The following action was taken by the southold Town Planning Board,
Monday, November 7, 1983.
RESOLVED that whereas, a formal application for the
subdivision plat entitled "James Manos"
Mattituck was submitted to the planning Board
and, a filing fee in the amount of $100 was paid
approval of a

May 18, 1983, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, southold, New York, on October 18, 1983 at

PROPOSED MINOR SUBDIVISION - JAMES MANOS
MILLERS RIGHT OF WAY - MATTITUCK
July 15. 1983
The subject property was carefully inspected on July 8. 1983 in
regard to drainage and runoff conditions.
Findinqs
1. Soil is Carver plymouth sands with rapid permeability
(reference S.C.S. Soil Map).
2. Surface slopes on Lots ~ I, 2, and 3 are generally less than
5%. Land slope on Lot ~ 4 is 3 to 15%.
3. Land cover is excellent with a mixture of trees and shurb
type growth.
4. Runoff permeability of this property is in excess of 6.3
inches per hour throughout its profile (reference S.C.S.
Inventory & Evaluation Inspection dated 10/8/82). There was
no signs of errosion from runoff on any part of the property
inspected.
5. Holbrook Lane collects runoff from the various driveways
feeding into it and conveys it from both east and west
direction to its low point just west of the N/S property
line between Manos and Jahn. There is evidence that this
runoff flows both north and south off both sides of Holbrook
Lane at this location. As Holbrook Lane is higher than the
area immediately to the north of it. it forms a berm like

barrier across the 15 ft. contour line and restricts surface
runoff from north to south.
Recommendations
With the properties excellent soil permeability and ground
cover, runoff is obviously not a problem. So as to maintain
this excellent runoff control after development the fOllowing
actions are recommended,
1. Maintenance of a 58 ft. strip of natural ground cover along
the south side of Lot n 2 and along the west side of Lot ~ 4
as a deed restriction.
2. At the south end of the new right of way between Lots ~ 2
and 3 and as it turns onto the line between Lots n 3 and 4,
slope the road surface to insure that runoff is diverted to
its east and north edges to be naturally infiltrated into
3. If. in the future. the infiltration rate in the low portion
the soil, and prevented from being discharged to the south.
of Lot ~ 4 should become reduced to the point where an
unusually heavy rainfall should not be absorbed, than
consideration should be given to the construction of a berm
along the west property line of Lot ~ 4 between the 28 ft.

Dear ]ir. Raynor:
I share 0 common lot line on both the southerly Cind westerly sides
of t-~() prolosed i.bove subdivision. Both of these lines lead to a
low area of my property which already has a serious drainage
problem during heavy rains.
I note from a letter to you from Mr. Manos, dated July 17, 1983,
that he has withdrawn his engineering report and drainage plan
sent to you on October 7, 1982.
His new proposal is based on a U. S. Soil Conservation Service
analysis and a report prepared by Peconic Associates Inc.
In his letter to you, dated July 17, 1983, he agrees basically
to the recommendations 1 and 2 of the Peconic Associates Inc.
report of July 15, 1983 and agrees to incorporate them into the
deeds for lots 2 and 4. However, my only concern is that
recommendation no. 3 of the peconic Associates report is not
mentioned, and even if it were, recommendation no. 3 starts with
the words, "If, in the future..." and continues, in effect,
that if a drainage problem develops the construction of a berm
should be considered.
Therefore, my question to the Planning Board is: What recourse
do I have if, after ~ property is sold, a severe draina~&
problem develops in relatively short heavy rains rather than 6"
in 24 hours or only 1/4" per hour? Short heavy rains of 1" to 2"
per hour are not uncommon and are especially damaging when they
occur in early spring when the ground is still frozen.
To summarize, I only request that the Planning Board consider
what protection it can provide regarding possible future drainage
problems as discussed above but not addressed by the letter of
James Manos dated July 17, 1983. How could future purchasers of
lots 2 and 4 be held accountable?

Notice of Hearing
NOTICE IS HEREBY GIVEN that pursuant to Section 276 of the Town
Law, public hearings will be held by the Southold Town Planning
Board at the Town Hall, Main Road, SouthOld, New York, in said town
on the 18th day of October, 1983, on the question of the following:
7:30 p.m. Approval of the minor subdivision of James Manos,
located at Mattituck, Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at a point in the northwesterly corner of the herinafter
described premises, said point being situate the following 2 courses
and distances when measured easterly along the northerly side of
"Miller"s Right of Way" and southerly across said "Miller's Right
of Way" from the corner formed by the intersection of the said
northerly side of "Miller's Right of Way" with the easterly side of
Mill Road, as shown on Map of Jackson's Landing at Mattituck, filed
in the Office of the Clerk of the Sounty of SuffOlk on March 28th,
1969 as Map No. 5280;
(1) South 83 degrees 26 minutes 00 seconds East 402.37 feet;
(2) South 1 degree 25 minutes 20 seconds East 24.23 feet to the
point of beginning;
RUNNING THENCE from said point of beginning, South 83 degrees 26
minutes 00 seconds East along the southerly side of "Miller's
Right of Way", 491.00 feet to land now or formerly of Blatz;
THENCE South 10 degrees 07 minutes 00 seconds East along last
mentioned land and along land now or formerly of Burke and along
land now or formerly of Kells and passing through three (3) monu-
ments, 411.46 feet to concrete pipe and land now or formerly of
Sander;
THENCE North 83 degrees 26 minutes West along last mentioned land
75.00 feet;
THENCE South 2 degrees 50 minutes 40 seconds West still along last
mentioned land, 200.00 feet to concrete pipe in the northerly side
of "Young's Right of Way", also known as "Holbrook Lane";
THENCE North 83 degrees 11 minutes 30 seconds West along the north-
erly side of "Young's Right of Way" also known as "Holbrook Lane",
200.00 feet to a monument;

