Part 1: Provides objective data and information about a given project and its
site. By identifying basic project data, it assists a reviewer in thE'
analysis that takes place in Parts II and III.
Part II: Focuses on identifying the range of possible impacts that rray occur fran a
project or action. It provides guidance as to whether an impact is likely
to be considered snall to rroderate or whether it is a potentially large
impact. The form also identifies whether an impact can be mitigated or
reduced.
Part III: If any impact in Part II is identified as potf>J1tially large, then Part 3
is used to evaluate whether or not the impact is actually important.

Re: Review of Traffic Evaluation

Dear Benny:
As per your authorization, we have completed a review of the Traffic evaluation
prepared by Dunn Engineering Associates for the above captioned application. The project
review was conducted with particular focus on the applicant's request to provide two curb
cuts along its frontage on Main Road (NYS Route 25). The followlng comments pertain to
the site, and the information submitted, followed by a conclusion as to the appropriateness
of the proposed access and circulation scheme.
Existing access to the site is presently uncontrolled along the entire frontage of Main
Road with the exception of removable signage which sometimes restricts access directly
north of the pump Island. Main Road serves as the principal access to the site; however, the
site may also be accessed by Sunset Avenue and Marratooka Lane. These secondary access
points are also not channehzed with formal curb cuts. As noted in the Dunn Engineering
report, the sight distance at all access points is excellent, exceeding the minimum stopping
sight distances recommended by the American Association of State Highway and
Transportation Officials (A Policy on Geometric Design on Highways and Streets,
AASHTO, 1990). It should be noted that some foliage pruning is required on Sunset
Avenue in order to meet and exceed the AASHTO recommended rrnnimum stopping sight
distance.
An examination of the accident history at the intersections of Main Road/Sunset
Avenue and Main Road/Marratooka Lane revealed a low incidence of traffic accidents.
The accident frequency for the three year period from 1987 to 1989 consisted of two
reportable accidents and one nonreportable accident. Although the accident rate was not
expressed in the customary terms of the number of accidents per million vehicle-miles of
travel, three accidents over a three year period is well below the number of accidents that
would warrant a "High Accident Location" status for an intersection on the New York State
Department of Transportation highway system.
Observations of the site as presently configured revealed no operational problems
and internal and external circulation functioned well. The addition of a canopy over the
pump dispenser island is not expected to adversely affect operations or internal circulation.
A canopy would serve to provide a better focus to the site in addition to the usual benefits a
canopy provides to patrons using the gas pumps (i.e. weather protection).

Traffic Review
In addition to the canopy, the applicant proposes to create two curb cuts along Main
Road and one formal curb cut each on Sunset Avenue (30 feet south of Main Road), and on
Marratooka Lane (50 feet south of Main Road). Clearly, the curb cuts on the side streets
would benefit operations by more orderly control of the flow of traffic ingressing and
egressing the site from the side streets. Curb cuts on the side roads would also reduce the
number of conflict points with pedestrian and motor vehicle traffic along Sunset Avenue and
Marratooka Lane.
The question regarding the number of curb cuts on Main Road is one that requires
assessment of the specific site conditions and circulation operations. Consideration should
be given to the geometrics, observation of current operations, adjacent and nearby land uses,
site layout and traffic circulation. The site appears to function well in its present condition.
The excellent sight distances are a contributIng factor and the low accident frequency is a
confirmation of good operation in the vicinity of the NYS Route 25/Marratooka Lane
intersection. The relatively close proximity of the pump island to Main Road lends itself to a
"flow-through" operation which would be facilitated by two curb cuts. The proximity of the
pump island to Main Road also reduces the queuinll area for inllress and egress creating
conflicts that could degrade circulation. Such conflIcts could spIll out onto Main Road
creating delays and hazardous conditions.
The presence of a convenience store on site in addition to the ,gas pumps will
generate additional internal circulation patterns within the site. The Internal traffic flow
permitted by two curb cuts on Main Road would become more significant in consideration of
these additional internal circulation needs. The curb cuts on the two side streets will
complement the Main Road curb cuts to help separate the internal flows and will serve local
traffic from Sunset Avenue and Marratooka Lane thereby eliminating additional movements
onto NYS Route 25 in order for trips originating from these two streets.
If the presently uncontrolled site access were reduced to only one curb cut on Main
Road, this would result in a number of vehicles diverted to the secondary accesses on the
side streets (Marratooka and Sunset Lane). Traffic so diverted to the side streets could
increase the number of potential conflicts. This could in turn increase accident potential
with pedestrians and local traffic as well as add to the overall delay of traffic tryIng to gain
access to Main Road from Sunset Avenue and Marratooka Lane. We are in agreement that
the alternate flow through traffic scenario utilizing one curb cut to Route 25, and one curb
cut to Marratooka, could result in a dangerous queuing situation as vehicles await gaps along
Route 25 from the Marratooka Lane side street.
In summary, the traffic access scenario proposed by the applicant appears to be sound
with respect to traffic operations with no negative impact. Proposed improvements to the
site will enhance operations and improve safety due to the presently uncontrolled site access
scheme. It is recommended that two curb cuts on Main Road be allowed in this particular
case due to the site specific conditions of existing site layout and operations, specifically
internal/external circulation, separate traffic flows for the on-site convenience store, and the
desire to minimize side street conflicts.

Dear Mr. Leon:
In accordance with the requests by Mr. Bill Moore, Esq. and you, Dunn Engineering Associates
has completed a professional traffic engineering examination of the Mobil Gas Station and
convenience food store on the south side of Route 25 between Sunset Avenue and Marratooka
Lane in Mattituck, Town of Southold, New York.
The major aspects of our examination included: a) a review of the existing access in relation
to the internal and external traffic flows as well as sight distances and accident records, b) the
improved access to the site as proposed by Tartan Oil Corporation in relation to expected
internal and external traffic flows, c) the access to the site as suggested by the Town of South old
Planning Department in relation to expected internal and external traffic flows, and d) necessary
improvements to enhance the traffic flow.
These aspects are discussed in the following paragraphs of this letter report.
Review of Existinl1 Access. Sil1ht Distance. and Accident Records
With the exception of a short section of curb located on the southwest corner radius of
Marratooka Lane and Route 25 (Main Road), the site is uncurbed along the entire frontage
on the south side of Route 25. Therefore, access can be obtained to the site at any point along
Route 25. Entering and exiting traffic presently use the entire frontage to access the site. In
addition, no curbs exist along the site frontage on the west side of Marratooka Lane, and access
is obtained by entering and exiting the site at any point along the site frontage on Marratooka
Lane. The site frontage along the east side of Sunset Avenue is uncurbed between the south
side of Route 25 and a tree line which covers a portion of the site frontage along the east side
of Sunset Avenue. Thus, access to the site is obtained at any point along the east side of
Sunset Avenue between Route 25 and the existing tree line.

