traffic flow problems with customers and the drivers of trucks. The entrances located on New Suffolk Avenue are also a hindrance and deterrent for large truck deliveries. The reason being is because of limited turning points where potential planters are expected to be built. Please look at this request as fair and reasonable. Store. Unfortunately I believe that' the problem was created when the Planning Board insisted that I replace the 30 ft. existing light poles with 12 ft. poles. Now, in order to light the parking lot, the lights must shine out rather than down. Although this cost me several thousands of dollars, I was told the Planning Board would not give me approval unless I agreed to replace them. I am more than willing to cooperate in any way you might suggest as long., as it doesn't further limit the parking lot lighting and doesn't cost me any more money. I am presently struggling financially to renovate the interior so I may rent the rear portions of the building. I am writing to relay the complaints and to ask your help. Is there something that could be done to redirect the lights, to shield them or to somehow resolve this problem? The Planning Board received a letter from Mr. Stocken, a copy of which is attached, in which he states that the outstanding work at the site will be completed as finances permit. The outstanding items are: 1. Installation of six street trees. 2. Installation of planters in parking lot. 3. Screening of the dumpster. 4. Clearing of debris out of rear portion of property. 5. Receipt of six revised site plans with Health Department's approval stamp. It is my understanding that installation of the rear portion of the mansard roof will not be possible due to the shape of the building in the rear and the location of ventilating equipment on that portion of the building. Accordingly, consider our request for its installation withdrawn. Since Mr. Stocken has agreed to complete the outstanding items noted above, this Board has no objections to the issuance of a Certificate of Occupancy subject to the usual one year review. Quite frankly, Z am'doing what I can as finances permit. There were many costs that Z had not anticipated when I purchased the property. Z can assure you that eYerything will be finished. In fact, I hope to plant more shrubs in the front, but not until ne×t spring. I had expressed concern about putting a Mansard on the west- ernly side of the building as required by the Board. As of June 25, the Mansard was hit twice by delivery trucks. I ha?e put guide posts out from the building and hope this will solve the problem. I would just Tike to suggest you consider tractor trai~ er delivery trucks in future decisions. I met with Mr. Stocken at the site on 2-14-92 to discuss some of his questions concerning the existing storm water drainage system that is located under the paved parking area at his site. My last report indicated that existing drainage systems were not shown on the Survey submitted to your office for review. The reason for this is that the majority of the existing drainage is underground and no accurate records were kept to describe the system in its entirety. I walked the Site with Mr. Stocken and reviewed a report that was given to him by a contractor hired to investigate the existing system. This report could not fully detail the system but it did however give enough details to make an educated guess. I also visited the site during the recent rain this past weekend and I did not see any major amounts of runoff leaving the site. It is therefore my recommendation that the existing on-site system should be considered adequate to handle the runoff in the lower/developed portion of the Site. The elevated section of property to the Bast along New Suffolk Ave. in the rear of the building is vacant. Any improvements to this section ( ie.; Roads, Parking Lot Pavement, etc. ) should include New Drainage Systems to handle any additional runoff that may be created by the now construction. He is at a juncture where the interior building has been gutted and he is in the process of carting that away. He would like the Board's permission to continue. As I know the Board is locked into a time frame with regard to SEQRA for its procedure. He would be requesting that he be allowed to install the doors and windows necessary in front of the building. I discussed this with the Senior Building Inspector and he has indicated both verbally and in writing that he has no objection to this. So, we would like to ask permission to continue demolition and reconstruction of that building. Mr. Orlowski: Is this in conformance with the elevations that we've looked at? Mr. Raynor: There would be no changes in the elevations? Ms. Scopaz: We just got the letter this afternoon. Mr. McDonald: Do you have a copy? Mr. Raynor: Your office has my copy. ~Mr. Orlowski: You just want to start working on the exterior? Mr. Raynor: It is only on the front fascia. New windows and doors. I can not tell what the size or depth of the existing leaching pools are or even the quantity of pools that actually exist. Therefore, I can not determine the adequacy of the existing system. The raised pavement area in the rear of the building along New Suffolk Ave. appears to have no drainage at ail. a minimim, drainage basins should be installed in this area to handle its own runoff. The Planning Board has reviewed Mr. Stocken's October 17th letter which was addressed to you. The Board's responses to each of Mr. Stocken's objections are: The existing