The following action was taken by the Southold Town Planning
Board, Monday, January 13, 1986.
RESOLVED that the Southold Town Planning Boar~ approve
the set-off for Martin and Barbara Bergman for 2 lots on
4.1 acres located at Cox Neck Road, Mattituck, survey dated
June 13, 1985; subject to the following conditions:
1. Approval from the Suffolk County Department of Health
Services pursuant to Article 6.
2. Correspondence from the Health Department and DEC
under the State Environmental Quality Review Act.
3. Comments and recommendations from the Suffolk County
Planning Commission.
4. Maintenance of the natural vegetation as a buffer
between the house and marsh area to avoid any run--off.
Would you please forward six (6) surveys in accordance
with the enclosed list of requirements for our re~erral
to the Suffolk County Planning Commission. When the
above conditions (1-3) have been met, the Chairman will
endorse the surveys.

The close proximity of a right-of-way to the proposed location of the
dwelling on Lot 2, and to a lesser extent on Lot 1, can only result in
the loss of those residential amenities one has come to expect in a
suburban residential community. For example, visual intrusion, noise,
raising of dust and excessive speed that can jeopardize children or
pets or both.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on April 2,
1985 reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Martin & Barbara Bergman", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to
disapprove said map for the following reasons:
The proposed subdivision will result in the creation of a
landlocked parcel; that is, a parcel that does not have
frontage on an existing or proposed public road. The creation of
such a lot is contrary to good subdivision layout principles and
creates problems as far as access by emergency and service
equipment is concerned. This lack of access could result in
health, safety and welfare problems for the future residents of
the landlocked lot, not to mention potential disputes over the use
and maintenance of any right-of-way over an adjacent parcel that
may be created for the purpose of access.
Creation of a landlocked lot also places the Zoning Board of
Appeals in the awkward position of having to grant a building
permit for the lot under (Section 280-a) of the Town Law, as the
future owner(s) of the landlocked lot cannot be held responsible for
the landlocked nature of their parcel.
The existing right-of-way through the parcel is not conducive to the
optimum siting of a residence on one or both lots.

Dear Mr. 0rlowski,
In regard to your letter of April 22~ 1986 and the Suffolk County
?lanning Commission's objections raised on April 8, 1986, these have
all been addressed and previously brought before the Planning Board's
administration (Southold) and were ruled on favorably.
The right of way mentioned in the county's objectbns on plot 1 and 2
do not address the fact that the right of way is presently being used
by the adjacent property. The Board previously ruled both by fie~in-
spection and hearings that the present right of way road is adequate
in every respect. '
As to ebjection #3, field inspection by the board addressed these speci-
fic questions regarding proximity of right of way to dwellings on lots
1 and 2 and every effort has been made to maintain rural and secluded
nature of the lots in question.
In the past~both the Planning Board of the Town of Southold and the
Environmental Quality Control Board have ruled £avorably on all issues
raise~ and I am sure the ~lanning Board will see fit to overrule these
present objections by the count~ since these matters have already been
fully investigated and researched to the satisfaction of the ?lanning
Board.
Your attention to this matter as soon as possible would be greatly
appreciated. ·

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains Jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
