Dear Mr. Scheinberg:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, February 4, 1991.
Be it RESOLVED that the Southold Town Planning Board
authorize the Chairman to endorse the final surveys dated
October 12, 1989. This subdivision received conditional final
approval on February 13, 1990. All conditions of approval have
been fulfilled.
Enclosed is a copy of the map which was endorsed by the
Chairman. The mylar maps, which were also endorsed by the
Chairman, must be picked up at this office and filed in the
office of the County Clerk. Any plat not so filed or recorded
within sixty (60) days of the date of final approval, shall
become null and void.
As per Section A106-25 (C) of the Town Code, the Planning
Board must be notified at least two (2) days prior to the
commencement or completion of any work on each stage or
operation of the construction of improvements.
In addition, on November 27, 1990, the Town Board adopted
amendments to Chapter A108, the Highway Specifications, of the
Town Code. In particular, for subdivision servicing 2-4 lots; a
16 foot road, rather than a 20 foot road is required. A copy of
this resolution is enclosed for your assistance.

ACTION OF THE BOARD OF APPEALS
Upon Application of ADAM ASSOCIATES INC. for a Variance
as provided by New York Town Law, Section 280-A for approval of
access for emergency and fire vehicles over a private
right-of-way extending off the easterly side of Cox Neck Road,
Mattituck, in an east-west direction a distance of approximately
616.30 feet. The subject right-of-way is referred to on the
County Tax Maps as part of Parcel No. 1000-113-14-11 and is
situated 670+- feet north of the intersection of C.R. 48 (North
Road)'and Cox Neck Road. The parcels to which access is
requested in this application is identified as County Tax Map
Nos. 1000-113-12-10.1, 10.3, 10.2, 9, 8; (and Parcel No.
1000-113-14-11 restricted for park and recreation area use).
All areas of access are located in the R-80 Residential Zone
District.
WHEREAS, a public hearing was held on January 14, 1993, and
all those who desired to be heard were heard and their testimony
recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. RELIEF REQUESTED. The portion of the right-of-way
premises which is under consideration in this appeal application
extends from the easterly side of Cox Neck Road, Mattituck, in
an easterly direction, 616.33 feet to the beginning of "Adam's
Road," a private road (having received approval by the Southold
Town Planning Board in the Minor Subdivision application for
Adam Associates February 4, 1991). The 616.33 ft. right-of-way
is shown on the Suffolk County Tax Maps as part of lot 11,
District 1000, Section 113, Block 14, and is more particularly

shown in detail on a map prepared by Joseph A. Ingegno, L.S.
dated September 4, 1992.
2. PRESENT CONDITION OF RIGHT-OF-WAY. The condition of
the base of this right-of-way is good and has a present width of
approximately eleven (11) feet. However, the road does need
some minor improvements. There is a curve which needs to be
straightened, and the improved width of the right-of-way should
be widened to 14 feet at its center and have a 16 ft.
unobstructed clearance for sufficient maneuvering and access by
emergency (fire) vehicles and trucks.
3. In considering this application, the Board also finds
and determines:
a) the benefit to the applicant, as weighed against
the detriment to the health, safety, welfare of the community,
is greater, and is not unreasonable or substantial in relation
to the requirements;
b) the benefit sought by the applicant cannot be
achieved by some other method, feasible for applicant to pursue,
other than this request;
c) the relief requested will not have an adverse
effect or impact on the physical or environmental conditions in
the neighborhood or district;
d) the difficulties created are related to the land
and are not personal to the landowner;
e) this application, as conditionally granted, will
not be adverse to the preservation and protection of the
character of the neighborhood and the health, safety, and
welfare of the community.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Dinizio, it was
RESOLVED, to ADOPT the following conditions in this
application as applied under the provisions of New York Town
Law, Section 280-A, concerning access over a private
right-of-way:
1. That the entire right-of-way be improved 14 feet in
width, and have an unobstructed clearance at 16 feet (or more)
from the center point of the right-of-way;

2. That the first 100+- ft. length extending from the east
side of Cox Neck Road be widened from the present 11+- feet to
14 feet for sufficient manueverability by fire and emergency
vehicles;
3. That the remaining length be straightened and pot-holes
filled with a mixture of bankrun and 10am, or stone blend
mixture, or other material as is acceptable by the Chairman of
this Board;
4. That the entire length of' the subject right-of-way
(616+- feet) be improved with the placement of 2" stone blend,
with continuance maintenance and good condition at all times
5. That in widening this right-of-way to 14 feet, very few
trees be removed and only as is necessary; and in the event the
straigh~ning of the curved area in this right-of-way could avoid
the removal of large tree(s), that a map may be submitted by the
applicant locating the subject trees on a sketch for the purpose
of considering a request for a slight change (slight curve).
Any modification for intent to avoid the removal of any large
trees may be approved, in writing, at the discretion of the
Chairman or his appointed representative(s).
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Dinizio, Villa and Wilton. This resolution was duly adopted.

