(631) 765-1809 James Dinizio,Jr. l *t �p Fax(631)765-9064 http://southoldtown.northfork.net BOARD OF APPEALS TOWN OF SOUTHOLD FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF APRIL 22, 2004 ZBA#5440 - GEORGEA KAPASSAKIS Property Location: 955 Cedar Drive, East Marion CTM 22-2-43 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 32,319 sq. ft. lot is shown as Lot 10 on the Map of Aquaview Park, with 280.69 feet along the east side of Cedar Drive in East Marion BASIS OF APPLICATION: Building Department's September 5, 2003, Notice of Disapproval, citing Code Sections 100-33 and 100-244B in its denial of a building permit application concerning a proposed dwelling at less than 40 feet from the front lot line and less than 50 feet from the rear lot line, location of the existing detached garage in the side yard instead of a rear yard, after the dwelling is constructed. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants in their original application requested variances to locate a new dwelling, approximately 60 in length overall by 45 feet, and centered on this lot. The setbacks proposed are 35 feet from the front lot line and 41+- feet from the rear property, at its closest points, as shown on the July 3, 2003 survey prepared by Peconic Surveyors, P.C. The proposed construction also places an existing detached garage on the northerly portion of the lot in a side yard location. ADDITIONAL INFORMATION:AMENDED RELIEF: During the April 22, 2004 public hearing, the applicants were requested to increase the setbacks for a possible alternative plan that would be more conforming to the code's required setbacks of 40 feet from the front lot line and 50 feet from the rear lot line. On April 15, 2004, the applicant submitted a revised survey dated April 9, 2004, and 8/26/02 building plans prepared by Penny Lumber, increasing the setbacks to 40 feet from the front lot line and 45 feet from the rear line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed new house construction will have two livable floor levels and was reduced to (overall) measurements of 41'9" deep by 59'. These dimensions reflect the submitted survey of Peconic Surveyors, P.C. dated April 9, 2004. The rear yard set back will be no closer than 45 feet from the rear property line. The front yard setback as proposed will conform to the current requirement with a 40 ft. minimum. There are similar rear yard setbacks established in the area. 2. The benefit sought by the applicants was achieved by an alternative method feasible for applicant, which removed the need for a front yard variance, and reduced the variance relief from 8 feet to 4 feet for the rear yard setback. 3. The requested area variance is minimal and represents a 10% reduction in the current code for a 45-ft. minimum rear yard. The code requirement is a minimum of 50-foot from the rear lot line. 4. The difficulty was self-created when planning the new home resulted in a design and size which did not conform to the current setback requirements of the zoning code. 5. No evidence has been submitted to suggest that this minor variance will have an adverse impact on a physical or environmental condition in the neighborhood. The geometry of the lot is 120 feet deep by 280 feet long, and existing is applicant's detached garage. The property is zoned Residential, and no wetlands exist at the site based on the information given. 6. With regard to the detached garage, the garage will remain-in its existing location which is at least 50 feet from the front lot line, and 38.8 feet from the rear line, 17.8' from the side line. The use and purposes of the building will remain as an accessory for garage and storage purposes related to the new dwelling. No benefit would be derived if the garage were moved closer to the easterly lot line. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to DENY the relief as applied for, and • Page 3—May 6,2004 ZBA No.5440—G.Kapassakis CTM 22-2.43 at East Marlon ..
