I.,N.Y. 11971 Dear Mr. Wickham: Your letter of October 6, 1971, regarding my request for a minor sub-division of the property I'm buying from Mr. Case is appreciated, but puzzling. I really don't want to divide to six acres. Because of my commitments to travel in the next ten days, I've asked Russ Case to be good enough to show you and the other members how my wife, I, my sister and daughter, son-in-law, intend to use this property. As I may have mentioned to you, our immediate and long-range plans are to have other members of my family live on this location. None of us are particularly in- terested in the property right behind the Rogers Funeral Home, and in order to buy the land we need, I thought that we should buy this land in order not to leave Mr. Case with anything less than a profitable sale. The way we intend to use this acreage is in five lots, as originally requested. The lots are oddly assigned because of my giving members of the family first choice as to where they would like to have their homes. Each of us anticipate building on an acre, with the exception of my son-in-law and daughter, who wish to acquire two acres. If this property is divided in this manner, it is a minor sub-division of five, as originally submitted. If a division of five, as originally submitted and as stated in this letter, is not in keep- ing then I believe that the quickest way for us to meet your objectives, and the object- ives of your Board, is to buy only as much of the first acre next to Rogers as shown in Mr. Van Tyle's map of six equal acres -- only as much of the first acre adjacent to the funeral home in which to bring in the private lane in a curving manner, thereby eliminating one of the objections of the sharp turns and reducing the request down to an absolute of five acre building sites. Mr. Case, knowing both your Plan Boards interests and objectives, will make our position clear. If the latter suggestion is what's needed to expedite the starting of -2- Mr. John Wickham October 13, 1971 our homes this Fall, rest assured that I am more than willing to make that the final plan if Mr. Case is, even though it does entail a somewhat different finan- cial commitment to Mr. Case. Mr. Case has acknowledged his willingness to put in writing a commitment that, in the future development of his property, if and whenever that should be, that he will provide, as you suggest, and as the Suffolk Planning Commission requests, a connecting link to this private right-of- way off the right-of-way from Case's Lane. Because of your understanding of my stated intentions, because of Mr. Case's willingness to help me meet the requirements of the Southold Town Planning Board, I hope that before the 27th of October, we will have through agreement, overcome any objections and be given approval to proceed with construction. Babcock requests two statements from me : 1 . That there will be a connection between Case 's Lane and the right of way to the Babcock subdivision when and if the remaining property is developed. As I pointed out there is a 50 foot strip between Dr. Olson and Alsen Timbrook that was left to provide access to Case 's Lane from this part of the :property. Another possibility would be from Case' s Lane Extension, a private road to the Cedars Golf Clubhouse. 2. That it is not my intention to apply for another sub- division : Since Van Tyle 's map showed the Case name in error, it seems to have created the impression that I ap )lied for the subdivision. I made it clear to Mr.Babcock when he bought the property that I would not do this. I represented him at the meeting as a personal favor as he was unable to attend. The property was sold to Mr.Babaock as a matter of financial necessity rather than any desire on my part. I can assure you that I do not intend to ask for a subdivision. Dear John: While it is not my desire, nor that of members of my family,to sell any part of the land that we have inherited as it has been in the family for many generations, we know now, we must . I have realized for many years that we must some day face the inevitable facts. For the last ten years it has been a desperate scramble to kee , the income from the property ahead of the taxes. The taxes last year amounted to more than the total annual income only nine years ago. Part of the increase in income has come from rental to the Cedars Golf Course. The Golf Course was built at a personal financial sacrifice on non productive land. I had hoped that it would prove a Food investment. To date it has not, altho as you are probably aware, we have been rewarded with many, many unsolicited compliments as to the beauty of the area. Unfortunately you can't spend compliments. Some members of our family have been faced with dificult financial burdens through sickness, etc. Selling some lots along Case' s Lane has resulted in the only available money from the property. With the death of our Aunt , Lizzie Horton, last year, the Osborne farm (North end) and Waters Lot (South end) became the property of my four brothers and myself; namely Harrison, Henry (now deceased) , Ralph, Norman and myself. My youngest brother Norman has had more bills due to sickness that any one family usually has pile up. He is now in more desperate circumstances than many persons receiving Welfare and he must sell his share. His lawyer is now pressinx for an immediate settlement. Altho he and his lawyer proposed that we divide up the property a couple of years ago, I managed to -cersuade them that we could do better by keeping it in one piece, if possible. To make any kind of an ea'uitable division would have meant dividing the Osborn farm, the seaters lot end the main center section of our Grandfa.ther' s farm each into five pieces resulting in fifteen pieces, in addition to the already existing several pieces. I showed him the location he is presently buying as there is access to the M&in Road by a 20 foot strip of prooerty east of the Rogers Funeral Home. (Rogers long ago turned down a proposed exchange of land to widen this strip) . Sale to A9r.Babcoc�c offers the only solution to stop the Immediate division of the land to solve Norman's pressing