Dear Mr. Raynor:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on November 2, 1992:
Be it RESOLVED that the Southold Town Planning Board
authorize the Chairman to endorse the final surveys dated May 3,
1992, with the following condition to be affixed to the map:
No building permits shall be issued for the proposed lots
until the dry hydrant is installed. (The dry hydrant has
been allowed in lieu of a submersible well.) Such hydrant
shall meet the specifications and water volume requirements
of the Mattituck Fire District. In addition, such hydrant
shall be accessible to the fire department at all times.
Enclosed please find a copy of the map which was endorsed
by the Chairman. The mylar maps, which were also endorsed by
the Chairman, must be picked up at this office and filed in the
office of the County Clerk. Any plat not so filed or recorded
within sixty (60) days of the date of final approval, shall
become null and void.

Dear Mr. Raynor:
The following took place at a meeting of the Southold Town
Planning Board on September 14, 1992:
The final public hearing which was held at 7:30 P.M. was
closed.
The following resolution was adopted:
WHEREAS, Joseph A. Wanat is the owner of the property known
and designated as SCTM#1000-112-1-16.1, located on the north
side of Bergen Avenue in Mattituck; and
WHEREAS, this Minor Subdivision, to be known as Bergen
Hollows, is for 4 lots on 10 acres; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
June 4, 1991; and
WHEREAS, a final public hearing was closed on said
subdivision application at the Town Hall, Southold, New York on
September 14, 1992; and
WHEREAS, all the requirements of the Subdivision
Regulations of the Town of Southold have been met; and
be it therefore,

RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated May 13, 1991
that were received by the Planning Board office on August 27,
1992, subject to fulfillment of the following conditions. All
conditions must be met within six (6) months of the date of this
resolution.
The submission of five (5) paper maps and two (2)
mylar maps all containing a valid stamp of approval
from the Suffolk County Department of'Health Services
and all revised as follows:
The driveway for Lot 4 must continue along the
common driveway shown for Lots 2 and 3 in order
to access the building envelope shown for Lot 4.
The interior boundary of the conservation
easement shown for Lot 4 is to be removed, and
the entire area within the outside boundary is to
be shown as a conservation easement.
A notation must be placed on the map stating that
a Declaration of Covenants and Restrictions has
been recorded for the subdivision. The Liber and
Page number must also be indicated.

The August 15, 1992 correspondence from the Mattituck
Fire District must be clarified as to whether or not a
firewell is required for this subdivision. If a.
firewell is required, the location of such must be
indicated on the final map.

The draft Declaration of Covenants and Restrictions
must be revised and must be re-submitted for review by
the Planning Board and the Town Attorney. Once it is
approved, it must be recorded in the office of the
County Clerk.
The $6,000.00 park and playground fee ($2,000.00 for
each lot that does not contain an existing residential
structure) must be submitted.

FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
· Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

Dear Hr. Orlowski:
The Board of Fire Commissioners has agreed that Hr. Wanat may install
a "dry hydrant" in lieu of the submersible well mentioned in our
letters of August 15, 1992 and April 11, 1991.
This dry hydrant shall be located at the east side of the irriga-
tion pond, approximately 1000' north of the subdivision. This dry
hydrant shall meet the specifications and water volume requirements
of the Mattituck Fire District. Mr. Wanat must also guarantee
that it will be accessible to the the fire department at all times.

Dear Mr. Rayn0r:
On April 11, 1991, in response to the Planning Board's
inquiry as to whether or not a firewell was needed for the
above mentioned four lot subdivision, the Planning Board
received a recommendation from the Mattituck Fire District for
a firewell to be located at the southeast corner of proposed
lot ~4. On April 15, 1991, the Planning Board notified you that
such firewell would be required.
It is understood that you then discussed the firewell
situation with the Board of Fire Commissioners, resulting in the
Commissioners' letter of August 15, 1992, which stated that it
would be satisfactory to them if the firewell were moved 100'
to the east of the original site.
It is the Planning Board's opinion that the August 15, 1992
letter does not eliminate the need for a firewell for the four
lot subdivision. Rather, it allows your client to locate the
well 100' to the east of the original location (on his
neighbor's property) if such is agreeable to the adjoining
property owner.
In light of the above, in addition to the conditions of
final approval, prior to any endorsement of the Bergen Hollows
minor subdivision, it will be required that one of the following
take place:
a. the firewell be installed;
b. a bond for the firewell installation be submitted to
the Town;
c. a condition be placed on the map that prior to the
issuance of any building permits for dwelling units
for the proposed lots that the firewell be installed.

