Simicich cluster subdivision. Charles Cuddy, Esq. Mr. Cuddy
presented 6 copies of a map to the board. There was discussion
on the park and playground area presented on the map and Mr.
Wickham said the board could waive the requirement for park and
playground if iq thought it was breaking up viable agriculture.
On motion made by Mr. Coyle, seconded by Mr. Wall, it was
RESOLVED to grant final approval to the map of the minor
subdivision of property of Edgar and Arlene Marvin and authorize
the chairman to sign the map.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall
Mr. Wickham signed the map and one copy was presented to Mr. Cron
who was still in the audience.
8:30 p.m. Public Hearing on the question of the approval ef the
final map of the subdivision "Country Club Estates" owned~ by Philip
Babcock and others end located at Cutchogue. Gary FlannerOlsen,
Esq. and Philip Babcock.
Mr. Raynor read the legal notice of hearing and presented proofs
of publication in the Long Island Traveler-Watchman and the Suffolk
Times. He went over the checklist and reviewed the file.
Mr. Wickham: We said we wanted some sort of covenant that LOt #32
would not be presented at a future time for a variance for change
of use.
Mr. 01sen: You said you wanted permitted uses in Agricultural-
Residential.
Mr. Raynor: The file seems to be in order. As is the custom,
we will open the hearing with anyone present this evening that
would like to speak in opposition to the subdivision "CoUntry
Club Estates". Hearing none, is there anyone.present this
evening that weuld like to speak in favor of the proposed sub-
division "Country Club Estates"?

Gentlemen:
r represent the owners of the above referenced property. My
client is in contract to sell the premises, conditioned upon
receiving a certificate of occupancy.
It is my understanding that my client was told by the Building
Department that they had completed everything necessary to
obtain a Certificate of Occupancy. However, when my client
went to pick up the CO, they were told that they were soley
responsible for paving and providing drainage for a 450' Right
of Way (survey enclosed). They were told that this was a
requirement of the restrictive covenants filed for the
subdivision.
I have carefully reviewed the restrictive covenants recorded in
the Suffolk County Clerk's Office at Liber 8404 page 117. (copy
attaChed hereto). The covenants contain UQ provisions
whatsoever for paving the Right of Way. They refer only to the
fact that no further subdivision is allowed.
My clients were then advised by the Town that a Temporary CO
could be issued nonetheless. This promise was also reneged,
and my clients told that "the Planning Board does not want to
get involved in a fight with the neighbors.'
It seems that the hostility referred to stems from my clients
opposition to the adjoining Owners (Mattes) application two
years ago to establish bed and breakfast at their residence.
As you know, my clients were simply exercising their
constitutional right to be heard at a public hearing.
Moreover, when my clients commenced an Article 78 proceeding,
they were also exercising their constitutional rights to access
of the courts. As you know, the lawsuit was subsequently
discontinued.
Further investigation into this matter reveals that the
requirements for the road improvements were imposed
approximately two years ago as a direct result of the Mattes'
application for a bed and breakfast establishment. The Town

recognized the potential dangers of having the unpaved Right of
Way being travelled by numerous visitors to the Mattes
business/residence. These same hazards were raised by my
clients at the public hearings when they opposed the Bed and
Breakfast at the Mattes residence.
Ironically, my client is now being told that a CO will not be
issued unless they pave a road for the benefit of the Mattesl
Not only is this requirement patently unfair, but it also
damages my client to the extent that they will be unable to
close on the house in accordance with the contract of sale.
Since the house has been vacant for over a year, and the

client is in contract to sell the premises, conditioned upon
receiving a certificate of occupancy.
It is my understanding that my client wae told by the Building
Department that they had completed everything necessary to
obtain a Certificate of Occupancy. However, when my client
went to pick up the CO, they were told that they were soley
responsible for paving and providing drainage for a 450' Right
of Way (survey enclosed). They were told that this was a
requirement of the restrictive covenants filed for the
subdivision.
I have carefully reviewed the restrictive covenants recorded in
the Suffolk County Clerk's Office at Liber 8404 page 117. (copy
attached hereto). The covenants contain UQ provisions
whatsoever for paving the Right of Way. They refer only to the
fact that no further subdivision is allowed.
My clients were then advised by the Town that a Temporary CO
could be issued nonetheless. This promise was also reneged, r--
and my clients told that "the Planning Board does not want to ~
get involved in a fight with the neighbors.ft _______

