Dear Ms. Wickham:
The following took place at a meeting of the Southold Town Planning Board
on Monday, November 3, 1997:
The final public hearing, which was held at 7:30 p.m. was closed.
The following resolution was adopted:
WHEREAS, Sallie W. Wells is the owner of the property known and designated
as SCTM# 1000-113-13-1 and James and Mary Ellen Ruhf are thu ¢,wner$ of the
property known and designated as SCTM# 1000-113-13-2 Ioof!ted o;~ tiie .~?~uth
side of Westphalia Rd., approximately 24 feet west of the ir'~te[seciicm with
Bennett's Pond Lane and Westphalia Rd. in Mattituck; and
WHEREAS, this proposed lot line change is to subtract 0.3'1 acres fi ,:,[i ~ ;:~'
existing 17.88 acre parcel, and to add it to an existing 0.87 acre parcel; and
WHEREAS, the Southoid Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on October 6, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and

WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on November 3, 1997; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated January 24, 1997, and authorize the Chairman to
endorse the final surveys subject to fulfillment of the following condition. All
conditions must be met within six (6) months of the date of this resolution:
The filing of new deeds reflecting the lot line change. Copies of the
recorded deeds must be submitted to this office.

transfer a strip of property at the northeast corner of the
property measuring 55.90 feet along Westphalia Road and
241.00 feet in depth, to my neighbors to the East, James
Ruhf and Mary Ellen Ruhf.
I am making this conveyance in consideration of the
friendship and care they have shown me as neighbors over the

We have been asked by the gentleman purchasing the
Sallie Wells property to have the surveys redone to
eliminate the three notations on the map as to removal of
the existing residence, abandonment of existing cesspools,
and sanitary facilities for new structures.
These notations should not have appeared on the map
because the existing residence and cesspools will continue
to be used. Since the map does show new structures, that
notation is irrelevant.
Accordingly, we have had the notations removed and ask
that your approval be modified to reflect the enclosed maps
dated 1/24/97 revised 1/16/98. We enclose eight copies of
the map.
We are anticipating a closing within the next few days,
at which time the required deeds will be recorded. Copies
will thereafter be delivered to you to comply with your six
month condition.

Abigail Wickham: Good evening. My name is Abigail Wickham. I'm here on
behalf of Mrs. Wells, the owner of the property. These are your affidavits of
posting and publication. This is a fairly simple application and I won't belabor
the Board other than to explain the reason for the request. Mrs. Wells did
decide after many years to sell her property and in consideration of a lot of
extra effort and help on behalf of her neighbors in helping her in her later
years, she and her family did want to give them a strip of property along
their side for a little additional protection and that is the reason for the lot
line change; to keep their property on which the residence is located a little
bit further away from what is, at the present time going to be a horticultural
operation, and down the road we're not sure what could be developed or
whatever, so that's the reason for the application. If you have any questions
I'd be glad to answer them.

This notice is issued pursuant to Part 617 of the implementing regulations
pertaining to Article 8 (State Environmental Quality Review Act) of the
Environmental Law.
The Southold Town Planning Board, as lead agency, has determined that the
proposed action described below will not have a significant effect on the
