map for Mohring Enterprises located at Mattituck. Everything is in order,
this is for a set off on that piece of property at County Route 48.
Ms. Scopaz: One thing, I don't know if it is too late to dd this, but
you might also want to consider the same type of buffering ~hat~'would
be the same as for the Arbeeny property for this one also on the two portions
of the business property that~hbuts residential property.

The following action was taken by the Southold Town Planning
Board, Monday, November 24,1986.
RESOLVED that the Southold Town Planning Board approve
the set off of Mohring Enterprises to set off 3.563 acres in
the B - Business zone from 36.9 acres in the A - Residential
Zone located at Sound Avenue and Cox Neck Road, Mattituck,
survey dated September 12, 1986; subject to:
1. Receipt of Article 6 approval pursuant to the Suffolk
County Department of Health Services.
2. Consideration of the recommendations of the Suffolk
County Planning Commission (if any).
The Planning Board was not in favor of extending the set
off line 30 feet in to the residential property. The major
subdivision will be considered upon completion of the above
mentioned conditions to finalize the set off.
Would you please forward six (6) surveys in accordance
with the enclosed list, for our referral to the County Planning
Commission. Thank you.

Northwesterly corner of Sound Avenue, C.R. 48, and Cox
Neck Road, Mattituck, New York.
Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on April 1,
1987 reviewed the proposed subdivision plat, entitled, "Minor Subdivision - M.
C. Enterprises at Mattituck" referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to approve
said map subject to the following nine conditions deemed necessary to help
preserve the traffic safety and carrying capacity of Sound Avenue, a county
road.
No lot shall be subdivided or its lot lines changed in any manner
at any future date unless authorized by the Town of Southold Planning
Board.
Since this tract has the potential to be further subdivided, any
subdivision of any part of this tract in the future shall have a map of
the subdivision filed in the office of the County Clerk.
Ail driveways on Sound Avenue shall make an angle of at least 70° and
preferably 90° with the county road.
Each lot having frontage on Sound Avenue shall have a turnaround
provision, such as a T-shaped shunt, se that a vehicle leaving a lot will
not have to back out into the traffic stream on the road.
No driveway or entrance road on Sound Avenue or Cox Neck Lane shall be
located within fifty (50) feet of the ends of the short radius curve

after a public hearing. Adjoining property owners shall be entitled
to notice of such public hearing but their consent to such
modification shall not be required.
The final map shall bear the following note: A Declaration of Covenants
and Restrictions has been filed in the Suffolk County Clerk's office
which affects lots in this subdivision.
The Con~nission also offers the following comments on the map for your use
and consideration:
It is suggested that before approval is granted to this subdivision
that the subdivider be required to submit this proposal to the Suffolk
County Department of Health Services for review to insure that the
proposed subdivision will meet the requirements and standards of that
agency.
Conditional approval of this subdivision does not in any way imply
approval of the layout of future subdivision of this tract presently
under consideration.
The map of this minor subdivision should be filed in the office of the
County Clerk. This is to insure the validity of the subdivision map and
that the subdivision map will be available to the general public in a
central office of official records.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review Act and 6NYCRR Part
617, Section 617.10 and Chapter 44 of the Code of the Town
of Southold, notice is hereby given that Southold Town Planning
Board as lead agency for the action described below has determined
that the project will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
The~minor subdivision of Mohring Enterprises, located at
Mattituck is a set-off of 3.563 acres from 36.9 acres.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment
were likely to occur should the project be implemented
as planned.
Because there has been no response from the Suffolk County
Planning Commission in the alotted time, it is assumed
that there are no objections or comments from that agency.
However, an application under Article 6 will be required
for approval of the water and sewer.
Because there has been no response from the NYS Department
of Environmental Conservation in the alotted time, it is assumed
that there are no objections or comments from that agency.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

RESOLVED that the Southold Town Planning Board approve
the set off of Mohring Enterprises to set off 3.563 acres in
the B Business zone from 36.9 acres in the A - Residential
Zone located at Sound Avenue and Cox Neck Road, Mattituck,
survey dated September 12, 1986; subject to:
1. Receipt of Article 6 approval pursuant to the Suffolk
County Department of ltealth Services.
2. Considerati'on of the recommendations of the Suffolk
Cgunty Planning Commission (if'any).
The Planning Board was not in favor of extending the set
off line 30 feet in to the residential property. The major
subdivision will be considered upon completion of the above
mentioned conditions to finalize the set off.

In regard to the above, I am aware from attending Monday's meeting of the
Town Planning Board that the set-off application was set down for field
inspection and the Town determined to be lead agency SE~fA. I had three
questions in regard to the application which I would appreciate your bringing
to Mr. Orlowski's attention and getting back to me concerning:
1. It occurs to me from a reading of Section 100.22(D) of the Town Zoning
Code, that our proposed set-off might be increased by extending the set-off
line 30 feet~to the adjouning A residential/agricultural distri~-,~ per the
attached sketch. My client would prefer to do this if the Town^Board has no
objections.
2. I believe in the past, the Planning Board has not required Health
Department approval in regard to certain set-offs. I would appreciate being
advised as to whether any such approval will be required in this case and if so
the extent of such approval required.
3. As you know, in June, the initial application for the major subdivision
regarding the above was made. The matter was thereafter placed on the Planning
Board calendar for sketch plan review. The Board suggested a cluster concept
and a new sketch plan showing same reproduced and provided, ~ince that point
the subdivision has lain dormant.
My client and I would very much appreciate it if the Planning Board would
recalendar the major subdivision proposal for the next ~'/~/e date in order
that we can get throug~the point of at least sketch plan approval on that
matter while simultaneously processing the set-off.
