Re: Subdivision of John and Catherine Simicich/Thorton Smith
Dear Mr, 0rlowski:
As you are aware I represent John Simicich and Catherine Simicich,
his wife, in connection with a two lot subdivision for their
property located off of Bergen Avenue, Mattituck, New York. One
of the two parcels is to be retained by Mr. & Mrs. Simicich and
merged into their farm parcel. The other parcel is to be
exchanged with Thornton Smith and should be included in his
subdivision.
It is my understanding that the parcels to be conveyed to Mr.
Smith will be included in his subdivision and reviewed by the
Health Department. The parcel being retained by Mr. & Mrs.
Simicich is to be utilized for farming purposes. Under this
circumstance it would appear unnecessary and in fact a futile
effort to request that the applicants proceed to the Health
Department for Article 6 approval. In this instance, because of
the unique facts I ask that the applicants not be required to
obtain Health Department approval before the Planning Board grants
final minor subdivision approval.
We have enclosed a check in the sum of $200.00 representing the
required fee in connection to the two lot subdivision and ask that
the matter be placed on the agenda for a hearing.

Dear Mr. Cuddy:
Please let this confirm the request of the Planning
Board at the regular meeting of October 8, 1984.
Prior to any further action, the Board will conduct
a field inspection of the premises.
It was requested, however, that you apply for a set-off
on the parcel to be merged to the property owned by Catherine
Simicich. It was also recommended that the West lot line
of Lot No. 2 be moved 60' to the West to connect with
the Easterly line of Lot No. 4~ and show the building envelope
on Lot No. 2.
If you have any questions, please don't hesitate to
contact our office.
We also request that you submit six (6) copies of the
amended map for the minor subdivision. Enclosed are the
forms for filing a set-off.

In response to your September llth letter, this is to advi~e
that Catherine Simicich owns the parcel adjoining the proposed
subdivision. The area to be conveyed to her will be merged into
and become part of her parcel, which now is 29,9 acres and would
then become 38,4 acres. The parcel being conveyed to Mrs, Simicich
is not being treated as nor will it be Used as a separate parcel,

Dear Mr. Cuddy:
The Planning Board reviewed the file for the above mentioned
application at the regular meeting of September 10, 1984.
Prior to any action, it was the consensus of the Board that
a field inspection will be made.
The Board, however, requests clarification as to the
parcel indicated to be conveyed to Catherine Simicich. The
Board questions the intent of the parcel, as it appears that
the subidivision contains five (5) lots which would have to
be filed as a major.
If you have any questions, please don't hesitate to contact
our office. Following the field inspection, this matter will
be placed on the agenda of the Board for the October 8 meeting.
