Prior to an approval of the site's access and issuance of a New York State Highway Work Permit (HWP), the following items must be addressed: 1. The plans should clearly show all existing and proposed pavement markings, signs and curb cut changes. It appears the request is to construct a 2-way entrance with 15' lanes separated by a 7' median or island. Please provide construction plans and NYSDOT Standard Details showing what is being proposed. We recommend that your design professional consult our driveway policy manual which is available on our website at www.nysdot.gov. On the NYSDOT A-Z bar click on "H," then click on Highway Work Permits and then click on Policy and Standards for the Design of Entrances to State Highways. All work and material details shall be shown referenced to NYSDOT specification item numbers. The proposed driveway design should be in accordance with the design guidelines outlined in the above noted manual. Please provide the following information: a. Indicate edge of pavement. b. Show a driveway profile that indicates the high point of the driveway is at the NY 25 highway right-of-way line. If this cannot be accomplished, please show how all site runoff will be collected and contained, including calculations that support the choice of facilities being used to accomplish this. c. Indicate if crosswalk will require any restriping. e. There are two drainage grates that appear to be behind the edge of pavement. If curb will be installed, indicate how the grates and drainage will be addressed. f. Show the existing crosswalk across NY 25. Indicate an Americans with Disabilities Act (ADA) compliant connection between the crosswalk and the sidewalk. It appears that a ramp and a section of sidewalk might be required. Include Item 608.21-Embedded Detectable Warning Units. We suggest addressing both sides of the crosswalk with this permit. Reference NYSDOT Standard Sheets 608-01 Sidewalk Curb Ramp Details (Sheets 1-4) for more information. g. Indicate the proposed NYSDOT driveway type & provide Type Detail. Consult NYSDOT Sheet 608-04 Driveway Entrance Details for more information. h. Indicate how the sidewalk will cross the proposed driveway, i.e.Type 3-level across or Type 2-ramps down to cross. i. Indicate any sidewalk proposed to be replaced. j. Provide sidewalk or ramp (as required) at west side of driveway up to the property line, to connect to future sidewalk installation. Detectable warning units are not required across driveway. k. Indicate the full layout and construction of the proposed 7' wide median and whether any portion of it will be located in the ROW, i.e. raised curb or striped pavement. Any median in the ROW must allow ADA compliant accessibility across it, i.e. striped median or a dropped curb the width of the sidewalk. 1. A 4' diameter tree is indicated to be removed from applicant's property to allow expansion of the driveway entrance. For long-term enhancement of the highway corridor, we suggest planting a new tree east of the driveway entrance. 4. Please show on the plan where the sign will be in relation to the NY 25 ROW line. Please submit five (5) copies of revised plans. In your response letter, please state how the above comments are addressed, item by item. A pedestrian accommodation plan, as well as Work Zone Traffic Control plan, in accordance with the current National Manual of Uniform Traffic Control Devices and NYS supplement, shall be provided as part of the plan set. The check, which you submitted with the Highway Work Permit application, is the correct fee for the proposed type of operation; however, the fee is not required until such time as the plans are approved for Highway Work Permit issuance. NO. 4729 - Mattituck Library Parcel: 13900 Main Road, Mattituck 1000-114-11-2 Zone District: RO Residential Office and R-40 Date of Public Hearing: August 18, 1999 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's 1.5-acre parcel is located in Mattituck with 135.35 ft. frontage along the south side of Main Road (NYS Route 25) and lot depth of 505.10 feet (along easterly side property line). The property is improved with a one-story frame and brick Library building located in the Residential Office (RO) Zone District, and the rear portion of the lot is located in the R-40 Low-Density Residential Zone District. BASIS OF APPLICATION: Southold Town Zoning Code, Chapter 100, Article VII, Section 100-72 for a library addition at 8.52 feet from the easterly side property line. The Code requirement is 15 feet in this RO Zone District. APPLICANT'S REQUEST: Applicant requests a variance in a proposed library expansion with a minimum 8.5 feet setback at the southeast corner of a bowed wall on the east side of the building. Details are more particularly shown on the Plan Ll-02 dated April 19, 1999 prepared by Beatty, Harvey & Associates Architects. All parking and screening will be determined by the Southold Town Planning Board as provided under the Zoning Code site plan regulations. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1) The east wall of the proposed addition extends only 10 feet beyond the existing east wall, but the resulting reduction in side yard setback is greater (from about 25 feet to 8.5 feet) because the building wall is not parallel to the property line. 2) The size and shape of the lot dictate that any expansion be in the form of an addition at the rear of the building. Because the easterly wall of the building is not parallel to the property line, any reasonable sized addition at the rear requires an easterly side yard setback variance. Room on the west side is severely limited by the need to maintain the driveway giving access to parking behind the building. 