RESOLVED, that the improvements as inspected by Chairman
Goehringer and Member Dinizio, to the existing right-of-way
extending from Westphalia Road to the premises of the applicant,
Thomas Perillo, (1000-114-1-7, BE AND HEREBY ARE APPROVED AND
ACCEPTED TO BE IN COMPLIANCE with this Board's decision,

On July 7, 1985, your office provided us with a copy of Suffolk County
Department of Planning's letter to you dated June 7, 1985, setting forth
their resolution to disapprove the above "minor subdivision", I am, once
again, appalled at Suffolk County's uncompromising attitude in connection
with matter~ given in-depth attention and consideration by the Town of
Southold.
We respectfully request that, based upon the carefully deliberated deci-
sions of both the Southold Town Zoning Board of Appeals on 2/14/85 and
the Southold Town Planning Board on 4/1/85, amended 5/6/85, the Planning
Board override the County's disapproval.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on June 5,
1985, reviewed the proposed subdivision plat entitled, '~inor Subdivision -
Thomas Perillo", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to disapprove said map
for the following reason:
Creation of a subdivision with substandard lots, that is, lots whose areas
are considered less than the minimum required by the zoning classification of
the property, constitutes an overintensification of land use in a groundwater
sensitive area in what is meant to be a low density area. Such action could
establish a precedence for future subdivision of this kind which would essen-
tially be a circumvention of the Town Board's action taken over the past years
to upzone these groundwater sensitive areas. The Commission feels that the Town
Planning Board should have the prerogative to review this type of application
rather than it being left to the sole discretion of the Zoning Board of Appeals.

on survey map dated May 30, 1984 as vacant property of a total of

3. Article III, Section lO0-31, and Bulk Schedule of the Zoning
Code, requires a minimum area of 80,000 sq. ft. and minimum lot width
of 175 feet for each proposed parcel of land established subsequent
to June 10, 1983 (date effectuated);
4. Parcel #1 is proposed to be 1.5323 acres (66,746± sq. ft.)
consisting of Part of Lot 19, and 20 of a former 1916 subdivision

of "Point Pleasant," having frontage along Home Pike Road of 144.20±
feet and an average lot width of 248.10 feet, with frontage along
Darby's Branch of Mattituck Creek of 352± feet (along a tie line).
5. Parcel #2 is proposed to be 1.6651 acres (72,531 sq. ft.)
consisting of Lots 17, 18, and part of 19 of the former subdivision
of 1916 of "Point Pleasant," and having frontage along Home Pike Road
of 80± feet and an average lot width of 150+ feet with frontage along
Darby's Branch of Mattituck Creek of 260± feet (see survey dated
May 30, 1984).
6. In viewing the area, the board finds: (a) the neighboring
parcels to the west to be of a size similar or smaller than that
proposed by this application, varying from 44,000 sq. ft. and greater
for area, and from 80' lot width and greater; (b) the relief
is the minimal available under the circumstances.
7. The right-of-way in question is private and is pending
acceptance by this board as to anticipated improvements in accordance
with the September 30, 1982 decision of this board under Appeal
No. 3025, pursuant to New York Town Law, Section 280-A.
In considering this appeal, the board also finds:
1. That the relief requested is minimal;
2. That this proposal is consistent with those
existing in the surrounding neighborhood;
3. That there will be no effect on population

BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:///''
1. That there be no further lot size reductions (no further
division);
2. New York Town Law, Section 280-A, concerning conditions as
imposed by this board involving the subject right-of-ways, extending
from Westphalia Road and along premises of the applicant, as follows:
(a) Commencing from Westphalia Road and extending along
the premises in question: [1] a minimum width of 15 feet and [2]
such minimum 15-foot width shall be surfaced with a minimum depth
of two inches of packed three-quarter-inch stone blend so as to
afford access for emergency vehicles. Such stone blend may be
either applied to the ground surface and shaped, or the surface
may be excavated to permit the application of packed blend to a
depth of two inches;
(b) Commencing from Silkworth Road and extending along
the premises in question: [1] a minimum width of 15 feet and [2]
such minimum 15-foot width shall be surfaced with a minimum depth
of four inches of packed three-quarter-inch stone blend so as to
afford access for emergency vehicles. Such stone blend may be
either applied to the ground surface and shaped, or the surface

(e) That this access road be approved, after notification,
by the Board of Appeals as to meeting the above requirements.

Comments:
The Health Department's primary environmental concern
pertaining to development is that the applicant comply with
the requirements of the Suffolk County Sanitary Code especially
Article V and VI, and relevant construction standards for
water supply and sanitary sewage disposal. These considerations
are to be reviewed completely at the time of application, Full
consideration in placement of water supply wells and disposal
systems is given to state and town wetland requirements. The
Health Department maintains jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval.
Other portions of the Suffolk County Sanitary Code also
apply to co~nerciaI development such as Article XII, The
