A. For new building or new use:

4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.

MEETING OF JULY 21, 2005

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 79,976 sq. ft. parcel has 250 feet along Mill
Lane and lot depth of 320 feet and is improved with a two-story frame dwelling and accessory
structures, as shown on the March 27, 2000 survey prepared by Anthony W. Lewandowski.
BASIS OF APPLICATION: Building Department's April 27, 2005 Notice of Disapproval, citing
Sections 100-242A and 100-244, in its denial of an application for a building permit to construct a
proposed addition. The reason stated for disapproving the application is the addition is less than 55
feet from the front lot line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 7, 2005 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct an addition extending18
feet from the north side of the existing dwelling, as shown on the 2/8/2005 diagrams prepared by
Penny Lumber. The setback is proposed at 42.2 feet from the front lot line in line with the existing
setback of the dwelling and 48 feet, shown on the applicant's site diagram.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The addition is proposed on the northerly side of
the house, in line with the existing front setback of their home. The home has existed in this location
for more than 60 years and is presently set back 42.2 feet from the front lot line, at its closest point.

The existing home is one of two older farm houses existing on that side of the street, and the
present setback is in keeping with the other established homes in the neighborhood.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicants wish to design the addition with
similar architectural design as this farm house style and not to excavate on the south side of the
house where 100 year old Maple trees are established.
3. The variance granted herein is the maximum front yard reduction that the Board would approve.
4. The difficulty has been self-created in that the house contains a nonconforming setback and the
code requirement is 55 feet from the front lot line.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an addition, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by
Member Orlando, and duly carried, to
GRANT the variance as applied for, as shown on the 2/8/2005 diagrams prepared by Penny
Lumber and applicant's site diagram.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Orlando, and Dinizio.
(Member Simon was absent.) This olution was duly adopted (4-0).

1 The Information on this set of construction documents is to relate basic design
intent and framing details. They are intended as a construction aid, not a substitute
for generally accepted good building practice and compliance with current New York

Fasteners and Connectors for Wood Frame Construction
1 A continuous load path between footings, foundations walls, floors, studs and roof
framing shall be provided.
2 Approved connectors, anchors and other fastening devices not included In the
Standard Building Code, Table 2306.1 shall be Installed In accordance with
manufacturer's recommendations.
3. Metal plates, connectors, screws, bolts, and nails exposed directly to the Weather or
subject to salt corrosion in costal areas, shall be stainless steel or hot dipped
galvanized
4. Where windows and doors interrupt wood structural panel sheathing and siding,
framing anchors or connectors shall be provided at the top and bottom of cripple
studs, header studs, and at least one stud at each side of opening.
5. Ridge straps shall be attached to each pair of opposing rafters except where collar
ties of 1x6 or 2x4 lumber is located in upper third of attic space and attach to each pair
of rafters

8. Sill Plate to Foundation Anchorage. Sill plate shall be anchored to the foundation

minimum of one anchor bolt shall be provided within 6 to 12 inches of each end of
each plate. Anchor bolts shall have a minimum embedment of 7 inches in concrete/
masonry foundations. Anchor bolts shall be located within 12 inches of corners and at
spacing not exceeding 4 feet on center.
