Davis RE: Access road in oroperty of Nicholas Fon+ana at Matt ituck The property survey (6-30-79) shows a 25 ft. R.O.W. that provides access to the four lots in the subdiwlsion. "here is an existing narrow dirt road that meanders slightly through the property for access to houses on Lots No. 2 and No. 4. The house on Lot No. i has a separate entrance from Cox's Neck Road. There is a partially completed house on the easterly part of Lot No. 3. "he existing entrance road at Cox's Neck Road is not entirely wi±bin the 25 ft. R.O.W. The north R.O.W. line is 97 ft. from a monument on Cox's Neck Road and the north side of the existing en+rance road is 120 ft. from ?ne same monument. The R.O.W. should be staked out to determine the location of the present road. "he orooerty is wooded and from observation the road was laid out to by-pass some of the larger trees. The survey should have shown +he existing road location. I would recommend that the existing road be improved by the addition of 6" of bankrun with 20% of gravel for a width of 12 ft. The location should be centered in the R.O.W. wherever possible as the contours indicate that the north side of the R.O.W. is higher than the south side throughou~. ~.r ~ienry E. Nov. 17, 1981. 11971 11743 Sir: I appeal to you to judge my case with some kind consideration and ~mderstanding. The records are in the file in your office but let me briefly explain how I got into this terrible mess. When I ordered the Acorn House in 1978, the company rec- co~mnended a builder, ~r. George Friedmann, who would satisfactorily buil~ to their specifications. I made a gift of the house to my daughter, ~rs. Franklin, and she took charge of consulting with the builder on the details, I merely paid the bills. In ~lay, 1981, when I applied for a permit to build the Barn iiouse for myself on the last lot, I was told that kr. ~'rie~nann had not completed all the requirements for Eetting the approval of the Board for the sub-division. That was a terrible shock to me and I immediately started on the project of getting the approval of the Board for the subdivision survey. At that time I was not aware of' the road improvement specification, because your letter of ~ay 15, 1979, which mentioned that requirement, was sent to ~r. Yried~ann. Somehow, he failed to deliver this letter to my daughter or to me. ~his letter is mot in my file, where 1 carefully kept all the records sent to me, including the ~uilding Permit issued to Ar. Priedmann for the Acorn House, and the O.K. for the Final Inspection. I did not know about this letter until ~r. Hindermann sent me a copy of it on ~ov. 4, 1981. I :realize now that 1 sho~ld i~ave checked with the Board, but since i ass~ned that %r. 2'rie~nann had completed the requirements, I was not aware of any need to question the i~oard. The house was used on s~mner week-ends and vacations, and the absence of the C.O. was not realized, if the Board, somehow, could have notified me that the U.O. was lecking, I'm certain I would have followed through on it. I'm upset because this is delaying the building of the Barn ~ouse. ~he local mason, pl~aber and electricial are anxious to get to work o~ their contracts. If I could get permission to proceed with the work, I would be will:ing to post a bond assuring the com- pletion of the road. i have owned this property for over 20 years and would like ~o preserve the natural character o£ the area. In order that we may proceed with the signing of the map, would you submit, to our office, three final copies of the map which must include the following eight conditions: Approval of this subdivision shall be made subject to the subdivision meeting the requirements and stand- ards of the Suffolk County Department of Health Services. No lot shall be subdivided or any lot line changed in any manner at any future date unless authorized by the Southold Planning Board. Should any additional lot be created within this parcel as it now exists a map of the subdivision shall be filed in the office of the County Clerk. No new sanitary disposal facility shall be constructed or located within 100 feet of the easterly boundary line of the property. 5 o No stormwater runoff shall be directly directly discharged into Mattituck Creek or into the tidal wetlands bordering the creek. (2) Sept. 24, 1981 Clearing and grading within each lot shall be limited to that necessary for siting and constructing a house with the intent of preserving as much of the natural vegetation on the site as possible so as to minimize stormwater runoff and erosion, and also to help preserve that part of the swale that is located within the sub- division. Erosion and sediment control measures shall be required during and immediately after construction on each lot to insure that stormwater runoff will not carry eroded soils and other deleterious materials into Mattituck Creek and the tidal wetlands bordering the creek. The above conditions shall be filed as covenants and re- strictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. DESCRIPTION OF ACTION The minor subdivision of Nicholas Fontana, located in Mattituck, New York. The project has been determined not to have a significant effect cn the environment for the following reasons: An environr~cntal assessment has been submitted which indicated that nc significant adverse effects to the environment were likely'to occur should the project be implemented as planned. Because there has been mo response in the allotted time from the New York State Department cf Environmental Conservation it is assumed that there is no objection nor con~ents by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands. The Suffolk County Department of Health Services kas indicated its agreement with the l~d agency designation. It has reviewed the project and finds that there may ~e a problem with getting potable water due to nitrate contamination in the area. DESCRIPTION OF ACTION The minor subdivision of Nicholas Fontana, located in Mattituck, New York. The project has been determined not to have a significant effect cn the environment for the following reasons: An environmental assessment has been submitted which indicated that nc significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no xesponse in the allotted time from the New York State Department cf Environmental Conservation it is assumed that there is no objection nor con~ents by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands. The Suffolk County Department of Health Services kas indicated its agreement with the le~d a~ency designation. It has reviewed the project and finds that there may ~.e a problem with getting potable water due to nitrate contamination in the area. After due study and deliberation it resolved to approve said map sub- ject to the following eight conditions deemed necessary to help preserve the natural and aesthetic attributes of Mattituck Creek. Approval of this subdivision shall be made subject to the subdivi- sion meeting the requirements and standards of the Suffolk County Department of Health Services. 2. No lot shall be subdivided or any lot line changed in any manner at any future date unless authorized by the Southold Planning Board. o Should any additional lot be created within this parcel as it now exists a map of the subdivision shall be filed in the office of the County Clerk. 4. No new sanitary disposal facility shall be constructed or located within 100 feet of the easterly boundary line of the property. 5. No stormwater runoff shall be directly discharged into Mattituck Creek or into the tidal wetlands bordering the creek. Clearing and grading within each lot shall be limited to that neces- sary for siting and constructing a house with the intent of preserv- ing as much of the natural vegetation on the site as possible so as to minimize stormwater runoff and erosion, and also to help preserve that part of the swale that is located within the subdivision.
