RE: Preliminary Draft EIS - Norris Estate Development DATE: 22 July 1988 To facilitate the commencement of review of the above mentioned development, the preparer, JAC Planning Corporation, has submitted copies of a preliminary draft EIS. We have completed a review of the preliminary draft and find this to be a good way to begin a complicated project. Quite naturally, it being a preliminary draft, pieces of information are incomplete and as yet unavailable. The purpose of this memo is to inform you and the applicant of the major informational needs in order to complete an acceptable draft, and to point out areas of contention that may need to be revised for a draft to become acceptable. Our comments are keyed to the page numbers in the preliminary draft. Sections obviously missing or incomplete will not be noted here. I . Page 2.12 Page 3.58 Pages 3.7 and 3.11 There are other approvals required (NYSDEC - LI Well permit, Wetlands permits, NYSDOS CZM Consistency Review) and the Suffolk County Planning Commission would also review the zone change. CPWS-24 has been superseded by the Suffolk County Water Resources Manaqement Plan and the North Fork Comprehensive Water SupplY Plan, and should not be utilized as a primary information source. The concept of water budget area and permissive sustained yield must be updated with today's data. The North Fork Water Supply Study shows that most of the Norris site is outside of the water budget area. The text needs to be modified and detailed to include the two more recent reports. Allusions to other data are made without specific citations or copies of the other data. The easterly well appears to have the worst water quality. The central well testing is incomplete. What are "aesthetic reasons"? What are "...a limited number of analysis from other studies in the area..."? A much more rigorous discussion of groundwater quality impacts is necessary. The discussion on pages 3.8 through 3.13 is totally unconvincing that there is sufficient water quantity of a quality that would cause no significant adverse impacts on groundwater in surrounding areas. The discussion of the comprehensive plan should be brought up to date. The Southold Planning Board adopted an updated Master Plan in December of 1985 and amended it in August of 1987. The Zoning Ordinance Amendments have been and continue to be identified as the "Master Plan". This is a misnomer and should be corrected for the draft. The discussion on water supply needs to be more detailed and maps of the salinity problem areas and Health Department waivers need to be shown. The discussion on groundwater impacts needs to be rewritten entirely. The one paragraph conclusion presented can not be drawn from the earlier text statements. There needs to be a discussion on the groundwater quality recharged in the zones of concentration of all proposed well sites to begin to determine the long term viability of the wells. The communication with the Mattituck Fire District needs to be shown. Why was 70 gpd selected? 100 to 110 is a normal planning figure. Where is it in relation to the well recharge zone? Surely a more accurate depiction of the municipal cost/benefit of multi-family developments can be found than a quote from the 1967 Comprehensive Plan. The proposed water treatment plant is shown to impact on Wetlands B, C, and D yet the text states that there will be no impact. This appears to be contradictory. In terms of environmental impact, the water plant could be placed in a better location. The water analysis to justify the equipment proposed is not included in the text. Evidence as to sufficiency of the storage and distribution systems from the Mattituck Fire District needs to be shown. Reference is made to the 2' contour in 1959 which is outdated information. Schondebare. 9:15 A.M. - Police Chief Winters met with the Board to discuss the proposed amend- ment to the Alarm Systems Law by deleting Alarm Agent and changing the penalty section. The Chief stated the Alarm Law is working very well, residents are comply- ing and cooperating (see resolution no. 4). 9:25 A.M. - Community Development Administrator James McMahon met with the Board to discuss the proposed partial 1988 budget for the Seed Clam Program under the NYS-DEC Shellfish Management Grant. Mr. McMahon said it will be necessary to purchase the lumber and hardware shortly for the construction of 15 new clam racks. The Town Clerk will advertise for bids when the specification list is complete (see resolution,s no. 5 and 16). _",l 9:30 A.M. - For Discussion Items: (1) Memorandum from the Office of the Town 7{ Attorney concerning the definition of "family" under the Zoning Ordinance. Town Attorney Schondebare and Assistant Town Attorney Berntsson recommend an amend- ment to Section 100-13 to clarify the definition. The board agreed, and a proposed Local Law will be prepared. (2) Memorandum from Town Attorney Schondebare with regard