Our review of sight distances indicated that available sight distance is good at all points along
the site frontage on Route 25. This available sight distance along Route 25 ranges from 900
feet to the east and over 1000 feet to the west at the easterly end of the site on Route 25. At
the westerly end of the site on Route 25, the sight distance available to the east is 800 feet and
750 feet to the west. Sight distances range between these values at other points along the
uncurbed site frontage on Route 25.
At the intersection of Marratooka Lane and Route 25 good sight distance exists to both the
east and the west with a sight distance of 900 feet to the east and 1000 feet to the west along
Route 25.
Sight distance is also good along Marratooka Lane to the south from the easterly side of the
site where available sight distance is 600 feet.
Furthermore at the intersection of Sunset Avenue and Route 25 good sight distance also exists
to both the east and west with a sight distance of 800 feet to the east and 750 feet to the west
along Route 25.
Sight distance to the south on Sunset Avenue from the west side of the site is somewhat
restricted by brush and tree branches growing out over the edge of pavement to the south.
However, this sight distance would be improved to 500 feet or more by minor pruning.
Based on accepted sight distance standards, the stopping sight distance required at Route 25
based on a posted speed limit of 40 miles per hour is 400 feet. Furthermore, the stopping sight
distance required on Marratooka Lane and Sunset Avenue is 350 feet based on a posted area
speed limit of 35 miles per hour. Therefore, the existing available sight distances at Route 25
and Marratooka Lane, Route 25 and Sunset Avenue and across the Route 25 site frontage are
excellent based upon minimum stopping sight distances. Also, sight distances on Marratooka
Lane to the south from the easterly site frontage is excellent based on minimum stopping sight
distances. The improvable sight distance to the south on Sunset Avenue would exceed minimum
stopping sight distance values after some pruning was accomplished.
Accident data was obtained from the New York State Department of Transportation on all the
accidents that have occurred in the vicinity of the site over the three year period of 1987
through 1989. This accident information revealed that over the three year period, one
reportable accident occurred in 1987 at Route 25 and Sunset Avenue. At the intersection of
Route 25 and Marratooka Lane, over the three year period, one reportable accident occurred
in 1987 and one classified as a non reportable accident occurred in 1988. No accidents were
reported on Route 25 along the site frontage between Marratooka Lane and Sunset Avenue
during the three year period. Non reportable accidents are those accidents that are not required
to be reported to the Department of Motor Vehicles. A review of this data revealed that these
intersections are not considered as high accident locations. Furthermore, this data revealed
there is no serious traffic safety problems in the vicinity of the site. This accident information
is particularly significant in view of the fact that in times of heavy uninterrupted traffic flow on
Route 25, it becomes difficult to make turns out of Marratooka Lane and Sunset Avenue,
particularly in the summer.

Our observations of existing conditions revealed that there are no major problems with the
internal or external traffic flows at the site. However some recommended modifications
regarding access to the site are contained in a following section of this letter. These
modifications are intended to enhance both the internal site circulation and minimize potential
external traffic flow problems.
Review of Access As Proposed bv Tartan Oil Company
The access configuration as proposed by Tartan Oil Corporation in their revised site plan of
November 20, 1991 would alter the site frontage along the south side of Route 25 to provide
raised continuous curbing with two separate driveway openings for access to and from the site
on Route 25. The westerly access point would be 30 feet wide and would be located
approximately 25 feet east of Sunset Avenue. This access drive would allow left and right turns
into the site and left and right turns out of the site onto Route 25.
Another 30 foot wide easterly access drive would be located on Route 25 approximately 35 feet
west of Marratooka Lane. This access drive would allow left and right turns into the site and
left and right turns out of the site onto Route 25.
This access plan, on the easterly side of the site would provide a raised curb extending 125 feet
south of Route 25. Site access would be provided by a 25 foot wide drive on the west side of
Marratooka Lane and would be located 50 feet south of Route 25. This access drive would
permit right and left turns out of the site and left and right turns into the site.
Along the westerly side of the site, on the east side of Sunset Avenue a raised curb extending
70 feet south of Route 25 would be provided. Site access on Sunset Avenue would be by a
25 foot drive located 30 feet south of Route 25. The curb and access drive have been located
to afford the least adverse impact on an established tree line on the east side of Sunset Avenue.
The location of the drive also is suited to reduce potential internal traffic conflicts between
entering and exiting traffic and patrons stopped at the kerosene/diesel pump area in the vicinity
of the drive. Left and right turns would be permitted both in and out of the drive.
As previously discussed good sight distance will exist at both of the proposed access points at
Route 25 and also along the west side of Marratooka Lane. Sight distance, although restricted
along Sunset Avenue, can be improved to 500 feet by pruning overhanging tree branches on the
east side of Sunset Avenue to the south.
It is usual for most of the traffic accessing a facility such as this to be generated from the
highway lane adjacent to the facility. Thus, it can be expected that most of the traffic entering
this site from Route 25 would originate from the west. The predominant traffic flow therefore
would be for most vehicles to enter the site by using the westerly driveway and leave by the
easterly driveway on the south side of Route 25. The location of these two driveways provide
for an efficient traffic flow both into the site from Route 25 and out of the site onto Route 25.

The formal access drives on Marratooka Lane and Sunset Avenue provided in this access plan
will allow for an orderly traffic flow pattern both within the site and on these adjacent roadways.
Review of Access SUIll!ested by Southold Town Planning Department
The access configuration as suggested by the Southold Town Planning Board would alter the site
frontage along the south side of Route 25 to provide raised continuous curbing with only one
driveway opening for access to and from the site on Route 25. This single access point on the
south side of Route 25 would be located to the west near Sunset Avenue and would allow left
and right turns into the site from Route 25 and left and right turns out of the site onto Route
25.
The suggested plan also proposes that curbing be installed along the east side of Sunset Avenue
with one driveway opening at a point approximately one hundred feet south of Route 25. The
driveway will allow left and right turns into the site from Sunset Avenue and left and right turns
out of the site onto Sunset Avenue.
The access proposed along Marratooka Lane would provide for curbing along the west side of
Marratooka Lane with two access driveways. The northerly access driveway would be located
approximately fifty feet south of Route 25 and would allow for left and right turns into the site
from Marratooka Lane and left and right turn out of the site onto Marratooka Lane. Because
of its location, this driveway was intended to service gas customers utilizing the pumps in the
front of the facility and also walk. in customers to the convenience food store. The southerly
site access driveway as proposed at approximately one hundred feet south of Route 25 on the
west side of Marratooka Lane would provide access to a proposed convenience food store drive
up window at the rear of the gas station. Since the proposal to provide the convenience food
store drive up window at the rear of the gas station has been dropped however, this southerly
driveway on Marratooka Lane would be unnecessary.
Since this plan provides for only one combined entrance/exit on the Route 25 site frontage,
most of the patron traffic will utilize this driveway to enter the site from Route 25 and will exit
the site onto Marratooka Lane through the proposed northerly site access driveway on the west
side of Marratooka Lane. In order to return to Route 25 from the site, traffic will make a left
turn onto Marratooka Lane and will proceed a short distance to the north and then enter Route
25 by either making a right turn or a left turn.
The approximate distance between Route 25 and the location of the proposed driveway on
Marratooka Lane is 50 feet. Considering a vehicle length at 20 feet, enough storage room will
be provided between Route 25 and the northerly site driveway for two and one half cars.
During times of uninterrupted traffic flows on Route 25, such as that which occurs during the
summer months, few gaps may occur in Route 25 traffic flow that would enable side road traffic
to enter the mainstream of Route 25. For this reason, an accumulation of traffic generated
from the site at times could queue up from Route 25, across Marratooka Lane and back onto
the site, thereby blocking Marratooka Lane to vehicles entering from Route 25. Considering

