The meeting began at 7:10 p.m. with four LPC members present. EXECUTIVE SESSION. The Members entered into Applications: ?? N&J MANAGEMENT CO. PROPERTY (TPDR) [executive session] SCTM #: 1000-113-13-1.2 Location: 4735 Westphalia Rd, Mattituck Total Acreage: ±17.32 acres PDR Acreage: ±15-16 acres Zoned: R-80 CPF: Yes Reviewed offer and appraisal received from landowner [executive session]. (Eric Keil not in attendance for this discussion as landowner is a relative) LPC reviewed sales comps in landowner’s appraisal. LPC had concerns re: some of the values/adjustments in landowner’s appraisal. Melissa Spiro was directed to contact landowner regarding issues with landowner’s personal appraisal. LPC cannot guarantee to landowner usage of State language in easement as Town did not receive State grant. MOTION made by Ray Huntington, seconded by Michelle Zaloom to increase previous offer to landowner for a development rights easement, leaving a reserved area around the cottage and a proposed residential building lot. Motion carried 5/0 (Eric Keil recused) END OF EXECUTIVE SESSION Adoption of Meeting Minutes: ?? Adoption of LPC meeting minutes from May 16, 2006 MOTION made by Ray Huntington, seconded by John Sepenoski, to accept minutes of May 16, 2006. Motion carried 4/0/2 (Eric Keil & Michelle Zaloom abstained) Applications continued: ?? NEW SUFFOLK LAND CO. (f/k/a Campbell) SCTM # 1000-55-1-8.3 Location: 5455 Youngs Avenue, Southold Total PDR Acreage: 22.56 acres Continued review of request for building within easement area. Melissa told LPC that she met again with Ben Sisson to discuss different locations discussed and preferred by some members of LPC. Ben Sisson had staked one proposed location from LPC’s review. LPC noted that they prefer that any ag structures be placed on an adjacent parcel owned by landowners where development rights remain intact. LPC had lengthy discussion re: pros and cons of possible site locations. MOTION made by Eric Keil, seconded by Ray Huntington, to approve ag structure building in location (northeastern corner of 55-1-8.3) requested in letter dated March 24, 2006, and to allow for uses requested in same letter provided doors to building face westerly away from Youngs Avenue. Motion failed: 3/3 MOTION made by Lillian Ball, seconded by Ray Huntington, to allow the ag structure and uses requested in March 24, 2006 letter, on landowners’ adjacent property known as 55-1-8.4 as Town owns development rights on this property also. Ag structure to be located at the southern most side of the property, in the southeast corner by Youngs Avenue. No restrictions placed on building orientation. Motion carried: 5/1 (Eric Keil) Note taken that consensus among LPC members could not be reached for location suggested by landowner; however, consensus was reached for an alternative ag structure location on the property. ?? GIRARDS PROPERTY SCTM # 1000-107-10-10.1 Location: 6900 Wickham Ave, Mattituck Total Acreage: 10.10 acres (GIS 10.18 acres) Zoned: A-C F/MWet: 0 acres Subdividable: Yes CPF: Yes Reviewed status after Melissa’s meeting with landowners. HOLD as Melissa had not heard back from landowners prior to meeting. ?? FITF, LLC PROPERTY (Dixon Harvey – open space) SCTM #: 1000-9-8-2 Location: Reservoir Road, Silver Eel Cove, Fishers Island Total Acreage: 2.20 acres (GIS (3.22 acres) Subdividable: NZ Zoned: R-80 and MII (0.89 acre) FWet: 0 acres MWet: GIS 0.31.acres CPF: Yes Reviewed status of offer. Melissa Spiro met with landowner’s attorney, Patricia Moore, in regard to proposed limits to be placed on MII area (area not offered to Town). Landowner may request zone change from MII to residential. Landowner wants residential use in the existing building on site, willing to restrict size to existing footprint, but want to be able to move building and to replace it in a different location. In addition, he