Dear Board Members:
By order of Adam Associates, and for'the account of same, we hereby
establish this Irrevocable Letter of Credit in your favor up to the
aggregate amount of Nineteen Thousand One Hundred Seventy-Two and
50/100 ($19,172.50) U.S. Dollars available by your drafts at sight
accompanied by this Original Letter of Credit said:
A copy of a Resolution of the Town Board, purportedly
certified by the Town Clerk, which indicates:
"Adam Associates has failed to complete all of the roads and
improvements to be completed by Adam Associates with regard to a
minor subdivision map entitled "Adam Associates", approved by the
Planning Board of the Town of Southold, on February 13, 1990,
extended on August 14, 1990, and that as a result of said failure,
there is due and owing an amount equal to the face amount of our
attached draft. We further certify that the amount drawn hereunder
is for the sole purpose of completing those items of improvement
which were to have been completed by Adam Associates."
This Letter of Credit remains in force in Southold, New York and
must be presented for ~ayment by the beneficiary at our counters at
9025 Route 25, Mattituck, New York, not later than July 27, 1994
and all drafts thereunder must be negotiated on or before that
'date. It is a condition of the Letter of Credit that it will
expire July 27, 1994.
Partial drawings under this Letter of Credit are permitted.
Each draft must state that it is "Drawn under Letter of Credit #M-
.93364 of North Fork Bank dated July 27, 1993 and the amount
endorsed on this Letter of Credit.
We hereby agree with the Drawers, endorses and bona fide holders of
drafts drawn under and in compliance with the terms of this Letter
of Credit that such drafts will be duly honored upon presentation
to the drawee.
Except so far as otherwise expressly stated, this credit is subject
to the Uniform Customs and Practice for Documentary Credits (1983

The contractor for the above referenced subdivision has
requested a final inspection of the site for the purpose of
releasing the Bond. As you know, the Highway Specifications were
revised after the bond had been posted for this project. It was
therefore necessary to modify the items listed in the bond
accordingly.

Dear Mr. Ward:
As per your request, I have reviewed the request for a 50 %
reduction in the Bond for the above referenced Subdivision. As
you know, the road construction requirements for this project
were considerably reduced due to the new Highway Specifications.
The revisions to the code were adopted after the Bond was posted
and before the actual construction started.
Additional work and cost estimates also had to be included
in the Bond due to required improvements located within the
existing Right-of-Way that provides access to the property. This
additional work was specified and approved of by a decision from
the Zoning Board of Appeals.
I have reformulated the required bound estimate to coincide
with the changes listed above. To date, the clearing, grubbing,
rough grading and drainage installations have been completed in a
satisfactory manner. The items that have not been completed add
up to slightly less than half of the original Bond total. I
would therefore recommend a 50 % reduction of the original
Bond.

At the ~uggestion of Ms. Melissa Spiro of your Department, ~ am
writing this letter to request a revlew of the following situation.
Adam Associates is currently in the process of having a road
constructed for the recently approved subdivision on Cox Neck Road
'off the North Road in Mattituck. This subdivision was appzoved
with contingency of the construction of a roa~ to permit access to
the two lots within the subdivision. The Town of Southold required
a performance bond in the amount of $36,000 which Adam Associates
had complied with by creating an account at the Mattituck North
Fork Bank in this amount.
At this point considering the economic situation so many
businesses are facing, Adam Associate does not have the funds
available to finance the construction of the road. We have ~ade
every attempt to secure financial support including a request for
a construction loan from tile North Fork Bank and an Insurance
Company, but have failed because land can not be used as
collateral.
- We are turning to the Town of $outhold, which, by the way, I !%ave
lived for many years, for support and assistance. Specifically, we
are requesting that the Town, upon receipt of the completio[~ of
specific work and which would meet with the approval of the Town
Engineer, release funds to compensate the c~n~actor. It is
understood that the $36,000 would be used only for the construct:ion
of the road. As an additional point, it is anticipated that the
current cost of construction will be considerably !ess than ~zhat
wi%ich was pro3ected approximately two years ago.