again the minimal storage area between Route 25 and the northerly site driveway, it would not
require too many vehicles to saturate the intersection area and create an all stopped situation.
Thus, the provision of only one access point on Route 25 will result in additional traffic on
Marratooka Lane which could increase the delays to local traffic on Marratooka Lane desiring
to turn onto Route 25.
Proposed Improvements
As a result of the conduct of our traffic engineering examination, it is recommended that the
two driveways on the south side of Route 25 (Main Road) as proposed by the Tartan Oil
Corporation plan be installed and maintained as the principal access to the combination gas
station and convenience food store.
The two driveways will serve both on site and off site traffic needs and will offer the most
efficient traffic flow patterns for traffic entering and leaving the site on Route 25. This
configuration will allow exiting vehicles to store within the site instead of on Marratooka Lane
during times of high uninterrupted traffic flows on Route 25.
Providing the two access points on the site frontage on Route 25 will eliminate the potential for
a traffic problem on Marratooka Lane. A single access point on Route 25 would result in, a)
additional turns for vehicles to access the site, b) internal traffic circulation problems, c)
additional traffic volumes on Marratooka Lane and d) additional delays to vehicles accessing
Route 25 from Marratooka Lane. Thus, two access points on Route 25 are recommended. Left
and right turns into the site and left and right turns out of the site onto Route 25 will be
permitted at each of the two site access points on Route 25.
It is also recommended that access to the site on Sunset Avenue and Marratooka Lane be
channelized through formal driveways instead of the free access which now exists along both
of these roadways. Therefore, one access point is recommended on the west side of Marratooka
Lane and one access point is recommended on the east side of Sunset Avenue. These access
drives would allow left and right turns into the site and left and right turns out of the site from
and onto the adjacent roadways.
The single access point recommended on the west side of the site on Sunset Avenue would be
located a short distance south of Route 25 and would primarily serve the local area residents
from the south desiring to access the gas station and convenience food store. The location of
this drive would not require removal of major trees located in the tree line along the east side
of Sunset Avenue. The location is also compatible with good internal traffic patterns in the area
of the kerosene/diesel pump located on the west side of the site.

The proposed parking plan within the site is designed to minimize conflicts between parking
and unparking patrons of the convenience food store and drive through vehicles using the gas
pumps.
It is further recommended the overhanging branches be pruned on the east side of Sunset
Avenue to maintain good sight distance to vehicles exiting the site onto Sunset Avenue.

I am in receipt of your letter dated February 20, 1992, and
have spoken with your office staff regarding the Mattituck Mobil
site.
Our client had hoped that before incurring the expense of
drawing up the full blown site plan, that the Board would review
the traffic study and advise if it agreed with the traffic
engineer's conclusions regarding two curb cuts for state Route 25,
and the curb cuts as proposed by the applicant on Sunset Ave. and
Marratooka Road.
The site plan which was provided was done primarily to provide
a base of information for the traffic study.
Please advise if this proposed method of proceeding is
acceptable.

The Planing Board has reviewed the revised map dated April
18, 1990.
The following changes must be made before the Board can
prcl:eed with its review.
1. Drainage plan and calculations must be shown.
2. Parking calculations must be shown, including
handicapped parking.
3. An enlarged diagram of the floor plan showing all uses
must be provided.
4. Curbing must be installed around the entire property.
5. One curb cut must b~ provided on Route 25 and one cut
on Marratooka Road. There is to be no curb cut on
Sunset Lane. The curb cut on Marratooka Road should
be located away from the intersection.
6. A landscaping plan must be provided. Street trees
must be provided on Route 25, Marratooka Lane and
Sunset Avenue.

7. The free standing sign must be twenty-five (25) feet

height of such sign shall be fifteen (15) feet.

shielded from adjoining properties.

Enclosed please find the traffic engineering report prepared by Dunn Engineering
Associates dated December 5, 1991 which addresses the Mobil Gas Station on Route 25
in Mattituck.
We requested this study to address, in particular, the number of curb cuts to provide
ingress and egress to the site.
Also enclosed is a copy of the site plan upon which this traffic study was made.
Please advise if you find the site plan with the conclusions of the traffic study
acceptable, and we will furnish additional prints of the site plan and continue with the

Dear Mr. Leon:
In accordance with the requests by Mr. Bill Moore, Esq. and you, Dunn Engineering Associates
has completed a professional traffic engineering examination of the Mobil Gas Station and
convenience food store on the south side of Route 25 between Sunset Avenue and Marratooka
Lane in Mattituck, Town of Southold, New York.
The major aspects of our examination included: a) a review of the existing access in relation
to the internal and external traffic flows as well as sight distances and accident records, b) the
improved access to the site as proposed by Tartan Oil Corporation in relation to expected
internal and external traffic flows, c) the access to the site as suggested by the Town of Southold
Planning Department in relation to expected internal and external traffic flows, and d) necessary
improvements to enhance the traffic flow.
These aspects are discussed in the following paragraphs of this letter report.
Review of Existinl1 Access. Sii1ht Distance. and Accident Records
With the exception of a short section of curb located on the southwest corner radius of
Marratooka Lane and Route 25 (Main Road), the site is uncurbed along the entire frontage
on the south side of Route 25. Therefore, access can be obtained to the site at any point along
Route 25. Entering and exiting traffic presently use the entire frontage to access the site. In
addition, no curbs exist along the site frontage on the west side of Marratooka Lane, and access
is obtained by entering and exiting the site at any point along the site frontage on Marratooka
Lane. The site frontage along the east side of Sunset Avenue is uncurbed between the south
side of Route 25 and a tree line which covers a portion of the site frontage along the east side
of Sunset Avenue. Thus, access to the site is obtained at any point along the east side of
Sunset Avenue between Route 25 and the existing tree line.

