Dear Mr. Yakaboski:
The following action was taken by the Southold Town Planning
Board at the regular meeting of May 21, 1984.
RESOLVED that the Southold Town Planni~g Board accept the
suggested resolution of F.J.' Yakaboski, esq regarding the
access road report of the right-of-way within the subdivision
of James Manos at Mattituck subject to the withdrawal of
the article 78 against the Planning Board. Said resolution
reads as follows:
WHEREAS, on the 6th day of February, 1984, this
Board adopted a resolution wherin it accepted the report
of Inspector John W. Davis, designated Report NO. 340, with
respect to the minor subdivision of James Manos at Mattituck,
and,
WHEREAS, as adopted, said resolution is unclear as
to what portions of the report constitute requirements
and which are recommendations which need not be acted
upon by the applicant,
NOW, THEREFORE, BE IT
RESOLVED, that the road report of Inspector John
W. Davis, dated January 7, 1984, with respect to the sub-
division of James Manos, designated as Report No. 340, be
accepted and, based upon such report and all other submis-
ions to this Board in connection with the above-referenced
minor subdivision,this Board determines as fOllows:
1. That the applicant, in constructing the access
road or right-of-way to Lot 4 as shown on said subdivi-
sion plan, be required to proceed in accord with the
recommendations numbered 1 through 6 of said report.
2. The applicant, James Manos, however, may, subject
to approval of this Board, use alternate materials in
the construction of said roadway; and be it

a factor of over 3. As the kinetic energy varies with the
square of the velocity, the errosion capacity of the runoff
will be increased 9 times, and the quantity of material that
can be erroded to the 5th power, or 243 times. Therefore,
you can see why there is concern in regard to the
construction of the referenced berms. It is also why the
maintenance of the 5S ft. wide strips with their natural
ground cover is so desirable as well as keeping the area to
be cleared along the right of way to the minimum required.
Hopefully, you will find the above information helpful and,
as you mentioned, I am sure a meeting with John Davis will
result in an amiable and agreeable solution to all parties.

Dear Mr. Orlowski:
Subject: Minor Sub-Division - James Manos.
Reference our telephone conversation the week of 27
February. As I mentioned, the site was visited immediately
fOllowing the heavy rains on 24 February and 28 February.
As you know, many areas experienced flooding during these
two heavy rains, especially the one on the 28th. In neither
case was there any evidence of runoff from the Manos
property onto the Jahn property. There was, however,
considerable runoff from the Jahn property immediately to
the west of Manos onto the Manos property. There was also
considerable runoff down Holbrook Lane, the majority of
which discharged off the road to the south.
It may be helpful to provide some references on the use of
berms or terraces from a recognized authority, "Ayres", on
runoff and soil errosion: ".... .acts as a shallow diversion
ditch to carry the excess water off at low velocity."
".... .must be carefully planned and constructed according to
definite standards." "... ..a good dependable outlet vital
to a berm or terrace." ".. ...unless they match the ground
contour perfectly, they may do more harm than good."
".... .question of legal liability for damage... ..if.... .the
diversion of water from its natural direction of flow in
such a way to cause injury to adjoining property."
The construction of a berm along the south side of Lot ~ 2
has the potential in Significantly changing the area's
runoff characteristics. First, the disturbance of the
present ground cover changed value of C (coefficient of
runoff in formula) from an approximate .18 to .60. This, in
turn, will increase both the velocity and rate of runoff by

Petitioners, JAMES MANOS and STELLA MANOS, respectfully allege:
1. Petitioner JAMES MANOS and his wife, petitioner STELLA
MANOS, are owners as tenants by the entirety of unimproved land
comprising approximately 5.3 acres situated in MATTITUCK, TOWN
OF SOUTHOLD, COUNTY OF SUFFOLK identified on County Tax Map
1000 as Section 113, Block 6, Lot 14.
2. The respondents at all times herein mentioned constituted
all the members of the PLANNING BOARD OF THE TOWN OF SOUTHOLD of
which the respondent HENRY E. RAYNOR, JR., was and still is the
CHAIRMAN.
3. After a public hearing on October 18, 1983 the PLANNING
BOARD approved, by resolution on November 7, 1983, the application
submitted to it by petitioner JAMES MANOS for a four lot minor
subdivision of the land described in "1", above. Exhibits A & B.
4. For its consideration and as part of the official record

