Board, Monday, April 14, 1986.
RESOLVED that the Southold Town Planning Board override
the resolution of denial from the Suffolk County Planning Commission
with regard to the minor subdivision of John and Dorothy Moeller
located at Home Pike Road, Mattituck. The reasons for overriding
this decision are indicated in the March 31 memorandum from
the Executive Administrator of the Town.

I have reviewed the Suffolk County Planning Commission's
resolution regarding the above mentioned subdivision.
The Suffolk County Planning Commission denied this subdivision
because the lots will not have frontage on an existing or
proposed public road. With respect to this reasoning, the
following is offered for your information.
All of the adjoining lots, which front on Home Pike Road,
a private road, have certificates of occupancy. This road
was approved and accepted and is utilized for access to
other parcels.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on February
5, 1986, reviewed the proposed subdivision plat, entitled, "Minor Subdivision-
John W. Moller and Dorothy Moller", referred to it pursuant to Section 1333 of
the Suffolk County Charter. After due study and deliberation it resolved to
disapprove said map for the following reason:
The proposed subdivision will result in the creation of two
landlocked parcels; that is, parcels that do not have frontage on an
existing or proposed public road. The creation of such lots is
contrary to good subdivision layout principles and creates problems
as far as access by emergency and service equipment is concerned;
this could result in health, safety and welfare problems for the
future residents of these lots. Creation of landlocked lots also
places the Zoning Board of Appeals in the awkward position of having
to grant a building permit for each of these lots under Section
280-a of the Town Law as the future owners of these lots cannot be
held responsible for the landlocked nature of the parcels.

The public hearing on this application was held on September 9, 1982.
Upon application of CHARLES P. ZIEGLER by Gary Flanner Olsen, Esq.,
Main Road, Mattituck, NY for a Variance to the Zoning Ordinance, Article
II, Section 100-23(C) and Article III, Sections 100-30 and 100-31, Bulk
Schedule, for permission to locate buildings with insufficient setbacks
as exist on the premises due to the proposed location of the subdivision
lines and for permission to retain garage use of building on Lot No.2,
and for a Variance for Approval of Access, New York Town Law, Section
280-A. Location of Property: Home pike Road, Mattituck, NY; Subdivision
Los No. 12, 13 and 14 as shown on Map of Point Pleasant No. 270; Suffolk
County Tax Map Parcel No. 1000-114-1-5.
The board made the following findings and determination:
By this appeal, appellant seeks: (a) permission to divide the
entire 3.5-acre parcel into two parcels, Parcell having an area of
89,000+- square feet with a road frontage of 121.14 feet, and Parcel 2
having an area of 44,000+- square feet with a road frontage of 80 feet
(radius); and (b) approval of access over private roads known as
Home Pike Road, extending 519 feet over Silkworth Road, and extending
further approximately 499 feet to Westphalia Road. The access roads
in question are shown to have a minimum width of 30 feet. Existing on
the land in question is a large one-family house on Parcel 1 and a
garage structure in disrepair on Parcel 2 set back 12 feet from the
southerly sideyard line and slightly forward of the front of the
house on Parcell. The premises in question front along Mattituck
Creek and approvals have been obtained from the N.Y.S. Department of
Environmental Conservation under Permit No. 10-82-0185.
For the record, it is noted that the Southold Town Planning Board
has approved this subdivision as a "set-off" pursuant to Section 106-13
of the Code on August 18, 1982.
It is the opinion of the board that to deny the relief requested
would result in practical difficulties to the applicant in that: (a)
there is more than 40,000 square feet of land area upplied to each
parcel and without a frontage variance, a division would not be
possible; (b) the structure on Parcel 2 is existing and is located
with reasonable setbacks from all property lines, and without this
variance, the building would have to be removed; (c) this access is
the only way feasible to this property, and is also utilized for access
to other parcels along this route.

In considering this appeal, the board determines that the variances
requested are not substantial; that the circumstances herein are unique
and practical difficulties have been shown; that by allowing the vari-
ances no substantial detriment to adjoining properties would be created;
that the difficulty cannot be obviated by a method feasible to appellant
other than a variance; that no adverse effects will be produced on
available governmental facilities of any increased population; that
the relief requested will be in harmony with and promote the general
purposes'of ~oning; and that the interests of justice will be served by
allowing the variances requested, as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was
RESOLVED, that Appeal No. 3025, application of CHARLES P. ZIEGLER
be and hereby is APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the building existing on Parcel 2 at the time of this
determination and as shown on the Amended Map of 8/31/82 shall not be
considered a principal structure or dwelling. In the event that at
any time in the future this building on Parcel 2 is to be used, reno-
vated or occupied as a principal building, the same must be moved so
as to conform with all front, side and rear yard requirements of the
code for principal buildings.
2. That no sideyard variances shall be granted for any dwelling
erected on either of these two parcels.
3. That the access roads to these parcels shall be improved in
the following methods:
(a) Commencing from Westphalia Road and extending approxi-
mately 499 feet along Silkworth Road: [1] a minimum width of fifteen
feet and [2] such minimum IS-foot width shall be surfaced with a
minimum depth of two inches of packed three-quarter-inch stone blend
so as to afford access for emergency vehicles. S~ch stone blend may
be either applied to the ground surface and shaped, or the surface may
be excavated to permit the application of packed blend to a depth of
two inches;
(b) Commencing from Silkworth Road and extending approxi-
mately 519 feet along Home Pike Road: [1] a minimum width of fifteen
feet and [2] such minimum IS-foot width shall be surfaced with a
minimum depth of four inches of packed three-quarter-inch stone blend
so as to afford access for emergency vehicles. Such stone blend may
be either applied to the ground surface and shaped, or the surface may
be excavated to permit the application of packed blend to a depth of
four inches;
4. Where the terrain of the land over which such access roads
are traversed is such that drainage problems may occur, the applicant
and/or owners shall be required to construct such drainage facilities
as may be recommended by the Town road engineer;
5. That this access road must be maintained at all times in good
satisfactory condition as stipulated above for access by emergency
vehciles;
6. That this access road be approved by the Board of Appeals or
Town road engineer as to meeting the above requirements;
7. That this variance is subject to referral to the Suffolk
County Planning Commission pursuant to Sections 1323, et seq. of the
Suffolk County Charter;