Our review of sight distances indicated that available sight distance is good at all points along
the site frontage on Route 25. This available sight distance along Route 25 ranges from 900
feet to the east and over 1000 feet to the west at the easterly end of the site on Route 25. At
the westerly end of the site on Route 25, the sight distance available to the east is 800 feet and
750 feet to the west. Sight distances range between these values at other points along the
uncurbed site frontage on Route 25.
At the intersection of Marratooka Lane and Route 25 good sight distance exists to both the
east and the west with a sight distance of 900 feet to the east and 1000 feet to the west along
Route 25.
Sight distance is also good along Marratooka Lane to the south from the easterly side of the
site where available sight distance is 600 feet.
Furthermore at the intersection of Sunset Avenue and Route 25 good sight distance also exists
to both the east and west with a sight distance of 800 feet to the east and 750 feet to the west
along Route 25.
Sight distance to the south on Sunset Avenue from the west side of the site is somewhat
restricted by brush and tree branches growing out over the edge of pavement to the south.
However, this sight distance would be improved to 500 feet or more by minor pruning.
Based on accepted sight distance standards, the stopping sight distance required at Route 25
based on a posted speed limit of 40 miles per hour is 400 feet. Furthermore, the stopping sight
distance required on Marratooka Lane and Sunset Avenue is 350 feet based on a posted area
speed limit of 35 miles per hour. Therefore, the existing available sight distances at Route 25
and Marratooka Lane, Route 25 and Sunset Avenue and across the Route 25 site frontage are
excellent based upon minimum stopping sight distances. Also, sight distances on Marratooka
Lane to the south from the easterly site frontage is excellent based on minimum stopping sight
distances. The improvable sight distance to the south on Sunset Avenue would exceed minimum
stopping sight distance values after some pruning was accomplished.
Accident data was obtained from the New York State Department of Transportation on all the
accidents that have occurred in the vicinity of the site over the three year period of 1987
through 1989. This accident information revealed that over the three year period, one
reportable accident occurred in 1987 at Route 25 and Sunset Avenue. At the intersection of
Route 25 and Marratooka Lane, over the three year period, one reportable accident occurred
in 1987 and one classified as a non reportable accident occurred in 1988. No accidents were
reported on Route 25 along the site frontage between Marratooka Lane and Sunset Avenue
during the three year period. Non reportable accidents are those accidents that are not required
to be reported to the Department of Motor Vehicles. A review of this data revealed that these
intersections are not considered as high accident locations. Furthermore, this data revealed
there is no serious traffic safety problems in the vicinity of the site. This accident information
is particularly significant in view of the fact that in times of heavy uninterrupted traffic flow on
Route 25, it becomes difficult to make turns out of Marratooka Lane and Sunset Avenue,
particularly in the summer.

Our observations of existing conditions revealed that there are no major problems with the
internal or external traffic flows at the site. However some recommended modifications
regarding access to the site are contained in a following section of this letter. These
modifications are intended to enhance both the internal site circulation and minimize potential
external traffic flow problems.
Review of Access As Proposed by Tartan Oil Complll\Y
The access configuration as proposed by Tartan Oil Corporation in their revised site plan of
November 20, 1991 would alter the site frontage along the south side of Route 25 to provide
raised continuous curbing with two separate driveway openings for access to and from the site
on Route 25. The westerly access point would be 30 feet wide and would be located
approximately 25 feet east of Sunset Avenue. This access drive would allow left and right turns
into the site and left and right turns out of the site onto Route 25.
Another 30 foot wide easterly access drive would be located on Route 25 approximately 35 feet
west of Marratooka Lane. This access drive would allow left and right turns into the site and
left and right turns out of the site onto Route 25.
This access plan, on the easterly side of the site would provide a raised curb extending 125 feet
south of Route 25. Site access would be provided by a 25 foot wide drive on the west side of
Marratooka Lane and would be located 50 feet south of Route 25. This access drive would
permit right and left turns out of the site and left and right turns into the site.
Along the westerly side of the site, on the east side of Sunset Avenue a raised curb extending
70 feet south of Route 25 would be provided. Site access on Sunset Avenue would be by a
25 foot drive located 30 feet south of Route 25. The curb and access drive have been located
to afford the least adverse impact on an established tree line on the east side of Sunset Avenue.
The location of the drive also is suited to reduce potential internal traffic conflicts between
entering and exiting traffic and patrons stopped at the kerosene/diesel pump area in the vicinity
of the drive. Left and right turns would be permitted both in and out of the drive.
As previously discussed good sight distance will exist at both of the proposed access points at
Route 25 and also along the west side of Marratooka Lane. Sight distance, although restricted
along Sunset Avenue, can be improved to 500 feet by pruning overhanging tree branches on the
east side of Sunset Avenue to the south.
It is usual for most of the traffic accessing a facility such as this to be generated from the
highway lane adjacent to the facility. Thus, it can be expected that most of the traffic entering
this site from Route 25 would originate from the west. The predominant traffic flow therefore
would be for most vehicles to enter the site by using the westerly driveway and leave by the
easterly driveway on the south side of Route 25. The location of these two driveways provide
for an efficient traffic flow both into the site from Route 25 and out of the site onto Route 25.

The formal access drives on Marratooka Lane and Sunset Avenue provided in this access plan
will allow for an orderly traffic flow pattern both within the site and on these adjacent roadways.
Review of Access SUi:l1ested by Southold Town PlanniT\11 Department
The access configuration as suggested by the Southold Town Planning Board would alter the site
frontage along the south side of Route 25 to provide raised continuous curbing with only one
driveway opening for access to and from the site on Route 25. This single access point on the
south side of Route 25 would be located to the west near Sunset Avenue and would allow left
and right turns into the site from Route 25 and left and right turns out of the site onto Route
25.
The suggested plan also proposes that curbing be installed along the east side of Sunset Avenue
with one driveway opening at a point approximately one hundred feet south of Route 25. The
driveway will allow left and right turns into the site from Sunset Avenue and left and right turns
out of the site onto Sunset Avenue.
The access proposed along Marratooka Lane would provide for curbing along the west side of
Marratooka Lane with two access driveways. The northerly access driveway would be located
approximately fifty feet south of Route 25 and would allow for left and right turns into the site
from Marratooka Lane and left and right turn out of the site onto Marratooka Lane. Because
of its location, this driveway was intended to service gas customers utilizing the pumps in the
front of the facility and also walk-in customers to the convenience food store. The southerly
site access driveway as proposed at approximately one hundred feet south of Route 25 on the
west side of Marratooka Lane would provide access to a proposed convenience food store drive
up window at the rear of the gas station. Since the proposal to provide the convenience food
store drive up window at the rear of the gas station has been dropped however, this southerly
driveway on Marratooka Lane would be unnecessary.
Since this plan provides for only one combined entrance/exit on the Route 25 site frontage,
most of the patron traffic will utilize this driveway to enter the site from Route 25 and will exit
the site onto Marratooka Lane through the proposed northerly site access driveway on the west
side of Marratooka Lane. In order to return to Route 25 from the site, traffic will make a left
turn onto Marratooka Lane and will proceed a short distance to the north and then enter Route
25 by either making a right turn or a left turn.
The approximate distance between Route 25 and the location of the proposed driveway on
Marratooka Lane is 50 feet. Considering a vehicle length at 20 feet, enough storage room will
be provided between Route 25 and the northerly site driveway for two and one half cars.
During times of uninterrupted traffic flows on Route 25, such as that which occurs during the
summer months, few gaps may occur in Route 25 traffic flow that would enable side road traffic
to enter the mainstream of Route 25. For this reason, an accumulation of traffic generated
from the site at times could queue up from Route 25, across Marratooka Lane and back onto
the site, thereby blocking Marratooka Lane to vehicles entering from Route 25. Considering