upon which the subdivision was granted, the PLANNING BOARD had
before it substantial evidence showing that no water runoff or
drainage problems existed or would exist in the subdivision under
conditions of total potential development permitted under the
zoning code of the Town of Southold. This evidence included an
evaluation report dated October 8, 1982 from the U.S. Department
of Agriculture, Soil Conservation Service. The Soil Conservation
report was made after an on-site inspection of the subdivision by
a specialist employed by the service, ALLAN CONNELL. Exhibit C.
5. The Soil Conservation Service evaluation report was
submitted by the petitioner JAMES MANOS to the Chairman of the
Planning Board, HENRY E. RAYNOR, JR., on October 12, 1982, at
which time MR. RAYNOR acknowledged that the Soil Conservation Ser-
vice of the United States Department of Agriculture was considered
authoritative on drainage matters by Southold Town.
6. The Town of Southold's standard for the inclusion of
drainage facilities in a subdivision is set forth in Section
A-I06-36 of the Code of the Town of Southold which, in pertinent
part, provides for drainage facilities "based on the anticipated
runoff from a six-inch rainfall in a twenty-four (24) hours'
storm...under conditions of total potential development permitted
under the zoning code."
7. Using the above standard adopted by the Town of Southold,
the Soil Conservation Service evaluation shows that there is, at
present, no runoff from the subdivision and that runoff would

be "negligible" under the proposed land use conditions. In
pertinent part, the evaluation states with reference to the
subject land as follows:
"This soil is very well drained with permeability rates
in excess of 6.3 inches per hour throughout the profile.
(See soil report). An estimate of runoff from a 25 year
24 hour rainfall, with a rainfall depth of six inches,
under existing land use conditions, showed that there
would be no runoff coming from the watershed area.
"Further calculations were made to determine the peak
rate of runoff under the proposed land use conditions.
Even with the addition of impervious structures the run-
off would be negligible."
8. An independent study (Exhibit D) conducted by the firm
of PECONIC ASSOCIATES INC. confirms the conclusions of the Soil
Conservation Service and describes a drainage problem caused by
runoff from driveways, unrelated to the subdivision, which is
discharged onto Holbrook Lane which in turn conve~s the runoff
to the lane's low point. At the low point the water spills off
the lane and onto the land of EDGAR JAHN, who is the owner of
land adjacent to the subdivision. The aforedescribed occurrence
has been observed by the petitioner JAMES MANOS and others on
numerous occasions.
9. The said EDGAR JAHN's objections to the subdivision were
set forth in his letter to the Planning Board dated October 15,
1983, which was part of the Planning Board record of the proceed-
ing leading to the approval of the subdivision. (Exhibit E)
10. By letter dated July 17, 1983,petitioner JAMES MANOS
informed the Planning Board that even though evidence showed that

there were no runoff problems caused by the subdivision, he,
nonetheless, in the interest of hastening successful completion
of the subdivision application, would provide deed restrictions
in the deeds of two (2) subdivision lots which abutted MR. JAHN's
property. These restrictions would provide for a 50 foot wide
strip running along MR. JAHN's property wherein the ground cover
would be maintained except as would be needed for a future drive-
way. The area restricted would total approximately 25,000 square
feet. (Exhibit F)
11. Due consideration in the proceedings on the application
for the subdivision was given to all the above by the Planning
Board and after public hearing on October 18, 1983, it approved
the application on November 7, 1983 allowing the subdivision
without conditions relating to drainage.
12. Three months later and pursuant to a request to it by
petitioner JAMES MANOS for specifications for a subdivision acces
road, the Planning Board by an ~ parte resolution on February 6,
1984 accepted report No. 340 of road inspector JOHN DAVIS "regard
ing the access road within the subdivision" (emphasis supplied).
13. The Planning Board Chairman, HENRY E. RAYNOR, refused
to provide the petitioner JAMES MANOS with a copy of MR. DAVIS'
report prior to the Board's acceptance. Upon receipt on February
10, 1984, of the resolution, and the report which it accepted,
petitioners discovered that the recommendations of the road in-
spector went beyond specifications for the access road in that

