My November 5, 1982 letter to you was in response to the question which you asked, wherein I advised you that the owners of Lots 132 to 139 have an easement over Bayberry Road for purposes of ingress and egress. Based upon your January 14, 1983 letter and Bill Wickham's January 10, 1983 letter, it would appear that you now seek my opinion as to the fee ownership of the bed of Bayberry Road (i. e. , who owns the land under this mapped street) . The lots and roads in question are shown on a subdivision map entitled "Amended Map A of Nassau Point owned by Nassau Point Club Properties, Inc. " dated June 28, 1922 and filed in the Suffolk County Clerk's Office on August 15, 1922 as Map No. 156. The history of the conveyances of the lots on both sides of Bayberry Road as well as Bayberry Road are as follows: Nassau Point Club Properties, Inc. conveyed Lots 132 to 139, inclusive to J. Alonzo Hulse on April 12, 1926. On April 13, 1926, Hulse conveyed these lots to John D. Howell (L. 1183 cp 561). On April 2, 1947, Amy Rowland Raynor, as executrix of the Estate of John D. Howell conveyed these lots to Arthur H. Huene and Elsie B. Huene, the present owners, by deed recorded in Liber 2691 at page 413. Henry E. Raynor, Jr. -2- January 20, 1983 By deed dated August 29, 1951, Nassau Point Club Properties executed and delivered a Quitclaim deed to Abraham L. Garber and Albert Pollack which purported to convey Bayberry Road to Garber and Pollack, who thereafter, by deed dated August 2, 1971, and recorded in Liber 6978 of deeds at page 392, conveyed Lots 222 to 226, inclusive, and Bayberry Road to Mr. & Mrs. Cartnick. There appears to be a dispute between Huene and Cartnick as to their res- pective rights in Bayberry Road. Huene claims ownership of one-half of the bed of the road adjacent to his lots, as well as an easement over the entire width of the road. Cartnick appears to claim ownership of the road by virtue of the Quitclaim deed from Nassau Point Club Properties in 1951 to Garber and Pollack and from the latter to him and his wife in 1971. It would appear that all the conveyances of the lots in question were made by reference to the Nassau Point subdivision map. The rule of law is that when an owner of property sells lots in reference to a map, which lots abut upon a street shown on the map, the purchaser is entitled to have the land shown as a street left open forever as a street. It is also the law that the conveyance of subdivision lots, in the absence of -J an express reservation, conveys the fee title to the center of the street on which the lot abuts, subject to the rights of other lot owners and their invitees to use the entire area of the street for highway purposes. Applying the above principles of law to the present circumstances, it is my opinion that Huene is the fee owner of the easterly half of Bayberry Road abutting his lots (Lots 132 to 139, inclusive, on the east side of Bayberry Road) and that Certnick is the fee owner of the other half thereof. That the owners of the lots abutting on Bayberry Road have an easement over the full width of Bayberry Road for purposes of ingress and egress. Turning now to Cartnick's application for approval of his Minor Subdivision Map, I have the following comments: The subdivision regulations and application forms require that the owners of the land shown on the subdivision map join in the application. Since the map filed with the Planning Board includes all of Bayberry Road, and since Cartnick only owns half of it, either the owner of the other half should join in the application or the map should be amended to exclude the half not owned by Cartnick. I also think that since all lot owners abutting this road have easements over the entire width thereof, that it might be advisable to exclude the entire road from the map. Mr. Wickham: Mr. Chairman, I would like to make a statement. For the record I am William Wickham for the firm of Wickham, Wickham & Bressler of Mattituck. I represent Mr. and Mrs . Huene who own lots 132 through 139 opposite this property. It is my understanding that this application included all of Bayberry Road. We make no objection to the subdivision as far as 222 is concerned, that' s your problem we ' re across the street. But we do object to Bayberry Road being included as part of it and the square footage also being included in it. I have before me a photostat copy of the official map as filed which shows lot number 22 and Bayberry Road. I am not unmindful of the fact that the Cartnick deed includes the description of Bayberry Road which is probably the reason for its inclusion there . I am not unmindful aiso of the fact that this acquisition of Bayberry Road was from a deed of Nassau Point Properties of Walter Johnson to Pollack and Garber in 1951, apparently after they bought lot #222 . My first point is that this Bayberry Road is an open easement for a right-of-way on a filed map, and as owners of lots 132 through 139 we have an unequivocal easement with the full extent of Bayberry Road. These lots are, I believe, considered as separate lots since Nassau Point is exempted from the merger provisions . So each of these lots would have a right-of-way over the full extent of Bayberry Road. We are particularly concerned about the upper lots , 139, 138 and 137 because on that section which fronts on Nassau Point Road there is a deep depression and we cannot build there . My second point is that I think it is also good law that on a filed map where a con- veyance is made by lot number only that conveyance includes that part of an adjoining road to the center line thereof. We acquired our lots in 1947 , sometime before the Walter Johnson deed. The prior owner acquired them in 1926 and so they were conveyed out by Nassau Point properties somewhere between 1922 and 1926 . I was not able to get the original deed out of Nassau Point Properties because Mr. Huene just learned about this late Friday afternoon and he called me at the office and the office was closing. However, I do have some deeds in the office, the original deeds of Nassau Point Club Properties which do actually recite that the properties include the fee to the center of any road. We would not like the road included for another reason that if it is said that the property line goes up to the east side of the road it might give owners the thought of putting fences , trees or hedges along and block and block our access and we maintain we have • pg- (3) • 10/18/82 C full access for those two reasons . We also feel that if there are any vacant lots there and a building permit is given that it ought to take into consideration the westerly line of Bayberry Road and not the easterly. As a matter of fact the Cartnick deed does recite that this is subject to the rights any person may have. Certainly I think we have rights . I don' t think that Mr. Johnson should have given