again the minimal storage area between Route 25 and the northerly site driveway, it would not
require too many vehicles to saturate the intersection area and create an all stopped situation.
Thus, the provision of only one access point on Route 25 will result in additional traffic on
Marratooka Lane which could increase the delays to local traffic on Marratooka Lane desiring
to turn onto Route 25.
Pro'posed Improvements
& a result of the conduct of our traffic engineering examination, it is recommended that the
two driveways on the south side of Route 25 (Main Road) as proposed by the Tartan Oil
Corporation plan be installed and maintained as the principal access to the combination gas
station and convenience food store.
The two driveways will serve both on site and off site traffic needs and will offer the most
efficient traffic flow patterns for traffic entering and leaving the site on Route 25. This
configuration will allow exiting vehicles to store within the site instead of on Marratooka Lane
during times of high uninterrupted traffic flows on Route 25.
Providing the two access points on the site frontage on Route 25 will eliminate the potential for
a traffic problem on Marratooka Lane. A single access point on Route 25 would result in, a)
additional turns for vehicles to access the site, b) internal traffic circulation problems, c)
additional traffic volumes on Marratooka Lane and d) additional delays to vehicles accessing
Route 25 from Marratooka Lane. Thus, two access points on Route 25 are recommended. Left
and right turns into the site and left and right turns out of the site onto Route 25 will be
permitted at each of the two site access points on Route 25.
It is also recommended that access to the site on Sunset Avenue and Marratooka Lane be
channelized through formal driveways instead of the free access which now exists along both
of these roadways. Therefore, one access point is recommended on the west side of Marratooka
Lane and one access point is recommended on the east side of Sunset Avenue. These access
drives would allow left and right turns into the site and left and right turns out of the site from
and onto the adjacent roadways.
The single access point recommended on the west side of the site on Sunset Avenue would be
located a short distance south of Route 25 and would primarily serve the local area residents
from the south desiring to access the gas station and convenience food store. The location of
this drive would not require removal of major trees located in the tree line along the east side
of Sunset Avenue. The location is also compatible with good internal traffic patterns in the area
of the kerosene/diesel pump located on the west side of the site.

The proposed parking plan within the site is designed to minimize conflicts between parking
and unparking patrons of the convenience food store and drive through vehicles using the gas
pumps.
It is further recommended the overhanging branches be pruned on the east side of Sunset
Avenue to maintain good sight distance to vehicles exiting the site onto Sunset Avenue.

to do something with respect to the site plan. I was waiting for information from my client
and my client was waiting for information from me, as a result nothing was accomplished.
We have straightened that problem out and a revised site plan which will attempt to
address the concerns raised by the planning board in our last conference with them will be

Mr. Orlowski: Tartan Oil in Mattituck. You scheduled an
appointment with us to discuss your site plan.
Mr. William Moore: We would like to listen to what you have to
tell us.
Mr. Orlowski: I think we wrote it all out.
Mr. Moore: Well, we've got some problems with how to comply
with it and we would like to talk about it. You're letter of
June the 8th. The first three items obviously we can respond
to that. The fourth one, I would like to clarify that. On the
curbing around the property, I assume you are referring to the
improved area not back along the ---_.
Mr. Orlowski: The improved area?
Mr. Moore: Well, the paved area. I know it is a stupid
question but I just wanted to make sure. The real problem that
I see is the curb cut and I told Bob and I know similar
situations faced the board, the Sunoco station and I think they
ended up kind of conceding to your desire to have a single curb
cut on 25. We are still asking for two and I brought Lou to try
and explain why this site and the way the tanks and everything
else would justify two on 25.

Lou DeRonde: I would just like to say that I'm not a traffic
expert, I'm a Civil engineer but I'm not an expertise in
traffic. However, I made a phone call today to the State of New
York over in Happaugue and just discussed this. They have not
seen this plan because each plan stands on its own merit but
generally speaking the state would approve with this frontage of
201 feet, they would approve possibly two 35 foot curb cuts or
two 30 foot curb cuts. A certain distance in from the corners
because of the curb radius and they felt that this was something
that is practical for a location like this. It is accepted as a
industry standard and the State preliminarily does not have a
problem with it. I know the town is aSking for a single curb
cut here but that in itself has some complications in as much as
after riding by the site tonight I found that as we proceed East
on Route 25 there is a right hand curb as you are going towards
the sp.rvice station. That is further complicated by the fact
that there is a down grade right in front of the service
station. So ingress and egress out of the service station
becomes difficult.as you approach the easterly side of the
service station so it is to the benefit to have the ramp in
towards the westerly end of the curb cut for ingress, not only
for customers but also for the tractor trailer that must deliver
fuel to these tanks that were just recently installed towards
the rear of the property. The fills on these tanks are at the
northerly end and the tank wagon must come in and he has to
swing in and he has to park because all these tanks have a right
hand delivery so all the apparatus for deliveries are on the
right side of the truck which is limiting in itself but then the
truck would exit presently, correct me Barry, the truck exits
behind the service station on to Maratooka where he will make
a left hand turn and proceed west back to his terminal. We
would prefer to have the two curb cuts because it lends itself
much better to traffic flow on the service station not
withstanding what I just said about visibility on 25 to the west
leaving the service station. It is rather difficult. It would
be more beneficial to have the curb cut placed at the westerly
end of the curb cut, at the property, excuse me for egressing
for someone who was going to continue west just for visibility
sake and of course those who would continue east would exit on
the easterly curb cut but normally speaking in situations like
this and it has been a industry practice to put in two curb
cuts. If you were dealing with a hundred foot frontage here we
would be limited to single curb cuts but with this type of
frontage it seems practical to ask for two curb cuts.
Mr. Orlowski: Does the board have any questions?
Mr. McDonald: You haven't shown the curb continuing down either
Maratooka Lane or Central Avenue so are you planning to do
away with those curb cuts in those roads as well?
Lou DeRonde: I think that Tartan oil would like to have a
single curb cut on Sunset and a single curb cut on Maratooka.

Mr. McDonald: So you are going to have four potential entrances
and exits onto this property.
Lou DeRonde: That is correct.
Mr. McDonald: It is still you intention (inaudible)
Lou DeRonde: Number four curbing. I think the intent was to
extend the curbing down to where the unimproved area begins.
The wooded area runs from the easterly side approximately 70
feet back and approximately 50 feet back on Sunset and the
curbing will be brought up to that point.
Mr. Ward: What were the width of the curb cuts proposed for the
two side streets?
Mr'. Moore: I think thirty feet would be sufficient. The
distinction, or one of them, with this Sunoco station is they
are on a two corners, of Main Road and Factory. You get
problems and difficulties with three roads surrounding
properties.

Mr. McDonald: I think that was part of what we were thinking
about, because there were two existing roads on each side of
that, rather than create more confusion by having multiple
entrances and exits on Route 25, that we would utilize the roads
that are existing already to make sure that we had fewer access
points to that state road. I'm a little uncertain about what
you are talking about the visibility there cause it is not bad.
Bill Moore: If you come off the site and

the road?
Bill Moore: Probably.