the report included provisions regarding drainage which provisions
were wholly unrelated to the road. (Exhibits a,H,I & J).
14. On February 15, 1984 the Planning Board secretary
orally advised petitioner JAMES MANOS that the Planning Board's
February 6, 1984 resolution of acceptance of INSPECTOR DAVIS'
report was an approval of all the recommendations in the report
including those relating to drainage, notwithstanding the fact
that the language of the resolution does not appear to include
drainage recommendations. A written request for clarification
to CHAIRMAN RAYNOR went unanswered.
15. INSPECTOR DAVIS' report, after setting forth his recom-
mendations for the access road, states as follows:
"Drainage:
I have reviewed the drainage reports by Merlon E. Wiggin
Ph.D., M.E. and Allan Connell, D.C. for the owner. I
agree more or less with their findings, however there is
hardly any permeability with rainfall on frozen ground
which does occur on Long Island and also that the top
surface of land usually has a thin layer of material with
less permeability than the underlying material.
"The maintenance of a 50 ft. strip of natural ground cover
along the south side of Lot No. 2 and along the west side
of Lot No. 4 is a good idea. For further insurance that
runoff would not go into the Jahn property, I would recom-
mend that berms also be constructed along the south property
line of Lot No.2 and the west side of Lot No.4."
16. MR. DAVIS' standards of protecting against "rainfall on
frozen ground," etc., as shown in paragraph "15" above, are
inconsistent with those promulgated and published by Southold
Twon in Section 106-36 of the Code of Southold Town, above,

facts, based on his inspection, of the existence of a runoff

problem originating from the subdivision.
17. The installations of berms recommended by MR. DAVIS
is unwarranted, not based on the Town's requirements, and not
made in connection with the building of the access road, but
solely for "f'urther insurance" that no runoff will go onto MR.
JAHN'S land from the common lot lines with subdivis+on lots 2
and 4, a lineal distance of 475 feet.
18. On information and belief LAWRENCE TUTHILL is the
Town Engineer for the Town of Southold.
19. On information and belief, LAWRENCE TUTHILL's respon-
sibilities as Town Engineer include the making of evaluations
and recommendations to the Town of Southold regarding the need
for and/or design of drainage facilities in subdivisions.
20. On information and belief, the said LAWRENCE TUTHILL
on February 24, 1984 evaluated the drainage requirements for
the subject subdivision which evaluation process included an
on site inspection by him of the subdivision and its environs,
21. On information and belief, the said LAWRENCE TUTHILL
found that the installation of drainage facilities including a
berm on lot 2 was not required or necessary,

following the passage of 30 days from the filing of the Planning
Board's February 6. 1984 resolution which purportedly would
require the installation of berms on lots 2 and 4 as recommended
by inspector JOHN DAVIS. which requirement is inconsistent with
the recommendations and findings of the United States Department
of Agriculture's Soil Conservation Service. of Peconic Associates
Inc.. and. on information and belief. of LAWRENCE TUTHILL. the
Southold Town Engineer.
23. The resolution of the PLANNING BOARD on February 6.
1984 approving the road inspector's recommendations requiring
the installation of berms was and is unsupported by substantial
evidence. illegal. unconstitutional. arbitrary. capricious.
improper. and an abuse of its discretion in that the PLANNING
BOARD (1) wholly ignored and neglected to take into account its
own standards regarding the installation of drainage facilities
WhiCh. if applied. would make installation of berms unnecessary.
(2) took action that was contrary to. and inconsistent with.
its determination of November 17. 1983 Whereby it approved and
granted the subdivision without seeing fit to impose conditions
for drainage. after full public hearing. on publiShed notice
with opportunity for all interested parties to be heard. and
with subustantial evidence submitted for its consideration
regarding the subject of runoff and drainage. and (3) violated
the requirements of due process in its ex parte action resulting

in the resolution of February 6, 1984, depriving petitioners of
their property rights.
24. Thirty days have not elapsed since the filing of the
February 6, 1984 resolution of thePLANNING BOARD of the Town
of Southold and no previous application for a court review of
the resolution has been made.
WHEREFORE, petitioners respectfully request that pursuant
to the provisions of the statute in such cases made and provided,
a jUdgment be entered herein, directing that the decision of the
Town of Southold PLANNING BOARD made by resolution on February
6, 1984 be annulled; ordering that the determination approving
the subdivision on November 7, 1983, and the proceedings thereto,
were dispositive of the issue of drainage requirements; ordering
that the installation of berms or other drainage facilities on
lots 2 and 4 not be required; and for such further relief as the
Court deems just.