3) There is a stand of woods and brush along the easterly property line that extends a considerable distance into the neighboring property. East of the woods and brush on that neighboring property there is a large, black-topped church parking lot; the church building itself is located east of the property line by more than 100 feet. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Box 1179 Southold, New York 11971 Dear Mr. Kassner: June 3,1999 JUN 0 9 1999 Southold Town Planning Board I am writing in response to your inquiry about whether the Mattituck-Laurel Library could share the parking lot belonging to Sacred Heart Church in order to reduce the size of the parking lot associated with the Library's expansion project. As you may recall, in September of 1998, I spoke to you about this possibility and you indicated that a formal letter or agreement from the Church would be required if the Planning Board were to consider reducing the size of the new Library parking lot. I immediately wrote to Rev. Peter Allen, Pastor at the Sacred Heart Church. I have enclosed a copy of this initial correspondence. Father Allen had indicated that the request would have to be presented to him whereupon he would present it to the Bishop of the Diocese of Rockville Centre. After not receiving a response from either Father Allen or the Diocese, I sent Father Allen a handwritten note inquiring about the request. This was on December 15th, the day after the successful Library expansion vote. In February, after waiting for a reply once a~ain, I called Father Allen and set up a meeting for February 24th. At this meeting I shared the Library's expansion plans with him and inquired once again about our request. He said he would give a call to the Diocese and try to help. Recently, I have tried unsuccessfully to speak to Father Allen on the phone - until yesterday. He said he had not received a formal answer from the Diocese regarding our request, but he felt certain the Diocese is not willing to agree to the sharing of the Church parking lot. (516) 298-4134 · (Fax) 298-4764 I must add that Father Allen has been most cordial and has apologized on numerous occasions for not following up as I have apologized for "hounding" him about this matter. It appears that the Church is unwilling to formalize the shared parking arrangement. Further, it is the Library Board's concern that even if such an agreement were formalized, the Church could at any time end the agreement and leave the Library with inadequate parking. Peter Allen, Pastor Sacred Heart Church 27700 Main Road Cutchogue, New York 11935 Dear Father: Today I spoke on the phone with John Kennelly and he indicated that you are willing to entertain a request from the Mattituck-Laurel Library regarding the Church parking lot in Mattituck. As you know, the Library's Board of Trustees has explored over the past several years, the possibility of expanding the current building. A proposal is scheduled to be put before the community in early December 1998. The Town of Southold requires that the Library, because of the size of the building, have available 45 parking spaces as part of the expansion project. However, they agree to reduce this number to 22 spaces if the church agrees to allow the overflow to use the Church parking lot. I am writing to ask if the Church would consider agreeing to this proposal. Of course, the Library's insurance company would issue a certificate showing the Church as a named additional insured for claims arising out of use of the lot for parking. Essex our attorney, our only alternative is a request to the Southold Town Board for a change in the status of the parking lot. Atticle XV, Section 100 - 150, P-10073 states that the Town Board upon its own motion may amend, supplement, change, modify or repeal. See Section A an~ B for procedures. ~ile the Town Board has the legal right to take action on our behalf, we realize that such action may be time con- suming. In the meantime, we have a complete~ extension ready for public use. We need a temporary Certificate of Occupancy so that the building can be use8 until a modified parking lot can be built. We would like to appear before the working session of the Town Board on October 21st. If required we will appear at the public meeting. The basis of our appeal is economic hardship. We also would have to ~estroy many beautiful trees to accomodate a 19 car parking lot. Furtherlwe are afraid that perhaps an un~esirable element may use such a lot for non-library related activities. This has been a problem at other libraries. It is very difficult to understand the attitude of the Planning Board an~ the Zoning Boar~ of Appeal. When East Hampton;Public Library built a 4000 square foot extension no off-street parking was require~. Most recently, the Riverhead Library was not required to add additional parking for their large extension. It makes one wonder if our Town government really has the interest of the public in mind. When the project was