Lou DeRonde: You know the growth comes right out to the edge
of the shoulder of the road. Actually, the growth comes out
within the state right-of-way because there is some vacant
property to the west of the service station. As I can see
tonight, and as you come around there it is approximately
perhaps two or three hundred yards before you can see the
service station which you don't see, you see the brand sign
where it is on the corner. If the brand sign were not in the
position that it was in you wouldn't be able to see the service'
station going east until you were actually going past it and
that with the combination with the down grading presents this
Visibility problem. We have found that if you have good on-
site traffic patterns it lends itself not only to safety on the
egress and ingressing but it presents a much better traffic
flow and since this is in the local community most people will

distinguish that and after a while the whole thing w~ll kind of
blend itself and people become knowledgeable how to lngress ~nd
egress here but of course the main traffic flow for the serVlce
station is going to be not coming off Sunset or Maratooka,
his main business is coming off of 25 so that is where you have
to put your play.
Mr. Ward: Well, if we considered the two on State 25, my .
feeling is that I would want to see any curb cuts o~ the slde.
roads to be as far south as possible. I don't partlcularly llke
this cut as close as it is, it is just not good the way it is
now.
Lou DeRonde: Well, the state indicated what they, perhaps you
know this also, but they also have jurisdiction as far as
entering State roads off of town roads S0 the State is not going
to' permit a curb cut that is too close to the corner.
Mr. Orlowski: Do you have a letter from the State on any of
this?
Lou DeRonde: No, just some phone conversations today. They
suggested that what we do is submit the plan to them and they
will send a field inspector out and they will look at the
property and then make a recommendation to Tartan Oil what the
State feels will be adequate.
( Mr. Orlowski: Does the board have any other questions on this?
Mr. Latham: What is your plan for the natural woodland area?
Mr. Moore: Leave it the way it is in its natural state. This
will bring us to the number six point in the letter. The
landscaping plan, in strictly meeting the code, has the
landscaping across the front of the property. Inthis zone it
would be 25 foot deep and five feet across the front. We're
running into problems with this site. It happens all the time
when you get the existing site now trying to comply with the new
rule book and sometimes you physically can't do it. If you look
at the code, and if I'm reading the code correctly, a 25 foot
deep buffer across the front yard and then scale out the
property you are into and beyond the first existing pump island
so if you are coming up with a landscape plan, I think that is
partly why we are also here tonight to discuss that because we
have a large wooded area in the back. To what extent you want
or will require landscaping to the front of the property I think
we will have to discuss.
Mr. Ward: I think our feeling is that whatever you don't need
as pavement gets planted.

Mr. MCDonald: I don't have the background I guess everybody
else does. What I'm seeing in front of me, is this proposed or

is that pretty much there? This aren't that close to the road
presently are they?
Mr. Moore: Those pumps are where they are.
Mr. McDonald: That is eXisting as is.
Mr. Moore: We got yelled at at one point blacktopping, in fact
we got yelled at a few times. In fact that has always been a
massive asphalt or blacktop in one fashion good, bad or broken
up otherwise and when it came in and it was all blacktopped it
looked like we had come in and somehow schewed allover
everything which just wasn't the case. That's how it was and
nothing was being changed at that point.
Mr. McDonald: I think I would agree with Dick that by asking
for this and where you can't comply with the code it can't be
done. We're aSking to see your plan and what you want to do.
Keeping in mind the variables in the code that you think you can
comply with. I don't think we would necessarily hold you
strictly to it if it can't be held to.

Mr. Ward: For instance, if you get a line out here between the
curb cuts, you can have a big island in here landscaped and a
big island on the corner. I don't know why this is set up here,
why it isn't pushed back further or more on site. I don't know,
you could do a lot to dress this site plan up besides street
trees. You could get some low bed plantings in here. You know
the whole front here other than whatever curb cuts we finally
agree on could be all planted. It will be ten foot deep instead
of twentY-five.
Mr. Latham: Is that telephone gone now?
Mr. Moore: No, that pole is still there. About the sign, I
don't know if we need to go to the Zoning Board?
Mr. Ward: In the spirit of what we are looking for, where we
can, do corners. You know you've got your sign and other things
in there and here is where we've asked for the one curb cut. We
would like to take advantage of places like this where we can
get some low plantings in and plant some street trees.
Lou DeRonde: I would just like to point out to you, you see
that their layout is a bit different, it is more condusive to
one layout. They have islands that are not parallel to the
street. They have what they call the classic drive in islands
and this is more conducive to a single curb cut than we have
parallel lines that are already in existence.

Mr. Ward: If we are going to consider the two curb cuts on 25
and if the state will approve it and you want us to consider it
then we would definitely want to see these curb cuts as far
south as possible.

Lou DeRonde: If I can make a suggestion perhaps we can
present this in the State of New York now within the next few
days. I don't know how they are going to be about coming out
and inspecting it might take several weeks or something but they
will send out their recommendations and/or they will issue a
permit on this and then we can come back with that information
at some point and time and present it back to the board. Then
we can resolve that at least.

permit it doesn't necessarily mean that we are going to agree.
Mr. Moore: From a layman's standpoint, I had real concerns
about a single curb cut on 25. Whether you put it to the east
or to the west, whichever way you want to go back out of the
property doing a very sharp U-turn either to go east or to go
west depending on where you put it.
( Mr. Ward: The only thing is, I thought that the side streets
were usable.
Mr. McDonald: The other problem is for people who don't know
how to get in who are coming from the east going west. If you
don't know it and you are going to pull into this gas station
you wouldn't know enough to go into Maratooka, you would be by
it.
Ken Edwards: That is exactly what he said, most of the traffic
is going to be coming off of 25.
Mr. McDonald: The westward traffic doesn't have a problem, if
they are going to entrance, they are going to enter here. It's
fine, it is from the other direction.
Mr. Orlowski: We had Sunoco do a traffic study. Have you
done anything like that?
Lou DeRonde: No, I don't think there has been a traffic study
done.
Mr. MCDonald: Do you see Sunset being used very much? Do you
envision your tanker coming in through there to come in?
~ Lou DeRonde: I believe they do, yes.

Mr. Orlowski: You won't be able to get behind that building
anymore will you?
Mr. McDonald: Is this the plan that we have in our files right
now?
Mr. Moore: Yes.
Mr. McDonald: You're going to come down with other
modifications as well. The canopy mayor may not be there?
Mr. Moore: We would like to have the canopy there, the goal is
we are trying to sell a gallon of milk, bread, etc.. A drive-in
window.
Mr. McDonald: Does he have to go to the ZBA for this?
Mr. Moore: I would like to keep my list to a minimum.
Mr. McDonald: I'm only thinking what's -- this is now a fast
food establishment.

Mr. Moore: I will go back and review the zoning code and make
recommendations to my client as to the feasibility or wisdom of
that idea. The question I guess I have got for ourselves is, if
you move those curb cuts back along the property would that
tanker still use them. Then he is doing a right hand turn up
Sunset and back along the property.
Lou DeRonde: Obviously, its going to put you back into the
wooded area.
Mr. Moore: There is a minimum distance that you want to be.
Mr. Orlowski: This tanker is going to fill up and go behind
this station to get out then.
Lou DeRonde: I brought along a standard, you can lay this
over your site plan. You see the truck will come in. This is
the same scale as the site plan and it is a right hand drop so
it is actually like this. The wagon comes in, I believe as
Barry was saying, it comes in over here and it will lay in here
something like this. Presently, because the fills are in the
front here, there's four tanks here, he probably lays pretty
much parallel because these hose's are afixedand he probably
parks something maybe in this fashion so he doesn't have to move
the truck when he makes a delivery which is becoming a no, no

Mr. Orlowski: Are you figuring on taking him out this way
then?

out here and he comes out on Maratooka and then continues
back to the terminal.
Mr. Orlowski: It suppose to be a very high canopy.
Lou DeRonde: Well, this canopy appears to be the same as your
standard bridge clearance at least 14 feet if it were approved
by the Zoning Board of Appeals.
Mr. Orlowski: The sign says "Under New Management". Is that
affecting this in any way?
Mr. Moore: No, because that is a tenant of Barry's.
Mr. Orlowski: Oh, O.K, J: noticed it was closed then if opened
again.