The Planning Board has reviewed the maps that were
submitted on July 31, 1992. Please note the following:
The scale of the map is 1" equals 50'. The Planning
Board requires all maps to be at a scale of 1" equals
100'. Therefore, the map as presented is not
acceptable.
In a letter dated April 15, 1991, the Planning Board
advised you that a firewell was required for the
subdivision. The location of the firewell was not
shown on the final map.
The building envelope indicated for Lot 94 shows the
typical building setbacks, which allows developement
to occur within the conservation easement. The
building envelope should be revised so that the entire
envelope is located outside the conservation
easement.
Due to the ambiguity of the conservation easement on

An Environmental assessment has been submitted, reviewed
and it has determined that no significant adverse effects
to the environment were likely to occur should the project
be implemented as planned.
Because there has been correspondence received from the
Department of Health Services commenting that that agency
has no objection to the Planning Board's designation as
lead agency. The agency also recommended that the Planning
Board protect the kettle depression in the vicinity of the
proposed development. The Planning Board has required
building envelopes and conservation easements for all
applicable lots in order to protect the kettle depressions.
Because there has been correspondence received from the New
York State Department of Environmental Conservation
commenting that the Department of Environmental
Conservation does not have jurisdiction unless the
subdivision crosses a regulated area.

' As per the your request of April 23, 199l we have completed a p/'eliminarv review of
the above referenced project. Tasks and completed activities are identified as follows:
Reviexv Part I LEAF
The parcel has been field inspected by CVA, and the LEAF has been reviewed and
amended as necessary. A copy of same is attached.
Prepare Part II LEAF
The Part II LEAF checklist has been completed and is also attached. Additional
information concerning our findings is included below.

Advise as Necessary
The parcel has been inspected and environmental references concerning the site and
area have been consulted. The site includes 10.00 acres of land, proposed to be
subdivided into four (4) lots, all in excess of 80,000 square feet. The parcel was at
one time part of a larger parcel which extends north to Long Island Sound, and
includes several perched ponds and wetlands areas. The subject 10 acre land division
will not affect these resources, and the surface water features are in excess of 900 feet
away.
The overall 10 acre site is presently occupied by a home, with associated barn
structures, and a horse paddock. The home will remain on Lot 1, and the barns will
remain on Lot 3. New structures are proposed to be constructed on Lots 2, 3 and 4,
following approval of the land division.
There are significant depressions, located on Lot 1, and between Lots 3 and 4. These
features can be and should be avoided in locatin$ homes on these lots. The
depressions are grassed, and are not characterist,c of natural geologic features, as the
vegetation and grades have been modified. The balance of the site consists of
meadow and grassed areas. There are large maple tress lining the driveway on Lot 1,
and there is an area of maple trees and oroamental trees west of the eastern
depression, on Lot 2 and 3.
The site is located in Gronndwater Management Zone IV (outside of the water
budget area), and will conform to SCDHS density requirements. The site is in a

general area which has been impacted by nitrate and aldicarb contamination
according to the North Fork Water Supply Plan. SCDHS Article 4 approval for a
water source with possible treatment measures is necessary. The proposed intensi~
of land use is low (0.5 dwelling units per acre), and is consistent with area use and
zoning.
The configuration of lots provides suitable means of access, and adequate area for
construction of dwellings without significantly impacting site resources. The Plarming
Board may wish to consider aligning access for all four (4) lots with the bend in
Bergen Avenue, in order to avoid a driveway closely offset from this turn which may
cause traffic conflicts as the road becomes more heavily utilized in the future. This
can be accomplished using a driveway easement for Lot 4, over Lots 2 and 3.
The Part I and II Long EAF failed to reveal any significant impacts to site
- environmental resources, which would warrant the preparation of a Draft EIS.
Accordingly, the Board may wish to consider adopnng a Negative Declaration, based
upon the reasons outlined herein.
I hope this letter provides the board with the information needed to complete review
of this project. We would be pleased to provide additional input upon regluest. Please do

dated April 23, 1991, regarding the above-referenced proposal.

Our agency has no objection to the Town's designation as lead agency.
* Sanitary Code Compliance:
Jurisdiction and Application Status:
Under the authority of the Article 6, of the Suffolk County Sanitary Code, the SCDHS
maintains jurisdiction over the final location of sewage disposal and water supply systems.
The applicant, therefore, should not undertake the construction of either system without
Health Department approval.
Our agency has no record of a current application for this proposal. We encourage the
project sponsor to submit an application to the SCDHS at the earliest date so that a
technical assessment of this action can be made.