. It seems that the hostility referred to stems from my clients
opposition to the adjoining owners (Mattes) application two
years ago to establish beo and breakfast at their reSidence.
As you know, my clients were simply exercising their
constitutional right to be heard at a public hearing.
Moreover, when my clients commenced an Article 7.8 proceeding,
they were also exercising their constitutional rights to access
of the courts. As you know, the lawsuit was subsequently
diacontinued.-
Further investigation into this matter reveals that the
requirements for the road improvements were imposed
approximately two years a90 as a direct result of the Mattes'
application for a bed and breakfast establishment. The Town

recognized the potential dangers of having the unpaved Right of
Way being travelled by numerous visitors to the Mattes
business/residence. These same hazards were raised by my
clients at the public hearings when they opposed the Bed and

Map for above 4 lot minor subdivision by Van Tuyl dated amended
December 2, 1977 shows the access 25 ft. R.O.W. in a straight align-
ment from Luther's Road. Another map by Van Tuyl dated amended
August I, 1984 shows the 25 ft. R.O.W. with an angle to the north for
a length of approximately 120 ft. from Luther's Road before meeting
the straight length. The original alignment (straight) would involve
removing some large trees at Luther's Road. The owners of Lot No. I
(Mattes) did not have a copy of the 1984 amended map. Also, the
deeded 25 ft. R.O.W. for Mattes does not include the change shown on
the 1984 survey, only the original layout. I had assumed the deeded
R.O.W. covered the revision.

According to your letter of December 30, 1986 improvements for the
access road should be pursuant to 280-a which would require a road
width of 15 ft. The cesspool shown in the 25 ft. R.O.W. has been
relocated and the building with R.O.W. encroachment has been demolished.
Advised that demolition debris was backfilled in probably a cellar and
that there has been ground settlement there since.
Recommendations:
I. Use access road alignment as shown on map dated amended August I, 1984.
2. Van Tuyl to submit a profile that meets the existing driveway ele-
vation in the revised R.O.W.
3. Road width 15 ft. with a 2" asphalt top course on a compacted 6"
bankrun base containing 15% or more of gravel and 10% of loam.
4. Part of the existing blacktop driveway can probably be retained
with widening to 15 ft. Widening to be on a base as noted above.
Provide suitable exit and entrance radii in the pavement width
where it meets Luther's Road.
5. Remove topsoil for the 15 ft. width east of the driveway. Replace
this excavation with compacted clean material to the subgrade for the
6" base.
6. The length of the road, 450 ft.!, will increase the runoff into Luther's
Road. Install leaching basins Rt. and Lt. 8' diam. by 8 ft. at Luther's
Road.

I submit this letter on behalf of August Stahl who owns Lot No.4,
on a minor sub-division map approved by the Planning Board in 1977, under
the title of "Minor Subdivision Made For Arlene Marvin At Mattituck, Town
of Sou tho 1 d, New York".
Dear Mrs. Long:
The problems on which I kindly ask for your resolution, are as fol-
lows:
There is a legend on the map that access to all of the lots on the
filed map (including the Stahl parcel) is over the 25 foot right
of way which fronts on Luthers Road.
The 25 foot right of way is improved, up to a point, but that point
does not reach the Stahl property.
The question is: Who is responsible for the improvement of the right
of way?
What specifications must be met in improving the right of way for the
purposes of ingress and egress?
Who is responsible for the general maintenance and care of the right
of way, including snow removal?
I am hoping that the Planning Board, in adopting the Resolution approv-
ing the Subdivision Map clearly set forth answers to the above questions.
May I ask if you will kindly review the file and advise, so that we will
know how to proceed. If there is any further information that you require, or
any fees required, please advise.

Dear Muriel:
In accordance with your letter to me of November 25, 1977,
we are enclosing herewith, in duplicate, duly executed appli-
cation for approval of plat together with check payable to the
Town of Southold in the sum of $40.00.
We shall shortly prepare covenants and restrictions regard-
ing the fact that no lot will be further subdivided. We are
also contacting Van Tuyl this instant date to have him modify
the map of the minor subdivision to indicate that access will
only be from the right of way onto Luther's Road, and that no
lot on the minor subdivision will be further subdivided.
We would appreciate, however, in the meantime if this matter
were promptly forwarded on to the County for their review. We
should very much like to have this come on for a final hearing
and approval, if at all possible in January and in no event later
than February.

status of the above-captioned matters.
It is our understanding that Roderick Van Tuyl has sub-
mitted the final maps to your office for the purpose of having
a final public hearing scheduled. If such be the case, we
should appreciate being advised as tothe date and time of
such final hearing.
As we had previously indicated to the Planning Board,
time is somewhat of the essence in securing the approval of
the proposed minor subdivision for our clients, Edgar and
Arlene Marvin. We would have hoped that by this date the
matter would have been reviewed by the Board and that approval
thereof would be secured at the next meeting of the Planning