Lou DeRonde: The edge is behind the service station now and
if you can envision....
Mr. Ward: How does he come in?

Lou DeRonde: He comes in off of Sunset. He comes in across
the corner here and pulls in parallel. If there is a curb cut
of sufficient size a 25 a 35 foot curb cut, that size truck can
negotiate that turn.
Mr. Ward: So you may be able to eliminate the one on this size.
Mr. Latham: You mentioned 35 a couple of times rather than
30.
Lou DeRonde: Well again, it is up to the state. The state
has been giving out some 30's. They will not give out two forty
foot curb cuts in any instance. In most instances they have
been giving 30 to 35 depending on the site. Allan was just
saying with Mobile, this is an 85 hundred gallon truck, but the
brand of the station is Mobile and he neglected to say is that
Mobile has gone to larger tank wagons and you have probably seen
them. They are 12,000 gallons which are some seven feet longer
so we do need more room to negotiate turns. The quicker you get
the truck off the road the less hazardous it is. They always
come to a stop before they enter and the laws the way they are

the traffic study that you itemize and look at the whole
situation of two curb cuts. The reason is that on two other gas
stations on 25, the board has asked the gas station to go down
to reduce the two existing curb cuts down to one.
Mr. Moore: Which was the other one, I'm just cu~ious?
Ms'. Scopaz: Hess gas station. They are coming in with a
similar type canopy proposal and we have asked for the same
thing. Landscaping and going down to one curb cut, the same as
on the Sunoco site plan. So if we are asking for a traffic
study that you detail the projected traffic flow taking into
account Sunset Lane, Maratooka Lane and two curb cuts from the
traffic sector point of view.
Mr. McDonald: We haven't actually asked for that.

Ms. Scopaz: I'm making the suggestion that if you do that, I
think that should be taken into consideration.
Lou DeRonde: The Sunoco station. When the islands are
perpendicular to the street the turning radius of getting out,
these minimum turning radius for vehicles would probably in most
instances, I don't know which came first the chicken or the egg
here, was there a different layout first that they had two curb
cuts that the islands were parallel to 25 or did they come in
initially with these perpendicular islands for 25.
Mr. Moore: The Sunoco is presently parallel.
Melissa: Right.
Lou DeRonde: Now they are but on the proposed site plan they
are perpendicular because they wouldn't have an option to
getting back on to 25 even if there were another curb cut. They
would have no choice but to exit onto Factory Avenue. I don't
think that is a controlled intersection. In fact, I know there
isn't a light there.
Lou DeRonde: You can imagine some of these service stations
in Manhattan, they have trucks that are just dedicated to one
service station.

ourselves on the landscaping plan. The street trees provide

problems for us and I understand the ideas of the corners and
curb cuts and the low growth ideas make sense that we start
creating visibility problems for intersections and street trees
because I'm not sure where we are headed.
Mr. McDonald: We'll go down there and take a look at it. We
are gOing to want some street trees, certainly there are some
places where the street trees can go in here. Just for your own
information, we want the lighting contained on the site, we
don't want another Mobile station like on the North Road where
we have to fight and fight over the lighting on that. It is not
because anybody is right or wrong its just that's the way it
was. In the middle of the night I don't want light glaring.
Mr. Moore: ThanV you for your time.
Mr. Lou DeRonde: Just a conclusion, I just spoke to Barry and
he would be agreeable about your concern about lighting.
Perhaps as we landscape these corners, assuming that they did
get two curb cuts and the board would approve two, low level
lighting could be employed at the entrances that wouldn't be
offensive to any neighbors or anyone else and it could be done
very, very effectively with the correct landscaping. It could
be quite handsome.
Mr. McDonald: We would appreciate anything you would like to do.

In confirmation of our conversation in respect to the Mobil
gas station in Mattituck, it is my understanding that the
Planning board Wants Tartan Oil, Corp. to have a site plan
indicating curbing to be installed around the property With one
CUrb cut on Marratooka Road and one curb cut on State Route 25.
There is to be no curb cut on Sunset Lane. In addition the site
plan should show proposed landscaping and a drainage plan which
should include the calculations required by the Town Ordinance.
Lastly, they would like an enlarged diagram of the floor plan
together with the parking calcUlations to insure th~t there ~s a
proper amount of parking Spaces provided based upon the use to
which the property is being put.

Dear Melissa:
In confirmation of our conversation in respect to the Mobil
gas station in Mattituck, it is my understanding that the
Planning board wants Tartan Oil, Corp. to have a site plan
indicating curbing to be installed aro~nd the property with one
curb cut on Marratooka Road and one curb cut on State Route 25.
There is to be no curb cut on Sunset Lane. In addition the site
plan should show proposed landscaping and a drainage plan which
should include the calculations required by the Town Ordinance.
Lastly, they would like an enlarged diagram of the floor plan
together with the parking calculations to insure that there is a
proper amount of parking spaces provided based upon the use to
which the property is being put.

With regard to the above-named appeals, I would like to
make a few observations.
First, the landowner currently enjoys a substantial bene-
fit from being the only business-zoned property in the immediate
neighborhoo<l. The proposed Master Plan zoning respects this
business zone, even though the preservation of this business zone
outside of the hamlet business district essentially contradicts
one of the aims of the Master Plan, which is to prevent strip devel-
opment on State Route 25.
Second, the proposed intensification of use by the addition of
an accessory retail use which bears no clear relationship to the
gas station use raises other questions.
For example, should a Special Exception use such as a gas
station be allowed to have non-automotive retail accessory uses?
Should the Town encourage the mixing of these two somewhat dis-
parate uses on one site? One of the major reasons why many zoning
codes have placed such specific restrictions on gasoline stations
is the potentially hazardous nature of the use.
If the proposed accessory use is allowed, where does one
dwaw the line with regard to the nature of permitted retail uses?
For instance, would a florist shop be an acceptable retail use?
Or perhaps a fast food take-out shop? Will allowing the proposed
retail use open the door to expanding that retail use beyond that
specific use that is being requested tonight? If the newspaper-
fast food-cigarette business doesn't do well, but the video ren-
tal business does, how does one control the change from this
type of retail to the other?
Finally, it may be useful to reverse the question. If a
retail shopping center, whether large or small, asked for per-
mission to open a gas station as an access6ryuse, would you
consider the request for the second use_as a strictly accessory
use?
Lack of time prohibits a more detailed analysis. If the
Board so wishes, -however, I am willing to address these questions
in greater depth.