The Southold Town Board at their August 28, 1984 meeting adopted the follow-
ing resolution granting the Moller relief petition:
WHEREAS, Victoria Helen Moller, as Executor of the Estate of John W.
Moller, by petition dated March 7, 1984, applied to the Southold Town
Board for relief from the Bulk requirements of the Zoning Code with
regard to a proposed minor subdivision to be known as "Minor Sub-
division of John W. Moller and Dorothy Moller," shown as Plots 4, 5,
6 and 7 on Map of Point Pleasant, Mattituck, New York, and
WHEREAS, said petition was referred to the Southold Town Planning
Board and Suffolk County Department of Planning for their recommenda-
tions, and
WHEREAS, a public hearing was held by the Southold Town Board on
said petition on the 14th day of August, 1984, at which time all
interested persons were given an opportunity to be heard thereon,
now, therefore, be it
RESOLVED that Victoria Helen Moller, as Executor of the Estate of
John W. Moller, be Granted relief from the Bulk requirements of the
Zoning Code as provided in Local Law No. 11 - 1983, with regard to
minor subdivision to be known as "Minor Subdivision of John W. Moller
and Dorothy Moller," and be it further
RESOLVED that the premises described in said petition shall be subject
to the Bulk requirements of the Southold Town Zoning Code in effect
prior to May 20, 1983.

Dear Judy;
I have reviewed the documents which you sent me relative to the
above petition for rei ief pursuant to Section 100- 31. 1 B (1) of the
Zoning Code.
The application to the Planning Board for subdivision map approval
and a letter of transmittal thereof to the Planning Board is dated
March 14, 1983, six days prior to the deadline date of March 20,
1983. In view of the fact that the application was dated six days
prior to the deadline, a question arises as to whether or not the
application was actually filed with the Planning Board prior to March
20, 1983. I would assume that the records of the Planning Board
would indicate the date that the subdivision map application was
received by the Planning Board. It is the normal procedure that such
appl ications have a stamp indicating the date received. FOI' these
reasons, I am unable to advise the Board on the question of whether
or not the petition complies with the provisions of the Zoning Code. I
would suggest that the matter be referred to the Planning Board in
order for it to determine the question of whether or not the
subdivision application dated March 14, 1983, was in fact filed with
the Planning Board prior to March 20, 1983.

TO: THE TOWN BOARD OF THE TOWN OF SOUTHOLD
It is respectfully alleged as follows:
1. Your Petitioner resides at Westphalia Road, Mattituck,
New York, and is one of the Executors under the Last Will and
Testament of John W. Moller, deceased, lately domiciled in
Mattituck, Town of Southold, Suffolk County, New York.
2. On March 14, 1983, your Petitioner's predecessors in
title, John W. Moller and Dorothy Moller, submitted an applica-
tion for approval of a minor subdivision to be known as "Minor
Subdivision for John W. Moller and Dorothy Moller" to the
Southold Town Planning Board. Accompanying this application
were: a short Environmental Assessment Form dated March 13,
1983; six (6) prints of "Minor Subdivision Plan for John W.
Moller and Dorothy Moller" prepared by Young & Young dated
January 25, 1983; and a check payable to the Town of Southold
Planning Board in the amount of $50.00 to cover the required
filing fee. A copy of the foregoing application and allied
papers is attached hereto as Exhibit A. The whole purpose of the