problems. We really do not have much choice. I might add that we possibly could sell only land that is over 500' from the State road and eliminate the necessity of County aperoval. As you can attest John, the Old House, as a National Monument, Instead of private property„ and the entire Library Village Green Complex exists today only because you and I personally worked out Your idea to beautify the Village and preserve our treasured heritage. (This lone- before zoning. ) I mention this only because, knowing you, I doubt if' the rest of the members of your Board are aware of this . I would also like to be immodest enough to point out that we accepted for our portion of the property Just enough to pay off mortgages that were taken out to pay taxes during the depression. The Old House was given to the people of the Town. Since this property was the only property we had on the Main Road, I think your Board Members will recognize we could have made a greater monetary gain by selling to a Super Market. Althoup,h we know we are now faced with the inevitable, we would like to see something a little better than Just another housing development. I'm pleased to hear that there seems to be no problem at all about (the proposed sub-division), the land which I have purchased from Mr. Case for use by my wife, myself, and members of my family, because in working with the understanding that we would meet the town's approval (and I do genuinely appreciate the importance of the long-range effects of your present good efforts in good residential zoning), both my daughter, sister and I have made substantial plans for homes there. My daughter and her husband, I hope not unfortunately, sold their house last week in the hope of moving into the Cutchogue community this winter-early spring. My sister, Lucy Uhl, is now in the process of selling her home, with plans drawn up for her particular house in Cutchogue; so, naturally, the investment we have all made to date, the commitments and plans, are more than of just normal importance. Your request that Mr. Case and I attend your next Planning Board Meeting to discuss why I bought and he sold us the above mentioned property is a request I'll be only too willing to keep. Let me assure you and the Board that I am not a professional land developer or builder. My request to Mr. Case was to make available to me a suit- able piece of land on which to build some only individual homes for my family and friends. I'm not involved in any land development or other acreage land acquisition in the Town of Southold at present, nor do I contemplate being so in the foreseeable future. I am not involved in any way with any land owned by my brother, Richard, or by Mr. Rimmler. I am only looking for an opportunity to return to the town of Southold where I lived for so many years earlier, to return to a place where I may enjoy the country which I have always appreciated, where I might live near the Golf Course and in the Community of Cutchogue. While I was not aware of the significance of this properties lying within 100-feet of the State Highway, I certainly will follow the suggestion of your Board and have made preparations, as suggested by Mr. Terry, for a survey by Mr. Van T71e for such purposes as anticipated, and that with the expected approval as suggested by you and Mr. Terry of your Plans Board, that we will be privileged to move ahead with our plans to build in the very near future. 0 Mr. John Wickham September 13, 1971 You didn't mention the date of the next Planning Board Meeting, but I want to be there and I'll call Mr. Terry to request the time and date of the meeting. Hope that the date does not coincide with schedules to be out of State in the next month, commit- ments made earlier which would be difficult to change at this time; commitments where I am representing our publishing company and the opinions of our subscribers. Thanks for your courtesies and considerations. I have done my best to comply with your wishes, the wishes of Mr. Terry and the other members of the Board by making our current actions and requests known to the Board in the spring of this year. While I'm very fond of Mr. Case and would consider it a privilege to be involved in any of his future plans, whatever they might be, in regard to his future real estate interest, I can assure you, as will he, such is not the case at the present time. Un- doubtedly, the land development adjacent to that which I contracted to buy from Mr. Case, will make an important and attractive addition to the growth of the residential community of Cutchogue, and I hope that the plans for the future of this additional property are even more beneficial than what is intended by myself, my wife, my sister and my daughter; but, there's no way of our knowing at this time. Questions were asked, however, about the wisdom of commencing the development of a substantial block of open land with a minor sub- division. We would appreciate it if you and Mr. Case could attend our nest Planning Board meeting and discuss this matter somewhat more fully . In cases like this the P] anninq Board sometinica requires a letter of intent stating that the owner or developer will not request another minor subdivision in this area nor will he re-divide anv_ lot shown. Dear Mr. Wickham: The staff has examined the proposed subdivision of land on the land now or formerly owned by the Case Estate and offer the following comments. It is felt that serious consideration be given to the layout of the proposed easement which will provide access to the proposed building sites. It is doubtful that emergency vehicles, such as, fire equipment, will be able to make the acute turns in the easement presently designed. At the very least the bends should be restricted to right angles. Consideration should also be given to an alternate means of access to these plots in the event that the easement becomes blocked or impassable for any reason. In our examination, we have assumed that consideration has been given to the effect of this subdivision upon the future development of the re - mainder of the northerly end of the Case tract, should it become avail- able for development.