this deed. He mastered a good subdivision and violated many instances . You have a lot of lots on Nassau Point with two houses, split lots. This apparently is another example. Mr. Johnson was very willing to give a deed on something that would dangle in front of him and that happened many times and that' s why you 've got a violation on Nassau Point. As I said before we have no objection to the subdivision as far as lot number 222 is concerned. We object to having Bayberry Road included in any respect and we object very strenuously. Thank you. Certainly will give us something this office and both the Town Attorney' s Office should re- search to come up with a specific . if you have the availability to supply the board with any documentation with regard to your presen- tation tonight we would certainly like it. The road that is there now, Bayberry Road, is my entrance to my house at present. And that road as far as I am concerned must remain a private road. But there is an entrance on the northerly side of Wunneweta Road which we have kept closed for these meny years at the advise of our attorney' s so that it has not been a public road for many years , but there would be access to this minor subdivision and I should think there would also be an access to those lots that have been mentioned. But the other access road as far as we are concerned could not really be used because this is the main entrance to my home . Mr. Raynor: Dr. Cartnick, would you supply also the board the deed that you have to your property so that we may also refer this to councel and come up with a determination. Thank you very much. This Depart- ment is in agreement with your designation of lead agency. The pro- Posed subdivision appears to conform with the minimum lot area requirements in the case where an individual water supply and sewage disposal facilities are proposed. Mr. Wickham: Mr. Chairman , I would like to make a statement. For the record I am William Wickham for the firm of Wickham, Wickham & Bressler of Mattituck. I represent Mr . and Mrs . Huene who own lots 132 through 139 opposite this property . It is my understanding that this applicatio: included all of Bayberry Road . We make no objection to the subdivision as far as 222 is concerned, that' s your problem we ' re across the street. But we do object to Bayberry Road being included as part of it and the square footage also being included in it. I have before me a photostat copy of the official map as filed which shows lot number 22 and Bayberry Road. I am not unmindful of the fact that the Cartnick deed includes the description of Bayberry Road which is probably the reason for its inclusion there . I am not unmindful also of the fact that this acquisition of Bayberry Road was from a deed of Nassau Point Properties of Walter Johnson to Pollac : and Garber in 1931 , apparently after they bought lot 4222 . My first point is that this Bayberry Road is an open easement for a right-of-way on a filed map, and as owners of lots 132 through 139 we have an unequivocal easement with the full extent of Bayberry Road. These lots are , I believe , considered as separate lots since Nassau Point is exempted from the merger provisions . So each of these lots would have a right-of-way over the full extent of Bayberry Road. We are particularly concerned about the upper lots , 139 , 133 and 137 because on that section which fronts on Nassau Point Road there is a deep depression and we cannot build there . My second point is that I think it is also good law that on a filed map where a con- veyance is made by lot number only that conveyance includes that part of an adjoining road to the center line thereof . We acquired our lots in 1947 , sometime before the Walter Johnson deed . The prior owner acquired them in 1926 and so they were conveyed out by Nassau Point properties somewhere between 1922 and 1926 . I was not able to get the original deed out of Nassau Point Properties because Mr. Huene just learned about this late Friday afternoon and he called me at the office and the office was closing . However, I do have some deeds in the office, the original deeds of Nassau Point Club Properties which do actually recite that the properties include the fee to the center of any road. We would not li':e the road included for another reason that if it is said that the property line goes up to the aast side of the road it might give owners the thought of -putting fences , trees or hedges along and block and block our access and we maintain we have pg. (3) 10/18/82 Cfull access for those two reasons . We also feel that if there are any vacant lots there and a building permit is given that it ought to take into consideration the westerly line of Bayberry Road and not the easterly. As a matter of fact the Cartnick deed does recite that this is subject to the rights any person may have . Certainly I think we have rights . I don ' t think that Mr. Johnson should have given this deed. He mastered a good subdivision and violated many instances . You have a lot of lots on Nassau Point with two houses, split lots . This apparently is another example . Mr. Johnson was very willing to give a deed on something that would dangle in front of him and that happened many times and that' s why you 've got a violation on Nassau Point. As I said before we have no objection to the subdivision as far as lot number 222 is concerned. We object to having Bayberry Road included in any respect and we object very strenuously. Thank you. Certainly will give us something this office and both the Town Attorney' s Office should re- search to come up with a specific . . . if you have the availability to supply the board with any documentation with regard to your presen- tation tonight we would certainly like it. I in fact do have a deed for Bayberry Road which I have had for the twelve years that I have owned this property and I was assured . . . and I have paid taxes on this road. I can see Mr. Wickham's concern about it and in fact I would not wish to intrude on his access to his land if ever that land is sold. The road that is there now, Bayberry Road, is my entrance to my house at present. And that road as far as I am concerned must remain a private road. But there is an entrance on the northerly side of Wunneweta Road which we have kept closed for these meny years at the advise of our attorney' s so that it has not been a public road for many years , but there would be access to this minor subdivision and I should think there would also be an access to those lots that have been mentioned. But the other access road as far as we are concerned could not really be used because this is the main entrance to my home . Mr. Raynor: Dr. Cartnick, would you supply also the board the deed that you have to your property so that we may also refer this to councel and come up with a determination. Thank you very much.