This situation creates an enormous burden on the membezs/friends of
Adam Associates as we are clearly aware of in our agreement, that
Adam Associates cannot negotiate ~he sell of these properties
without the access road being complete.

and hand, to resolve a situation.

Dear Mr. Scheinberg:
It has come to the Planning Board's attention that the
cross section shown on the approved subdivision map is not in
accordance with the Town Highway Specifications. The Board
stated in their previous correspondence that a 16 foot road,
rather than a 20 foot road is required. It should be noted
however, that the 16 foot road is to be constructed in
accordance with the Highway Specifications, rather than the
cross section shown on the endorsed map.
You should be aware that before building permits can be
issued on either Lots 1, 2 or 3, the lot owners will have to
obtain approval from the Zoning Board of Appeals in order to
improve the roadway between your property and Cox Neck Lane.

Planning Board at a meeting held on Tuesday, February 13, 1990.

The following actions were taken by the Southold Town
Planning Board on Monday, September 11, 1989.
RESOLVED to override the March 3, 1989, Suffolk County
Planning Co~ission report which disapproved the above mentioned
proposal. The Planning Board offered the following reasons in
support of their determination:
The Board has required that a road be built to Town
Standards to provide access to the residential lots;
The cul-de-sac has been revised to have a diameter of
one-hundred (100) feet to provide adequate turnaround
area for ambulances and small fire equipment vehicles.
RESOLVED to adopt the bond estimate dated August 29, 1989
and recommend its approval to the Town Board. The estimate is
for the amount of 48,345.00 dollars, with an inspection fee of
2,900.00 dollars. The Board has eliminated item number 12
(street lights) and added a firewell to the bond estimate.
The Planning Board has referred a copy of the subdivision
map to the Mattituck Fire Commissioner. You will be notified as
to where the firewell must be located. The location of the
firewell must also be marked on the final map.
Upon submission of final maps (2 mylars and 5 paper prints)
with the Health Department approval stamp, the Board will
proceed with their review and will schedule a final public
hearing.

Appeal No. 3843:
Upon application of ADAM ASSOCIATES for a Variance to the
Zoning Ordinance, Article VIII, Section 100-82 for approval of
insufficient lot area and width of proposed Lot No. 4 (which is
located in the LB Zone District) as shown on the subdivision map
pending before the Southold Town Planning Board. Property
location: North Side of C.R. 48, Mattituck, NY; County Tax Map
District 1000, Section 113, Block 12, Lot 10.
WHEREAS, a public was held and concluded on June 29, 1989
in the Matter of the Application of the ADAM ASSOCIATES under
Appeal No. 3843; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and ~are
familiar with the premises in question, its present zoning and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. The subject premises is a described parcel of land
containing a total area of 7.6797 acres with 150.54 ft. frontage
along the north side of County Road 48 and 363.36 ft. frontage
along a private right-of-way (to the north), Hamlet of
Mattituck, Town of Southold, and identified on the Suffolk
County Tax Maps as District 1000, Section 113, Block 12, Lot
10.
2. Under jurisdiction by this Board in this application is
the requested lot area of proposed Lot No. 4 of 56,029 sq. ft.
with the established 150.54 ft. lot width. The remaining
section of the premises is proposed for division into three
other lots which will conform to the minimum lot size
requirement for the R-80 Low-Density Residential Zone District
as follows: (a) Lot #1 consisting of 90,182 sq. ft.;
(b) Lot #2 consisting of 98,275 sq. ft. and (c) Lot #3

Subdivision Map prepared by Peconic Surveyors & Engineers dated

3. Article VIII, Section 100-82 and Bulk Schedule, of the
Zoning Code for this requires a minimum lot area of 80,000 sq.
ft. and 175 ft. width for each newly established parcel in this
Limited Business (LB) Zone District.
4. In considering this application, the Board finds and
determines-.
(a) that the circumstances of this application are
uniquely related to the premises;
(b] that the relief requested is not unreasonable in
light of the circumstances;
(c) that the variance will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience and/or order of the Town;
(d) that although the relief requested is substantial
in relation to the requirements, the grant of the variance will
not create any increase in density since the lots are improved
with residences;
(e) that there is no other method feasible for
appellants to pursue other than a variance;
(f)

