The following action was taken by the Southold Town Planning Board,
Wednesday, August 18, 1982.
RESOLVED that the Southold Town Planning Board approve a set-off
106-13 as designated on the subdivision map of Charles P. Ziegler,
located at Mattituck subject to the fOllowing conditions:
1. Completion of the State Environmental Quality
Review Act
2. Approval from the Zoning Board of Appeals
3. Applicant receiving permits from the New York
State Department of Environmental Conservation.
Upon receipt of three copies of the final map and the above conditions
being met, the chairman will endorse his approval on said maps; two
copies will be returned to your office for your files.

The public hearing on this application was held on September 9, 1982.
Upon application of CHARLES P. ZIEGLER by Gary Flanner Olsen, Esq.,
Main Road, Mattituck, NY for a Variance to the Zoning Ordinance, Article
II, Section 100-23(C) and Article III, Sections 100-30 and 100-31, Bulk
Schedule, for permission to locate buildings with insufficient setbacks
as exist on the premises due to the proposed location of the subdivision
lines and for permission to retain garage use of building on Lot No.2,
and for a Variance for Approval of Access, New York Town Law, Section
280-A. Location of Property: Home Pike Road, Mattituck, NY; Subdivision
Los No. 12, 13 and 14 as shown on Map of Point Pleasant No. 270; Suffolk
County Tax Map Parcel No. 1000-114-1-5.
The board made the following findings and determination:
By this appeal, appellant seeks: (a) permission to divide the
entire 3.5-acre parcel into two parcels, Parcell having an area of
89,000+- square feet with a road frontage of 121.14 feet, and Parcel 2
having an area of 44,000+- square feet with a road frontage of 80 feet
(radius); and (b) approval of access over private roads known as
Home Pike Road, extending 519 feet over Silkworth Road, and extending
further approximately 499 feet to Westphalia Road. The access roads
in question are shown to have a minimum width of 30 feet. Existing on
the land in question is a large one-family house on Parcel 1 and a
garage structure in disrepair on Parcel 2 set back 12 feet from the
southerly sideyard line and slightly forward of the front of the
house on Parcell. The premises in question front along Mattituck
Creek and approvals have been obtained from the N.Y.S. Department of
Environmental Conservation under Permit No. 10-82-0185.
For the record, it is noted that the Southold Town Planning Board
has approved this subdivision as a "set-off" pursuant to Section 106-13
of the Code on August 18, 1982.
It is the opinion of the board that to deny the relief requested
would result in practical difficulties to the applicant in that: (a)
there is more than 40,000 square feet of land area upplied to each
parcel and without a frontage variance, a division would not be
possible; (b) the structure on Parcel 2 is existing and is located
with reasonable setbacks from all property lines, and without this
variance, the building would have to be removed; (c) this access is
the only way feasible to this property, and is also utilized for access
to other parcels along this route.

In considering this appeal, the board determines that the variances
requested are not substantial; that the circumstances herein are unique
and practical difficulties have been shown; that by allowing the vari-
ances no substantial detriment to adjoining properties would be created;
that the difficulty cannot be obviated by a method feasible to appellant
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that
the relief requested will be in harmony with and promote the general
purposes of z"Oniilg; and that the interests of justice will be served by
allowing the variances requested, as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was
RESOLVED, that Appeal No. 3025, application of CHARLES P. ZIEGLER
be and hereby is APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the building existing on Parcel 2 at the time of this
determination and as shown on the Amended Map of 8/31/82 shall not be
considered a principal structure or dwelling. In the event that at
any time in the future this building on Parcel 2 is to be used, reno-
vated or occupied as a principal building, the same must be moved so
as to conform with all front, side and rear yard requirements of the
code for principal buildings.
2. That no sideyard variances shall be granted for any dwelling
erected on either of these two parcels.
3. That the access roads to these parcels shall be improved in
the following methods:
(al Commencing from Westphalia Road and extending approxi-
mately 499 feet along Silkworth Road: [1] a minimum width of fifteen
feet and [2] such minimum l5-foot width shall be surfaced with a
minimum depth of two inches of packed three-quarter-inch stone blend
so as to afford access for emergency vehicles. Svch stone blend may
be either applied to the ground surface and shaped, or the surface may
be excavated to permit the application of packed blend to a depth of
two inches;
(bl Commencing from Silkworth Road and extending approxi-
mately 519 feet along Home Pike Road: [1] a minimum width of fifteen
feet and [2] such minimum l5-foot width shall be surfaced with a
minimum depth of four inches of packed three-quarter-inch stone blend
so as to afford access for emergency vehicles. Such stone blend may
be either applied to the ground surface and shaped, or the surface may
be excavated to permit the application of packed blend to a depth of
four inches;
4. Where the terrain of the land over which such access roads
are traversed is such that drainage problems may occur, the applicant
and/or owners shall be required to construct such drainage facilities
as may be recommended by the Town road engineer;
5. That this access road must be maintained at all times in good
satisfactory condition as stipulated above for access by emergency
vehciles;
6. That this access road be approved by the Board of Appeals or
Town road engineer as to meeting the above requirements;
7. That this variance is subject to referral to the Suffolk
County Planning Commission pursuant to Sections 1323, et seq. of the
Suffolk County Charter;

