Dear Mr. Gianone:
The following action was taken by the Southold Town Planning
Board at a regular meeting held March 17, 1981.
RESOLVED to approve the amendment to the site plan of
"Sundown" as requested by the present owner, Gene Gianone,
include the following:
to
1. The moving of the garage on the premises fifty feet back
from its original site.
2. The elimination of parking from the front of the
building.
3. Changing of the in and out status of the driveways. The
east driveway will be the entrance and the west driveway
the exit.
4. Providing of on site parking for 28 cars which is an
additional 20 cars from the original plan.

Dear Henry;
As per our phone conversation today pertaining to the changes
in the site plan for my resturant in Mattituck. I have had the garage
on the premises moved fifty feet back from its original site. We
have on site parking for 28 cars.(75'X 150' divided by 350 sR. ft.
per car.) These figures are compiled from the original site plan for
the "Sundown". I plan to have no parking in the front of the building.
This area will be used for our customers to pick up their cars after
they have dined. We plan to use valet parking.
I would also like to change the in and out status of the
driveways. We will use the east driveway for our entrance and the west
for our exit. We will be opening for dinner at 5:30, Reeve Lumber
closes at 5:00, There sould be no problems for either business.
We~have installed a new grease trap and an additional 1200 gal.
cess pool to meet Health Dept. codes for an occupancy of eighty people.
Since we seat 42 people in our dining room ,I do not think that we will
have more than 70 people ,including employees at any one time.
I hope that this will explain our intentions to you. If you
have any questions please call me , and I will furnish any information
you may need.

suggest that any further correspondence be taken up with him
on this matter.
Concerning your comments on the adjacent business property,
please note that a meeting was called with the Chief of Police,
~embers of the Town Board and other property owners in the
neighborhood to correct this problem at which time you did see
fit to not attend. I draw this to your attention to let you
know that the problem wasn't neglected by this office or any
other office in the Town of Southold.

Thank you for your letter of August llth.
On October 3, 1977 the Southold Tovm Planning Board approved
the site plan of the "Snndovm" for the principles, Mr. Edward
Cosgrove and Mr. Davis True. The extent of the approval under
the ~urisdiction of the Planning Board with regard to this
property is as follows:
1. Adequate ingress and egress with regard to traffic
patterns.

Dear Mr. Raynor:-
As residents and taxpayers of this community,
we are greatly disturbed and concerned with the
operation of an establishment located on the Main
Road in Mattituck known as the "Sundown". While
only a few signatures appear in this letter, please
be assu~ed that many more people are concerned
about this situation but we thought it unnecessary
to obtain more signatures at this time.
It is our understanding that the "Rundown" was
originally granted permission by your Board to operate
a Restaurant and Bar at its present location. As
far as we can detez~nine, the "Sundown" never was and
is not now a Restaurant. Instead, it is strictly a
Bar whose operations are conducted in a noisy and
boisterous fashion without regard or respect to the
feelings of the residents in this area~. Actually,
it is a health hazard because one cannot obtain a
good nights sleep due to all the noise originating
within the establishment. On many nights, this
abuse continues until 4:00 and 9:00 o'clock in the
morning.
What is equally disturbing is the conduct o£
the patrons as they are leaving the premises. The
hooting, yelling, tooting of auto horns is
unbelievable. Loud arguments have ensued on the
street wit~ profane language used, using the streets
and front lawns as public rest rooms, leaving debris
such as empty beer bottles, etc. These goings on
could at least be called "disturbing the peace".

Now we believe in free enterprise and the
right of an individual to make a living and we
do not wish or intend to place any obstacles in
path of anyone so involved. However~ it is our
opinion that we as taxpayers are also entitled to
Some protection and the right to enjoy our homes
in peace. We request that you look into this
situation and see what can be done to grant us
some relief.

Dear Mr. Tsontakis~
Site development plans for the above noted project have been
reviewed by this office. Please be advised that we have,
in general, no objection to the requested ingress and egress;
we will however require the installation of raised concrete
curbed channelization at both driveways to a length inside
the property of approximately 20 fto Furthermore, we request
that the two on-site drainage basi~s be moved approximately
5 ft. further south. It will not be necessary to resubmit
revised prints showing these alterations, aa it can be
handled by our field engineer, MT. John Youngman.
Therefore, upon receipt of a bond (sample attached) for $1000
and a check to the State of New York to cover contingent liabil-
ity insurance and permit fee (total $52.50 if no street curb
and sidewalk is to be installed, $2.50 if street curb and side-
walk are required by this officel pending field investigation}l,
a Highway Work Permit application will be prepared for your
signature.
.When the signed applications are returned, the permit will be
issued.

27, 1977, I have checked the proposed parking as submitted
in hatch marked areas (3) and find as follows:
1. Front area marked for 1,$00 Sq Ft ecales out at 1288 sq ft.
2. the middle area marked for 1,$00 Sq ft scales out at 1~7 sq ft.
~ the rear area marked for 1~00 sq ft scales out at 1957 sq ft
the total hatch marked area on plan = ~102 sq ft
At proposed capacit~ of $O persons, 8 spaces are required @
350 sq ft per space = 2~00 Sq ft paved parking.
This site plan for the "sundowner" should be on a 6 month and
again a lye=r rewiew in case they do"catch on" and it becomes a
popular spot, additional parking will have to be made in rear of lot.
Send me a finaly approved plot pla signed by the board with
all imposed conditions written on it.

Enclosed please find revised site plan for the referenced
project. As per your request at the Planning Board Meeting
held on September 19, 1977, I have been in contact with the
Building Inspector and have noted the parking area in ac-
cordance with his recommendations. I have also contacted
the Department of Transportation, State of New York. This
Department is in the process of enumerating the curbing
and sidewalk requirements, if any. I have made a notation
on the drawing to the effect that the Department of Trans-
portation requirements shall be complied with. I also
assume since this property abuts a state road that the
Planning Board would be satisfied with an insurance that
the Statels requirements will be complied with.
I pray that the Planning Board finds this site plan in order
and grants their approval.

Gentlemen;
I have looked over the proposed site plan for the
"Sundowner" restaurant & bar, S/S Main Road, Mattituck, N.Y.
dated 8/15/77, and make the following comments:
1. Curb cuts, curbing and sidewalk details must be approved by
N.Y.State Dept Transportation, Hauppauge, AND Ray Dean, Supt.
of highways.
2. We are dealing with an existing building, trees etc., the
proposed circular "in & out" traffic pattern is O.K.
3. The parking spaces shown are not 350 sq ft as required, there is
enough area in the rear for adequate parking forgO patrons
as proposed but same is not properly shown.
$. The proposed ground sign location, 5 ft back from property line
is OK.
5. I note drainage catch basin in each driveway, to catch runoff water
before it reached the main road~ the capacity of these dhould be
checked ( minimum 6 inch rainfall)
6. the property is zoned for the proposed use.
7. Planting~ lighting & drainage is up to Planning Board judgement.