The Suffolk County Planning Co~nission at its regular meeting on March 1,
1989, reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Adam Associates" referred to it pursuant to Section A14-24, Article XIV of the
Suffolk County Administrative Code. After due study and deliberation it
resolved to disapprove said map for the following reasons:
The proposed subdivision will result in the creation of landlocked
parcels; that is, parcels that do not have frontage on an existing or
proposed public road. The creation of such lots is contrary to good
subdivision layout principles and creates problems as far as access by
emergency and service equipment is concerned. This lack of access
could result in health, safety and welfare problems for the future
residents of landlocked lots, not to mention potential disputes over
the use and maintenance of any right-of-way over an adjacent parcel
that may be created for the purpose of access.
Creation of landlocked lots also places the"

The Commission also offers the following comments on the map for your use
and consideration:
1. It is suggested that the subdivision be redesigned.
2. Relative to Lot 4
a)
Adequate drainage structures are to be provided to contain on-site
all stormwater runoff resulting from the development and
improvement of this property so that the stormwater will not flow
into Middle Road, a county road.
b)
Ail driveways on Middle Road should make an angle of at least 70°
and preferably 90° with the county road.
o)
Lot 4 should have a turnaround provision, such as a T-shaped
shunt, so that a vehicle leaving a lot will not have to back out
into the traffic stream on the road.
d)
In order to minimize the number of access points on Middle Road
and to insure that there will not be any conflicts between the
points of access that are created, consideration shall be given to
creating a plan indicating the placement of access for parcels
along this road and the parking areas on these lots.
Consideration shall also be given to establishing, through the
creation of easements, common use of access points and parking by
these lots; that is, allowing a vehicle to pass from a parking
area on one lot to another parking area on a lot without the
vehicle having to reenter the road.
The right-of-way in the adjoining subdivision "Heritage Manor" should
be converted to a public road as originally proposed.
The right-of-way proposed over Lots 1, 2 and 3 should be redesigned as
a public road with an offer of dedication to the Town of Southold.
Provision should be made for an ample turnaround for emergency
vehicles.

was previously zoned Business, is now zoned Limited Business
(LB). The lot size under the LB zone must be 80,000 square feet.
The Planning Board can not proceed with the application as
is, Lot ~4 must conform to the Town Code.
Please note also that the proposed road for the residantial
lots must be in accordance with the alternate road
specifications. These specifications require a 20 foot wide
wearing course, not a 16 foot wide pavement as shown on the map
submitted. Road profiles for the 20 foot road must be submitted
for review by the Engineer.

1. This project requires access from Cox Neck Road along
the existing 50 feet right-of-way. A road profile and
drainage plan are required for this road.
2. The plan for the proposed 25 foot right-of-way calls for
a 16 foot wide pavement. The Town's alternate road
specifications require a 20 foot wide wearing course.
Upon receipt of a revised plan showing the necessary
drainage and road width, we will prepare a bond estimate.

The following is a synopsis of our meeting of May 17, 1988.
Adams Associates- Proposed minor subdivision on the N/S of
CR 48, 176.46' E/O Cox Neck Lane, Mattituck SCTM #1000-113-12-10.
After a review of the facts and the correspondence from the
applicant's attorney, it was determined that:
1. The Planning Board could require the applicant to upgrade
the right-of-way in accordance with Town specifications,
e~en though the applicant does not own the right-of-way
p~oper, but merely has right of access over it.
2. The applicant's attorney concedes that her client can be
required to upgrade the right-of-way.
3. The applicant's attorney is incorrect in asking the
Planning Board to require other parties to the right-of-way
to share the cost of upgrading same. The requirement to
upgrade the road is a direct result of her client's wish to
subdivide his land in the manner proposed.
The Cove - Proposed amendment to site plan on S/S Main
Bayview Road (Corey Creek) Southold. SCTM #1000-87-5-20.
The reco~umended procedure to be followed so as to comply
with SEQRA requirements is to have applicant complete Part I
of the Long Envionmental Assessment Form. The proposed
amendment involves the addition of a tennis court and
swimming pool adjacent to Bayview Road.
PERFORMANCE BONDS
Developer has the option of either building the road and
completing it to the Plannning Board's satisfaction within one
year of conditional final approval or posting a performance bond
for a period of time not to exceed an initial period of three
years. Under NY State Town Law, the Town cannot require a
developer to S~bstitute a letter of credit or a passbook for a
performance bond where road construction is concerned.
' However, where sidewalks, drainage and sanitary systems are
concerned, letters of credit, cash and passbooks can be required.
But if a developer asks to use a letter of credit or passbook for
the road portion of the bond estimate, we can accept it.
The Town has a problem with developers who have proven less
than cooperative in extending bonds. No conclusion was reached on
how to deal with this situation. My suggestion at this point is
that the Planning Board shou~ put the developer on notice at the
time it grants final approval (signs the Map) that if the road is
not completed prior to the expiration date of the bond and if he
does not request an extension of said bond in a timely fashion
(three months prior to its expiration), that the Town will find
him to be in default and will prosecute. If phrased as stated
above, the onus of notification will be placed on the developer.
If any of the foregoing is incorrect, please notify me.

