Gentlemen:
I represent Shirley Saland, attorney-in-fact for Joseph
Saland. I am informed that at your last meeting the Saland
application to divide premises on Bayberry Road into two parcels
was heard, and that at that meeting Mrs. Hermine F. Hillmer spoke
against the application and raised some questions about a dispute
over the property involved.
Although there was a controversy some time ago between
Joseph Saland and the Hillmers relating to the purchase by the
Hillmers of the property now owned by them which bounds this
property on the north, there is no existing dispute. As a matter
of fact, any vestiges of an old dispute were resolved by the
Salands entering into a contract with Mrs. Hillmer for the sale
to her of one of the parcels which is the subject of this applica-
tion. The contract is dated June 21, 1977, and under the provisions
thereof, the matter is scheduled to close on January 10, 1978,
although the contract is conditional upon your Board approving the
application for the division into two lots. I enclose a copy of
the contract herewith. Mrs. Hillmer is represented by Frederick J.
Tedeschi, of 403 Main Street, Greenport, New York, in connection
with the aforementioned contract. I telephoned him today about
this matter, and he was amazed to learn that Mrs. Hillmer had
appeared before your Board to speak against the application.
I trust that you will now be able to render a decision
promptly since the other parcel involved in this application is
the subject of another contract with another person, and this con-
tract is scheduled to close on or before November 15, 1977.

19. The amount of any unpaid taxes, assessments, water charces and sewer rents which the seller IS obligated to pay and dis~
charge, with the interest and penalties thereon to a date not less than two business days after the date of closll1g title, may at the
option of the seller be allowed to the purchaser out of the balance of the purchase price. provided official bills therefor with
interest and penalties thereon figured to said date are furnished by the seller at the closing.
20. If at the date of closing there may be any other liens or encumbrances which the seller is obligated to pay and discharge,
the seller may use any portion of the balance of the purchase price to satisfy the same, provided the seller shall simultaneously
either deliver to the purchaser at the closing of title instrumenb in recordable form and sufficient to satisfy such liens and en~
cumbrances of record together v,"ith the cost of recording or filing said instruments; or, provided that the seller ha5 made
arrangements with the title company employed by the purchaser in advance of closing, seller will deposit with said company
sufficient monies, acceptable to and required by it to insure obtaining and the recording of such satisfactions and the iS5uance
of title insurance to the purchaser either free of any such liens and encumbrances, or with insurance against enforcement of
same out of the insured premises. The purchaser, if request is made within a reasonable time prior to the date of closing of
title, agrees to provide at the closing separate certified checks as requested, aggregating the amount of the balance of the
purchase price., to facilitate the satisfaction of any such liens or encumbrances. The existence of any such taxes or other liens
and encumbrances shall not be deemed objections to title if the seller shall comply with the foregoing requirements.
21. If a search of the title discloses judgments, bankruptcies or other returns against other persons having names the same as or

Gentlemen:
Enclosed herewith is survey dated May 3, 1977,
made by Roderick Van Tuyl, P. C., covering premises bounded on
the West by Bayberry Road, on the South by Bridge Lane, on the East
by Lot 129, Amended Map 'A' of Nassau Point Club Properties, Inc.,
Map No. 156, and on the North by land of Carl D. Hillmer and
Hermine F. Hillmer.
The premises are owned by Joseph Saland, whom I
represent, and are shown on the map as two parcels, one consisting
of 1.04 acres, and the other consisting of 1.0 acre.
My client has agreed to sell the 1.04-acre parcel,
which I have designated as Lot #1 in pencil, to one person, and has
agreed to sell the one-acre parcel, which I have designated as
Lot #2, to another person. The proposed purchaser of Lot #2 is one of
the owners of the adjacent property on the north designated as
C. & H. Hillmer.
I asked Mr. Terry, the Building Inspector, whether
any approval is required for this proposed division, and he indicated
that since it involves an existing filed map, the proposed division
should be submitted to you for approval. Accordingly, it is respect-
fully requested that you approve the proposed division.
If anything further is required from us, kindly
advise promptly.
Also please advise if our personal appearance before
your Board is required.