to the purchase of testing equipment for use by Trustee President Bredemeyer, stating the equipment will be owned by the Town. Town Board has no objection to the purchase of this equipment. (3) Application from Account Clerk Barbara Rudder for the vacant position on the Board of Ethics - Board agreed to her appointment (see resolution no. 17). (4) Application for renewal of a trailer permit by Laurel Greenhouses, Inc. - Board approved (see resolution no. 18). (5) Application for renewal of trailer permit by Wolf Pit Nurseries, Inc. - Board approved (see resolution no. 19). (6) Discussion of the candidates interviewed t!" for the two vacant positions on the Water Advisory Committee. After some discussion, the Board agreed to expand the committee from five to seven (see resolution no. 20) and appoint four new members (see resolutions 21 & 22). (7) Trailer permit application by Richard and Sophia Greenfield - see 11 :25 A.M. and resolution no. 23). (8) Discussion relative to adding the automobile of Beach Manager Robert Muir to the Town's auto liability policy and general liability policy. Since Mr. Muir transports lifeguards and uses his vehicle to travel to the beaches throughout the summer season) Board agreed to the coverage and amended resolution no. 2. " 10:25 A.M. - David Emilita conducted a scoping session on the Carr-Wanat change 1 of zone application. John Hart, Esq. and associates, Henry Raynor, Richard Carr, Sam .McLendon and other interested individuals were presenting during this session. Mr. Emilita explained that this is to be treated as a second site of a two-sited project, the Norris Estate Subdivision property being the other property in question. Since both applications comprise essentially one project occuring on two sites, a single EIS covering both sites is appropriate. Since the Planning Board would be review- ing both sites, it would assume Lead~_Agency status on all matters. The Town Board would have discretionary authority over the change of zone application in accordance with the Zoning Ordinance. Once an understanding was reached with respect to the applicant proceeding on a parallel course with the Planning Board and Town Board, Mr. Emilita commenced the scoping session. ..... The two parcels were conveyed as one 9.137 acre parcel in 1942. In 1947, the one 9.137 acre parcel was divided when the eastern-most lot was deeded to another party. Both of these parcels existed prior to the enactment of the Zoning Code and should have no effect on this applica- tion for a set-off. The first objection as to landlocked parcels is misplaced because access is provided over a right-of-way fran Bergen Avenue which will be improved to meet the specifications of the zoning Board of Appeals, as required by their decision dated February 2, 1984 under Appeal No. 3217. 2. The second objection as to lot width requirements is not applicable here as the property diIrensions are in keeping with good planning. The southerly line was designed to correspond with the southerly line of the t\\'O neighboring lots to the East, to continue the right-of-way in a straight line. The contractual arrangerrents for this set-off were entered into prior to the effective date of the increased width requirerrents. To catply with the width requirerrents, applicant would have to widen the lot by 25 feet, resulting in an oversized lot of about 141,500 square feet. To shorten the lot and make it wider would result in an uneven right-of-way or an "odd corner" in the main parcel which would be useless for farming. 3. With respect to the third cament addressed to lack of an overall plan and possible future lack of suitable beach access, it should be noted that 651 feet of beach frontage remains on the main parcel, which can provide suitable beach access in the future. This set-off is similar to the previous t\\'O set-offs fran the original parcel. In addition, there is no reason why this set-of will not fit in with any future overall plan. , , . After due study and deliberation it resolved to disapprove said map for the following reasons: 1. The proposed subdivision will result in the creation of a landlocked parcel; that is, a parcel that does not have frontage on an existing or proposed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned; this could result in health, safety and welfare problems for the future residents of this lot. Creation of a landlocked lot also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for this lot under Section 280-a of the Town Law as the future owner of this lot cannot be held responsible for the landlocked nature of the parcel. 2. Allowing this subdivision will set a procedure for the creation of lots that will not meet lot width requirements. 3. Property is being subdivided without an overall plan which can result in the inappropriate location of open space and lack of suitable ac- cess to the beach when the remaining 107 acres are subdivided.
