Dear Mr. Raynor: The Suffolk County Planning Con~nission at its regular meeting on October 3, 1979, reviewed the proposed subdivision plat, entitled, "Minor Subdivision - Moebius Associates", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to the following condition deemed necessary to help preserve the natural and aesthetic attributes of Cutchogue Harbor: Since stormwater runoff resulting from the development and improvement of the lots within this subdivision can add to that from the roads and adjoining properties and which appears to be reaching the beach and Cutchogue Harbor, adequate drainage structures shall be constructed on each lot to retain on each site the runoff re- sulting from the development and improvement of the lot. The Commission also offers the following comment on the map for your use and consideration: It is the opinion of the Commission that a short radius curve is required at the northeast corner of Fleet's Neck Road and East Road to help bring the inter- section up to modern standards and provide for adequate sight distance and turning movements. DESCRIPTION OF ACTION The minor subdivision of Moebius Associates is a three-lot residential subdivision of 2.665 acres at Cutchogue, New York. The project has been determined not to have a significant effect on the environment for the following reasons: ~_n environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The NYSDEC has indicated that this parcel would not appear to be within the jurisdiction of its department under the Tidal Wetlands Act and voiced no objection to the project. The Suffolk County Department of Health Services did not respond to an inquiry within the allotted time indicating that they have no objection. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land regulations. I am also in receipt of a letter to the Planning Board from Charles G. Lind of the Suffolk County Department of Planning dated October 4, 1979. I hereby request that the Planning Board override the conditions and comments of the Suffolk County Planning Com- mission as it pertains to this particular minor subdivision pursuant to the Suffolk County Charter, the Town Law, and the General Municipal Law for the following reasons: The conditions are onerous, unrealistic and are in error. Fleets Neck Road (Pequash Avenue) and East Road are old, estab- lished Town roads. The three lots in this minor subdivision would be the only parcels of land in the entire neighborhood that would be burdened with the requirement of providing dry wells or other water retaining devices. The road in front of lot No. 3 drains in an easterly direction toward Eugene's Creek not to the foot of Fleets Neck Road (Pequash Avenue) and the area of Great Peconic Bay. The applicant applied to the Southold Town Planning Board for a minor subdivision consisting of three lots. Two of the lots contain 40,001 square square feet and the third contains 36,087 square feet. The Planning Board conditioned the minor subdivision upon the Board of Appeals granting a variance for the lot containing 36,087 square feet. It should be noted that the westerly boundary of this property is designated as Fleet's Neck Road, but the proper name of the road is Pequash Avenue. The Board agrees with the reasoning of the appli- cant since most of the lots in the surrounding area are considerably smaller than the size of Lot No. 3 in the subdivision. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance.