no signs of errosion from runoff on any part of the property
inspected,
5. Holbrook Lane collects runoff from the various driveways
feeding into it and conveys it from both east and west
direction to its low point just west of the N/S property
line between Hanos and Jahn. There is evidence that this

runoff flows both north and south off both sides of Holbrook
Lane at this location. As Holbrook Lane is higher than the
area immediately to the north of it. it forms a berm like

barrier across the 15 ft. contour line and restricts surface
runoff from north to south.
Recommendations
With the properties excellent soil permeability and ground
cover, runoff is obviously not a problem. So as to maintain
this excellent runoff control after development the following
actions are recommended:
1. Maintenance of a 58 ft. strip of natural ground cover along
the south side of Lot H 2 and along the west side of Lot H 4
as a deed restriction.
2. At the south end of the new right of way between Lots H 2
and 3 and as it turns onto the line between Lots H 3 and 4,
slope the road surface to insure that runoff is diverted to
its east and north edges to be naturally infiltrated into
the soil, and prevented from being discharged to the south.
3. If. in the future. the infiltration rate in the low portion
of Lot H 4 should become reduced to the point where an
unusually heavy rainfall should not be absorbed, than
consideration should be given to the construction of a berm
along the west property line of Lot H 4 between the 28 ft.
contour lines.

Dear Mr. Raynor:
I share a common lot line on both the southerly and westerly sides
of the proposed-above subdivision. Both af these lines lead to a
low area of my property which already has a serious drainage _
problem during heavy rains.
I note from a letter to you from Mr. Manos, dated July 17, 1983,
that he has withdrawn his engineering report and drainage plan
sent to you on October 7, 1982.
His new proposal is based on a U. S. Soil Conservation Service
analysis and a report prepared by Peconic Associates Inc.
In his letter to you, dated July 17, 1983, he agrees basically
to the recommendations 1 and 2 ~ the Peconic Associates Inc.
report of July 15, 1983 and agrees to incorporate them into the
deeds for lots 2 and 4. However, my only concern is that
recommendation no. 3 of the Peconic Associates report is not
mentioned, and even if it_were, recommendation no. 3 starts with
the words, "If, in the future ..." and continues, in effect,
that if a drainage problem develops the construction of a berm
should be considered.
Therefore, my question to the Planning Board is: What recourse
do I have if, after the \lroperty is sold, a severearainalJe__
proolem-aevelops in rela ively short heavy rains rather than 6"
in 24 hours or only 1/4" per hour? Short heavy rains of 1" to 2"
per hour are not uncommon and are especially damaging when they
occur in early spring when the ground is still frozen.
To sUmmarize, I only request that the Planning Board consider
what protection it can provide regarding possible future draina~e
jroblems as discussed above. but not addressed by the letter of
ames Manos dated July 17, 1983. How could future purchasers of
lots 2 and 4 be held accountable?

SUBJECT: Minor Sub-division - James Manos.
Reference is made to report of John W. Davis, dated January
7, 1984.
In accordance with a verbal request from Mr. ,James Manos,
sub-division owner, respectfully request additional
consideration of the following items in subject report:
ACCESS TO LOTS 2 & 3: The assumption that the new access
road would be for Lot ~ 4 is not necessarialy correct. The
Owner requests, in the interest of conservation of wooded
area. ground cover, etc., that the flexibility be given to
have possible access from the new right of way also to Lots
2 and 3. Because of the lot configuration, this will permit
reduced length of access driveways, less removal of trees
and other ground cover, and better access for service and
emergency vehicles.
ROAD CONSTRUCTION: In lieu of the recommended road
construction, request a 4 to 6 inch compacted gravel base
course topped with a double application of crushed stone and
cutback asphalt. This type of road construction is more
easily maintained and the appearance is more in keeping with
the natural area of the lots.
RUNOFF: The sub-division and surrounding area was recently
inspected during a heavy rainfall period, and the runoff
conditions observed. A considerable amount of water was
observed running to the low point of Holbrook Lane from both
east and westerly directions. Sources included driveways on
the south side of Holbrook Lane. The majority of the runoff
then spilled onto Lot FF 4 and the adjacent Jahn property.

There was no evidence of runoff from Lot ~ 4 traversing to
the adjacent Jahn lot except that which was supplied by the
Holbrook Lane runoff. It is, therefore, felt that the
suggested berms would be of little benefit. In fact, based
on extensive U. S. Soil Conservation experience, berms more
often worsen runoff conditions and contribute to soil
errosion unless they are constructed on contour lines and
empty into specially designed and constructed and protected
waterways. It is suggested, however, that the road
construction where it turns for access to Lot ~ 4 be
constructed such that its cross section divert any runoff
down the right of way back onto Lot ~ 2.
Profile and road sections will be provided.
If appropriate and helpful, suggest a meeting for discussion
and review of the above items.

driveways along Helbrook lane which at the lane's low-point spills over onto
Mr. Jahn's property at a point 250 feet dietant from Lot 2.
In his letter of october 15, 19B3, Mr. Jahn states thB.t he hB.s e "serious

In making his recommendations for the accasS road in the R.O.W. identified
aa "Arvan's Ws.y" on the approved map, Mr. Davis "assumes" thB.t the proposed

2 and 3 can be from Miller's R.0.VI., is th..re any reason why optional access

for example, a house were sited in the southerly half of let 2 or :3, since

As you know, I was not given the opportunity to ex.min.. Mr. Davis' report
prior to its acceptanc8 by the Board. Thie is especially unfair since so much

Accordingly, I request that the Planning BORrd vacate its Resolution of

herein.