wants to increase height but willing to limit height to 28 feet. Landowner also restricting dock to no more than four (4) residential slips. LPC acceptable with restrictions and potential zone change as long as all in accordance with Town Code. EXECUTIVE SESSION. The Members re-entered into ?? ROZAKIS PROPERTY SCTM #: 1000-54-5-55.1 Location: 445 Dogwood Lane, Southold Total Acreage: 0.20 acres (GIS (0.2 acres) Subdividable: NZ Zoned: R-40 FM/Wet: 0 acres CPF: No Reviewed new application. Landowners offered in a suggested price range, a development rights easement on recently purchased vacant property adjacent to their home as a significant bargain sale to the Town. Although this property is located within an environmentally sensitive area, it is not listed on the Town’s Community Preservation Project Plan list. MOTION made by Michelle Zaloom, seconded by Eric Keil, to present an offer to landowners for a development rights easement only and landowner would retain fee title to the parcel. Motion failed 2/4. (Ray Huntington, Chris Baiz, John Sepenoski, Lillian Ball) MOTION made by Ray Huntington, seconded by Lillian Ball, to increase the amount of offer to be presented to landowner for a development rights easement. Motion failed 3/3. MOTION made by Chris Baiz, seconded by John Sepenoski, to increase the amount of offer for a development rights easement as a good faith, preservation promotion. [executive session] Landowners requested an increase to the purchase price offer for a development rights easement that was made by Town over a year ago. MOTION made by Lillian Ball, seconded by Ray Huntington, to direct Melissa Spiro to contact appraiser that prepared the appraisal on the Wesnofske property for an updated appraisal. Melissa explained issues that she had with the most recent appraisal prepared for the Town on the Stackler property. MOTION made by Ray Huntington, seconded by Eric Keil, to direct Randy Parsons of The Nature Conservancy, to commission another appraisal on the Stackler property. Motion carried: 6/0. END OF EXECUTIVE SESSION Inquiries: ?? McCARTHY PROPERTY SCTM #: 1000-122-4-47.1 Location: 2950 Ole Jule Lane, Mattituck Total Acreage: 2.0 acres (GIS 1.94 acres) Zoned: R-40 Subdividable: NZ F/Wet: 0 M/Wet: 1.75 acres CPF: Yes Discussed inquiry from County. County inquired as to interest in Town “partnering” with County for purchase of this parcel. LPC members willing to “partner”, however, need more details as to scope of project before committing to partnership. General: ?? State grant RFP Grant proposal due by June 30, 2006. Melissa Spiro, John Sepenoski, and Melanie Doroski to meet to discuss possible projects for grant submission. ?? Update re: Ag & Mkts meeting held June 12, 2006 Information received during the subject meeting was hand-out to committee members for their review. ?? SHALVEY – Closing scheduled for Tuesday, June 15, 2006, at 10:00 a.m. ?? C & D REALTY – Public Hearing scheduled for Tuesday, June 20, 2006 at 5:15 p.m. ?? CABERON PROPERTIES (Cedars Golf) – Fact gathering and resolving issues, designated to Ray Huntington. No public hearing has been set on this acquisition. ?? SHUR – presentation made by Tim Caufield, Peconic Land Trust. Adjacent property owner still interested in purchase of Shur farmland once development rights have been sold to the Town. Shur, in his sale to Town, wants an Ag Structure area designated in the northwesterly section of the parcel. Landowners th would like to close title on or about July 20 ?? 2005 SUFFOLK COUNTY TAX MAP BOOKS - The blue books need to be returned to the Land Preservation Department by Monday, June 19, 2006. Books were returned by Al Krupski, Michelle Zaloom, Ray Huntington, and Melissa Spiro. Books remain outstanding to Ray Blum and Eric Keil. Lillian Ball was given a new tan 2006 Suffolk County Tax Map Book. Next Regular Meeting: ??