approved by the Library Board, in the fall of 1979, we had an estimate from our Project Engineer for the building and site improvements. This estimate exceeded our available funds, but we choose to go ahead anyway with the idea that more money would be forthcoming. Because we felt that the parking requirements were excessive for the intended use, we attempted, unsuccessfully, to eliminate them through the Board of Appeals. Finally, at the Southold Town Planning Board Meeting of April 7, 1980, where the site plan was discussed, we then expressed our feelings about the parking lot and the fact that we would not have sufficient funds to complete. The Planning Board eluded to and mentioned that we would be given some relief to the extent that we would be allowed time to complete all the site improvements. The indication was that we could use the building under a temporary Certificate of Occupancy, until we could complete the outside work. In August of 1980, we applied for and were denied the temporary Certificate of Occupancy by the Building Inspector, because we could find no written record of the statements made at the aforementioned Planning Board meeting to substantiate our request. Mr. Fisher, the Chief Building Inspector, said that he would issue a temporary Certificate of Occupancy with Planning Board concurrence. Gentlemen: I ann hereby requesting your consideration of a problem encounted when attempting to obtain temporary certificate of occupanc¢ for thc: qubject premises, based on a hardship. At a special meeting of the Southold Town Planning Board, on April 21, 1980, approval of the site for the subject addition was granted, subiect to a one year review. This site plan indicated off-street parking in accordance with the zoning code of the Town of Southold. The Library Board agreed to the off-street parking as shown on the site plan although they felt that some other reasonable alternative, at a much lower cost, could be pro- posed and approved. Further, they did agree to the site plan as; presented to the Planning Board witha stipulatio~ at the meeting that they would be given a reasonable amount of time, one year, to either get approval of an alternate or complete a parl~ing lot in accordance with the site plans. Although, this was not stated in the mi~nutes of the meeting of the Planning Board, it had been verbally agreed to by the Planmng Board, and the implication of-approval was there, and, probably tape recorded. During ire planning stages of this project, an effort to obtain Federal Funds for the removal of Barriers for the handicapped was in progress. This program would also provide the necessary parking in compliance with lhe law. These plans were integrated into the total project plan, both in anticipated product and funding. Early in August, knowing that the Federal Funds were to be delayed, I broached the idea of a temporary Certificate of Occupancy with Mr. Oeorge Fisher. At that time, he had agreed that if tbe building was in compliance with the code and the lmlannlng Board, he would issue a temporary Certificate of Occupancy. We have both these elements. On August 21, 1980, on behalf of the Library Board, I made application for a temporary Certificate of Occupancy because the parking lot was . not completed. The Library did not h~ve the funds for this improve- ment. They were depending on a portlon of the funds for this parking lot to be forthcoming from Federal Funds allocated from Barrier Removal for the handicapped. The feasibility ~tudy made by Sills and Company on ]Barrier Removal included the required driveway and two parking spaces designed for the handicapped, as well as a walk. This would defray one-third of the cost of parking facility, which would greatly reduce the remaining burden to be carried by the Library. On August Z6, 1980, a notice of disapproval of application waz issued by Mr. Edward Hindermann, B,uilding~and Housing inspector, town of Southold. The reason for dlsapproval;was "Certificate of Occ~ti~ancy is denied until final site plan approval is given". Several lettez'~'~ passed, (see enclosur~sl. Article Xlll, Section 100-144 of the Town Zoning Code does not preclude the issuance of a temporary Certificate of Occupancy. We do in fact have an approved site plan with the difference being that all work is n~t completed. The purpose of the temporary Gertificate of Occupancy i~ to alleviate hardship cases such as these. A~n I to infer that the avenue of the temporary Certificate of Occupancy is closed? I,would agree with the Building Inspector if application were being made for a final Certificate of Occupancy. However, the reasou for requesting a Temporary Certificate of Occupancy !s ex,actly as stated above, and well ~vithin the New York State and Town law. if the Building Inspector's Office is concerned about the question of safety, then there is an alternative, I Would s~ggest that we be allowed to u~e the cleared area behind the building as a temporary parking field until lhe money is raised to complete the required parking. It is intended that this will be a sod covered area. I believe, that a request for a temporary Certificate of Occupancy is reasonable, under the circumstknces, i I further believe, this Certificate of Occupancy can be legally iss.t~ed, anid also that the Board of Trustees of the Library would not put the library in