Jr. located at Southold, in the Town of southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point marked by a concrete monument set on the southerly
line of Middle Road (County Road No. 48) at the northeasterly corner
of land now or formerly of Middle Road Corp. and the northwesterly
corner of the premises herein described; running thence along said
southerly line of Middle Road (County Road No. 48) North 670 06'
40" East a distance of 582.35 feet;
RUNNING THENCE on a curve to the right having a radius of 89.0 feet,
a distance of 162.01 feet to the westerly line of Youngs Avenue
(formerly known as Railroad Avenue) ;
RUNNING THENCE along said westerly line of Youngs Avenue (formerly

feet to a point marked by a concrete monument and land of Mallgren;

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of James Manos is a four-lot subdivision
located at Mattituck.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
stated no objection to the lead agency designation and
is in agreement with the initial determination. The
Dep~rtment has a complete application and it appears the
proJect can be served by subsurface sewage disposal system{s)
and individual water supply system{s) .
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
I enclose for your consideration an engineerina evaluation
with recommendations, dated July 14, 1983, prepared hy Mr. M.
Wioqin of Peconic Associates Inc. I also enclose a Soil Con-
servation Service analysis of the property dated October 8,
1982.
Both documents relate to the soil and run-off character-
istics of the suhject property.
Although the reports indicate run-off from a six inch,
twenty-four hour rainstorm would be "insiqnificant" even after
development, and presents "no problem'! qiven the very hioh per-
meability rate of the soil and the gentle angles of the slopes,
I nevertheless would take the steps descrihed in the Peconic
Associates' report in the interest of concluding this matter.
Accordin0ly, I aqree to provide restrictions in deeds to
lots 2 and 4 so as to leave undeveloped a fifty foot wide, 227
foot lono zone running east-west along the south side of lot 2
at the cornman lot line with the land of Jahn to the south, and
a 50 foot wide, 249 foot long zone running north-south along
the west side of lot 4 at the common lot line with the land of
Jahn to the west.
There would be a sliqht intrusion into the above area by
the south end of the proposed road as shown on the sketch plan
and by any driveway to be built from the proposed road to a
future dwelling on lot 4 which, logically, would be constructed
on the higher around located in the easterly half of lot 4.
Thus the driveway would take an easterly to southeasterly
course to the dwelling traversing the 25' and 20' elevation
lines and would serve the secondary function of a berm.
By letter dated October 7, 1982 I had sent you an engineering
report and drainage plan prepared without the benefit of the
information provided in the Oct 8 analysis of the Soil Conserva-

engineering report and drainage plan. However, I recently

area. A total of 4 houses are proposed on the property, Mr, Manos requested soils
information on the property including permeability rates. He was also concerned over
the possible increase in runoff which might be created by the development proposal.
SUGGESTED SOLUTION(S) The soil survey of Suffolk County sho'"ed the area to have a
soil type known as Carver plymouth sands at 15 to 35% slopes. An onsite investiga-
tion verified this fact however, the land slope fell within the 3 to 15 percent
r~nge averaging 8 percent. This soil is very well drained with permeability rates
in eKcess of 6.3 inches per hour throughout the profile. (See soil report).

of the property a berm could be constructed along the property line of the southwest
corner of your property. Both ends could be connected to the 25 foot contour line
or thereabouts. A survey would be needed to determine the beginning and end of the
berm. The runoff collected along this beral ./ould then seep into the soil profile.

If runoff became a problem onto the adjacent property owner in the southwest corner
of the property a berm could be constructed along the property line of the southwest
corner of your property. Both ends could be connected to the 25 foot contour line
or thereabouts. A survey would be needed to determine the beginning and end of the
berm. The runoff collected along this ber.l. 'lOuld then seep into the soil profile.

ALL that certain plot, or parcel of land, situate, lying and
being in the Village of Mattituck, Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point in the northwesterly corner of the
hereinafter described premises, said point being situate the
following 2 courses and distances when measured easterly along
I the northerly side of "Miller's Right of Way" and southerly
I across said "Miller's Right of Way" from the corner formed by the
intersection of the said northerly side of "Miller's Right of
Iii Way" with the easterly side of Mill Road, as shown on Map of
Jackson's Landing at Mattituck, filed in the Office of the Clerk
of the County of Suffolk on March 28th, 1969 as Map No. 5280;

point of beginning;
RUNNING THENCE from said point of beginning, South 83 degrees 26
minutes 00 seconds East along the southerly side of "Miller's
Right of Way", 491.00 feet to land now or formerly of Blatz;

mentioned land and along land now or formerly of Burke and along
