This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
I. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of I % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

Dear Mr, Verity :
I visited and inspected the 48220 Main Road building in Southold New York, It is my
understanding that the preexisting two family house is older than 60 years and predates building
codes, Inspection found the building to be divided into rooms as shown on the attached drawings,
Smoke and carbon monoxide detectors are installed in the locations shown on the drawings,
I nspection also found there to be only one kitchen with a range/oven installed on the first floor.
The most resent work performed at the building included interior non structural renovation, To the
best of my knowledge the work performed during this renovation is in conformance with the New
York State Building Code that was in affect at that time

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The subject property is situated on a 4.423 acre
parcel located along the south side of State Route 25 (a/k/a Main Road), Southold. The
property is improved with a two-story and one-story stucco principal dwelling structure
and accessory buildings. The only survey of record is dated August 10, 1996, prepared by
Roderick VanTuyl, P.c. for the new owners, Daniel, Thomas C. and Gregory Jerome.
BASIS OF APPEAL: The Building Inspector's July 14, 1998 Notice of Disapproval which
states: "as specified in the attached Pre-C.O. dated September 11, 1996, the existing
dwelling is listed as a Non-habitable one-family dwelling. Under Article III, Section 100-
31B(1) of the R-BO Zone, a special Exception is required to obtain a two-family dwelling."
RELIEF REOUESTED: Applicant is requesting a determination from the Board of
Appeals in favor of applicant-owner granting recognition as a two-family use regarding
Preexisting Certificate of Occupancy No. Z-24610 issued Septem-
ber 11, 1996. (No Article or Section was furnished by applicant other than that noted in
the Notice of Disapproval.)
REASONS FOR BOARD ACTION. DESCRlPED BELOW:
The present two-unit dwelling, although updated, has
been in existence for more than 60 years. The purpose
of this action is merely to recognize this existence. The recognition is

based upon personal knowledge of at least one member of this Board, Affidavits, and
pictures furnished by the applicants' attorney showing two antiquated kitchens, both of
which have been renovated as well as both individual units on each of the two floors of
this dwelling.
In considering this application, the Board deems this action to be the minimum necessary
and adequate to preserve and protect the character of the neighborhood, and the health,
safety, welfare of the community.

premises were in an un-heated, gutted, non-habitable condition at the time of
inspection.
An observation on this date shows the premises to have four electric service
meters, an extension at the rear, renovation of accessory structure and the
house is occupied.
These conditions are evidence of several violations of Town Code and NYS
Building and Fire Prevention Code.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of South old, Suffolk COlUlty, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The
applicant agrees to comply with all applicable laws, ordinances, building code, housing code, and regulations, and to admit
authorized inspectors on premises and in building for necessary inspections.