brick facade which has been painted white can be left as painted brick. However, on the remainder of the building, the concrete block is to be covered with stucco and painted white to match the brick. The rear and west side of the building should be stuccoed because of this building's prominent location. The rear portion of the building is of particular concern, whether an entrance is placed here or not, because of its visibility from New Suffolk Avenue. A mansard roof is to be placed on all three sides of the flat roof so that all roof equipment is screened from view and there is a four foot overhang. It is possible to install the roof without interfering with roof drainage and without creating a fire hazard. I recommend that you call Victor Lessard, Principal Building Inspector for further details and guidance. The sample shingle is not acceptable, as it does not match what is on the main part of the building. Unless Mr. Stocken intends to reroof the entire building with new shingles, it is suggested that he use a black shingle that resembles what is there now. The Board does not want Mr. Stocken to remove the trees in front of the building and the concrete planters which surround them. The trees are an attractive landscaping element. Also, since there will be a sufficient number of conveniently located parking spaces on the site, it will not be necessary to incur the expense of relocating the trees and removing the planters. When your client submits the site plan amendment application, we would like to see the following changes made to the presubmission site plan: Widen the landscaping buffer along New Suffolk Avenue by relocating the twelve parking spaces to the easterly end of the p~operty (adjacent to the existing spaces). The easternmost curb cut on New Suffolk Avenue should be relocated to more level ground further to the east. Correct the parking calculations. The figures for retail and office are reversed, and the total count should be 62 spaces. Reserve the entire south side of the building for a loading area and fire access. Show a four foot sidewalk alongside the building for the protection of employees opening doors into the loading area. The planting islands should be made larger. Existing landscaping-in the front of the building should be retained to the extent possible. Submit elevation drawings of all four sides. Orlowski, Jr., Southold Planning Board Town Hall Main Road Southold, New York 11971 Chairman Dear Mr. Orlowski: Yesterday, agreement was reached between Dean Blaikie of DEVAAKA Realty Company and Joseph Stocken of Handy Pantry Stores for the sale of the property on Route 25 and New Suffolk Avenue in Mattituck now known as the Tolendal Inn. The agreement is contingent upon the purchaser's obtaining mortgage financing for a conventional proportion of the purchase amount. The lender has reviewed the purchaser's financial information and expressed its willingness to make the necessary loan; however, it will provide loan proceeds only after receiving assurance that Handy Pantry Stores will be able to use the premises in a manner that will support prudent lending. Although the agreement between Mr. Blaikie and Mr. Stocken is silent on the matter, the Planning Board's acceptance of the change of use fundamentally underlies this sale and Mr. Blaikie's ability to dispose of this property in the required time frame. It is fairly widely known that last year Mr. Blaikie had been offered nearly half a million dollars more for this property than he now has reluctanty accepted. Although I am not entirely at liberty to state specifically the nature and gravity of the circumstances surrounding this sale, his need to sell this property now without delay is profound. Handy Pantry Stores is a group of eight small supermarkets serving communities in central Suffolk County. They carry a full line of grocery and associated household products, except for fresh meats, which have not proven economic. In both size and market niche, Handy Pantry stores fall between full-sized chain supermarkets and convenience stores. In order to bring this letter to you in the shortest possible time, I have not included the supporting materials you will require to help you analyze the changes intended. I will assemble the existing surveys, diagrams of the building showing current and proposed uses, along with a July 22. As intense than fact sheet, and deliver them to your office on Monday, you will quickly see, the intended use is far less that presently occupying the premises. In light of Mr. Blaikie's extreme need to conclude this sale together with the less intensive use proposed for the site, I respectfully request that the Southold Planning Board waives its requirement for site plan review for the proposed change of use. I understand that your only July meeting took place this past Monday, and that the Planning Board will not meet again until August 12. Widen the landscaping buffer along New Suffolk Avenue by relocating the twelve parking spaces to the easterly end of the property (adjacent to the existing spaces). Response The applicant does not wish to relocate the twelve spaces to the easterly end of the property. He would prefer to add three or four feet of depth to the existing landscaping along New Suffolk Avenue. He feels he needs the parking closer to the building. Request #2. The easternmost curb cut on New Suffolk Avenue should be relocated to more level ground further to the east. Response The applicant is willing to relocate this curb cut.