jeopardy by no~ complying ~vith any regulation or limitation. I believe that the Library ~vill comply without reservation to any reasonable stipulation made by the Building Inspector's office, so that they may be allowed to use the bailding. This situation has caused considerable impact in terms of non-productiw' work on my part, on the part of the Library Board, and the Town Dep-~rt- ments involved, it seems like a considerable waste of time to say nothJn~ about the fact that a Community facility is standing dormant. hereby request your consideration, in taking some action, so that we be allowed to use the library building. Dear Mr. Raynor: The following is a reply to the comments made by the Building Inspector with regard to the referenced site plan. Regarding the off-street parking, the code article X1 section 110-112, under Places of !~rorship, libraries, and other public buildings; "At lease one (1) space for each 200 square feet of floor area, but not less than one (1) for each five (5) where provided". The parking is to be computed on the basis of floor area. The floor area computation as shown on the site plan indicates nineteen (19) spaces required. Access (Section 100-112D) is a single lane only for nineteen (19) spaces. However, we will go along with the twenty (20) foot drive- way. Parking lot drainage pond fencing is not a requirement as indicated by the Building Inspector. He sight s the "Subdivision Regulations". This project can not be classified as a subdivision, therefore, this section of the zoning code does not apply. Further, this pond as stated in a previous communication is a misnomer and its size precludes it from the definition of a recharge basin. -Z- Aprilll, 1980 Mr. H. Raynor This natural drainage system was designed to be harmonious with the surrounding woods. This harmony would be destroyed if this pond were to be fenced in. Further, it is anticipated that up to two (2) inches of rain will be contained by the leaching pool never seeing the pond. Also, the percolation rate of the soil in this area is very high. A test hole indicates that sandy loam exists one (1) foot below the surface. At three (3) feet, the soil is sand and gravel. Since the rainfall must exceed three (3) inches in twenty four (24) hours (drywell and leaching) and it is expected that any standing water (up to 6" of rainfall) will percolate into the ground within three (3) hours after the rain stops. I see no need for fencing, iViay I also point out that there are many such drainage areas both natural and man-made. 5 Regarding the handicapped, we have assumed these provisions even though they are not specifically stated on the site plan. We agree to make these provisions. For your information~ separate funds under a Federal Grant have been allocated to make these and other improvements necessary to accomodate our handicapped. This project has been in the works for many months with several meetings with the building inspector's office. Contractors have been selected based on anticipated approval. These con- tractors will not hold these prices for long. Any further delays will cause an untenable financial burden to the extent that the project may have to be scrapped for now. Path of travel shall be planned so that the physically handicapped need not walk or wheel behind other parked cars and that path of travel within parking area is at minimum. Y. 11971 RE: Mattituck Library Addition Site Plan Gentlemen: I am in receipt of the comments made by Mr. John W. Davis in regard to the referenced project and feel that in general all the points are well taken. I intended to adjust the grade of the parking area to prevent run-in. I also will specify a splash pan (black top or concrete) in lieu of a head wall. Regarding the fencing, although it is generally sound engineering to pro- vide for this protection, in a large sump, I felt that in this case it is not necessary. The pond is to be dug to a depth of only two (2) feet. Also, "pond" is a misnomber since it is intended that this device will not hold water for any period of time. Since this water will only be present dur- ing a very heavy rain, it is doubtful that any people will be in the vicinity obviating the danger. On the other hand, if we place such a criteria on all water holes, then all our ponds and lakes should be fenced in. Plandated 3y5/80 COMMENTS: The drainage design for the paved parking area (6000 S.F.) is based on 6" of rain (assumed in 24 hrs.) with 100% runoff of 3000 C.F. to a 628 C.F. drywell connected by pipe to a containment pond shown as 2400 C.i This will take care of the paved parking area provided the pond bottom is in sand and gravel at the 2 ft. depth. The pond size (Notes 10 and 113 at 25 ft. x 20 ft. x 2 ft. with side slopes 2/1 can hold approximately 1100 C.F. An eliptical pond would have less capacity. With the pond bottom in sand and gravel, infiltration of 1300 C.F. should occur within 24 hours and the design would be effective. The designer may have investigated the soil conditions as to depth of sand and gravel. If not, I would recommend carrying the pond excavation to infiltration material and backfill with sand to the 2 ft. depth. The parking area should be constructed at graded elevations that will prevent runoff from adjacent areas entering same. Trees will have to be removed for the pond excavation.