Based on the limited information reviewed, it appears that the subject proposal can
conform to the density and approval standards of the SCSC.
* Natural Resources Protection
Based on the site survey provided for review, it appears that the subject parcel contains two
significant kettle depressions in the vicinity of the proposed developmem. In an effort to
provide for the protection of these unusual geologic features, we recommend that the Town
requhe the designation of these areas as open space and encourage their long-term
protection through the establishment of appropriate scenic easements.
We believe buffer restrictions should be imposed which provide for no future disturbance,
clearing, construction, or filling in these areas. Furthermore, we encourage the
establishment of building envelopes on those lots containing kettle depressions so that the
extent of allowable future development is clearly indicated to the property owners.
We appreciate the opportunity to review this application. If you have any questions, please

The Planning Board is in receipt of your letter of May 30, 1991,
in reference to the above mentioned subdivision.
The ten (10) acre parcel on which this subdivision is located
was created by a set-off from a 107 acre parcel. The set-off
created one parcel 10 acres in area, and another parcel
approximately 97 acres in area.
There are several perched ponds and wetlands areas on the 97
acre parcel. However, in the Planning Board's Environmental
Consultant's review of the Long Environmental Assessment for the
minor subdivision, he notes that the subdivision of the 10 acre
parcel will not affect these resources, and the surface water
features are in excess of 900 feet away. A copy of his report is
enclosed.
The proposed major subdivision (Heather Hills) of the 97 acre
parcel is inactive at this time. When the applicant decides to
proceed, the Planning Board will coordinate with your office.

Advise as Necessary
The parcel has been inspected and environmental references concerning the site and
area have been consulted. The site includes 10.00 acres of land, proposed to be
subdivided into four (4) lots, all in excess of 80,000 square feet. The parcel was at
one time part of a larger parcel which extends north to Long Island Sound, and
includes several perched ponds and wetlands areas. The subject 10 acre land division
will not affect these resources, and the surface water features are in excess of 900 feet
away.
The overall 10 acre site is presently occupied by a home, with associated barn
structures, and a horse paddock. The home will remain on Lot 1 and the barns will
remmn on Lot 3. New structures are proposed to be constructed on Lots 2, 3 and 4,
following approval of the land division.
There are significant depressions, located on Lot 1, and between Lots 3 and 4. These
features can be and should be avoided in locatin~ homes on these lots. The
depressions are grassed, and are not characteristic of natural geologic features, as the
vegetation and grades have been modified. The balance of the site consists of
meadow and grassed areas. There are large maple tress lining the driveway on Lot 1,
and there is an area of maple trees and ornamental trees west of the eastern
depression, on Lot 2 and 3.
The site is located in Groundwater Management Zone IV (outside of the water
budget area), and will conform to SCDHS density requiremen'ts. The site is in a

general area which has been impacted by nitrate and aldicarb contamination
according to the North Fork Water Supply Plan. SCDHS Article 4 approval for a
water source withpossible treatment measures is necessary. The proposed intensity
of 1.and use is low (0.5 dwelling units per acre), and is consistent with area use and
zomng.
The configuration of lots provides suitable means of access, and adequate area for
construction of dwellings without significantly impacting site resources. The Planning
Board may wish to consider aligning access for all four (4) lots with the bend in
Bergen Avenue, in order to avoid a driveway closely offset from this turn which may
cause traffic conflicts as the road becomes more heavily utilized in the future. This
can be accomplished using a driveway easement for Lot 4, over Lots 2 and 3.
The Part I and II Long EAF failed to reveal any significant impacts to site
environmental resources, which would warrant the preparation of a Draft EIS.
Accordingly, the Board may wish to consider adopttng a Negative Declaration, based
upon the reasons outlined herein.

The following resolutions were duly adopted by the Southold
Town Planning Board at a meeting held on Monday, April 1, 1991.
Be it RESOLVED that the Southold Town Planning Board, start
the lead agency coordination process on this unlisted action.
Be it RESOLVED that the Southold Town Planning Board grant
sketch approval on the map dated March 7, 1991 with the
following conditions:
The name of the subdivision is to be changed to be
significantly different from that of the previous
set-off.

The map is to be revised to show the four (4) lot
subdivision only.
3. Building envelopes are to be shown for all lots.
Sketch plan approval is conditional upon submission of
final maps within six months of the date of sketch approval,
unless an extension of time is requested by the applicant, and
granted by the Planning Board.
Five (5) paper prints and two (2) mylars of the final map,
all containing a current stamp of Health Department approval,
must be submitted before a final public hearing will be set.

In addition, the owner of the property must submit
authorization for you to act as his agent for the subdivision
application.
Please note also that in accordance with Section A106-38 E,
of the Subdivision Regulations, the Planning Board will be
requiring that a Park and Playground fee of $2,000.00 per each
vacant lot in the subdivision be deposited with the Town Board.
This fee will be required prior to any endorsement of the
subdivision by the Chairman.