Right-of-way Access
We are in receipt of your letter of March 31, 1988, asking that we
request permission from the owner of the right-of-way located to
the north of our clients' property for permission to use and improve
the right-of-way.
We point out to you that the right to use the right-of-way was
conveyed together, with the property, to our clients and to their
predecessors in title, presumably by a prior common owner. Chicago
Title Insurance Company has insured the use of the right-of-way to
our clients.
As to improvements, to the right-of-way, the law in New York State
has been clear since prior to the 1900's. A dominant owner, that
is one who has the right to use the land of another, in this case
as a right-of-way, may improve and repair the right-of-way in the
manner and to the extent reasonably calculated to promote the purpose
for which it was established. The only restrictions that the improve-
ment should not unreasonably interfere with the rights of other users
or with the rights of the owner. In this instance, the right-of-way
is shown as a right-of-way on the owner's filed map, (see report of
Chicago Title previously forwarded to you) so this consideration is
moot as to the owner. Road improvements which could be used by others
would certainly not interfere with the right of ingress and egress.
We would also point out to you at this time, however, that since
many persons (again, see report of Chicago Title) are entitled to
use the right-of-way, they should also share ratably in the cost of
maintenance, repair and presumably improvements. If you are intending

to insist on costly improvements which would be burdensome upon

We are in receipt of your letter of March 31, 1988, asking that we
request permission from the owner of the right-of-way located to
the north of our clients' property for permission to use and improve
the right-of-way.
We point out to you that the right to use the right-of-way was
conveyed together, with the property, to our clients and to their
predecessors in title, presumably by a prior common owner. Chicago
Title Insurance Company has insured the use of the right-of-way to
our clients.
As to improvements, to the right-of-way, the law in New York State
has been clear since prior to the 1900's. A dominant owner, that
is one who has the right to use the land of another, in this case
as a right-of-way, may improve and repair the right-of-way in the
manner and to the extent reasonably calculated to promote the purpose
for which it was established. The only restrictions that the improve-
ment should not unreasonably interfere with the rights of other users
or with the rights of the owner. In this instance, the right-of-way
is shown as a right-of-way on the owner's filed map, (see report of
Chicago Title previously forwarded to you) so this consideration is
moot as to the owner. Road improvements which could be used by others
would certainly not interfere with the right of ingress and egress.
We would also point out to you at this time, however, that since
many persons (again, see report of Chicago Title) are entitled to
use the right-of-way, they should also share ratably in the cost of
maintenance, repair and presumably improvements. If you are intending

to insist on costly improvements which would be burdensome upon
a minor subdivision of this nature, then we request you provide

The following actions were taken by the~Southold Town
Planning Board, Monday, April 13, 1987
RESOLVED that the Southold Town Planning Board declare
themselves lead agency under the State Environmental Quality
Review Act for the minor subdivision of Adams Associates
located at Mattituck. An initial determination of non-significance
has been made.
RESOLVED that the Southold Town Planning Board grant
sketch plan approval to the minor subdivision map for Adams
Associates located at Mattituck for 4 lots on 7.6797 acres,
Lot No. 4~in "B" zoning district, survey dated January 9,
1987.
It was also requested information with regard to the
Northerly right-of-way from Cox Neck Road. Does this right-
of-way service other lots to the east? This information
will help the Board determine the improvements to be made
for the access road within the right-of-way.