AcCording to the engineers of Petroleum Associates 80% of the run
off will be contained on the property. Approximately 20% of the
run off would run into Marratooka Lane. The englneer proposes
construction of a gully or swa1e along Marratooka inside the
property line directing the water to the lower area of the
property thereby retaining all runoff on the subject piece.

Dear Valerie:
On behalf of Tartan Oil I am hereby resubmitting an application
for site plan approval for the Mattituck Mobil Station located at
the intersection of State Route 25 and Sunset Avenue. The
original application dated August 4, 1987 was returned September
15, 1987 on the basis that it was incomplete.
Enclosed please find four (4) copies of the amended site plan
providing the information requested in your letter of September
15th, together with my check payable to the Southold Town Clerk
in the sum of $100.00.
Your letter of the 15th also included a checklist of items
requesting additional information on the site plan being
submitted. Among the information requested is the location and
arrangement of the proposed means of access and egress including
proposed curb cuts. It is not the intention of the owners to
engage in a complete renovation of the site. Nor is it
necesssary under the Southold Town Code for the applicant the to
take a pre existing business and bring it into complete
compliance with the ordinance. In light of the paving which was
done on the property, the applicant is prepared to provide the
necessary drainage to retain water on the site. In addition,
there is a gap in the screening to the rear of the property which
the applicant is also prepared to remedy with some plantings.
The sole reason the applicant must submit a site plan lies in the
fact that it has submitted an application to the Southold Town
Zoning Board of Appeals to permit partial self service of
gasoline at the station. Such a use requires site plan approval.
Simply because site plan approval is required by the code does
not necessitate the full range of site improvements contemplated

We presently have two applications pending concerning the above
premises which is located in the "B-1" General Business Zoning
District and more particularly shown on the attached survey.
The applications involve both a Special Exception for partial
self-service of gasoline and a Variance for a Convenience Store
in conjunction with present gasoline services on less than one
acre of land (Section 100-62).
Since it is our policy to coordinate reviews when an application
falls under both our jurisdictions, we would like to request
your position at this time. As you know, the building is exist-
i ng (except .:linr recent renovat ions, canopy addi t i on, new pumps,
etc.), and a copy of the Certificate of Nonconforming Premises
#Z14455 dated May 30, 1986 is attached for your consideration.
We are in a position to schedule this matter for a public
hearing and will need your input at this time, prior to the
public hearingL if you feel Planning Board jurisdiction is
appropriate. . It is our understanding that in the Matter of.
Sukru Ilgin, a resolution was adopted by the Planning Board
waiving jurisdiction for a similar(Variance)project.

will not adversely affect the health, safety, welfare, comfort,
convenience or order of the town.
The character of the use and development of uses in this zoning district
will not be affected by the approval of partial self-service on this

Partial self-service will not unduly increase vehicular traffic con-
gestion. Nor will such a use have effect on the availability and
adequacy of water and sewer resources. No additional parking demands
will be created by the proposed use and there will be no additional
noxious gases, odors, dust,light, vibration or noise by approval of
partial self service facilities. The fire suppression system will
reduce risk of injury and property damage. The propo sed use will not
produce overcrowding or undue concentration of people on the property.
Petitioner proposes that southerly side of southern island provide
full service operation with balance of southern island and northern
island to provide self-service. In addition kerosene and diesel
pumps are proposed to be self-service. Diesel and kerosene are standard
petroleum products offered for sale at gasoline serv~ce stations.
Motorists using diesel and keresene are penalized with higher prices
if such products must be provided only on a full-service basis. In
addition, many operators, particularly truck operators, prefer to
pump their own fuel. Such preference is still penalized with higher
fuel prices if full-service must be offered at that pump.

to insure the safe and orderly use of the pro~erty. The proposed use
will not adversely affect the health, safety, welfare, comfort,
convenience or order of the town.
The character of the use and development of uses in this zqning distric,
will not be affected by the approval of partial self-service on this
property. Nor will the proposed use adversely affect property values.
Partial self-service will not unduly increase vehicular traffic con-
gestion. Nor will such a use have effect on the availability and
adequacy of water and sewer resources. No additional parking demands
will be created by the proposed use and there will be no additional
noxious gases, odors, dust,light, vibration or noise by approval of
partial self service facilities. The fire suppression system will
reduce risk of injury and property damage. The propo sed use will not
produce overcrowding or undue concentration of people on the property.
Petitioner proposes that southerly side of southern island provide
full service operation with balance of southern island and northern
island to provide self-service. In addition kerosene and diesel
pumps are proposed to be self-service. Diesel and kerosene are standarc
petroleum products offered for sale at gasoline servjce stations.
Motorists using diesel and keresene are penalized with higher prices
if such products must be provided only on a full-service basis. In
addition, many operators, particularly truck operators, prefer to
pump their own fuel. Such preference is still penalized with higher
fuel prices if full-service must be offered at that pump.

The Board has requested the following information:
(1) Four prints showing all pole and building lights,
canopy lights, permanent egress/ingress areas [rear incl.].
Please clarify the types of lighting used in these areas,
which may all be sketched on the prepared site plans.
(2) Sketch showing the previous location of the pumps
and island [recently removed].
(3) Copies of permits authorizing recent renovation,
construction, and occupancy for the convenience store and
self-service gasoline operations. [If no permits are
available, please explain.]
We have asked the Planning Board to consider jurisdiction
in this matter. and vou will be advised as to whether or not
a formal request is ~et~ssaryfor a waiver from the site-plan
review requirement for this B-1 Business Zoning District

We presently have two applications pending concerning the above
premises which is located in the "B-1" General Business Zoning
District and more particularly shown on the attached survey.
The applications involve both a Special Exception for partial
self-service of gasoline and a Variance for a Convenience Store
in conjunction with present gasoline services on less than one
acre of land (Section 100-62).
Since it is our policy to coordinate reviews when an application
falls under both our jurisdictions, we would like to request
your position at this time. As you know, the building is exist-
ing (except for recent renovations, canopy addition, new pumps,
etc.), and a copy of the Certificate of Nonconforming Premises
#Z14455 dated May 30, 1986 is attached for your consideration.
We are in a position to schedule this matter for a public
hearing and will need your input at this time, prior to the
public hearing, if you feel Planning Board jurisdiction is
appropriate. It is our understanding that in the Matter of
Sukru Ilgin, a resolution was adopted by the Planning Board
waiving jurisdiction for a similar(Variance)project,

Petitioner proposes that southerly side of southern island provide
full service operation with balance of southern island and northern
island to provide self-service. In addition kerosene and diesel
pumps are proposed to be self-service. Diesel and kerosene are standard
petroleum products offered for sale at gasoline service stations.
Motorists using diesel and keresene are penalized with higher prices
if such products must be provided only on a full-service basis. In
addition, many operators, particularly truck operators, prefer to
pump their own fuel. Such preference is still penalized with higher
fuel prices if full-service must be offered at that pump.

property. The light shields requested by the Planning Board have

would be issued.
Please advise me of the status of the review of the site
plan submitted for the Mattituck station. Also, please advise if
you would like the applicant's engineer to discuss the