application was to divide the property in half so that one of the
children, Dorothy Raynor, could build a home on the vacant lot of
60,726 square feet. The remaining parcel of 57,888 square feet
would then be used by John W. Moller and Dorothy Moller during
their life and upon their death would be turned over to the
remaining children.
3. Upon information and belief, the Planning Board of the
Town of Southold after receiving the aforesaid application, re-
viewed the application but never scheduled any conferences or
otherwise moved with respect to said application; except that
over three months later on June 30, 1984, Henry E. Raynor,
Chairman of the Planning Board, sent petitioner's attorney a
letter stating the application for a minor subdivision would not
receive Planning Board approval because the two proposed lots
were less than 80,000 square feet. A copy of the letter is
attached hereto as Exhibit B.
4. Dorothy Moller, one of the original applicants for the
minor subdivision died on March 17, 1983, leaving a Last will and
Testament wherein everything was left to her husband, John W.
Moller. Your Petitioner was appointed as one of the Executors of
the Estate of Dorothy Moller by the Surrogate's Court of Suffolk
County on May 5, 1983. ,John W. Moller died on August 21, 1983,
leaving a Last will and Testament leaving the aforementioned pro-
perty to his three children, John W. Moller, Jr., victoria Helen
Moller and Dorothy Raynor. Your Petitioner was appointed as one

of the Executors of the Estate of John W. Moller by the
Surrogate's Court of Suffolk County on September 27, 1983.
(Copies of the Letters Testamentary dated May 5, 1983, and
September 27, 1983, are attached hereto as Exhibit C).
5. Your petitioner investigated this matter during July and
August, 1983, and was informed by the Southold Town Planning
Board secretary, Susan E. Long, that the Planning Board would not
entertain any further application regarding this subdivision
unless the Town Board of the Town of Southold granted appropriate
relief by the enactment of a Local Law authorizing the Planning
Board to proceed. Thereafter, Local Law No. 11-1983 providing
relief from the Bulk and Parking Requirements of the Zoning
Ordinance was adopted by the Town Board of the Town of Southold
effective October 11, 1983.
6. The Estate of John W. Moller complies with the purposes
of Local Law No. 11-1983 due to the fact the completed subdi-
vision application was presented to the Southold Town Planning
Board prior to May 20, 1983. Your petitioner's predecessors in
title, John W. Moller and Dorothy Moller, expended considerable
time and money in the preparation and planning of the proposed
subdivision which was in compliance with the zoning requirements
in effect prior to May 20, 1983, having expended the sum of
$850.00 to Young & Young on January 26, 1983, for the required
minor subdivision plan and the sum of $350.00 to attorney
Richard F. Lark, for the required legal work to prepare and file

the necessary application. Attached hereto as Exhibit D are the
statement of Young & Young dated January 26, 1983, and the state-
ment of Richard F. Lark, Esq. dated March 24, 1983.
7. As it was at the time of original presentation to the
Planning Board, the proposed minor subdivision map will be in
keeping with this established residential neighborhood. The
granting of the requested relief will enable your petitioner to
make a proper distribution of the estate to carry out the wishes
of John W. Moller and Dorothy Moller.
It is intended that pro-
posed Parcel 2 will be transferred to Dorothy Raynor, one of the
heirs, and Parcell will be transferred to victoria Helen Moller
and John W. Moller, Jr., the other heirs of the estate.
It is
not contemplated the property will be sold to third persons
8. The property affected by the petition is described as
follows:
ALL that certain plot, piece or parcel of land,
with the buildings and improvements thereon erected,
situate, lying and being in Mattituck, Town of
Southold, County of Suffolk and State of New York,
being shown as Plots 4, 5, 6, and 7 on Map of Point
Pleasant, dated April, 1916, Franklin Overton, Sur-
veyor, and filed in the Suffolk County Clerk's Office,
Riverhead, New York, as Map No. 720, and being more
particularly bounded and described as follows:
BEGINNING at a point at the southeasterly corner
of the premises herein which point of beginning is
153+ from the intersection of the easterly side of
a private road known as "Silkworth Road" and the
northerly side of a private road known as "Home
Pike"; running from said point of beginning along
the easterly line of Lot No. 3 on the Map of Point
Pleasant North 10 55' West 380.21 feet to the
approximate high water mark of Howard's Branch of
Mattituck Creek; running thence along the approximate

on a tie line the following six (6) courses and dis-
tances: (1) North 760 13' 40" East 48.16 feet; (2)

feet; (5) North 890 06' 30" East 102.98 feet; and
(6) South 740 39' 35" East 55.11 feet to the westerly

29' 30" West 413.40 feet to the northerly side of the
private road known as "Home Pike"; thence along the
northerly side of the private road known as "Home pike"
the following two (2) courses and distances: (1) South
830 16' West 102.00 feet; and (2) South 830 16' West
101.00 feet to the easterly line of Lot No. 3 on the
Map of Point Pleasant and the point or place of BEGINNING.

buildings and improvements thereon erected, situate, lying
and being in Mattituck, Town of Southold, County of Suffolk
and State of New York, being shown as Plots 4, 5, 6, and 7
on Map of Point Pleasant, dated April, 1916, Franklin
Overton, Surveyor, and filed in Suffolk County Clerk's
Office, Riverhead, New York as Map No. 720, and being more
particularly bounded and described as follows:
BEGINNING at a point at the southeasterly corner of the
premises herein which point of beginning is 153! from the
intersection of the easterly side of a private road known
as "Silkworth Road" and the northerly side of a private
road known as "Home Pike"; running from said point of
beginning along the easterly line of Lot No. 3 on the
Map of Point Pleasant North 10 55' West 380.21 feet to
the approximate high water mark of Howard's Branch of
Mattituck Creek; running thence along the approximate high