SITUATION:Mr. Manos proposes to develop a 5 acre parcel of land into a residential
area. A total of 4 houses are proposed on the property. Mr. Manos requested soils
information on the property including permeability rates. He was also concerned over
Lhe possihle increase in runoff which might be created by the development proposal.
SUGGESTED SOLUTION(S) The soil survey of Suffolk County showed the area to have a
soi 1 type l<nown us Carver p lYUlouth sands at 15 to 35% slopes. An onsite investiga..
lion verified this fact however, the land slope fell within the 3 to 15 percent
r~nge averaging 8 percent. This soil is very well drained with permeability rates
in excess of 6.3 inches per hour throughout the profile. (See soil report).
An estimate of runoff from a 25 rainfall depth of 6
inches, under existing land use conditions, showed that there would be no runoff
coming from the watershed area.
Further calculations were made to determine the peak rate of runoff under the proposed
land use conditions. Even with the addition of impervious structures the runoff
would be negligible.

If runoff became a problem onto the adjacent property owner in the southwest corner
of the property a berm could be constructed along the property line of the southwest
corner of your property. Both ends could be connected to the 25 foot contour line
or thereabouts. A survey would be needed to determine the beginning and end of the
berm. The runoff collected along this bee," would then seep into the soil profile.

The public hearing on this matter was held on June 17, 1982.
Upon application of Jfu~ES NANOS, by Rudolph H. Bruer, Esq., Main Road
Southold, NY for a Variance for Approval of Access, New York Town Law, Sec-
tion 280a. Location of Property: 400 feet easterly of Nill Road, Mattituc}
bounded north by Bungalow Lane; west by Private Right-of-Way, Janis and
others; south by Private Right-of-\vay; east by Boechman and others; County
Tax Na~ Parcel No. 1000-113-6-14.
The board made the following findings and determination:
By this appeal, appellant seeks approval of access OVer a private
r igh t-of --,'Iay: (l) extending up to approximately 860 feet E,asterly from
Nill Road and known as Bungalow Lane (or Miller's Road) and approximately
25 feet in width; (2) extending southerly from Bungalow Lane [supra]
approximately 457 feet and referred to as "Young's Right-of-way"; (3)
extending '-'gain easterly from "Young's Right-of-Way" approximately 464.06
feet (to the southeast corner of Parcel 4 in this proposed subdivision).
Upon inspection of the rights-of-way in question, the board finds
right-or-way (1), supra, to be in excellent condition and or adequate
width. The board also finds rights-of-way (2) and (3), supra, to be in
fair con:Jition una a fair width, and that drainage facilities shoUld be
constructed within the subdivision to prevent the existing flooding
problems ~long the areas of right-of-way (3), supra.

is referred until all of the condit-lons set forth herein have been
complied with;
4. That a minimum of three leeching basins shall be installed
within proposed Subdivision Lots No. 3 and 4 in low areas to eliminate
water runoff;
5. That these access roads and l~ ching basins must be maintained
at all times in good satisfactory condition as stipulated above;
6. That the above requirements be inspected by the Town Engineer
as to compliance.
Location of Property: Private Roads extending easterly and thence
southerly from I-lill Road, Mattituck, NY; Parcel In Question being known
as Suffolk County Tax Map District 1000, Section 113, Block 6, Lot 14.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

Board at a regular meeting held on August 3, 1981.
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review Act
for the minor subdivision of James Manos located at Mattituck. An
initial determination of non-significance has been made.
The Southold Town Planning Board feels that this subdivision
should be referred to the Zoning Board of Appeals for t.heir comments
on this subdivision. Until we are in receipt of their suggestions

BEGINNING at a point in the northwesterly corner of the
hereinafter descried premises, said point being situate the
following 2 course,s And distances when measur<?d easterly along
the northerly side of "Miller's Right of Way" and southerly
across said "Miller's Right of Way" from the corner formed by the
intersection of the said northerly side of "Miller's Right of
Way" with the easterly side of Mill Road, as shown on Map of