8. That this variance is subject to approvals from the N.Y.S.
Department of Environmental Conservation and the Southold Town
Planning Board;
9. That no certificate of occupancy shall be issued for these
premises or for the construction of any buildings or structures, or
for existing buildings or structures on these premises, to which
this access is referred until all of the conditions set forth herein
have been complied witb.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of SouthOld, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Charles P. Ziegler, is a two lot
subdivision located at Mattituck.
The project has been determined not to have a significant
effect on the environment for the fOllowing reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The Suffolk County Department has indicated they have
no objection with the lead agency designation. How-
ever, the water supply may be limited due to salt
water incursion.
Because there has been no response in the allotted
time from the New York State Department of Environ-
mental Conservation it is assumed that there is no
objection nor comments by 'that agency. Applicant
should be aware that a permit may be required because
of the proximity to the wetlands.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

GENERAL CONDITIONS
1. The permittee shall file in the office of the appropriate Regional
Permit Administrator, a notice of intention to commence work at least 48
hours in advance of the time of commencement and shall also notify him
promptly in writing of the completion of the work.
2. The permitted work shall be subject to inspection by an authorized
representative of the Department of Environmental Conservation who may
order the work suspended if the public interest so requires.
3. As a condition of the issuance of this permit, the applicant has ac-
cepted expressly, by the execution of the application, the full legal respon-
sibility for all damages, direct or indirect, of whatever nature, and by whom-
ever suffered. arising out of the project described herein and has agreed to
indemnity and save harmless the State from suits, actions, damages and
costs of every name and description resulting from the said project.
4. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the waterway or flood plain or deep holes that may have a tendency to
cause injury to navigable channels or to the banks of the waterway.
5. Any material to be deposited or dumped under this permit, either in
Ihe waterway or on shore above high-water mark, shall be deposited or dumped
at the locality shown on the drawing hereto attached, and, if so prescribed
thereon, within or behind a good and substantial bulkhead or bulkheads, such
as will prevent escape of Ihe material into the waterway.
6. There shall be no unreasonable interference with navigation by the
work herein authorized.
7. That if future operations by the State of New York require an alteration
in the position of the structure or work herein authorized, or if, in the opinion
of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flooc1 flows or endanger
the health, safety or welfare of the people of the State, or loss or" destruction
of the natural resources of the State, the owner may be ordered by the Depart-
ment to remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State; and if, upon the expiration or revocation
of this permit, the structure, fill, excavation, or other modification of the
watercourse hereby authorized shall not be completed, the owners shall,
without expense to the Slale, and to such extent and in such time and manner
as the Department of Environmental Conservation may require. remove all or
any portion of the uncompleted structure or fill and restore to its former
condition the navigable and flood capaCity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or
alteration.

8. That the State of New York shall in no case be liable for any di1mage
or injury to the structure or work herein authorized which may be caused by lIr
result from future operations undertaken by the State for the consNvatiQn or
improvement of navigation, or for other purposes, and no claim or right 10
compensation shall accrue from any such damage.
9. That if the display of lights and signals on any work hereby authmize,j
